Who has Standing to Sue
in a Title IX Case?
• Depends on type of claim:
– Participation claims: Courts have
uniformly recognized that female students
who seek to participate in a sport at a level
not offered by the school have standing to
bring a program-wide participation claim.
– Scholarship and Treatment Claims:
Students seeking to challenge inequities in
scholarships and the treatment of athletes
must already participate in the school’s
athletic program.
