six months will be issued <strong>in</strong> case the victim stays for the<br />

<strong>in</strong>vestigation or proceed<strong>in</strong>gs <strong>and</strong> is will<strong>in</strong>g <strong>to</strong> co-operate<br />

with the authorities. Prior <strong>to</strong> a residence permit States are<br />

obliged <strong>to</strong> offer a reflection period the length of which has<br />

<strong>to</strong> be determ<strong>in</strong>ed by national laws.<br />

The Council Framework Decision on the st<strong>and</strong><strong>in</strong>g of victims<br />

<strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs 42 is not applicable <strong>to</strong> victims<br />

of traffick<strong>in</strong>g specifically but conta<strong>in</strong>s important rights for<br />

trafficked persons <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs. It <strong>in</strong>cludes <strong>in</strong>ter<br />

alia the right <strong>to</strong> receive <strong>in</strong>formation <strong>and</strong> it further requires<br />

that victims of crim<strong>in</strong>al acts are entitled <strong>to</strong> receive a decision<br />

<strong>in</strong> reasonable time on the compensation by the perpetra<strong>to</strong>r<br />

dur<strong>in</strong>g the crim<strong>in</strong>al proceed<strong>in</strong>gs.<br />

A central <strong>in</strong>ternational non-b<strong>in</strong>d<strong>in</strong>g <strong>in</strong>strument is the ‘UN<br />

Pr<strong>in</strong>ciples <strong>and</strong> Guidel<strong>in</strong>es on <strong>Human</strong> Rights <strong>and</strong> <strong>Human</strong><br />

<strong>Traffick<strong>in</strong>g</strong>’ 43 elaborated by the UN Office of the High Commissioner<br />

for <strong>Human</strong> Rights. This <strong>in</strong>strument encourages<br />

States <strong>to</strong> put the human rights of trafficked persons <strong>in</strong> the<br />

centre of all efforts aga<strong>in</strong>st traffick<strong>in</strong>g <strong>in</strong> human be<strong>in</strong>gs. The<br />

<strong>in</strong>strument conta<strong>in</strong>s guidel<strong>in</strong>es on <strong>in</strong>ter alia protection of<br />

trafficked persons, law enforcement, prevention <strong>and</strong> <strong>in</strong>ternational<br />

co-operation. States are called upon <strong>to</strong> “ensure that<br />

trafficked persons are protected from further exploitation<br />

<strong>and</strong> harm” <strong>and</strong> they should ensure that adequate care is<br />

not conditional upon the will<strong>in</strong>gness <strong>to</strong> co-operate <strong>in</strong> legal<br />

proceed<strong>in</strong>gs (pr<strong>in</strong>ciple 8). 44 States are encouraged <strong>to</strong> enable<br />

a safe return of trafficked persons <strong>to</strong> the State of orig<strong>in</strong> <strong>and</strong><br />

they should offer an alternative <strong>to</strong> the return <strong>in</strong> case the<br />

return would be a serious risk <strong>to</strong> the safety of the trafficked<br />

person (pr<strong>in</strong>ciple 11).<br />

The OSCE Action Plan <strong>to</strong> Combat <strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Human</strong><br />

Be<strong>in</strong>gs 45 serves for the participat<strong>in</strong>g States as a supportive<br />

<strong>to</strong>olkit <strong>in</strong> order <strong>to</strong> implement efforts aga<strong>in</strong>st traffick<strong>in</strong>g <strong>in</strong><br />

human be<strong>in</strong>gs. Accord<strong>in</strong>g <strong>to</strong> the Action Plan participat<strong>in</strong>g<br />

States should take <strong>in</strong><strong>to</strong> account root causes of traffick<strong>in</strong>g<br />

<strong>in</strong> human be<strong>in</strong>gs when implement<strong>in</strong>g preventive measures<br />

<strong>and</strong> should <strong>in</strong>clude <strong>in</strong>ter alia issues such as discrim<strong>in</strong>ation<br />

at the work place (po<strong>in</strong>t IV.7.3). Participat<strong>in</strong>g States should<br />

on the residence permit issued <strong>to</strong> third-country nationals who are victims of<br />

traffick<strong>in</strong>g <strong>in</strong> human be<strong>in</strong>gs or who have been the subject of an action <strong>to</strong><br />

facilitate illegal immigration, who cooperate with the competent authorities<br />

consider establish<strong>in</strong>g a fund for compensat<strong>in</strong>g trafficked<br />

persons, which could be f<strong>in</strong>anced by confiscated assets<br />

(po<strong>in</strong>t III.1.5).<br />

2.2.2 Elements of the Def<strong>in</strong>ition of <strong>Traffick<strong>in</strong>g</strong><br />

<strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs<br />

Article 3 of the Palermo Pro<strong>to</strong>col def<strong>in</strong>es traffick<strong>in</strong>g <strong>in</strong> human<br />

be<strong>in</strong>gs as “the recruitment, transportation, transfer,<br />

harbour<strong>in</strong>g or receipt of person, by means of the threat or<br />

use of force or <strong>other</strong> forms of coercion, of abduction, of fraud,<br />

of deception, of the abuse of power or of a position of vulnerability<br />

or of the giv<strong>in</strong>g or receiv<strong>in</strong>g of payments or benefits <strong>to</strong><br />

achieve the consent of a person hav<strong>in</strong>g control over an<strong>other</strong><br />

person, for the purpose of exploitation” 46 .<br />

The def<strong>in</strong>ition can be divided <strong>in</strong><strong>to</strong> three elements, which<br />

are: action, means <strong>and</strong> purpose. The first element covers actions<br />

such as recruitment, hous<strong>in</strong>g or transportation, which<br />

are usually the first steps taken by traffickers. The action<br />

element is very broad <strong>in</strong> order <strong>to</strong> be able <strong>to</strong> reach not just<br />

the recruiter, but also owners, supervisors or controllers of<br />

any place of exploitation such as a farm, fac<strong>to</strong>ry, brothel or<br />

household. 47<br />

Secondly, traffickers use specific means such as use of force<br />

<strong>to</strong> secure that action. 48 Further means are coercion, abduction<br />

or the abuse of a position of vulnerability. The abuse of<br />

a position of vulnerability <strong>in</strong>cludes any situation <strong>in</strong> which<br />

the person <strong>in</strong>volved has no real <strong>and</strong> acceptable alternative<br />

but <strong>to</strong> submit <strong>to</strong> the abuse <strong>in</strong>volved. 49<br />

The third element of the def<strong>in</strong>ition is the purpose of exploitation.<br />

Accord<strong>in</strong>g <strong>to</strong> the Palermo Pro<strong>to</strong>col, “exploitation<br />

shall <strong>in</strong>clude, at a m<strong>in</strong>imum, the exploitation of the prostitution<br />

of <strong>other</strong>s or <strong>other</strong> forms of sexual exploitation, forced<br />

labour or services, slavery or practices similar <strong>to</strong> slavery,<br />

servitude or the removal of organs” 50 . The Palermo Pro<strong>to</strong>col<br />

gives an open-ended list of forms of exploitation but does<br />

not def<strong>in</strong>e the term ‘exploitation’ itself. 51<br />
