mandate that the FCC include municipalities and<br />

political subdivisions among those whose authority is<br />

protected from state action by § 253, A-13. Thus the<br />

FCC is subject to two conflicting mandates. And<br />

Missouri is barred from regulating the<br />

telecommunications ef<strong>for</strong>ts <strong>of</strong> “any entity” that it has<br />

created or may create. Texas, by contrast, remains free<br />

to regulate its political subdivisions. Except to the<br />

extent they have already litigated the question in lower<br />

federal or state courts, states outside the Eighth Circuit<br />

and Texas do not know what they can do. And no one<br />

really knows the extent to which Congressional use <strong>of</strong><br />

general language suffices to remove some portion <strong>of</strong> the<br />

States’ sovereignty.<br />
