The State <strong>of</strong> Missouri, through its Attorney General, Jeremiah W. (Jay) Nixon, respectfully petitions <strong>for</strong> a<br />
writ <strong>of</strong> certiorari to review the judgment <strong>of</strong> the United States Court <strong>of</strong> Appeals <strong>for</strong> the Eighth Circuit restricting the<br />
State’s ability to define the authority <strong>of</strong> its own political subdivisions.<br />
Opinions Below<br />
The opinion <strong>of</strong> the court <strong>of</strong> appeals (Appendix (“App.”) A-2 through A-13), filed August 14, 2002, is<br />
reported at 299 F.3d 949 (8 th Cir. 2002). The court <strong>of</strong> appeals’ order denying rehearing, entered November 20,<br />
2002, appears in the appendix at A-14. The opinion <strong>of</strong> the Federal Communications Com-mission (App. A-15<br />
through A-32) is reported at 16 F.C.C.R 1157 (2001).<br />
Jurisdiction<br />
The court <strong>of</strong> appeals entered its judgment on August 14, 2002. That court denied rehearing on November<br />
20, 2002. The jurisdiction <strong>of</strong> this Court is invoked under 28 U.S.C. § 1254(1).<br />
