REAL ESTATE NEWS BRIEFS<br />

NAR tops one million members<br />

The National Association of <strong>Real</strong>tors ® has become the first trade association in America to<br />

exceed one million members. Dues paying membership in NAR, its institutes, societies and<br />

councils, now totals 1,005,785, according to the association's latest membership data. Of those<br />

members, 94 percent are registered to vote and 87 percent voted in the last election. Now more<br />

than ever, with more than 2,312 REALTORS ® in every congressional district in the U.S. and more<br />

than half of them supporting RPAC, the association is positioned to better represent the interests<br />

of property owners across the nation. In <strong>Mississippi</strong>, membership has exceeded 5,100 REAL-<br />

TORS ® which comprise the largest business trade association in the state.<br />

Sales to near record despite rate rise<br />

Economic growth is expected to remain above historic averages over the next two years, stimulating<br />

job growth and sustaining home sales despite higher interest rates, according to the<br />

UPDATE ON LEGISLATIVE ISSUES IMPORTANT TO YOUR BUSINESS<br />

<strong>2004</strong> legislative session yields major REALTOR ® victories<br />

MAR agenda will enhance housing opportunity in <strong>Mississippi</strong><br />

The <strong>Mississippi</strong> Legislature may have grappled with thorny state budget<br />

issues and tort reform, but when it came to passing the <strong>Mississippi</strong><br />

Association of REALTORS ® ’ <strong>2004</strong> legislative agenda, lawmakers wasted<br />

no time in saying "aye." Every bill MAR had an<br />

interest in this year was signed by Governor Haley<br />

Barbour.<br />

The REALTOR ® agenda included measures to<br />

ease financial, regulatory and education barriers<br />

to homeownership in <strong>Mississippi</strong>.<br />

"As part of our focus on a better quality of<br />

life, MAR is dedicated to strengthening the relationship<br />

between current and future homeowners,<br />

the communities in which they live<br />

and the elected officials and policymakers<br />

who affect their lives and futures," said MAR<br />

President Bruce Kammer of Poplarville. "We<br />

thank our legislators for moving forward<br />

with responsible state policies that provide<br />

for broader housing opportunity."<br />

Thanks to MAR’s efforts, the following<br />

new laws will take effect July 1:<br />

Housing opportunity<br />

MAR was successful in passing new<br />

legislation that establishes financial literacy education<br />

as part of secondary schools’ curricula (SB 3016).<br />

"Financial literacy education will allow young people to learn about the<br />

consequences of bad credit before they begin to receive all of those credit card<br />

and car loan advertisements," Kammer said.<br />

And the interest on real estate brokers’ escrow accounts statute has been<br />

updated in order to be used more effectively. Brokers voluntarily will be<br />

allowed to designate their escrow accounts as interest bearing, and the interest<br />

will fund a new Housing Opportunity Trust Fund administered by MAR and<br />

the <strong>Mississippi</strong> Bankers Association designed to provide local grants<br />

and fund programs that create greater housing opportunity (HB 1597).<br />

MAR also pushed to allow municipal governments the option of offering<br />

down payment assistance to their employees.<br />

Homestead exemption<br />

Downtown revitalization remains a priority for our state in towns stretching<br />

from the Delta to the Coast. That’s why REALTORS ® supported legislation that<br />

aids in revitalization efforts in downtown communities where citizens are moving<br />

to live and work. MAR helped to pass legislation that will allow homestead<br />

exemption for owner-occupied residences in multi-use properties (SB 2438).<br />

REALTORS ® assisting cities<br />

Prior to the legislative session, Meridian commercial broker Larry Dudley<br />

alerted MAR’s Legislative and Regulatory Affairs Advocacy Group to the fact that<br />

there were statutes preventing REALTORS ® from getting paid for assisting cities<br />

in the disposition of surplus city-owned property. Thanks to successful legislation,<br />

after July 1 REALTORS ® can be compensated for their efforts in selling<br />

city or county property (SB 2502).<br />

<strong>Mississippi</strong> License Law<br />

Working with the <strong>Mississippi</strong> <strong>Real</strong> <strong>Estate</strong> Commission and the Senate and<br />

House committee chairmen, MAR was successful in securing passage of legislation<br />

that would allow brokers to pay commissions to an individual agent or<br />

agent’s LLC, LLP or S-Corp.<br />

Also, MAR successfully increased the errors and omissions insurance premium<br />

cap to $250. The previous law allowed for a $150 cap. While premiums<br />

are not expected to increase in the near future, MAR wanted the law to anticipate<br />

any market-driven changes in insurance premiums so that the insurance<br />

remains available to real estate licensees and ultimately benefits the consumer.<br />

Other bills<br />

1% professional services tax dies<br />

MAR was successful in killing a bill that would have created an additional tax<br />

on professional services that REALTORS ® render. (HB 757)<br />

Municipality "home rule" bill dies<br />

In partnership with the <strong>Mississippi</strong> Home Builders Association, MAR helped<br />

kill a bill that would have given cities virtually unlimited taxing authority and<br />

could have made impact fees legal in this state (SB 2915). MAR is currently<br />

challenging the constitutionality of impact fees in <strong>Mississippi</strong> and is supported<br />

by Attorney General Jim Hood.<br />

initiatives, calls to action, fair share contributions and conversations with<br />

legislators by members like you. These accomplishments continue to move<br />

<strong>Mississippi</strong> forward and reaffirm that the REALTOR ® voice is being heard by the<br />

REALTORS ® oppose<br />

latest federal preemption of state laws<br />

OCC rule preempts state predatory lending laws and favors megabanks<br />

Urging Congress to become more active and diligent in using its oversight<br />

powers to bridle excessive and overly zealous federal regulations<br />

remains a priority of the National and <strong>Mississippi</strong> Associations of REAL-<br />

TORS ® .<br />

On February 12, <strong>2004</strong>, the federal government’s Office of the Comptroller<br />

of the Currency (OCC) finalized a rule preempting state consumer protection,<br />

licensing and lending laws for megabanks and their operating subsidiaries. The<br />

rule is the latest in a series of federal government decisions that give special<br />

treatment to big corporations without considering the potentially negative<br />

impact on consumers. The rule is helping to create an industry that is dominated<br />

by a few huge banking concerns, leaving consumers with fewer choices<br />

and higher rates.<br />

NAR and MAR believe the OCC preemption rule is bad for consumers, bad<br />

for small business and bad for REALTORS ® . And we’re not alone. The governors<br />

of all 50 states, their attorneys general (including our own Attorney<br />

General Jim Hood), state banking supervisors and state legislatures are joined<br />

by consumer groups such as AARP and the Consumer Federation of America<br />

in opposition to the OCC rule. Only the OCC itself and the megabanks it regulates<br />

support the rule.<br />

MAR has written letters asking the OCC to rescind its rule and is asking its<br />

members to write or call their congressman to express their opposition. MAR<br />

President Bruce Kammer has also written to <strong>Mississippi</strong>’s four Congressmen<br />

and two U.S. Senators asking them to urge the OCC to rescind the onerous rule.<br />

"If federal regulators are not stopped or questioned by Congress, they will<br />

eventually influence the nation’s smaller banks to get federal charters and, in<br />

the process, eliminate the states’ voice on consumer protection issues,"<br />

Kammer said.<br />

We believe that only Congress should debate and enact laws that can so<br />

profoundly change whole sectors of the economy. Unelected regulators should<br />

not be deciding the fate of whole industries, Kammer added.<br />

Similar to the proposal to permit banks to engage in real estate and the<br />

withdrawn reform proposal of the <strong>Real</strong> <strong>Estate</strong> Settlement Procedures Act<br />

(RESPA) to give competitive advantage to mortgage lenders over settlement<br />

service providers, the OCC rule gives tremendous advantages to the largest<br />

national banking and financial services companies at the expense of consumers<br />

and much smaller real estate companies.<br />

The OCC rule sets the stage for a national real estate licensing process that<br />

preempts the state licensing laws now in place. And it could lead to a vast array<br />

of other federal preemptions. n<br />

New and improved: <strong>2004</strong> MAR Standard forms revisions<br />

Important updates on homeowners’ insurance, wood infestation, pre-closing inspections and more<br />

The number of REALTORS ® using the <strong>Mississippi</strong> Association of REAL-<br />

TORS ® library of standard forms and the ZipForm interactive software<br />

continues to grow. In local boards around the state where many brokers<br />

require the use of MAR forms exclusively, REALTORS ® have expressed<br />

relief about not having to interpret a multitude of different contracts.<br />

In March, revisions were made to several of MAR’s standard forms based<br />

on recommendations from members who use them, from our legal counsel<br />

and the Standard Forms Working Group.<br />

Two new forms were added to the forms library for <strong>2004</strong>: A Lead Based<br />

Paint Disclosure for Lessors and an Independent Contractor Agreement. In<br />

order to be in compliance with IRS regulations, it is suggested that brokers<br />

have an Independent Contractor Agreement on file with each agent that is<br />

signed and current.<br />

The following substantive changes were made to existing forms:<br />

Contract for the Sale and Purchase of <strong>Real</strong> <strong>Estate</strong> (F-1)<br />

Paragraph 1: includes a clause requiring the purchaser to make an<br />

application for homeowners insurance in addition to making a loan application.<br />

Paragraph 8: Proration - Includes a statement indicating that homestead<br />

exemption has or has not been applied for as stated on the Property<br />

Condition Disclosure Statement.<br />

Paragraph 9: Commission - Since commission is not an item on the<br />

Purchase Agreement to be negotiated by the parties, the blanks for insertion<br />

of commission have been deleted and replaced by a clause referring back to<br />

the agreements that established the commission – the listing agreement and<br />

the compensation offered through MLS: Seller / Buyer of property sold<br />

under this contract agrees to pay as per the listing agreement and prior<br />

offer of cooperation and compensation.<br />

Paragraph 14: Pre-Closing Inspection - Since the words "home inspection"<br />

are indicative of an inspection performed by a home inspector, a clause<br />

has been added to clarify that a "home inspection" performed in <strong>Mississippi</strong><br />

must be performed by a licensed home inspector: Any home inspection<br />

where the approval is made a contingency for purchase must be performed<br />

by a <strong>Mississippi</strong> licensed home inspector.<br />

Paragraph 15: Wood Infestation Report – Clarification has been added<br />

to include a remedy if wood infestation is found and the requirement that a<br />

material change, if found, must be disclosed.<br />

A. If such infestation constitutes material damage, the purchaser can<br />

declare the contract null and void and have his earnest money refunded.<br />

Additionally, when any infestation is found on the subject property, the seller<br />

can either furnish a warranty of approved treatment and correct any structural<br />

damage caused by such infestation or deem said repairs as cost prohibitive<br />

and declare the contract null and void refunding the purchaser’s<br />

earnest money.<br />

B. Any material change to the subject property shall be disclosed in<br />

accordance with the <strong>Mississippi</strong> <strong>Real</strong> <strong>Estate</strong> Brokers License Act of l954 as<br />

Amended 90-501-523 allowing for termination of the offer as prescribed by<br />

law.<br />

Counter Offer: A new section has been added within the Purchase<br />

Agreement for two counters. The Forms Library still includes a separate<br />

Counter Offer (F-14) for further counters, if needed.<br />

Buyer Representation Agreement (F-8)<br />

Several changes have been made to the Buyer Representation Agreement<br />

to clarify the roles and responsibilities of the buyer and the Buyer Agent. The<br />

most substantive change, however, is in the addition of language to assist the<br />

broker in attempting to keep a client that might be in conflict with the Buyer<br />

Agent and who plans to exercise the 15-day termination clause required to<br />

be in the agreement. Under the section titled Client Agrees, the following language<br />

has been added: Broker reserves the right to reassign you to another<br />

agent within the firm for representation should you and the Broker<br />

mutually agree that reassignment is best.<br />

Property Issues Addendum (Form 27)<br />

The Property Issues Addendum is one of the most utilized forms in the<br />

MAR forms library. A paragraph has been added to address the current<br />

issues surrounding the availability and affordability of property insurance as<br />

follows:<br />

The availability and cost of homeowners or property insurance depends<br />

on a number of factors, including your personal insurance, financial and<br />

credit history, materials and conditions present in or on the property, and the<br />

claims history on the property. Some insurance companies base part of their<br />

underwriting decision on Loss History Reports that show the history of insurance<br />

claims or property losses concerning the property or made by you concerning<br />

other properties. At the time you close on the purchase of your real<br />

property, most insurance companies will only issue a binder to you. A binder<br />

is NOT an insurance policy; it is only a temporary commitment to provide<br />

insurance coverage. From the effective date of the binder, the insurance company<br />

has 90 days to review the insurance application and other information<br />

and determine whether it will issue an insurance policy on the terms set forth<br />

in the binder. You are advised to consult directly with insurance companies<br />

of your choice regarding the availability and costs of insurance coverage for<br />

the property. Further, if the property is located in a flood zone, the mortgage<br />

lender may require that you obtain and pay for flood insurance on the property<br />

and its improvements. n<br />

Saying goodbye to the typewriter:<br />

One REALTOR triumphs over technology<br />

Technology is becoming an important factor in our lives and a critical success<br />

factor in the business of real estate. E-mail and the web have become<br />

second nature. Nobody wonders what the Internet is anymore, and the<br />

prediction of a computer in every home is coming true. As a broker/owner and<br />

appraiser, I thank technology one minute and curse it the next. I’m sure you<br />

can relate. I act as "technology guru" for my office and am the one my agents<br />

call when their computers freeze or start zigging instead of zagging.<br />

One thing I have learned about technology is that you must keep up. Until<br />

recently, I refused to connect my office to a network. I worried that one mistake<br />

on the network could result in all of my priceless data being lost. Finally, I<br />

realized that I’ve been holding myself back. The time and money saved by networking<br />

just makes good business sense. I plan to have my office connected by<br />

this summer.<br />

If you haven’t learned to use a computer – or learned to use a computer well<br />

– I encourage you to take the plunge. My office is located within a block of<br />

Delta State University and many of my agents have taken computer classes.<br />

Becoming proficient in the use of e-mail, for example, has helped agents stay<br />

connected with clients and provides them with fast and efficient customer service.<br />

We have also switched exclusively to using digital cameras. Not having to<br />

wait for film to develop means that agents can e-mail pictures within minutes.<br />

The quicker we can accommodate our clients, the better our business will be.<br />

Technology has made my work as an appraiser much easier, too. Ten years<br />

ago I was typing my appraisals on a typewriter, pasting my maps and photographs,<br />

and drawing my floor plans with a ruler and pencil. Then, I would mail<br />

the appraisals via "snail mail." Now, I complete the report on my computer,<br />

including downloaded maps, digital pictures and a computer sketch. The entire<br />

appraisal is e-mailed within minutes.<br />

By the way, my typewriter now collects dust on a shelf in my supply closet.<br />

Isn’t it about time you retired yours, too? n<br />

Finding a computer that’s right for you<br />

You know the drill. You step out of the car<br />

with your eye on that shiny, new vehicle. You<br />

look to the left and to the right, hoping not<br />

to be spotted by a golf-cart driving vulture/salesman<br />

scouring the car lot for unsuspecting prey.<br />

But it’s too late. "Vinny" moves in from out of<br />

nowhere and the over-rehearsed sales pitch begins.<br />

Car dealers like Vinny aren’t the only ones creating<br />

high-pressure sales environments for their<br />

customers. Computer sales have become cutthroat<br />

in recent years with increased demand, stiff competition<br />

and rapidly changing technologies that<br />

can confuse even the most educated of consumers.<br />

Don’t be duped into buying more computer than<br />

you really need.<br />

Here are some tips to help you get started:<br />

1. First of all, start with the right frame of<br />

mind. Next to communications, a computer is one<br />

of REALTORS’ ® primary technological investments<br />

and should be treated as such. Successful real<br />

estate professionals know they must invest in education,<br />

marketing and technology on a regular<br />

basis. Assess where you are on the technology curve<br />

and figure out where you want to be and when.<br />

2. Second, remember that if it sounds too good<br />

to be true, it probably is. A cheap computer is<br />

rarely ever good, and a good computer is rarely<br />

ever cheap. Forget all of the gadgets. Forget all of<br />

the claims of speed. Forget all of the gigaflops,<br />

megabizzels and terrahassle and base your purchase<br />

on what really makes a computer perform.<br />

3. Never buy a computer with the industry’s<br />

fastest processor. Take the fastest processor and<br />

drop down two steps. That is where you’re most<br />

likely find the best value.<br />

4. Don’t be fooled into thinking you’re getting<br />

a great deal because you’ve been offered a free<br />

upgrade to a 120 gigabyte hard drive. Ask about<br />

the speed of that hard drive. Even with numerous<br />

applications, pictures and files stored on your system,<br />

you will never fill a 120 gigabyte hard drive.<br />

Insist on optimal hard drive speed. The faster your<br />

processor can access information on your hard<br />

drive the quicker the system will be. Insist on a<br />

7,200-10,000 RPM drive as opposed to the outdated<br />

5,400 RPM drive. The difference is incredible.<br />

5. And don’t forget about your RAM. Right now<br />

RAM is cheaper than it has ever been. Spend your<br />

money here. As applications advance and newer<br />

technology hits the streets, RAM is becoming the<br />

foundation for a good running machine. Insist on<br />

at least 512 Megabytes. And if you can swing it,<br />

bump it up to 1024 Megabytes. You won’t be sorry.<br />

6. Spend a few extra dollars and have a good<br />

video card (display adapter) installed. Often overlooked,<br />

the video card can have a major impact on<br />

speed and performance. Nothing is more frustrating<br />

than a computer that is slow in rendering and<br />

displaying information on the screen. "ATI<br />

Radeon" or "nVIDIA GeForce" are examples of<br />

excellent display adapters.<br />

7. And finally, recognize that a desktop computer<br />

is not always the best investment for a REAL-<br />

TOR ® . Today’s notebook computers can power an<br />

entire business and give you the flexibility you need<br />

to stay mobile and connected.<br />

In summary, be smart. Do your homework.<br />

Compare computer specs between brands. Ask for<br />

advice. A computer is an investment that will either<br />

make the next three to five years bearable or a<br />

complete headache. The bottom line: Invest wisely,<br />

and your research will pay off. n<br />

Lessons learned the hard way<br />

Acolleague once told me: "Good judgment comes from experience.<br />

Unfortunately, experience usually comes from bad judgment". This is so<br />

true when it comes to technology. Learning what not to do before you do<br />

it could save you time and money. So let me share a few things about various<br />

technologies that I’ve learned through "experience":<br />

Digital Cameras<br />

• Any camera over three mega pixels is overkill. Three mega pixels will produce<br />

an 11X17 high-resolution image that is much larger than any of us will every<br />

need. Anything bigger is a waste of money.<br />

Personal Digital Assistants (PDAs)<br />

• Keep a set of spare batteries<br />

for your PDA with you at<br />

all times.<br />

•Be sure you sync your PDA<br />

with your desktop at LEAST<br />

once a day.<br />

Computers<br />

• Heat kills computers.<br />

Keep your system as cool as<br />

possible.<br />

• You can never click the "save" button too much.<br />

E-mail<br />

• Be courteous. Don’t send huge files via e-mail (and don’t use an overly fancy<br />

HTML signature in your e-mail window that slows down the speed with which<br />

your recipients can open your message). Zip files first. Visit www.winzip.com,<br />

download the latest version and install it. To zip a file for e-mail, simply "rightclick"<br />

the file and select "zip and e-mail". This will compress your desired file<br />

and automatically launch a new Outlook e-mail message with the file already<br />

attached.<br />

Printers<br />

• If you buy a $79 printer, you will get a $79 printer. The funny thing is that the<br />

ink refills for a $79 printer can cost up to $65. Stick with the leader. Buy a good<br />

HP printer that will last.<br />

Internet Service Providers<br />

• Cheap "mom & pop" internet service providers are rarely "real web based<br />

solutions." Chose a reputable ISP based on service, support and company background.<br />

Security<br />

Your data is your livelihood. And the risk of your database and computerized<br />

files being compromised is great and very real. Don’t think it can never happen<br />

to you. Take necessary steps to avoid becoming the next target of system breaches,<br />

identity theft or back door virus attacks, including:<br />

• Using current anti-virus software and install inexpensive hardware firewalls<br />

(See virus protection article on this page for details).<br />

• Using discretion when it comes to sharing personal or business information.<br />

• Never sending banking account information via Instant Messenger or e-mail.<br />

• Always contacting the sender before opening suspicious e-mail attachments.<br />

Bug be gone: Making<br />

virus protection a priority<br />

The biggest threat to your computer comes from malicious programmers<br />

in the form of viruses. Viruses can destroy data on your computer,<br />

cause lockups and spread themselves out to everyone in your<br />

e-mail address book. Recent attacks such as Blaster and MyDoom replicated<br />

themselves in just such a way.<br />

How do you protect yourself? Get the best antivirus protection available,<br />

and keep those definitions updated.<br />

I highly recommend Symantec Norton AntiVirus software (www.symantec.com/nav/nav_9xnt/)<br />

since it has an auto update feature that will check<br />

for new virus definitions regularly when you are online and install them<br />

when there are new ones available. This is all done transparently and without<br />

any effort on the part of the user.<br />

The Symantec Antivirus Research Center (SARC) (www.sarc.com) is<br />

the leader in the virus protection field. When a virus is reported, SARC generally<br />

has a response within 24 hours.<br />

Broadband (DSL or cable) users who have more than one computer connected<br />

to the internet generally have a built-in layer of protection. A router, the<br />

equipment used to connect your network to the internet, offers protection by<br />

keeping your machine invisible to users outside of your network.<br />

Those who have only one computer connected to DSL or cable also<br />

need an added layer of protection. There are software solutions such as<br />

Norton Internet Security (www.symantec.com/sabu/nis/nis_pe/index.html)<br />

or Norton Personal Firewall (www.symantec.com/sabu/nis/npf/). However,<br />

hardware solutions are best. Consider installing a router<br />

between the modem and your PC. For more information<br />

Beyond MLS books:<br />

Embracing better ways to list and sell real estate<br />

The MLS Book is an endangered species for several reasons, not the least<br />

of which is the rapid onslaught of technology. Gone are the days when<br />

the only way to get a complete list of properties was to wait for the delivery<br />

of your MLS book (as much as two weeks old by the time it was delivered<br />

by the printer).<br />

With internet-based MLS systems becoming the norm, we need to prepare<br />

for (and embrace) those technologies that give us the edge in today’s environment.<br />

Here is a very brief look at only four alternatives. If nothing else, these<br />

should start you thinking of what will work best for the way you personally list<br />

and sell real estate.<br />

Custom searches<br />

For those who don’t care to go any deeper into technology than they have<br />

to, simple custom searches tailored to your market area are a viable alternative.<br />

It is easy to send this to your printer (complete with photos) so you have<br />

your own ‘mini-MLS book.’ How often you run those printouts would depend<br />

on your individual needs.<br />

Laptop computers<br />

A good laptop (combined with the right MLS-specific software) allows customized<br />

listing presentations and showing information without being connected<br />

to the internet. Remember to select a lightweight laptop that won’t be a<br />

chore to carry with you, and keep your comparable and current listing data as<br />

current as you need it.<br />

Personal digital assistants<br />

PDA’s (Personal Digital Assistants) have matured from the hard to read, difficult<br />

to use devices that debuted a few years ago. Monochrome, poor resolution<br />

screens have been replaced by full color, high resolution devices that are<br />

easy to read and use. They are a lightweight, less cumbersome alternative to<br />

MLS books and laptop computers. And the technology just keeps getting better.<br />

Hand-held, multi-function devices with the familiar Windows desktop are<br />

now available. Plus, there are several sites that offer sophisticated software for<br />

the Palm OS (operating system) as well as Windows devices. Several manufacturers<br />

have combined handheld technology with cell phone functionality, but<br />

these have enjoyed limited acceptance as they tend to be larger and heavier<br />

than consumers want.<br />

New generation devices<br />

Wireless hand-held devices that have builtin<br />

internet access are perhaps the most exciting<br />

alternatives to MLS books. The most versatile<br />

of these (embracing GSM technology) will<br />

change the way we communicate and access<br />

the internet on mobile devices, whether that<br />

be a cell phone, PDA, or combination device.<br />

These devices allow you to search the internet<br />

real-time, download MLS data, write letters,<br />

manage contact lists, send and receive e-mail<br />

and most other functions available on your<br />

desktop computer. You can access MLS anywhere<br />

there is a wireless connection to the<br />

internet with the same look, feel and functionality<br />

of your PC.<br />

The MLS Book was a valuable and indispensable<br />

tool in its day, but that day is fading<br />

fast. Technology is changing every facet of our<br />

lives whether we approve or not. Regardless<br />

of where you are on the technology scale, all<br />

of these new tools are available. Choose what<br />

works best for you. n<br />

REALTORS ® key into the latest<br />

home-showing technology<br />

Electronic key boxes simplify the home-showing process, enabling REALTORS ® to<br />

access properties without the burden of running around town to pick up keys. At<br />

least two REALTOR ® associations in <strong>Mississippi</strong> now use the latest Supra Keybox,<br />

part of the Supra Information Network (http://www.supraekey.com).<br />

Tony Jones, of Century 21 in Olive Branch, uses his Zire-71 Palm Pilot to activate the<br />

electronic key boxes in his area. The Palm emits an infrared signal which triggers the key<br />

box to open.<br />

Jones<br />

"I’m a real dinosaur, so if I can learn how to use this technology, anybody can," says Jones, who serves<br />

as president of the Northwest <strong>Mississippi</strong> Association of REALTORS ® . Just to make sure, the association<br />

hosted orientation sessions earlier this year when the new electronic key boxes were first installed. "We’d<br />

expected some problems," Jones says, "but it was really a very smooth transition, and now we’re beginning<br />

to see big savings in efficiency and time." It’s just one more way <strong>Mississippi</strong> REALTORS ® are relying on technology<br />

Novice: Avoiding SPAM<br />

Tired of your computer serving up SPAM to your inbox every morning? Ever<br />

wonder how so many people get your e-mail address? You are asked to enter<br />

your e-mail address as confirmation for most online purchases or transactions.<br />

And unfortunately, even though you check that box that says "No, I do not want<br />

to receive additional information about similar products and services." you<br />

probably still get hammered with e-mail almost instantly after checkout.<br />

Try this: Go to www.hotmail.com (or any other free e-mail provider) and<br />

sign up for a free e-mail account. Whenever you are making a purchase online<br />

and are required to enter an e-mail address for order confirmation, simply use<br />

the free Hotmail "junk" e-mail account. Save your business e-mail address for<br />

conducting business that doesn’t involve online purchases.<br />

Remember this: When you get junk e-mail and at the bottom it says, "If you<br />

wish to be removed from this list simply reply with the word ‘REMOVE’ in the<br />

subject field", don’t do it. Why? Because you will be added to a much more<br />

desired Spam list for marketers because they know the address is a real working<br />

e-mail address.<br />

Intermediate: Going Wi-Fi<br />

Considering a wireless network for your office? Wireless Networking or<br />

"Wi-Fi" is gaining popularity among brokers who are discovering how greater<br />

mobility and versatility can improve their agents’ productivity.<br />

Wireless adapters can be added to almost ANY device a REALTOR ® might<br />

use these days, including laptops, desktops, handhelds and printers.<br />

Remember that no matter what the application, you’ll want to make sure you<br />

use the same generation equipment (802.11A, B or G).Try to stay with the<br />

802.11G protocol, the newest version that is usually backward compatible with<br />

its predecessor 802.11B. This will allow the two variants to talk to each other.<br />

You can also mix wireless hardware brands making the technology even more<br />

Was there life before cell phones? If there was, most REALTORS ® can't<br />

imagine it. Cell phones are a REALTOR ® 's lifeline – the very heartbeat<br />

of home sales everywhere. And now there’s a growing cadre of techsavvy<br />

REALTORS ® whose businesses are equally dependent upon pocket PCs,<br />

e-mail, digital cameras and the like.<br />

From virtual home tours to video conference closings, technology is dramatically<br />

reshaping the real estate business. Those who embrace the changes<br />

are forging ahead of their competition, reaping the benefits of faster, more productive<br />

sales strategies by catering to a demanding public that wants service<br />

immediately, if not sooner. Here’s how enterprising REALTORS ® around<br />

<strong>Mississippi</strong> are harnessing today’s technology:<br />

Weaving webs of wonder<br />

After working several years for another real estate company, Madison<br />

REALTOR ® Cindy Litsinger decided to start her own firm last year, but knew<br />

she’d need professional help to create a catchy website. A web designer developed<br />

a virtual home tour for Litsinger <strong>Real</strong>ty (see it at<br />

www.homeshow360.com).<br />

"There are tons of people out there who’ll build your website, but some<br />

aren’t as good as others," Litsinger cautions.<br />

She’s been pleased with the<br />

Litsinger’s experience<br />

is not unusual. The<br />

National Association of<br />

REALTORS ® estimates that<br />

at least 80 percent of buyers<br />

now start their home<br />

searches online, and at least<br />

30 percent of them ultimately purchase<br />

a home identified during an online<br />

search. "The consumer has chosen this medium,"<br />

explains Randy Landis, Broker/Owner of Help-U-<br />

Sell Beacon <strong>Real</strong>ty in Tupelo, "so it’s up to the REAL-<br />

TOR ® to respond."<br />

His fee-for-service company relies on a website he describes as a "total<br />

office tool" (see it at www2.helpusell.com/beaconrealty). It provides Landis<br />

with a follow-up system that handles all leads, interoffice reporting and communications.<br />

"Anything you can do with technology to create efficiency in the<br />

Today’s REALTOR ® uses e-mail like yesterday’s REALTOR ® used the telephone.<br />

It is the tool of choice in developing new prospects and communicating<br />

with clients, according to NAR studies that show 96 percent of REALTORS ®<br />

use e-mail.<br />

Kim Noffsinger, of Coldwell Banker S.R.E. in Starkville<br />

(www.noffsinger.net), goes a step further with "tailored" e-mails that highlight<br />

specific details for prospective clients.<br />

Working with a software programmer she met through a local civic group,<br />

Noffsinger helped design a program that organizes data from new property listings<br />

in accordance with her own database of clients and prospective customers<br />

who’ve expressed interest in certain property features. The program then generates<br />

bulk e-mails alerting those in her database who would be interested. But<br />

it’s not just a general message with a string of addresses in the "Sent To" field.<br />

The program generates what looks like individualized emails with personal<br />

greetings and only one recipient’s e-mail address.<br />

"Within half an hour, I’ve e-mailed hundreds of people with information tailored<br />

just for them," Noffsinger explains. Her cost for the software: only $500.<br />

The downside, of course, is that it’s strictly for clients who are e-mail savvy.<br />

Noffsinger also says it’s crucial to have a system in place to respond immediately<br />

when customers reply to her e-mails. "Otherwise, good prospects may fall<br />

through the cracks," she warns. "But there’s no question this approach works;<br />

we see a huge percentage of our sales linked directly to our web site and our<br />

e-mails."<br />

REALTOR ® Lady Cox, of Coldwell Banker S.R.E. in Starkville<br />

(www.starkvillerealestate.com/realtors/cox.html), also uses e-mail to provide<br />

a unique service. With a degree in<br />

communications and experience in<br />

marketing, Cox produces an electronic<br />

newsletter that highlights several<br />

established neighborhoods in<br />

Starkville. "A lot of companies offer<br />

real estate newsletters you can just<br />

print your name on, but I write this<br />

one myself so I can make it specific to<br />

individual neighborhoods," Cox says.<br />

Electronic newsletters are driving more sales She estimates it would cost between<br />

home for Starkville REALTOR ® Lady Cox. $12-$15 per household if she printed<br />

and mailed the newsletter in paper form, but the e-mail newsletter gives her far<br />

greater reach at much less cost. She says clients also appreciate her environmentally<br />

friendly approach because it saves paper and is less like junk mail.<br />

Less paper, better form<br />

Broker/Owner Mark Warren, of ERA <strong>Real</strong> <strong>Estate</strong> Professionals in Jackson,<br />

came to the profession after a successful career in manufacturing and remembers<br />

thinking: "There’s an awful lot of faxing going on here." Like others in his<br />

company, he wondered if there weren’t easier ways to conduct transactions. He<br />

found several online document services and began working to incorporate<br />

those services into his own website (www.markwarren.net). The result is an<br />

online transaction capability that streamlines the whole real estate process.<br />

He’s been testing the system in-house for a couple of months and plans to<br />

launch it later this year. Forms, documents and other materials required for<br />

real estate transactions can be accessed and transmitted via e-mail. He purchased<br />

the service from a software company but had to modify his website to<br />

make it compatible. "The bigger hurdle was implementing a procedure in our<br />

office to keep the forms updated and maintain certain communications, but it<br />

was certainly worth the time and effort," Warren says.<br />

As a new REALTOR ® , Kevin Lawrence of Kosciusko <strong>Real</strong>ty (www.kosciuskorealty.com)<br />

agrees with Warren in thinking there’s a better way. He’s discovered<br />

ZipForms, the <strong>Mississippi</strong> Association of REALTORS ® ’ standard forms software,<br />

and prefers the convenience over<br />

paper versions. Using his Dell Axim<br />

pocket PC and a portable printer, he’s<br />

able to access ZipForms anytime, anywhere.<br />

"If my client needs a particular<br />

form, I don’t have to run back to the<br />

office. I just print it out right there," he<br />

says. Clients are impressed with this<br />

speed and efficiency, Lawrence notes.<br />

"I probably used ZipForms at least<br />

eight times already today."<br />

It was both a need and an objective<br />

that drove Al Allegue,<br />

Broker/Owner with RE/MAX by the Gulf (www.alndee.com), to find a better<br />

way. He now conducts real estate closings by video teleconference, enabling<br />

out-of-town parties to participate in real time without the hassle of designating<br />

a representative to attend in person. Documents are prepared in advance and<br />

e-mailed to the respective parties who review them prior to the closing. This<br />

saves time and cuts down on transaction costs, Allegue says. He estimates ordinary<br />

closings cost between $500 and$600 but does video closings for only<br />

$250.<br />

Once a year, his team of REALTORS ® evaluates the kinds of technology used<br />

by other professions. "We ask what’s out there that we can use to make our<br />

business more service-oriented and more profitable. That’s how we came up<br />

with this idea," he says. Allegue says video closings provide the ultimate in flexibility.<br />

"We once did a video closing at 1:00 a.m. because all the parties were<br />

in distant time zones," he recalls. Since he sees many clients from Kessler Air<br />

Force Base, this service is especially valuable when the military member is<br />

deployed or overseas.<br />

high in commercial<br />

real estate<br />

From education to MLS systems, contact management to virtual tours,<br />

technology has infiltrated every aspect of the practice of real estate.<br />

Nowhere is that more evident than in the world of commercial real estate,<br />

where investors are known to peruse online offerings, make offers and close<br />

deals, sometimes without ever visiting the property. The commercial real estate<br />

industry has responded by developing new tools in the effort to keep pace with<br />

the explosion of internet-based deal-making.<br />

Commercial Information Exchanges (CIEs) are internet-based property<br />

listing services, where information about available properties for sale or lease<br />

is displayed. In <strong>Mississippi</strong>, the <strong>Mississippi</strong> Commercial Association of REAL-<br />

TORS ® operates a CIE affiliated with the nationwide listing service, CCIMNet<br />

(see www.mcar.ms). Information about <strong>Mississippi</strong> properties is entered by<br />

members one time into the local property database and is accessible through<br />

a national database to any CCIMNet visitor anywhere in the world.<br />

Another technology tool seeing widespread use by commercial practitioners<br />

is "Site To Do Business," provided to members of the CCIM Institute. The<br />

site marries demographic information, GIS, transaction management, marketing<br />

software and mobile office devices into an extremely powerful, versatile<br />

Brokers who concentrate on the sale of recreational property, farmland<br />

and timberland rely heavily on mapping programs which combine GPS with<br />

satellite images and enable the user to draw property boundaries and highlight<br />

important features of the property, such as lakes, stands of timber, roads and<br />

fences.<br />

New technology tools appear at such a dizzying pace, that there’s even a<br />

popular annual conference dedicated to discussing, analyzing and debating the<br />

latest innovations in commercial real estate. <strong>Real</strong>Comm is held in early summer<br />

each year, and offers a large expo of available products, instructional lectures<br />

on technology and tours of nearby technology-friendly commercial properties,<br />

Commission…<br />

New form on its way<br />

The <strong>Mississippi</strong> <strong>Real</strong> <strong>Estate</strong> Commission is in the process of revising one of<br />

its mandatory forms to be posted on its website prior to implementation July 1,<br />

<strong>2004</strong>. The Cooperative Agreement for Non-<strong>Mississippi</strong> Licensed Brokers will<br />

be revised to further clarify that no money leaves the state in commission or<br />

referral fees unless the form is on file with MREC. The form also clarifies that<br />

only the principal broker is involved in the cooperating agreement.<br />

BPOs for a fee = Disciplinary action<br />

If a licensee receives any consideration (money, credit cards with a specific<br />

"balance" from retailers or any other valuable consideration) for providing<br />

a broker price opinion (BPO) or comparative market analysis (CMA), the<br />

minimum disciplinary action will be a three-month (90-day) suspension of the<br />

license and an equal penalty for the licensee’s broker depending upon the broker’s<br />

knowledge and participation. Rule IV A (7).<br />

License reciprocity with other states<br />

MREC is in the process of sending letters<br />

to other state’s <strong>Real</strong> <strong>Estate</strong> Commissions<br />

requesting that they allow license-for-license<br />

reciprocity for <strong>Mississippi</strong> licensees in<br />

exchange for equal licensing privileges for<br />

the out-of-state licensees.<br />

Our 800 members anxiously await the completion of<br />

our new office building. The building will house our<br />

state-of-the-art training room that will allow us to<br />

provide a host of educational and leadership training<br />

services. We anticipate completion by late summer.<br />

Over 250 members recently took advantage of<br />

four hours of free CE hosted by our REALTOR ®<br />

Services Board. We have it on good authority that it<br />

was a record-setting crowd for a local board. We are<br />

also actively involved in planning our annual Habitat<br />

for Humanity Golf Tournament for early fall.<br />

<strong>Mississippi</strong> REALTORS ® have raised almost $7,000 for Habitat for Humanity projects in <strong>Mississippi</strong> through the<br />

will be the first three to benefit from the proceeds. Each program will receive a $2,304 grant.<br />

The Internet, Floyd Cramer…and me<br />

How technology fueled my (first) mid-life crisis<br />

Idon’t really know what possessed me, there on<br />

the cusp of my fortieth birthday, to develop an<br />

addiction.<br />

Nostalgia, probably – that wistful yearning for<br />

my spent youth, for days when prospects had been<br />

as abundant as hairs on my head (an unfortunate<br />

simile, under the circumstances).<br />

It is a rite of passage that at 40 –<br />

upon realizing that this ride may well<br />

be half-done, statistically speaking –<br />

we guys go both vain and melancholy,<br />

begin to suck in our guts<br />

and trim our ears and pine<br />

away for those irrecoverable<br />

feelings of our pre-marriage,<br />

pre-mortgage, prekidney-stone<br />

adolescence.<br />

It’s enough to make a<br />

fellow a little crazy for a little<br />

while, drives him to do foolish<br />

things – a new car or a new job or a<br />

new wife, or even…a habit-forming<br />

pastime.<br />

Which brings me back to…well, me…and my<br />

internet addiction.<br />

I know what you’re thinking: Pornography.<br />

Websites with names like Lady Eve’s Feet.com.<br />

Cleverly disguised monthly charges to the<br />

MasterCard. Online purchases of Viagra and libidoenhancing<br />

herbs. Well get your mind out of the gutter.<br />

You won’t find any of that stuff on iTunes.com,<br />

the habit-forming, deceptively inexpensive music<br />

website that saw me through my first mid-life crisis.<br />

At iTunes.com one can download his youth to<br />

the tune of 99-cents-a-song. Needless to say, it’s<br />

downright amazing how quickly one can run up a tab.<br />

It started innocently enough: I’m fiddling one<br />

evening with my new laptop, a Macintosh<br />

PowerBook G4; I click on an icon that looks like a<br />

music note, and voila! There I am, listening to a<br />

beastly group, the Beastie Boys, singing a beastly song<br />

– I use the term loosely – called Ch-Check It Out.<br />

Undaunted, I began to explore,<br />

and within seconds…Nirvana!<br />

And not the band Nirvana, mind<br />

you. I’m talking real music: Floyd<br />

Cramer, originator of the “Nashville<br />

sound,” plugging away on that greatest of<br />

his songs, Last Date – from The Essential<br />

Floyd Cramer, the album on which my father<br />

wore out many a needle playing again and<br />

again in the early 1970s.<br />

Suddenly, I’m a kid again, and<br />

searching for more: Top of the World by<br />

The Carpenters. B. J. Thomas and<br />

Raindrops Keep Falling on My Head. Glen<br />

Campbell with Rhinestone Cowboy. Mac<br />

Davis singing the<br />

one that to this<br />

day makes my<br />

mother cry:<br />

W atchin’<br />

Scotty Grow.<br />

Merle Haggard wailing,<br />

played the guitar and<br />

the French harp….”<br />

Barry Manilow, writing<br />

the songs that make the<br />

whole world sing. The<br />

Captain & Tenille and<br />

Love Will Keep Us<br />

Together. And my personal,<br />

all-time favorite,<br />

Marty Robbins, “Out in<br />

the West Texas town of<br />

El Paso, I fell in love<br />

with a Mexican girl…”<br />

It had to be the sappiest,<br />

happiest musical<br />

evening I’d spent in<br />

years – demonstrating<br />

once again the power of<br />

nostalgia to make the<br />

ridiculous – in this case, those kitschy songs – seem<br />

sublime, if only for a moment<br />

Seventy-five dollars in charges and a stern<br />

rebuke from my wife later (who, I should point out,<br />

did ask me to download Kung Fu Fighting and No<br />

Parking on the Dance Floor especially for her), my<br />

melancholy was gone and a new addiction born of<br />

the confluence of nostalgia and technology, and<br />

enabled by MasterCard.<br />

Like they say on those commercials: Priceless. n<br />
