GOVERNOR ISSUED EXECUTIVE ORDER NO. 2010-02<br />

<strong>Yap</strong> <strong>State</strong> Governor Sebastian Anefal has issued an order to all the departments, offices and<br />

agencies of the <strong>State</strong> <strong>Government</strong> on matters concerning <strong>Yap</strong> Day celebration.<br />

In his statement, Governor Anefal referred to the <strong>State</strong> Code of Section 802 Title 1 of the <strong>Yap</strong><br />

<strong>State</strong> Code designates March 1st as <strong>Yap</strong> Day and a legal holiday in recognition of the traditions<br />

of the people of the <strong>State</strong>.<br />

He also said that Section further authorizes that “activities which are organized for the<br />

celebration of <strong>Yap</strong> Day may be held on a different day, or days, at one or more locations in the<br />

<strong>State</strong>”.<br />

The Governor uses this year’s celebration as one example. He said the <strong>Yap</strong> Day Committee has<br />

organized activities for the 2010 <strong>Yap</strong> Day celebration to be held on March 1, 2010, and March 2,<br />

2010 and urged participation of the public to honor, preserve, and reinforce the traditions and<br />

customs of the <strong>Yap</strong>ese people.<br />

Governor Anefal has declared March 2, 2010, as a non-working day for the <strong>Yap</strong> <strong>State</strong><br />

<strong>Government</strong>, except for those essential government employees who, due to the nature of their<br />

work must stand their duty on that day.<br />

In addition, the Governor directed all Heads of Departments and Offices and Division Chiefs to<br />

identify the essential employees and require that they work on March 2, 2010, and allow the nonessential<br />

employees administrative leave so that they can take part and participate in the second<br />

day celebration of <strong>Yap</strong> Day.<br />

PRESIDENT MORI CONVEYS SYMPATHY ON <strong>THE</strong> PASSING FOR FORMER FIRST<br />

LADY IRIS FALCAM<br />

Former First Lady Iris Green Falcam passed away on Friday, February 19, 2010. Mrs. Falcam<br />

was the First Lady during President Leo Falcam’s term from 1999-2003 and served as the<br />

Librarian for the Pacific Collection of the College of Micronesia-FSM from 1979 until her<br />

passing. She had also served as the Librarian of the Congress of Micronesia and as staff for the<br />

Public Information Office at the Trust Territory Headquarters in Saipan.<br />

Former First Lady Falcam attended the University of Hawaii at Manoa and Kapiolani Technical<br />

School.<br />

President Mori wrote to former President Falcam and expressed his sympathy on the passing of<br />

Mrs. Falcam. The President wrote that the late Mrs. Falcam will be remembered not only as a<br />

First Lady of our Nation but as a gracious and caring mother of our Nation. “She has been a<br />

devoted and hard-working public servant who has dedicated her professional career at the<br />

College of Micronesia-FSM and is well known for her charitable work in the FSM such as<br />

working for the Micronesia Red Cross and the Committee on the Rights of Children.” Mrs.<br />

Falcam also served as the Treasurer of the Pohnpei Lions Club, is a former member of the Board<br />

of Pohnpei Catholic School, and a member of the Pwihn en Mercedes, a Catholic women’s<br />

organization. In his letter, the President said that Mrs. Falcam’s compassion to improve the<br />

welfare of the FSM people demonstrated her great spirit of understanding and dedication to help<br />

others.<br />

Mrs. Falcam is originally from Hawaii but spent more than 40 years in the Micronesia.<br />

ONPA RELEASES INSPECTION REPORT <strong>OF</strong> KITTI COUNCIL ALLEGATIONS <strong>OF</strong><br />

ELECTION DISTRICT TWO IN POHNPEI<br />

The Office of the National Public Auditor (hereinafter, “ONPA”) announces the release of<br />

Report No. 2010-02: Inspection of Kitti Council Allegations Election District II In Pohnpei. Soft<br />

copy of the report is available for public review online at ONPA’s website www.fsmopa.fm and<br />

hard copies are available at the ONPA’s offices in Palikir, Pohnpei and Weno, Chuuk.<br />

The allegations that form the basis of Report No. 2010-02 were made by the Isokeohnedi En<br />

Wein Kitti and the Kitti Municipal Council (collectively, “Kitti Council”). The Kitti Council<br />

registered a formal complaint against the Election District Number Two (hereinafter, “ED#2”)<br />

Representative in the FSM Congress (hereinafter, “Senator”) and requested the ONPA<br />

investigate the matter. Seven specific allegations were made by the Kitti Council regarding the<br />

Senator’s involvement in the management and administration of publicly funded projects and,<br />

further, the misuse and abuse of public funds.<br />

The ONPA conducted an inspection into the allegations—its purpose to determine whether any<br />

evidence existed to support the allegations and, if so, whether a formal investigation is<br />

warranted. The ONPA’s inspection was completed pursuant to the authority established by Title<br />

55 FSM Code, Chapter 5 and in accordance with the Quality Standards for Inspections used by<br />

the U.S. Office of the Inspector General.<br />

Of the seven allegations, the ONPA concluded that three of the allegations warranted further<br />

investigation as follows:<br />

1. Senator’s involvement in the distribution of coral and PVC pipes purchased with public funds<br />

and distributed to private residences and churches;<br />

2. Senator’s involvement in suspending the Wone Elementary School Road project prior to its<br />

completion due to poor election results; and,<br />

3. Senator’s use of public funds to purchase airline tickets for campaign traveling.<br />

Said allegations were referred to the ONPA’s Compliance Investigation Division (CID) for<br />

formal investigation. On completion of CID’s investigation, any findings of illegal activity will<br />

be referred to the Department of Justice for further investigation and/or prosecution.<br />

The four other allegations made by the Kitti Council were found to be lacking merit and were not<br />

referred to CID. These included an allegation that funds had been allocated for the purchase of a<br />

flatbed truck for the Kitti Municipal <strong>Government</strong> and that Kitti had not received the truck. The<br />

inspection team found that ED#2 had purchased a flat bed truck, however, the project and<br />

procurement documents had not specified that the truck would be provided to the Kitti Municipal<br />

<strong>Government</strong>. The truck was assigned to a different<br />

municipality within ED#2 and is accounted for.<br />

The Kitti Council also alleged that an outboard engine was purchased without proper<br />

appropriation of funds. The inspection found that line item section 1(3)(c)(x) of Public Law 15-<br />

44 had included an appropriation of funds for the purchase of an outboard motor to be used by<br />

the Kitti Police.<br />

The next allegation was that public funds allotted for the building and repair of civic centers<br />

were used to refurbish synagogues of certain churches. The inspection team found that funds<br />

were used to repair the Rohn Kitti and Nan Mand civic centers which are adjacent to churches.<br />

There was no evidence that<br />

the funds were used to repair the churches.<br />

The final allegation concerned funding for the Kitti Fish Market being used for other purposes.<br />

The inspection found that Public Law 15-30 had appropriated funds for the Fish Market but in<br />

December 2008 the law was repealed.<br />
