Constitutional Provisions Relating
to Circuit and District Judges
The following provisions of Kentucky’s Constitution are applicable to circuit
and district judges:
Section 117 – Circuit and district judges are to be elected from their
respective circuits or districts on a nonpartisan basis
Section 119 – Circuit judges are elected for terms of 8 years; district
judges are elected for terms of 4 years
Section 122 – Circuit and district judges must be citizens of the
United States, licensed to practice law in Kentucky and be residents of
Kentucky as well as the circuit or district from which they are elected
for 2 years next preceding their taking office; circuit judges must be
licensed attorneys for at least 8 years; district judges must be licensed
attorneys for at least 2 years
Section 123 – During their terms in office, circuit and district judges may
not practice law, run for elective office other than judicial office or hold
any office in a political party or organization •
