On behalf of <strong>the</strong> Blue Ridge Envir<strong>on</strong>mental Defense League and our members <strong>in</strong> Burke County, I<br />
write to comment <strong>on</strong> <strong>the</strong> Part 70 <strong>Title</strong> V <strong>permit</strong> <strong>for</strong> <strong>SGL</strong> Carb<strong>on</strong> <strong>in</strong> Morgant<strong>on</strong>. Please c<strong>on</strong>sider<br />
<strong>the</strong>se remarks <strong>in</strong> additi<strong>on</strong> to our oral testim<strong>on</strong>y presented at <strong>the</strong> public hear<strong>in</strong>g <strong>in</strong> Morgant<strong>on</strong> <strong>on</strong><br />
June 5, 2003.<br />
Overview<br />
As you know, <strong>SGL</strong> Carb<strong>on</strong> Corporati<strong>on</strong> is <strong>the</strong> world’s largest producer of graphite and carb<strong>on</strong><br />
products. <strong>SGL</strong> manufactures syn<strong>the</strong>tic graphite and is classified under SIC code 3624 <strong>for</strong><br />
Electrical Industrial Apparatus Carb<strong>on</strong> And Graphite Products. <strong>SGL</strong> Carb<strong>on</strong> Corporati<strong>on</strong> emits<br />
235 t<strong>on</strong>s/year of particulates (PM-10), 108 t<strong>on</strong>s/year of sulfur dioxide (SO 2 ), and 717 t<strong>on</strong>s/year<br />
of carb<strong>on</strong> m<strong>on</strong>oxide (CO). <strong>SGL</strong> Carb<strong>on</strong> is <strong>in</strong> close proximity to Class I areas and is a major<br />
source of air polluti<strong>on</strong> <strong>in</strong> an area which is near<strong>in</strong>g n<strong>on</strong>-atta<strong>in</strong>ment. There<strong>for</strong>e, we recommend<br />
that North Carol<strong>in</strong>a regulators use all possible means to ensure <strong>the</strong> lowest possible air emissi<strong>on</strong>s.<br />
Up<strong>on</strong> review of <strong>the</strong> <strong>draft</strong> <strong>permit</strong>, <strong>the</strong> <strong>permit</strong> review, and <strong>the</strong> <strong>permit</strong> applicati<strong>on</strong>, we recommend<br />
that new m<strong>on</strong>itor<strong>in</strong>g, producti<strong>on</strong> limits, and recordkeep<strong>in</strong>g be required be<strong>for</strong>e <strong>the</strong> <strong>permit</strong> is<br />
issued.<br />
<strong>SGL</strong> Carb<strong>on</strong> Prosecuted <strong>for</strong> Restra<strong>in</strong>t of Trade<br />
In 1999 <strong>SGL</strong> Carb<strong>on</strong> Aktiengesellschaft pled guilty to violat<strong>in</strong>g <strong>the</strong> Sherman Act and agreed to<br />
pay a $135 milli<strong>on</strong> f<strong>in</strong>e <strong>for</strong> participat<strong>in</strong>g <strong>in</strong> an <strong>in</strong>ternati<strong>on</strong>al c<strong>on</strong>spiracy to fix prices. This was <strong>the</strong><br />
third largest penalty ever given by <strong>the</strong> US Department of Justice <strong>for</strong> antitrust crimes.<br />

<strong>SGL</strong> Carb<strong>on</strong> Faces F<strong>in</strong>ancial Hard Times<br />
The share price of <strong>SGL</strong> Carb<strong>on</strong> has decl<strong>in</strong>ed precipitously s<strong>in</strong>ce <strong>the</strong> anti-trust violati<strong>on</strong>s. In June<br />
1997 <strong>the</strong> per share price was $46.50; by June 2000 it had fallen to $22.50. As of June 2003 <strong>the</strong><br />
per share price is $4.34, a mere 9% of its value <strong>in</strong> 1997. Dur<strong>in</strong>g <strong>the</strong> first quarter of 2003, <strong>SGL</strong><br />
Carb<strong>on</strong>’s sales revenues fell 4%. The possible impact of cutbacks <strong>on</strong> capitalizati<strong>on</strong>, operat<strong>in</strong>g<br />
costs, and plant ma<strong>in</strong>tenance should not be overlooked by DAQ.<br />

<strong>SGL</strong> Carb<strong>on</strong> Violates Particulate Matter Emissi<strong>on</strong>s Standards<br />
<strong>SGL</strong> Carb<strong>on</strong> has a history of n<strong>on</strong>-compliance with standards <strong>for</strong> c<strong>on</strong>trol of particulates. Several<br />
Notices of Violati<strong>on</strong> are detailed <strong>in</strong> <strong>the</strong> DAQ’s <strong>permit</strong> review: six NOVs <strong>for</strong> fabric filter failures<br />
<strong>in</strong> three separate baghouses.<br />
In additi<strong>on</strong>, residents liv<strong>in</strong>g near <strong>the</strong> plant <strong>in</strong> a Morgant<strong>on</strong> neighborhood dubbed “Carb<strong>on</strong> City”<br />
report l<strong>on</strong>g-term, gross depositi<strong>on</strong>s of particulate emissi<strong>on</strong>s. Some of <strong>the</strong>se reports were<br />
provided <strong>in</strong> oral testim<strong>on</strong>y at <strong>the</strong> public hear<strong>in</strong>g <strong>in</strong> Morgant<strong>on</strong> <strong>on</strong> June 5, 2003 by ex-employees<br />
whom we c<strong>on</strong>sider to be credible sources due to <strong>the</strong>ir l<strong>on</strong>g-stand<strong>in</strong>g experience with plant<br />
operati<strong>on</strong>s. The DAQ has taken some steps to improve m<strong>on</strong>itor<strong>in</strong>g and report<strong>in</strong>g s<strong>in</strong>ce <strong>the</strong> NOVs<br />
of January-August 2000. But plant neighbors’ reports of “black carb<strong>on</strong>” deposits <strong>on</strong> outdoor<br />
furniture and automobiles c<strong>on</strong>t<strong>in</strong>ue to <strong>the</strong> present time. Based <strong>on</strong> <strong>the</strong>se reports, <strong>the</strong> plant<br />
c<strong>on</strong>t<strong>in</strong>ues to exceed particulate standards; <strong>the</strong> DAQ cannot <strong>permit</strong> an <strong>on</strong>go<strong>in</strong>g violati<strong>on</strong>.<br />
North Carol<strong>in</strong>a rules, 15A NCAC 2D .0515 Particulates from Miscellaneous Industrial Processes,<br />
stipulate allowable particulate emissi<strong>on</strong>s based <strong>on</strong> process rates. But <strong>the</strong> <strong>draft</strong> <strong>permit</strong> fails to<br />
ensure compliance with exist<strong>in</strong>g regulati<strong>on</strong>s. Weekly visible emissi<strong>on</strong>s checks and weekly and<br />
m<strong>on</strong>thly <strong>in</strong>specti<strong>on</strong> and ma<strong>in</strong>tenance requirements of <strong>the</strong> fabric filter units do not allow DAQ or<br />
<strong>the</strong> public to adequately determ<strong>in</strong>e if <strong>the</strong> plant is <strong>in</strong> compliance. <strong>SGL</strong> Carb<strong>on</strong> plant has dozens of<br />
fabric filter polluti<strong>on</strong> c<strong>on</strong>trol devices which must be ma<strong>in</strong>ta<strong>in</strong>ed at maximum efficiency to keep<br />
harmful particulate emissi<strong>on</strong>s with<strong>in</strong> legal limits.<br />
We recommend that DAQ stipulate filter<strong>in</strong>g velocity and/or pressure drop limits <strong>on</strong> fabric filter<br />
c<strong>on</strong>trol devices. A well ma<strong>in</strong>ta<strong>in</strong>ed fabric filter baghouse may achieve 99% or better collecti<strong>on</strong><br />
efficiency <strong>on</strong>ly when filter<strong>in</strong>g velocity is at an optimum level. For example, <strong>the</strong> maximum<br />
filter<strong>in</strong>g velocity <strong>for</strong> carb<strong>on</strong> and graphite particles has been shown to be 2.0 cfm/ft 2 . (Air<br />
Polluti<strong>on</strong> C<strong>on</strong>trol: A Design Approach, Cooper and Alley, Sec<strong>on</strong>d Editi<strong>on</strong>, 1994) Filter<strong>in</strong>g<br />
velocity is a product of baghouse size and pressure drop; both parameters are affected by cost<br />
c<strong>on</strong>siderati<strong>on</strong>s. Exist<strong>in</strong>g ec<strong>on</strong>omic factors could very well put pressure <strong>on</strong> operat<strong>in</strong>g costs <strong>in</strong><br />
such matters, result<strong>in</strong>g <strong>in</strong> less than optimal polluti<strong>on</strong> c<strong>on</strong>trol. Without tighter c<strong>on</strong>trol of<br />
baghouse parameters, DAQ cannot assure compliance with 15A NCAC 2D .0515 or NAAQS.<br />
O<strong>the</strong>r opti<strong>on</strong>s <strong>for</strong> compliance would be stack test<strong>in</strong>g and producti<strong>on</strong> rate limits. NC rule 15A<br />
NCAC 2D .0501(c)(14) states that <strong>for</strong> emissi<strong>on</strong> rates based <strong>on</strong> process rates, “provisi<strong>on</strong>s shall be<br />
made <strong>for</strong> c<strong>on</strong>troll<strong>in</strong>g and measur<strong>in</strong>g <strong>the</strong> producti<strong>on</strong> rate.” Particulates emissi<strong>on</strong> limits are<br />
governed by <strong>the</strong> follow<strong>in</strong>g process-based <strong>for</strong>mulae:<br />
Up to 60,000 pounds/hour process<br />

Producti<strong>on</strong> rate limits must be added to <strong>the</strong> <strong>permit</strong> to ensure compliance and to protect public<br />
health.<br />
Stack test<strong>in</strong>g is not required but it may be prescribed by DAQ accord<strong>in</strong>g to Permit Review<br />
secti<strong>on</strong> VI.A.2.a.ii.C which states:<br />
Stack test<strong>in</strong>g is not required to ensure compliance with this regulati<strong>on</strong>. However<br />
<strong>the</strong> test method c<strong>on</strong>diti<strong>on</strong> will be put <strong>in</strong> <strong>the</strong> <strong>permit</strong> <strong>in</strong> <strong>the</strong> event that DAQ or EPA<br />
f<strong>in</strong>ds that due to improper operati<strong>on</strong> violati<strong>on</strong>s, etc, source test<strong>in</strong>g is required.<br />
Test<strong>in</strong>g requirements are specified <strong>in</strong> 2D .0501(c)<br />
DAQ should require that c<strong>on</strong>t<strong>in</strong>uous emissi<strong>on</strong> m<strong>on</strong>itor<strong>in</strong>g be added now to <strong>the</strong> Part 70 <strong>permit</strong> to<br />
ensure compliance and to protect public health.<br />
