DECLARATION<br />
ON LAND ISSUES<br />
AND CHALLENGES<br />
IN AFRICA<br />
WE, the Heads of States <strong>and</strong> Government of the African Uni<strong>on</strong>,<br />
meet<strong>in</strong>g at our Thirteenth Ord<strong>in</strong>ary Sessi<strong>on</strong> <strong>in</strong> Sirte, Libyan Arab<br />
Jamahiriya, from 1 to 3 July 2009;<br />
REAFFIRMING the commitments we have made to poverty<br />
eradicati<strong>on</strong> with the view to rais<strong>in</strong>g the liv<strong>in</strong>g st<strong>and</strong>ards of our<br />
peoples <strong>and</strong> the wellbe<strong>in</strong>g of our future generati<strong>on</strong>s;<br />
RECOGNISING the centrality of <strong>l<strong>and</strong></strong> to susta<strong>in</strong>able socio-ec<strong>on</strong>omic<br />
growth, development <strong>and</strong> the security of the social, ec<strong>on</strong>omic <strong>and</strong><br />
cultural livelihoods of our people;<br />
AWARE of the rich heritage of Africa’s <strong>l<strong>and</strong></strong> <strong>and</strong> related resources<br />
especially its unique natural eco-systems;<br />
FURTHER AWARE of the diversity <strong>and</strong> complexity of the systems<br />
under which <strong>l<strong>and</strong></strong> <strong>and</strong> related resources are held, managed <strong>and</strong><br />
used;<br />
NOTING the diversity of <strong>issues</strong> <strong>and</strong> <strong>challenges</strong> fac<strong>in</strong>g access to, use<br />
<strong>and</strong> management of <strong>l<strong>and</strong></strong> resources; <strong>and</strong> the threat relat<strong>in</strong>g to <strong>l<strong>and</strong></strong><br />
<strong>and</strong> related resources <strong>in</strong>clud<strong>in</strong>g those aris<strong>in</strong>g from changes <strong>in</strong> the<br />
global, political <strong>and</strong> ec<strong>on</strong>omic envir<strong>on</strong>ment;

CONSCIOUS of the need for str<strong>on</strong>g systems of <strong>l<strong>and</strong></strong> governance rooted <strong>in</strong><br />
pr<strong>in</strong>ciples of susta<strong>in</strong>ability <strong>in</strong> an effort to ensure preservati<strong>on</strong>, protecti<strong>on</strong><br />
<strong>and</strong> renewability of Africa’s <strong>l<strong>and</strong></strong> <strong>and</strong> related resources;<br />
FURTHER NOTING the steady progress which our countries have made<br />
<strong>in</strong> the <strong>in</strong>itiati<strong>on</strong>, review, revisi<strong>on</strong> or comprehensive development of <strong>l<strong>and</strong></strong><br />
policies <strong>and</strong> their implementati<strong>on</strong> <strong>in</strong> order to ensure that their various<br />
<strong>l<strong>and</strong></strong> sectors play an important role <strong>in</strong> development;<br />
WELCOMING the jo<strong>in</strong>t <strong>in</strong>itiative taken by the African Uni<strong>on</strong> Commissi<strong>on</strong>,<br />
the <strong>United</strong> Nati<strong>on</strong>s Ec<strong>on</strong>omic Commissi<strong>on</strong> for Africa (UNECA) <strong>and</strong> the<br />
African Development Bank (AfDB) with support from development<br />
partner organisati<strong>on</strong>s, <strong>in</strong> draft<strong>in</strong>g a c<strong>on</strong>t<strong>in</strong>ental framework <strong>and</strong> guidel<strong>in</strong>es<br />
<strong>on</strong> <strong>l<strong>and</strong></strong> policy development <strong>and</strong> implementati<strong>on</strong> for use as a resource by<br />
AU Member States <strong>in</strong> their efforts to improve the performance of their<br />
various <strong>l<strong>and</strong></strong> sectors;<br />
ACKNOWLEDGING the comprehensive c<strong>on</strong>sultati<strong>on</strong>s <strong>and</strong> discussi<strong>on</strong>s<br />
that have been c<strong>on</strong>ducted <strong>and</strong> the experts <strong>in</strong>puts made <strong>in</strong> the course of<br />
the preparati<strong>on</strong> of the c<strong>on</strong>t<strong>in</strong>ental Framework <strong>and</strong> Guidel<strong>in</strong>es <strong>on</strong> L<strong>and</strong><br />
Policy <strong>in</strong> the five regi<strong>on</strong>s of Africa;<br />
CONSIDERING the Report of the African Uni<strong>on</strong> Jo<strong>in</strong>t C<strong>on</strong>ference of<br />
M<strong>in</strong>isters resp<strong>on</strong>sible for Agriculture, L<strong>and</strong> <strong>and</strong> Livestock held <strong>in</strong> Addis<br />
Ababa, Ethiopiafrom 22 to 24 April 2009, <strong>and</strong> the recommendati<strong>on</strong>s<br />
there<strong>in</strong> endorsed by the Executive Council;<br />
UNDERTAKE TO:<br />

prioritise, <strong>in</strong>itiate <strong>and</strong> lead <strong>l<strong>and</strong></strong> policy development<br />
<strong>and</strong> implementati<strong>on</strong> processes <strong>in</strong> our countries,<br />
notwithst<strong>and</strong><strong>in</strong>g the extent of multi-stakeholder<br />
c<strong>on</strong>tributi<strong>on</strong> to such processes <strong>in</strong>volv<strong>in</strong>g also civil<br />
society, private sector;

support the emergence of the <strong>in</strong>stituti<strong>on</strong>al framework<br />
required for the effective development <strong>and</strong><br />
implementati<strong>on</strong> of <strong>l<strong>and</strong></strong> policy <strong>and</strong> implementati<strong>on</strong>;<br />
allocate adequate budgetary resources for <strong>l<strong>and</strong></strong> policy<br />
development <strong>and</strong> implementati<strong>on</strong> processes, <strong>in</strong>clud<strong>in</strong>g<br />
the m<strong>on</strong>itor<strong>in</strong>g of progress.<br />
RESOLVE TO:<br />

ensure that <strong>l<strong>and</strong></strong> laws provide for equitable access<br />
to <strong>l<strong>and</strong></strong> <strong>and</strong> related resources am<strong>on</strong>g all <strong>l<strong>and</strong></strong> users<br />
<strong>in</strong>clud<strong>in</strong>g the youth <strong>and</strong> other <strong>l<strong>and</strong></strong>less <strong>and</strong> vulnerable<br />
groups such as displaced pers<strong>on</strong>s;<br />
strengthen security of <strong>l<strong>and</strong></strong> tenure for women which<br />
require special attenti<strong>on</strong>.<br />
REQUESTS the Commissi<strong>on</strong> <strong>in</strong> collaborati<strong>on</strong> with the Regi<strong>on</strong>al Ec<strong>on</strong>omic<br />
Communities, UNECA, AfDB <strong>and</strong> other partners to:<br />

to work towards the establishment of an appropriate<br />
<strong>in</strong>stituti<strong>on</strong>al framework to provide coord<strong>in</strong>ati<strong>on</strong> of<br />
follow up activities <strong>and</strong> facilitate mutual learn<strong>in</strong>g<br />
by Member States as they develop/review their<br />
<strong>l<strong>and</strong></strong> policies <strong>in</strong> accordance with the Framework <strong>and</strong><br />
Guidel<strong>in</strong>es;<br />
take measures for the establishment of a fund to<br />
support follow up activities to promote <strong>l<strong>and</strong></strong> policy<br />
development <strong>and</strong> implementati<strong>on</strong>;<br />
undertake measures for the establishment of<br />
mechanisms for progress track<strong>in</strong>g <strong>and</strong> periodic<br />
report<strong>in</strong>g by Member States <strong>on</strong> progress achieved.

INVITES the Regi<strong>on</strong>al Ec<strong>on</strong>omic Communities to:<br />

c<strong>on</strong>vene periodic regi<strong>on</strong>al platforms to facilitate<br />
experience shar<strong>in</strong>g, less<strong>on</strong>s learnt <strong>and</strong> dissem<strong>in</strong>ati<strong>on</strong><br />
of best practices <strong>in</strong> <strong>l<strong>and</strong></strong> policy formulati<strong>on</strong>,<br />
implementati<strong>on</strong> <strong>and</strong> m<strong>on</strong>itor<strong>in</strong>g based <strong>on</strong> members<br />
states experiences;<br />
appropriately capture <strong>and</strong> address <strong>issues</strong> of <strong>l<strong>and</strong></strong><br />
policies with<strong>in</strong> their respective comm<strong>on</strong> agricultural<br />
policy framework.<br />
URGES Member States to:<br />

review their <strong>l<strong>and</strong></strong> sectors with a view to develop<strong>in</strong>g<br />
comprehensive policies which take <strong>in</strong>to account their<br />
peculiar needs;<br />
build adequate human, f<strong>in</strong>ancial, technical<br />
capacities to support <strong>l<strong>and</strong></strong> policy development <strong>and</strong><br />
implementati<strong>on</strong>;<br />
take note of the steps outl<strong>in</strong>ed <strong>in</strong> the Framework <strong>and</strong><br />
Guidel<strong>in</strong>es <strong>on</strong> L<strong>and</strong> Policy <strong>in</strong> Africa for their <strong>l<strong>and</strong></strong> policy<br />
development <strong>and</strong> implementati<strong>on</strong> strategies.<br />
REQUESTS the Commissi<strong>on</strong>, <strong>in</strong> collaborati<strong>on</strong> with UNECA <strong>and</strong> AfDB, to<br />
carry out studies <strong>on</strong> the establishment of an appropriate <strong>in</strong>stituti<strong>on</strong>al<br />
framework that can support Member States <strong>in</strong> their efforts towards<br />
review<strong>in</strong>g, develop<strong>in</strong>g <strong>and</strong> implement<strong>in</strong>g <strong>l<strong>and</strong></strong> policies <strong>in</strong>clud<strong>in</strong>g<br />
mechanisms for progress track<strong>in</strong>g <strong>and</strong> report<strong>in</strong>g, as well as for the<br />
establishment of an African Fund for L<strong>and</strong> Policy, <strong>and</strong> report there<strong>on</strong> to<br />
the ord<strong>in</strong>ary sessi<strong>on</strong> of the Assembly <strong>in</strong> June/July 2010.
