At any time the holder of a premises licence or club premises certificate can make an applicati<strong>on</strong> to<br />
the Licensing Authority to vary their licence. These variati<strong>on</strong> applicati<strong>on</strong>s as well as brand new<br />
premises licence applicati<strong>on</strong>s must be advertised and can be subject to public representati<strong>on</strong>s.<br />
Advertising Of Applicati<strong>on</strong>s<br />
A blue notice will advertise an applicati<strong>on</strong> for a new licence or a variati<strong>on</strong> to an existing licence, a<br />
white notice will be used for a minor variati<strong>on</strong>. The notice must be prominently displayed <strong>on</strong> the<br />
premises, in a place that is accessible by the public.<br />
The notice will provide a final date for representati<strong>on</strong>s as well as brief details of the applicati<strong>on</strong>.<br />
For full variati<strong>on</strong>s and new premises licence applicati<strong>on</strong>s applicants must also place a notice about<br />
their applicati<strong>on</strong> in a local newspaper that covers the area in which their premises is situated. This<br />
notice will appear within 10 days of the applicant making their applicati<strong>on</strong> to the Licensing<br />
Authority.<br />

Criteria For <strong>Making</strong> A Representati<strong>on</strong><br />
Your representati<strong>on</strong> must be relevant and based <strong>on</strong> the likely effect the granting of the applicati<strong>on</strong><br />
will have <strong>on</strong> the promoti<strong>on</strong> of the licensing objectives:<br />
the preventi<strong>on</strong> of crime and disorder<br />
public safety<br />
the preventi<strong>on</strong> of public nuisance<br />
the protecti<strong>on</strong> of children from harm<br />
For example, if you are c<strong>on</strong>cerned the granting of a variati<strong>on</strong> will lead to an increase in crime and<br />
disorder in the area of the premises, give reas<strong>on</strong>s why you think this or detail specific incidents<br />
with dates and times to support your representati<strong>on</strong>. This is a relevant representati<strong>on</strong>.<br />
However, if you are c<strong>on</strong>cerned the granting of l<strong>on</strong>ger hours at the premises will lower house prices<br />
in the area or that you feel that another premises is not needed, or that if may affect an existing<br />
business already in the area; these are not relevant representati<strong>on</strong>s and cannot be c<strong>on</strong>sidered by<br />
the Licensing Authority.<br />
The Licensing Authority will not c<strong>on</strong>sider representati<strong>on</strong>s that are frivolous or vexatious, e.g. a<br />
frivolous representati<strong>on</strong> may be <strong>on</strong>e that does not have a serious purpose or is not serious in its<br />
nature, whilst a vexatious representati<strong>on</strong> may be <strong>on</strong>e that is made purely to cause annoyance to<br />
the applicant.<br />
<strong>Making</strong> A Representati<strong>on</strong><br />
Relevant representati<strong>on</strong>s must be in writing and submitted to the Licensing Authority. To assist<br />
objectors the Licensing Authority has created a form for making representati<strong>on</strong>s. You can access<br />
the form at www.tradingstandards.gov.uk/stockt<strong>on</strong>/licensing.htm or you can c<strong>on</strong>tact the <strong>Trading</strong><br />
<strong>Standards</strong> & Licensing Office to have a form sent to you via the post or e-mail. We would<br />
recommend that you use this form to submit your representati<strong>on</strong>. The form is designed to help<br />
extract the type of informati<strong>on</strong> which is required to ensure the representati<strong>on</strong> can be accepted.<br />
Your representati<strong>on</strong>s must reach us within the 28 day notice period. Late representati<strong>on</strong>s will not<br />
be c<strong>on</strong>sidered. If you are unsure when the applicati<strong>on</strong> was made, you can check with the council or<br />
look at the advertising of the applicati<strong>on</strong>.<br />
