than through a default or breach of contract by the<br />

contractor or for which he is responsible.<br />

(a) a variation or other substantial change in the quantity<br />

of an item of work<br />

(b) a cause of delay giving an entitlement to extension of<br />

time under a sub-clauses of these conditions<br />

(c) exceptionally adverse climatic conditions<br />

(d) unforeseeable shortage in the availability of personnel<br />

or goods caused by epidemic or governmental action,<br />

or<br />

(e) any delay, impediment or prevention caused by or<br />

attributable to the employer, the employer’s personnel,<br />

or the employer’s other contractors on the site.<br />

The table-6 below lists the provisions relevant to extension<br />

of time and its financial implication. There are 12 instances<br />

in <strong>FIDIC</strong>-<strong>99</strong> from which the contractor can claim for<br />

extension of time and out of which seven have explicitly<br />
