Please read before using the sample <str<strong>on</strong>g>letter</str<strong>on</strong>g>:<br />
If the P800 calculati<strong>on</strong> shows you have underpaid <strong>tax</strong> for <strong>2007</strong>/<strong>08</strong>, and you have checked<br />
and are satisfied that the calculati<strong>on</strong> is accurate, the sample <str<strong>on</strong>g>letter</str<strong>on</strong>g> below sets out some<br />
arguments which you might c<strong>on</strong>sider using or adapting <str<strong>on</strong>g>to</str<strong>on</strong>g> your own circumstances <str<strong>on</strong>g>to</str<strong>on</strong>g> show<br />
<str<strong>on</strong>g>HMRC</str<strong>on</strong>g> why they should write off the <strong>tax</strong> you owe, or collect it from your employer or<br />
pensi<strong>on</strong> provider instead.<br />
Please bear in mind that we cannot guarantee the outcome of any <str<strong>on</strong>g>letter</str<strong>on</strong>g> you draft using this<br />

A. Apply Extra‐statu<str<strong>on</strong>g>to</str<strong>on</strong>g>ry C<strong>on</strong>cessi<strong>on</strong> A19 <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>2007</strong>/<strong>08</strong> as I believe the same principles apply<br />
as for 20<strong>08</strong>/09 and 2009/10 for which years you have already agreed <str<strong>on</strong>g>to</str<strong>on</strong>g> write off the<br />
<strong>tax</strong> owed.<br />
B. Write off the <strong>tax</strong> owed for <strong>2007</strong>/<strong>08</strong> under Extra‐statu<str<strong>on</strong>g>to</str<strong>on</strong>g>ry C<strong>on</strong>cessi<strong>on</strong> A19, as you have<br />
delayed in using informati<strong>on</strong> in your possessi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> calculate, and tell me about, the<br />
underpayment. Not being an expert in <strong>tax</strong> matters, I had no reas<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> suspect that I<br />
might not be paying enough <strong>tax</strong>. I had thought that all <strong>tax</strong> due was deducted under<br />
<strong>PAYE</strong>.<br />
I also understand that when c<strong>on</strong>sidering my applicati<strong>on</strong> for ESC A19 you should first<br />
c<strong>on</strong>sider whether there has been any fault <strong>on</strong> the part of my employer/pensi<strong>on</strong><br />
payer(s); and therefore whether you should instead recover the underpayment from<br />
them.<br />
C. Write off the <strong>tax</strong> owed for <strong>2007</strong>/<strong>08</strong> under ESC A19 because the reas<strong>on</strong> for the<br />
underpayment is that my state pensi<strong>on</strong> and/or small occupati<strong>on</strong>al/pers<strong>on</strong>al pensi<strong>on</strong>s<br />
has not been <strong>tax</strong>ed correctly. There were known errors made by <str<strong>on</strong>g>HMRC</str<strong>on</strong>g> for that year.<br />

Please also treat this <str<strong>on</strong>g>letter</str<strong>on</strong>g> as a COMPLAINT as you have managed my affairs poorly. As a<br />
<strong>PAYE</strong> <strong>tax</strong>payer, I understand the law <strong>on</strong>ly requires me <str<strong>on</strong>g>to</str<strong>on</strong>g> keep records for the <strong>2007</strong>/<strong>08</strong> <strong>tax</strong><br />
year until 31 January 2010, so I am at a disadvantage in checking the calculati<strong>on</strong>. ‘Your<br />
Charter’ says you want <str<strong>on</strong>g>to</str<strong>on</strong>g> give me certainty that I am paying the right amount. Sending a<br />
calculati<strong>on</strong> of <strong>tax</strong> owed nearly three years after the end of the relevant year (a period in<br />
which financial circumstances could have altered dramatically) does not meet that objective<br />
and gives further grounds for writing off the <strong>tax</strong>.<br />

• an explanati<strong>on</strong> of where the figures have come from and any estimates used;<br />
• a detailed explanati<strong>on</strong> of how the <strong>tax</strong> underpayment occurred; and<br />
• full reas<strong>on</strong>s why you believe I must repay the <strong>tax</strong>.<br />
