Notice is hereby given that on May 20, 2013, the Director of the Ohio Environmental 

Protection Agency (“Ohio EPA”), pursuant to Ohio Revised Code (“ORC”) Chapter 3746 

and Ohio Administrative Code (“OAC”) Chapter 3745-300, issued a Covenant Not To 

Sue/Final Findings and Orders to City of Norwalk, the “Volunteer” for property known as 

Former Norwalk Foundry (the “Property”). 

The Volunteer conducted a voluntary action of the approximately 2.45 acre-Property, 

which is located at 53 Newton Street, Norwalk, Huron County, Ohio. A no further action 

letter for the Property was submitted on September 21, 2012 to the Voluntary Action 

Program of the Ohio EPA Division of Environmental Response and Revitalization by 

Joel A. Hunt, a Certified Professional as defined in ORC 3746.01(F) and OAC 3745- 

300-01(A). 

This action of the Director is final and may be appealed to the Environmental Review 

Appeals Commission (the “Commission”) pursuant to ORC 3745.04. The appeal must 

be in writing and set forth the action complained of and the grounds upon which the 

appeal is based. The appeal must be filed with the Commission within thirty (30) days 

after notice of the action. The appeal must be accompanied by a filing fee of $70.00, 

made payable to “Treasurer, State of Ohio”, which the Commission, in its discretion, 

may reduce if by affidavit it is demonstrated that payment of the full amount of the fee 

would cause extreme hardship. Notice of the filing of the appeal shall be filed with the 

Director within three (3) days of filing with the Commission. Ohio EPA requests that a

FOR 

GRAVITY SANITARY SEWER EXTENSIONS 

Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio 

EPA) Division of Surface Water (DSW) has issued a draft general Permit to Install (PTI) 

permit for new gravity sanitary sewer extensions in the State of Ohio. 

The issuance of this draft general PTI permit addresses the renewal of the General 

Permit to Install Gravity Sanitary Sewer Extension Ohio EPA Permit No. 3745-42- 

SS001 which expired on March 1, 2012. 

Applicants under this permit include communities and private entities that propose to 

install gravity sewers that connect to existing sewage treatment works which are 

covered by a National Pollutant Discharge Elimination System (NPDES) permit. This 

permit covers sanitary sewer extensions with pipe diameters of 8 inches to 12 inches, 

unless the project is not eligible for coverage as defined in the permit. Interested parties 

that will be contacted include major municipalities, county engineers, statewide 

environmental groups, business and trade associations, consultants, OEPA divisions 

and district offices, and other known interested parties. 

The gravity sanitary sewer extension general permit is intended to cover new sanitary 

sewer extensions installations. This general permit is not proposed to be available to 

existing sanitary sewer extensions, or suggested upgrades or changes to existing 

sanitary sewer extensions.
