interpretations. When deciding upon the matter, the Court should take into consideration that<br />
the Inter-American system of human rights has a subsidiary nature, and that the State should be<br />
granted a margin of appreciation for determining which restrictions are proportionate in<br />
complex matters. Hence, the Court should rule that Costa Rica did not violate the Convention<br />
when banning the technique of in vitro fertilization. A decision such as this one is also<br />
supported by the importance of the human right that the State is alleging to protect, and the<br />
national values reflected by an impeccable democratic system, where this matter was recently<br />
discussed. Furthermore, Costa Rica is entitled to apply the precautionary principle, which<br />
weighs in favor of protecting life in cases of doubt. Costa Rica should be granted a margin of<br />
appreciation for determining the best way of protecting the life of a developing human being.<br />
