NOTIFICATION<br />
In accordance with the approval <strong>of</strong> the 89 th meeting <strong>of</strong> the Executive Council <strong>of</strong> <strong>Assam</strong><br />
<strong>University</strong> vide resolution No. EC:89:04-13:30 held on 29 th April 2013 the rule regarding<br />
right to inspect and to get certified copy <strong>of</strong> the evaluated answer <strong>scripts</strong> <strong>of</strong> various <strong>Assam</strong><br />
<strong>University</strong> examinations under Right to Information Act 2005 is notified as under:<br />
STATEMENT OF OBJECT<br />
In view <strong>of</strong> Honourable Supreme Court’s judgment in Central Board <strong>of</strong> Secondary<br />
Education (CBSE) vs. Aditya Bandopadhya, Dated 09.08.2011, regarding the interpretation <strong>of</strong><br />
right to information under Right to Information Act 2005 which includes right to inspect or to<br />
get certified copy <strong>of</strong> the evaluated answer-script <strong>of</strong> the examinee, the following rules are<br />
framed for <strong>Assam</strong> <strong>University</strong>, Silchar.<br />
• How and Whom to apply.<br />
• The application must be written in a prescribed form only (may be downloaded from<br />
the website <strong>of</strong> <strong>Assam</strong> <strong>University</strong>, Silchar or may be personally collected from the<br />
CPIO <strong>of</strong>fice).<br />
• The duly filled-in Application Form should be submitted to the Central Public<br />
Information Officer (CPIO), <strong>Assam</strong> <strong>University</strong>, Silchar.<br />
• Who will apply<br />
• The examinee shall have to apply himself or herself and must put signature at the end<br />
<strong>of</strong> the prescribed Application Form along with contact number and place <strong>of</strong><br />
communication. No other person (even if authorised by the examinee) is entitled to<br />
apply for the above-mentioned purpose on behalf <strong>of</strong> examinee.<br />
• Documents and informations required in the enclosure.<br />
• The filled-in Application Form should be submitted along with (i) attested copy<br />
<strong>of</strong> the Admit Card for the concerned examination; (ii) attested copy <strong>of</strong> the Mark-<br />
Sheet <strong>of</strong> the concerned examination; (iii) attested copy <strong>of</strong> identity pro<strong>of</strong><br />
certificate issued by concerned College/<strong>University</strong>/Central or State Government;<br />
and (iv.) attested copy <strong>of</strong> registration certificate. The Principal <strong>of</strong> the concerned<br />
college or the HOD <strong>of</strong> the concerned Department has to attest the photo-copies <strong>of</strong><br />
the above-mentioned documents.<br />
• Application without the aforesaid required enclosures shall not be considered<br />
under any circumstances.<br />
• While claiming disclosure <strong>of</strong> evaluated answer-script (either inspection or for<br />
certified copy) the applicant must write the Roll, Number, Name <strong>of</strong> the Subject,<br />
Name <strong>of</strong> the Paper, Course Number, Name <strong>of</strong> the Examination, Year <strong>of</strong> the<br />
Examination and the Semester.<br />
• Type <strong>of</strong> disclosure.<br />
The applicant shall write very clearly the type <strong>of</strong> information in the prescribed<br />
column which he or she is seeking under RTI Act i.e. whether it is inspection or<br />
certified copy <strong>of</strong> the evaluated answer-script.<br />
• Requisite fees, mode <strong>of</strong> payment and to whom payment is to be made.<br />
• (i) For inspection <strong>of</strong> evaluated original answer-script for each paper: Rs. 1000/-.<br />
(Rupees one thousand only) alongwith RTI application fee <strong>of</strong> Rs. 10/- (Rupees ten<br />
only).<br />
• (ii) For certified copy <strong>of</strong> the each evaluated original answer-script: Rupees 1000/-<br />
initially at the time <strong>of</strong> filing RTI application beside Rs 10/- required for filing RTI<br />
application. Further, the applicant will have to pay Rs 2/- for each page subsequently<br />
for obtaining certified copy <strong>of</strong> evaluated <strong>scripts</strong>.
• The requisite fees be deposited through Demand Draft drawn in favour <strong>of</strong> Finance<br />
Officer, <strong>Assam</strong> <strong>University</strong>, Silchar. The said Demand Draft be enclosed with the<br />
filled-in Application Form. Application without requisite fees shall not be entertained.<br />
• Fees deposited for the said purpose will not be refunded under any circumstances<br />
even if the concerned information seeker does not turn up for the inspection <strong>of</strong> answer<br />
<strong>scripts</strong> or to get the certified copy.<br />
• If the applicant belongs to B.P.L category and claiming exemption from depositing<br />
required fees <strong>of</strong> Rupees 1,000 for inspection or certified copy <strong>of</strong> the answer-script,<br />
attested copy <strong>of</strong> the B.P.L card must be enclosed.<br />
• Time limit.<br />
• The filled-in Application Form should be submitted to the CPIO within six<br />
months from the date <strong>of</strong> the publication <strong>of</strong> the results.<br />
• Evaluated answer-<strong>scripts</strong> shall be preserved for a maximum period <strong>of</strong> one year<br />
from the date <strong>of</strong> the publication <strong>of</strong> the results for the inspection and to obtain the<br />
certified copy <strong>of</strong> the evaluated answer-<strong>scripts</strong>.<br />
• Under any situation right to inspect the evaluated answer-<strong>scripts</strong> or to get a<br />
certified copy <strong>of</strong> the same shall not be entertained after six months <strong>of</strong> the<br />
publication <strong>of</strong> the results.<br />
• Inspection process.<br />
• In both the cases, either at the time <strong>of</strong> inspection by the examinee or receiving<br />
the certified copy <strong>of</strong> the evaluated answer-script, all the original documents<br />
(whose attested copies were enclosed with the prescribed Application Form)<br />
shall be produced by the concerned persons and be verified for authentication.<br />
The applicant belonging to B.P.L category needs to show the original B.P.L card<br />
for verification before inspection or receiving certified copy.<br />
• If the application <strong>of</strong> the examinee is for only inspection i.e. to see and check,<br />
only the examinee himself or herself shall be allowed to inspect. At the time <strong>of</strong><br />
inspection, the examinee has to produce or show the original photo identity-card<br />
to the <strong>of</strong>ficer nominated or authorised by the <strong>Assam</strong> <strong>University</strong> for showing the<br />
answer-<strong>scripts</strong>, for the self-identification. Under any situation no other person on<br />
his or her behalf shall be allowed to inspect the evaluated answer-script.<br />
• The inspection <strong>of</strong> the evaluated answer-script/s under RTI Act, shall take place<br />
in a room in the Examination Department equipped with a Close Circuit<br />
Television (C.C.T.V) to keep the records <strong>of</strong> the movements <strong>of</strong> the information<br />
seeker and others. Under any situation, the examinee (here RTI applicant) shall<br />
not be allowed to take the answer-script/s out <strong>of</strong> the room. Moreover, the<br />
inspection will be done under the supervision <strong>of</strong> one teacher nominated by<br />
<strong>University</strong> authority <strong>of</strong> the concerned subject and one <strong>of</strong>ficer from the <strong>of</strong>fice <strong>of</strong><br />
Controller <strong>of</strong> Examination. Half an hour i.e. 30 minutes will be allotted for the<br />
inspection <strong>of</strong> each answer-script and any further extension <strong>of</strong> time will not be<br />
allowed. The candidate will put his or her signature at the time <strong>of</strong> receipt <strong>of</strong> the<br />
original answer-script in the duly maintained register and again put his or her<br />
signature after returning the above-mentioned answer-script.<br />
• The examinee will not be allowed to carry and keep mobile phone, pager, digital<br />
diary, any type <strong>of</strong> camera, I-POD etc in the room where inspection <strong>of</strong> the<br />
evaluated answer-script shall take place.<br />
• If the applicant is seeking the certified copy <strong>of</strong> the evaluated answer-script/s, the<br />
copy may be given to the duly authorised representative on his or her behalf.<br />
Under any situation the copy shall not be given to any other person except that<br />
duly authorised person after he or she shows his or her original photo-identity<br />
card.<br />
• CPIO <strong>of</strong>fice will inform the RTI applicant the suitable date and time for the<br />
personal inspection or the collecting the certified copy <strong>of</strong> the evaluated answerscript<br />
immediately after the Examination Department <strong>of</strong> AUS informs to CPIO<br />

that the answer-script or the certified copy is available and the arrangement is<br />
ready.<br />
• <strong>Evaluation</strong> and review.<br />
• Under any situation, the examinee will not be entitled to apply for re-evaluation after<br />
the inspection <strong>of</strong> the original answer-<strong>scripts</strong> or after getting certified copy <strong>of</strong> the<br />
evaluated answer-<strong>scripts</strong> if by the time the time-limit to apply for re-evaluation gets<br />
over as per <strong>Assam</strong> <strong>University</strong> Rules. As far as re-evaluation is concerned, the general<br />
rule regarding the prescribed period for re-evaluation shall be applicable.<br />
• In case, there is any error regarding the totalling <strong>of</strong> marks or for non-giving <strong>of</strong> marks<br />
to answer/answers by mistake, the examinee shall be allowed to appeal for review<br />
within seven days from the date <strong>of</strong> inspection.<br />
• Exemption clause<br />
Loss or damage <strong>of</strong> answer <strong>scripts</strong> due to accident, natural calamities or reasons<br />
beyond the control <strong>of</strong> the <strong>University</strong>; the candidate will be intimated about the<br />
reasons for which the information regarding the answer-<strong>scripts</strong> cannot be disclosed.<br />
• Mode <strong>of</strong> disclosure<br />
• In both the cases i.e. allowing inspection and providing certified copy <strong>of</strong> the<br />
evaluated answer-<strong>scripts</strong>, the relevant portion <strong>of</strong> the evaluated answer-script bearing<br />
identity <strong>of</strong> all the examiners i.e. the name <strong>of</strong> the Examiner, or Re-evaluator,<br />
Scrutinizer, Head Scrutinizer, shall not be shown or disclosed to the RTI applicants.<br />
The rule comes into force with immediate effect.<br />
