SUB: Direction under Section 5 of the Environment (Protection) Act, 1986 — in<br />
the matter of M/s Sunrise Ceramics Pvt. Ltd Morbi, Dist. Rajkot of<br />

WHEREAS CPCB vide its letter, dated 23/08/2012 issued directions under Section 18<br />
(1) (b) of the Water & Air Acts to Gujarat State <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> for directing the units<br />
operating coal based gasifiers in violation of the consent condition to stop the use of Gasifiers.<br />
WHEREAS in compliance of the directions issued by CPCB, Gujarat State <strong>Pollution</strong><br />
<strong>Control</strong> <strong>Board</strong> issued direction to your unit on 13.9.2012 under Section 33A & 31A of Water &<br />
Air Acts, directing to stop use of gasifier and dismantle it with immediate effect.<br />
WHEREAS a team of officers from <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, Zonal<br />
Office, Vadodara inspected Mis Sunrise Ceramics Pvt. Ltd, Morbi, Gujarat on<br />
2/11/2012 to assess the Compliance status of the environmenta l pollution and made the<br />
following observations .<br />
The unit had not complied with the aforesaid directions issued by Gujarat SPCB and<br />
continues to operate coal based gasifier and pollute the environment.<br />
The spray dryer installed by the unit emits significant pollution which indicates that the<br />
APCS i.e. scrubber/multicyc lone installed is either inadequate or operated poorly.<br />
Adequate monitoring provision and safe/proper access to the port hole does not exist<br />
in the unit and hence stack emission monitoring could not be conducted.<br />
The Contaminated/brownish water, generated from coal gas cleaning and water seal<br />
of gas pipeline was spread inside the factory premises and allowed to overflow on the<br />
land inside the plant which has all probability to contaminate the soil and ground<br />
water.<br />
The unit has taken membership of TSDF of Saurashtra Enviro Project Pvt. Ltd.,<br />
however the unit has not sent any tar or gasifier related cleaning water to TSDF.<br />
Dust suspension was observed in raw material handling area due the poor<br />
housekeeping.
WHEREAS the above mentioned observations of the inspecting team reflects noncompliance<br />
of the directions.<br />
AND WHEREAS the Ministry of Environment & Forests, Government of India, vide<br />
Notifications No. S. O. 157(E) of 27.02.1996 and S. O. 730 (E) dated 10.07.2002, has delegated<br />
the powers vested under Section 5 of the Environment (Protection) Act, 1986 (29 of 1986) to the<br />
Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, to issue directions to any industry or any local body<br />
or any other authority for violations of the standards and rules notified under the Environment<br />
(Protection) Rules, 1986 and amendment thereof.<br />
Now, THEREFORE, in view of the short-comings noticed and in exercise of the powers<br />
vested under the Section 5 of the Environment (Protection) Act, 1986, M/s Sunrise Ceramics<br />
Pvt. Ltd. is hereby directed to show cause why the unit should not be closed down.<br />
The unit is directed to submit its reply/clarification, with documentary proof in support of<br />
the claims made, within 15 days from the date of receipt of this notice failing which it will be<br />
presumed that the unit has nothing to say and action will be initiated against the unit under the<br />
provision of the Environment (Protection) Act, 1986 and amendments thereof.<br />

WHEREAS a team of officers from <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, Zonal<br />
Office, Vadodara inspected M/s Mark Glazed Tiles,Morbi,Gujarat on 6/11/2012 to<br />
assess the Compliance status of the environmental pollution and made the following<br />
observations .<br />
The unit had not complied with the aforesaid directions issued by Gujarat SPCB and<br />
continues to operate coal based gasifier and pollute the environment.<br />
The spray dryer installed by the unit emits significant pollution which indicates that the<br />
APCS i.e. scrubber/multicyclone installed is either inadequate or operated poorly.<br />
Adequate monitoring provision and safe/proper access to the port hole does not exist<br />
in the unit and hence stack emission monitoring could not be conducted.<br />
The Contaminated/brownish water, generated from coal gas cleaning and water seal<br />
of gas pipeline was spread inside the factory premises and allowed to overflow on the<br />
land inside the plant which has all probability to contaminate the soil and ground<br />

The unit has taken membership of TSDF of Saurashtra Enviro Project Pvt. Ltd.,<br />
however the unit has not sent any tar or gasifier related cleaning water to TSDF.<br />

Sub: Directions under section 5 of the Environment (Protection) Act, 1986 — Revoking<br />
WHEREAS, the <strong>Central</strong> Government has notified the standards for discharge of environmental<br />
pollutants from various categories of industries and common effluent treatment plants under Rule 3 of<br />
the Environmental (Protection) Rules 1986;<br />
WHEREAS, a joint team comprising officials of MoEF, CPCB and UPPCB visited Unnao, U.P. on<br />
August 3, 2012 to assess the status of pollution control in industries in Unnao and also collected<br />
effluent samples of CETPs and few industries in Unnao;<br />
WHEREAS, M/s Prime Chemicals, Unnao, UP., the basic chrome sulphate manufacturing industrial<br />
unit operating in UPSIDC Industrial Area Site- II, was inspected during the investigation on August 3,<br />
2012 and the inspection team observed poor housekeeping, stagnating water at many places, and<br />
haphazard storage of sludge in the premises of the unit, and found that the floor washings and runoff<br />
from the premises of the unit, possessing high concentration of Total Chromium (481.7 mg/I), was<br />
finding its way into the storm water drain outside the premises of the unit that ultimately joins river<br />
Ganga, which posed a grave threat to the environment;<br />
WHEREAS, in view of the shortcomings observed, CPCB vide its letter dated September 26, 2012<br />
directed M/s Prime Chemicals, Unnao, U.P., under Section 5 of the Environment (Protection) Act<br />
1986, to close all its operations with immediate effect and report compliance to this office;<br />
WHEREAS, in compliance of the closure directions issued by CPCB, M/s Prime Chemicals, Unnao,<br />
U.P. vide its letter dated October 23, 2012 reported stopping of production and closure of operations<br />
and submission of works being carried out for rectification of the shortcomings shortly for verification;<br />
WHEREAS, M/s Prime Chemicals, Unnao, U.P. vide its letter dated November I, 2012 reported<br />
completion of works and requested for verification;<br />
WHEREAS, a team of officials from CPCB Zonal Office, Lucknow inspected M/s Prime Chemicals,<br />
Unnao, U.P. on November 21, 2012 for verification and the inspection team made the following<br />
observations;<br />
The Unit was not in operation during inspection.<br />
Floorings in and around process area have been redesigned with proper slope to eliminate<br />
uncontrolled flow in process area.<br />
Floor in the process area has been lined with acid proof tiles.<br />
Drain network has been laid for intercepting floor spillages<br />
Catch pits provided for collection of floor spillages for recycling.<br />
Process waste/sludge storage area relocated in covered area to eliminate possible exposure to<br />
rains and the process waste/sludge packed in bags and kept in covered area.
NOW, THEREFORE, in view of the above the closure directions issued under Section 5 of the<br />
Environment (Protection) Act 1986 to M/s Prime Chemicals, Unnao, U.P. vide letter dated<br />
September 26, 2012 are revoked. The Unit shall ensure regular compliance of the following<br />
directions:<br />
The Unit shall ensure that the intercepted floor spillages are recycled in the process and there<br />
is no discharge of floor spillages from its premises at any point of time.<br />
The Unit shall ensure that all drains and catch pits provided for intercepting and collecting<br />
floor spillages for its recycling in the process are regularly cleaned.<br />
The Unit shall maintain records of material balance of Chromium consumption and BCS<br />
production.<br />
The Unit shall ensure that process waste/sludge is properly stored and disposed regularly to<br />
TSDF and the records properly maintained.<br />
The Unit shall ensure proper housekeeping in its premises.<br />
In case of non-compliance of the issued direction by the Unit any time in future, action as deemed fit<br />
under the Environment (Protection) Act 1986 shall be initiated.<br />

WHEREAS it was observed that Gasifier was operating in the unit and coal gasification technology<br />
adopted by the unit is outdated and the environmental pollution control measures inadequate, therefore,<br />
there is possibility of water, land and air contamination due to operation of these gasifiers<br />
WHEREAS it was observed that cleaning of crude coal gas using wet scrubbing generates large<br />
quantity of tar in the effluent besides the fugitive emissions.<br />
WHEREAS it was observed that brownish colour water was found in the gas sealing water tank of<br />
the unit. This effluent having high COD and phenol with traces of cyanide, if not managed properly has all<br />
the potential to contaminate the surrounding soil and water.<br />
WHEREAS it was observed that the scrubbed effluent after tar settling if not managed properly and<br />
allowed to overflow on the land inside the plant can contaminate the soil and ground water<br />
WHEREAS it was observed unit has taken membership of TSDF of Saurashtra Enviro Project Pvt.<br />
Ltd., however, the unit has not sent any tar or gasifier related cleaning water to TSDF.<br />
WHEREAS it was observed that the unit has spray dryer which uses hot air generated by the air<br />
heater/boiler. Cyclone and scrubber provided as Air <strong>Pollution</strong> <strong>Control</strong> devices (APCD) before the exhaust<br />
was not performing effectively resulting in particulate matter emission as visually observed through the<br />
stack.<br />
WHEREAS it was observed that adequate monitoring provision and safe/proper access to the port<br />
hole does not exist in the unit and hence stack emission monitoring could not be conducted.<br />
WHEREAS dust suspension was observed due to the poor housekeeping in raw material handling<br />
area.<br />
WHEREAS it was observed that the housekeeping was unsatisfactory as evident from improper<br />
solid waste stacking.
AND WHEREAS the Ministry of Environment & Forests, Government of India, vide Notifications<br />
No. S O. 157(E) of 27.02.1996 and S. O. 730 (E) dated 10.07 2002, has delegated the powers vested<br />
under Section 5 of the Environment (Protection) Act, 1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong><br />
<strong>Control</strong> <strong>Board</strong>, to issue directions to any industry or any local body or any other authority for violations of<br />
the standards and rules notified under the Environment (Protection) Rules, 1986 and amendment thereof.<br />
NOW,THEREFORE, in exercise of powers delegated to the Chairman <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong><br />
under Section 5 of the Environment (Protection) Act 1986, the following directions are issued to the unit<br />
using gasifier to comply with the following directionsi<br />
1. The gasifier installed by the unit should be stopped immediately and dismantled so as to comply<br />
with consent condition issued by the Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>.<br />
2 The unit should switch over to natural gas as fuel with immediate effect.<br />
The accumulated scrubbed water (Brownish Wastewater) from the unit should be disposed in<br />
environmentally sound manner i.e sending to incinerator along with other contaminated<br />
materials.<br />
The APCDs installed with the spray dryer should be properly operated or upgraded with high<br />
efficiency particulate matter control devices<br />
Stack of adequate height and with proper monitoring facility and access to the port hole should be<br />
provided in the kiln and spray dryer.<br />
Solid Waste should be properly disposed in a secured landfill site to avoid haphazard disposal.<br />
7. Housekeeping inside the premises should be improved especially in the raw material handling<br />
area.<br />
8 The unit shall submit an action plan to comply with the directions listed above along with Bank<br />
Guarantee of 'Rs. 5.00 Lac to ensure compliance of the above directions.<br />
The unit shall submit the action plan within 15 days along with Bank Guarantee on receipt of the<br />
directions for compliance of the above directions. In case of failure of the unit to comply with the above<br />

under Section 5 of the Environment (Protection) Act, 1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong><br />
<strong>Control</strong> <strong>Board</strong>, to issue directions to any industry or any local body or any other authority for violations of<br />
the standards and rules notified under the Environment (Protection) Rules, 1986 and amendment thereof.<br />
NOW,THEREFORE, in exercise of powers delegated to the Chairman <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong><br />
under Section 5 of the Environment (Protection) Act 1986, the following directions are issued to the unit<br />
using gasifier to comply with the following directions:<br />
1 The gasifier installed by the unit should be stopped immediately and dismantled so as to comply<br />
with consent condition issued by the Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong><br />
The unit should switch over to natural gas as fuel with immediate effect.<br />
The accumulated scrubbed water (Brownish Wastewater) from the unit should be disposed in<br />
environmentally sound manner i.e sending to incinerator along with other contaminated<br />
materials.<br />
The APCDs installed with the spray dryer should be properly operated or upgraded with high<br />
efficiency particulate matter control devices<br />
Stack of adequate height and with proper monitoring facility and access to the port hole should be<br />
provided in the kiln and spray dryer.<br />
6 Solid Waste should be properly disposed in a secured landfill site to avoid haphazard disposal.<br />
Housekeeping inside the premises should be improved especially in the raw material handling<br />
area.<br />
The unit shall submit an action plan to comply with the directions listed above along with Bank<br />
Guarantee of 'Rs 5.00 Lac to ensure compliance of the above directions.<br />
The unit shall submit the action plan within 15 days along with Bank Guarantee on receipt of the<br />
directions for compliance of the above directions In case of failure of the unit to comply with the above<br />

WHEREAS a team of officers<br />
of <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, Zonal Office, Vadodara<br />
inspected M/s Kondaliya Luxor, Morbi, Gujarat on 19 th July 2012 to assess the status of the<br />
environmental pollution.<br />
WHEREAS it was observed that the coal gasification technology adopted by the unit is outdated<br />
and the environmental pollution control measures inadequate, therefore, there is possibility of water, land<br />
and air contamination due to operation of these gasifiers.<br />
WHEREAS it was observed that cleaning of crude coal gas using wet scrubbing generates large<br />
quantity of tar in the effluent besides the fugitive emissions.<br />
WHEREAS it was observed that brownish colour water was found in the gas sealing water tank<br />
of the unit. This effluent having high COD and phenol with traces of cyanide, if not managed properly has<br />
all the potential to contaminate the surrounding soil and water.<br />
WHEREAS it was observed that the scrubbed effluent after tar settling if not managed properly<br />
and allowed to overflow on the land inside the plant can contaminate the soil and ground water.<br />
WHEREAS it was observed that foul smell and leakages were found from gasifier and overall<br />
working condition was very poor.<br />
WHEREAS it was observed that the unit has spray dryer which uses hot air generated by the air<br />
heater/boiler. Cyclone and scrubber provided as Air <strong>Pollution</strong> <strong>Control</strong> devices (APCD) before the exhaust<br />
was not performing effectively resulting in particulate matter emission as visually observed through the<br />
stack.<br />
WHEREAS it was observed that monitoring of stack emission could not be conducted as<br />
monitoring provision does not exist in the unit.<br />
WHEREAS it was observed that the housekeeping was unsatisfactory as evident from improper<br />
solid waste stacking and lack off proper approach roads within the premises etc.<br />
WHEREAS it was observed that adequate green belt has not been provided.<br />

The unit should switch over to LNG as fuel with immediate effect as per consent conditions.<br />
3. The accumulated scrubbed water (Brownish Wastewater) from the unit should be disposed in<br />
environmentally sound manner i.e. sending to incinerator along with other contaminated<br />

4 The APCDs installed with the spray dryer should be properly operated or upgraded with high<br />
efficiency particulate matter control devices.<br />
5. Stack of adequate height and with proper monitoring facility should be provided in the kiln and<br />

Sub: Closure Direction under Section 5 of the Environment (Protection) Act, 1986<br />
WHEREAS a team of officers of <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, Zonal Office, Vadodara<br />
inspected M/s Vikas Sanitary Works, Morbi, Gujarat on 19 th July 2012 to assess the status of the<br />
environmental pollution.<br />
WHEREAS it was observed that the coal gasification technology adopted by the unit is outdated<br />
and the environmental pollution control measures inadequate, therefore, there is possibility of water, land<br />
and air contamination due to operation of these gasifiers.<br />
WHEREAS it was observed that cleaning of crude coal gas using wet scrubbing generates large<br />
quantity of tar in the effluent besides the fugitive emissions.<br />
WHEREAS it was observed that brownish colour water was found in the gas sealing water tank<br />
of the unit. This effluent having high COD and phenol with traces of cyanide, if not managed properly has<br />
all the potential to contaminate the surrounding soil and water.<br />
WHEREAS it was observed that the scrubbed effluent after tar settling if not managed properly<br />
and allowed to overflow on the land inside the plant can contaminate the soil and ground water.<br />
WHEREAS it was observed that foul smell and leakages were found from gasifier and overall<br />
working condition was very poor.<br />
WHEREAS it was observed that the unit has spray dryer which uses hot air generated by the air<br />
heater/boiler. Cyclone and scrubber provided as Air <strong>Pollution</strong> <strong>Control</strong> devices (APCD) before the exhaust<br />

WHEREAS it was observed that monitoring of stack emission could not be conducted as<br />
monitoring provision does not exist in the unit.<br />
WHEREAS it was observed that the housekeeping was unsatisfactory as evident from improper<br />
solid waste stacking and lack off proper approach roads within the premises etc.<br />
WHEREAS it was observed that adequate green belt has not been provided.<br />

WHEREAS the Ministry of Environment & Forests, Government of India, vide Notifications No. S.<br />
O. 157(E) of 27.02.1996 and S. O. 730 (E) dated 10.07.2002, has delegated the powers vested under<br />
Section 5 of the Environment (Protection) Act, 1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong><br />
<strong>Control</strong> <strong>Board</strong>, to issue directions to any industry or any local body or any other authority for violations of<br />
the standards and rules notified under the Environment (Protection) Rules, 1986 and amendment thereof.<br />
WHEREAS, in exercise of powers delegated to the Chairman <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> following<br />
directions under Section 5 of the Environment (Protection) Act 1986, were issued to the unit on<br />
23/08/20/2:<br />
The gasifiers installed by the unit should be stopped immediately and dismantled so as to comply<br />
with consent condition issued by the Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>.<br />
The unit should switch over to LNG as fuel with immediate effect as per consent conditions.<br />
The accumulated scrubbed water (Brownish Wastewater) from the unit should be disposed in<br />
environmentally sound manner i.e. sending to incinerator along with other contaminated<br />
materials.<br />
The APCDs installed with the spray dryer should be properly operated or upgraded with high<br />
efficiency particulate matter control devices.<br />
Stack of adequate height and with proper monitoring facility should be provided in the kiln and<br />
spray dryer.<br />
Solid Waste should be properly disposed in a secured landfill site to avoid haphazard disposal.<br />
7. The unit shall submit an action plan to comply with the directions listed above along with Bank<br />
Guarantee of Rs. 5.00 Lacs to ensure compliance of the above directions.<br />
The unit shall submit the action plan within 15 days along with Bank Guarantee on receipt of the<br />
directions for compliance of the above directions.<br />
WHEREAS, the unit vide its letter, dated 11.09.2012, informed of the actions taken/proposed;<br />
Unit is in consultation and negotiation with Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> for grant of<br />
Consent Conditions & Authorization as per norms.<br />
Unit is applying for Consent Conditions & Authorization application with the membership<br />
of Transport Storage & Disposal Facility (TSDF )for total disposal of wastewater and<br />
coal tar at their end.<br />
Unit requires approximately six months time for compliance of the directions given by<br />
GPCB/CPCB and have requested not to dismantle their gasifiers.<br />
Unit has submitted Bank Guarantee of Rs 2.50/- lacs instead of Rs. 5.00/- lacs as asked<br />
stating that they are Small Scale industry.<br />
Unit has started process through consultants for evaluating new technology with<br />
modifications to comply with the directions.<br />
WHEREAS, in light of the reply submitted by the unit, and, exercise of the powers vested under<br />
Section 5 of the Environment (Protection) Act 1986, modified direction were issued to the unit on<br />
01/10/2012 stating The unit can approach the State <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> for obtaining consent after<br />
taking appropriate measures for pollution control and Environment Protection. The unit can operate with<br />
LNG till appropriate pollution control measures are taken for control of pollution from coal based gasifiers<br />
upto the satisfaction of Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> and consent for operation of gasifier are obtained<br />
from Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>"<br />
WHEREAS a team of officers from <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, Zonal Office, Vadodara<br />
inspected your unit on 1/11/2012 to assess the Compliance status of the environmental pollution and<br />
observed that your unit had not complied with the directions issued by CPCB and continues operating<br />
Gasifier without obtaining consent from Gujarat <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong><br />
WHEREAS based on the inspection made by CPCB, the unit was directed to ensure that the<br />
gasifier are operated only after obtaining due consent from Gujarat SPCB besides compliance with other<br />
points as listed in the directions dated 30.11.20/2 and submit the compliance report to CPCB by<br />
12.12.2012.
WHEREAS no report on the compliance status has been received from the unit till now thereby<br />
indicating that the unit is operating gasifier in violation of the consent conditions given by Gujarat SPCB<br />
AND WHEREAS the Ministry of Environment & Forests, Government of India, vide Notifications<br />
No. S. 0. 157(E) of 27.02.1996 and S. 0. 730 (E) dated 10.07.2002, has delegated the powers vested<br />
under Section 5 of the Environment (Protection) Act, 1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong><br />
<strong>Control</strong> <strong>Board</strong> to issue directions to any industry or any local body or any other authority for violations of<br />
the standards and rules notified under the Environment (Protection) Rules, 1986 and amendment thereof.<br />
Now, THEREFORE in light of above and in exercise of the powers vested under Section 5 of the<br />
Environment (Protection) Act, 1986, Mis Vikas Sanitary Works is hereby directed to close all its<br />
operations with immediate effect and report compliance to this office. /<br />

Sub: Directions under Section 5 of Environment (Protection) Act, 1986 to 111/s Chandrapura<br />
Thermal Power Station of DVC Ltd.-confirmation thereof<br />
WHEREAS Chandrapura Thermal Power Station (CTPS) of DVC located at Chandrapura, Dist Bokaro<br />
of Jharkhand has 8 units (3x130, 3x120 & 2x250 MW) with installed capacity of 1130 MW.<br />
WHEREAS, CTPS was inspected by the officials from <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>, Zonal Office,<br />
Kolkata on December 29, 2011 under ESS programme<br />
WHEREAS, the inspecting team made the following observations:<br />
That effluent from the plant was being discharged through 4 different open drains to river<br />
Damodar.<br />
That the concentration of suspended solids ( 121 mg/I) in the effluent carrying through drain<br />
No. 1 was found to be higher than the prescribed limit of 100 mg/I. Besides the effluent<br />
discharged from ash pond -D and Drain no.I1 were acidic & alkaline in nature ( pH 6.2 & 9.8<br />
respectively)<br />
That large amount of coal rejects have been dumped along the river Damodar within 100 m of<br />
river bed which cause cause silting of the river during monsoon season besides the possibility<br />
of spillover to river directly at any point of time.<br />
That dry flyash collection system is not installed in old units. Dry ash collection system is<br />
installed for new units but was not operational during inspection<br />
5 That the particulate matter emission from unit 2 was found to be 496 mg/Nm3 against the<br />
limit of 150 mg/Nm3.<br />
That the pollution control equipment and accessories in new Coal handling for units ( 7 & 8)<br />
are not adequate.<br />
That CTPS has neither achieved zero discharge nor provided AWRS as per the CREP<br />
recommendations.<br />
8. That hazardous waste is not stored properly<br />
WHEREAS, CTPS is causing air & water pollution and not complying with the environmental standards.<br />
WHEREAS, show cause notice under section 5 of EPA, 1986 was issued to CTPS on May 11, 2012 for<br />
compliance of the following directions<br />
1. That the effluent from the plant shall be discharged through single outlet or recycled after<br />
collecting in <strong>Central</strong> Monitoring Basin and treatment. All other outlets shall be<br />
discontinued. An action plan shall be submitted within one month.
That dumping of coal rejects along the river Damodar within the river bed falling into HFL<br />
of river should be stopped immediately to avoid silting of the river during monsoon season<br />
besides avoiding possibility of any spillover to river directly at any point of time. The<br />
earlier stored coal rejects shall be re-handled and stored at other place with proper care. An<br />
action plan for lifting of dumped coal rejects shall be submitted within one month.<br />
That CTPS shall provide dry flyash collection system in old units and make the system<br />
operational for new units<br />
That CTPS shall augment the efficiency of ESP of unit 2 so as to meet the limit of 150<br />
mg/Nm3 for particulate matter.<br />
That pollution control equipment and accessories installed in new Coal handling ( unit 7 &<br />
8) should be operated and maintained properly.<br />
That CTPS shall provide AWRS as per the recommendations of CREP within 12 months<br />
That CTPS will identify separate space for proper storage of hazardous waste<br />
8. That CTPS shall submit the bank guarantee of Rs. 25 lakhs to ensure compliance of the<br />
above directions .<br />
WHEREAS, DVC submitted time bound programme for compliance of directions, vide letter no.<br />
CT/CE/EM&PC/D-3/81 dated August 31, 2012.<br />
WHEREAS the Ministry of environment & Forests, Government of India, vide notification Nos. S.O. 157<br />
( E) of 27.02. 1996 and S.O. 730 ( E) dated 10.07.2002 has delegated the power vested under Section 5 of<br />
Environment ( Protection ) Act, 1986 ( 29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> , to<br />
issue any directions to any industry or any local body or any other authority for violations of the<br />
standards and rules notified under Environment (Protection) Rules , 1986 and the amendments thereof.<br />
Now, THEREFORE, in view of the above and exercising powers delegated to the Chairman, <strong>Central</strong><br />
<strong>Pollution</strong> control <strong>Board</strong> under section 5 of the Environment (Protection ) Act, 1986, considering the<br />
clarifications & time bound action plan, following directions are hereby confirmed to M/s Chandrapura<br />
Thermal Power Station of M/s DVC for compliance within the time limit as mentioned below:<br />
That effluent from the plant shall be discharged through a single outlet or recycled after<br />
collecting in <strong>Central</strong> Monitoring Basin and treatment. All other outlets shall be<br />
discontinued by December 31, 2013.<br />
That dumping of coal rejects along the river Damodar within the river bed falling into<br />
HFL of river shall be stopped immediately to avoid silting of the river during monsoon<br />
season besides avoiding possibility of any spillover to river directly at any point of time.<br />
The earlier stored coal rejects shall be re-handled and stored at other place with proper<br />
care by March 31, 2013.<br />
That CTPS shall provide dry flyash collection system in old units by March 31, 2013 and<br />
make the system operational for new units by December 31, 2013.<br />
That CTPS shall augment the efficiency of ESP of unit 2 so as to meet the limit of 150<br />
mg/Nm3 for particulate matter by March 31, 2013.<br />
That the pollution control equipment and accessories installed in new Coal handling<br />
unit 7 & 8) plant should be operated and properly maintained by March 31, 2013.<br />
That CTPS shall provide AWRS as per the recommendations of CREP by December 31,<br />
2013.
That CTPS will identify & prepose separate space for proper storage of hazardous waste<br />
in addition to existing open fenced space by December 31, 2013<br />
That CTPS shall submit the bank guarantee of Rs. 25 lakhs with validity upto March 31,<br />
2014 to ensure compliance of the above directions within one month.<br />
You are hereby directed to comply with the directions as per time line mentioned against each<br />
direction listed above. In case of failure to comply with the said directions, the <strong>Board</strong> will be constrained<br />
to initiate action as may be deemed necessary and appropriate in the circumstances of the case under the<br />

Directions under Section 5 of the Environment (Protection) Act, 1986<br />
WHEREAS, the <strong>Central</strong> Government has notified the standards for discharge of environmental<br />
pollutants from various categories of industries and common effluent treatment plants under Rule 3 of<br />
the Environmental (Protection) Rules 1986.<br />
WHEREAS a team of Zonal Office (North), <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> inspected M/s lqbal<br />
Leathers Ltd., Plot-3, Site-II, Industrial Area, Unnao (herein referred as Unit) on 29' h December, 2011<br />
and observed the following short-comings:<br />
The Total Chromium concentration in the effluent sample collected at the inlet and outlet of<br />
Primary Effluent Treatment Plant (PETP) was found to be 200 mg/I and 48 mg/I which<br />
indicated that the chrome liquor is not segregated properly and chrome recovery plant is not<br />
operated properly.<br />
The primary treated effluent being conveyed to Unnao CETP for secondary treatment was<br />
not complying with the CETP inlet norms for the parameters Suspended Solids (888 mg/L<br />
against 600 mg/I) and Total Chromium (48 mg/I against 2 mg/I).<br />
The Unit is not maintaining any records of operation of Primary Effluent Treatment Plant<br />
and Chrome Recovery Plant, chemicals used for treatment of effluent and solid waste being<br />
sent to TSDF Kanpur, Dehat.<br />
The Unit does not have proper treatment unit for soak liquor as effluent was found stored in<br />
lagoon.<br />
The Unit had not installed separate energy meter and flow measuring device at the PETP.<br />
One of the two water meters installed at bore well was non-operational.<br />
WHEREAS, CPCB issued directions to Uttar Pradesh <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> for rectification of the<br />
aforesaid short-comings by M/s lqbal Leathers Ltd., Plot-3, Site-II, Industrial Area, Unnao;<br />
WHEREAS, as part of Surveillance of industries in Ganga Basin to assess their status of compliance<br />
to pollution control norms, CPCB team inspected the tanneries in Unnao during August-September<br />
2012;<br />
WHEREAS, M/s lqbal Leathers Ltd., Plot-3, Site-II, Industrial Area, Unnao-209801, Uttar Pradesh<br />
was re-inspected on August 23, 2012 and the Unit was not in operation. The inspecting team observed<br />
the following short-comings:<br />
Primary treated effluent discharged by the Unit for further treatment at the CETP in<br />
UPSIDC Industrial Area Site II, Unnao exceeded the prescribed CETP inlet quality (primary<br />
treatment) standards for Total Cr.: 5.69 mg/I (Std.: 2 mg/I).<br />

Unit does not have arrangement for segregation and conveyance of chrome liquor generated<br />
from tanning section for its treatment at Chrome Recovery Plant for recovery of chrome.<br />
Installation of flow measuring device at outlet of PETP was in progress.<br />
Neither segregation of the effluent streams containing high TDS, generated from soaking<br />
and pickling processes, is adopted nor system for recovery of salt is installed. A lagoon<br />
filled with soak liquor was observed near PETP.<br />
Sludge drying beds were found filled with sludge.<br />
WHEREAS, the Ministry of Environment and Forests, Government of India, vide Notification S.O. 157<br />
of 27.02.1996 has delegated powers vested under Section 5 of the Environment (Protection) Act, 1986<br />
(29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> to issue directions to any industry,<br />
Municipal Corporation and other authority for violation of the notified emission and effluent standards<br />
under the Environment (Protection) Rules, 1986 and other standards, and<br />
NOW, THEREFORE, in exercise of the powers vested under the Section 5 of the Environment<br />
(Protection) Act, 1986, M/s Iqbal Leathers Ltd., Plot-3, Site-II, Industrial Area, Unnao is hereby<br />
directed to carry out improvement in the primary treatment system so as to comply with the prescribed<br />
primary treatment standards / CETP's design inlet parameters and to rectify all other short-comings<br />
within a period of three months.<br />
The compliance report of the above direction shall be submitted to the <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong><br />
within one week of the expiry of the time period stipulated for compliance of the directions.<br />
In case of non-compliance of directions, action against the Unit will be initiated under the provision of<br />
the Environment (Protection) Act, 1986 and amendments thereof<br />

WHEREAS, the <strong>Central</strong> Government has notified the standards for discharge of environmental<br />

WHEREAS, as part of Surveillance of industries in Ganga Basin to assess their status of compliance<br />
to pollution control norms, CPCB team inspected the tanneries in Unnao during August-September<br />
2012;<br />
WHEREAS, M/s Super Tannery Ltd., Unit- Ill, Leather Technology Park, Banther, Unnao, was<br />
inspected on August 27, 2012 and the inspecting team observed that primary treated effluent<br />
discharged by the Unit for further treatment at the CETP in UPSIDC Leather Technology Park,<br />
Banthar, Unnao exceeded the prescribed CETP inlet quality (primary treatment) standards for Total<br />
Cr: 6.8 mg/I (Std.: 2 mg/I) which indicated that either segregation of high chromium effluent stream<br />
was not proper or treatment for recovery of chromium and overall primary treatment was not<br />
adequate;<br />
WHEREAS, the Ministry of Environment and Forests Government of India, vide Notification S.O.<br />
157 of 27.02.1996 has delegated powers vested under Section 5 of the Environment (Protection) Act,<br />
1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> to issue directions to any<br />
industry, Municipal Corporation and other authority for violation of the notified emission and effluent<br />
standards under the Environment (Protection) Rules, 1986 and other standards, and<br />
NOW, THEREFORE, in view of the shortcomings noticed and in exercise of the powers vested under<br />

DIRECTION UNDER SECTION 5 OF THE ENVIRONMENT (PROTECTION) ACT, 1986 —<br />
NOTICE THEREOF.<br />
WHEREAS, the <strong>Central</strong> Government has notified the standards for discharge of<br />
environmental pollutants from various categories of industries under the Environment<br />
(Protection) Act,1986 and the rule framed there under; and<br />
WHEREAS, the Ministry of Environment 8 Forests, Govt. of India, vide notification<br />
S.O.157(E) of 27.02.1996 has delegated powers vested under Section 5 of the Environment<br />
(Protection)Act,1986(29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong>(CPCB),to<br />
issue direction to any industry, Municipal Corporation, Municipal Council, Cantonment <strong>Board</strong><br />
to any local or other Authority for the violation of emission and effluent standards notified<br />
under the Environment (Protection) Rules,1986 and other standards and norms; and<br />
WHEREAS, M/s Katyayini Paper Mills Pvt. Ltd., Village- Kuddiyawala, Jaspur -Kashipur<br />
Road, Dsitt- Udham Singh Nagar, Taluk-Kashipur, UK (hereinafter referred as 'the Unit') is a<br />
waste paper based plant producing Writing and Printing grade of paper using 10% imported<br />
waste as raw material with an installed production capacity of 60 TPD; and<br />
WHEREAS, CPCB issued direction under section 18(i)(b) of the Water Act, 1974 on July 12,<br />
2012 to Uttarakhand Environment Protection and <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> (UEPPCB) for<br />
implementation of prescribed detailed implementation programme (DIP) of "Charter for<br />
Water Recycling and <strong>Pollution</strong> Prevention in Pulp and Paper Industries in Ganga River<br />
Basin" by the identified industries located in catchment of river Ganga; and<br />
WHEREAS, Uttarakhand Environment Protection and <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> (UEPPCB)<br />
issued direction on 01.8.2012 to the Unit under section 33(A) of the Water Act to implement<br />
the Charter for Water Recycling and <strong>Pollution</strong> Prevention in Ganga River Basin' in the<br />
prescribed time bound manner; and<br />
WHEREAS, the Unit was inspected by a team of CPCB officials on December 07, 2012 for<br />
compliance verification and made the following observations:<br />
At the time of inspection, the Unit and its ETP were in operation.<br />
The Unit has installed ETP comprising of Equalization Tank, Primary Clarifier Aeration<br />
Tank, Secondary Clarifier and Sludge Drying Beds (SDB).<br />
The Unit's fresh water consumption is about 2450 m 3/day while Unit's effluent<br />
generation is about 1650 m3/day.<br />
The treated effluent sample analysis from ETP showed TSS-198mg/I; BOD-62 mg/I; and<br />
COD — 456 mg/I; which indicate non-compliance against the prescribed effluent<br />
discharge standard of 75mg/I; 30 mg/I and 225 mg/I respectively. The MLSS in the<br />
aeration tank was 125 mg/I indicating unstablised Aeration Tank and unsatisfactory<br />
operation and maintenance of ETP.<br />

5. Sludge and fibers were observed in equalization tank which needs to be removed.<br />
SDBs were found filled with sludge and needs to install filter press for dewatering the<br />
accumulated sludge.<br />
6 Measures such as installation of Sedicell and change of showers & nozzles are still not<br />
completed.<br />
7 Bypass line has been observed next to boiler section.<br />
8 The partially treated effluent is being discharged into local drain and the effluent<br />
characteristics of downstream of drain showed BOD-71mg/I (against the norms of<br />
30mg/I) which ultimately meets to river Dhela.<br />
9 Unsatisfactory progress with respect to implementation of the Charter has been<br />
observed.<br />
It is evident from the above observations that the Unit has not stabilised their ETP<br />
system and progress of charter implementation programme is unsatisfactory, owing<br />
to which discharge of partially treated effluent is posing threat to water quality of<br />
river Dhela and to the surrounding environment;<br />
AND NOW, THEREFORE, in view of the above observations and in exercise of the powers<br />
delegated to the Chairman, CPCB under section 5 of the Environment (Protection) Act,<br />
1986, notice is served herewith to show cause why the Unit shall not be closed down till<br />
upgradation and stabilization of ETP and satisfactory implementation of Charter action points<br />
so as to comply with the prescribed standards to the satisfaction of CPCB.<br />
You are hereby given an opportunity to file your objections (if any) to the above<br />
proposed directions within 15 days from the receipt its letter, failing which appropriate action<br />
will be taken against the Unit, without giving any further notice, in accordance with provisions<br />
of the Environment (Protection) sAct, 1986.<br />

WHEREAS, as part of Surveillance of industries in Ganga Basin to assess their status of compliance<br />
to pollution control norms, CPCB team inspected the tanneries in Unnao during August-September<br />

was inspected on August 27, 2012 and the inspecting team observed the following short-comings<br />

WHEREAS, Mis Leayan Global (P) Ltd, A-5 & A-6, UPSIDC, Industrial area, Banther, Unnao, was<br />
inspected on August 25, 2012 and the inspecting team observed the following short-comings:<br />
Primary treated effluent discharged by the Unit for further treatment at the CETP in<br />
UPSIDC Leather Technology Park, Banthar, Unnao exceeded the prescribed CETP inlet<br />
quality (primary treatment) standards for pH: 9.01 (Std. 6.5-9.0) and Total Cr: 9.9 mg/I (Std.: 2<br />
mg/I) which indicated that either segregation of high chromium effluent stream was not<br />
proper or treatment for recovery of chromium and overall primary treatment was not<br />
adequate.<br />
The production capacity (559 hides/day of Buff/Calf as on 25.08.2012) exceeds the<br />
permitted processing capacity of 360 hides/day.<br />
The effluent quantity discharge (295 KLD of effluent as on 08.08.2012) was more than the<br />
permitted discharge of effluent (216 KLD).<br />
Neither segregation of the effluent streams containing high TDS, generated from soaking<br />
and pickling processes, is adopted nor system for recovery of salt is installed.<br />
WHEREAS, the Ministry of Environment and Forests, Government of India, vide Notification S.O.<br />
157 of 27.02.1996 has delegated powers vested under Section 5 of the Environment (Protection) Act,<br />

WHEREAS, M/S Ruchira Papers Limited, Trilokpur Road, Kala Amb, Dsitrict Simaur, HP<br />
(hereinafter referred as 'the Unit') is engaged in the production of Kraft Paper (using 55%<br />
waste paper & 45 % Agro Waste) and Writing& Printing Paper (using Wheat Straw); and<br />
WHEREAS, the Unit was inspected by the officials of CPCB on 17.10.2012 under ESS<br />
programme and following observations were made:<br />
During inspection Unit and its ETP were in operation.<br />
Unit was found having multiple discharge points for the untreated effluent into drain.<br />
The treated effluent sample analysis from ETP outlet showed BOD-45.3 mg/I; COD-<br />
265 mg/I; and TSS-42.0 mg/I which indicate non-compliance against the prescribed<br />
effluent discharge standard of BOD (norms of 30 mg/I).<br />
MLSS was found 1413 mg/1 and MLVSS as 968 mg/I which indicates poor<br />
stabilisation of ETP.<br />
Sample analysis of the by-pass drain within the Units premises showed BOD-203<br />
mg/I; COD-1183 mg/I and TSS- 684 mg/I.<br />
Unit discharges its untreated effluent (BOD-398 mg/I, COD-1645 mg/I, and TSS- 627<br />
mg/I) directly into Jattah Nallah which meets to river Markande.<br />
7) Monitoring was carried out at stack of 22 TPH Multi fuel boiler. The particulate<br />
matter (PM) concentration was recorded as 273 mg/Nm 3 as against the stipulated<br />
norms of 150 mg/Nm3.<br />
It is evident from the above observations that the Unit is not complying with the<br />
prescribed effluent and emission discharge norms, bypassing the partially<br />
/untreated effluent into Jattah Nallah and posing a potential threat to the Markande<br />
river water quality;<br />

AND NOW, THEREFORE, in view of the above observations and in exercise of the<br />
powers delegated to the Chairman, CPCB under section 5 of the Environment<br />
(Protection) Act, 1986, notice is served herewith to show cause why the Unit should<br />

implemented so as to comply with the prescribed effluent discharge standards to the<br />

Directions under Section 5 of the Environment (Protection) Act, 1986<br />
WHEREAS, the <strong>Central</strong> Government has notified the standards for discharge of environmental<br />
pollutants from various categories of industries and common effluent treatment plants under Rule 3 of<br />
the Environmental (Protection) Rules 1986.<br />
WHEREAS, as part of Surveillance of industries in Ganga Basin to assess their status of compliance<br />
to pollution control norms, CPCB team inspected the tanneries in Unnao during August-September<br />
2012;<br />
WHEREAS, M/s Model Exim, Unit-II, Plot no.-A-32, Leather Technology Plant, Banther, Unnao,<br />
was inspected on August 25, 2012 and the inspecting team observed the following short-comings:<br />
Primary treated effluent discharged by the Unit for further treatment at the CETP in<br />
UPSIDC Leather Technology Park, Banthar, Unnao exceeded the prescribed CETP inlet<br />
quality (primary treatment) standards for Total Cr: 8.8 mg/1 (SW.: 2 mg/1) which indicated<br />
that either segregation of high chromium effluent stream was not proper or treatment for<br />
recovery of chromium and overall primary treatment was not adequate.<br />
Condition of settling tank indicated its improper operation.<br />
Sludge drying beds were found filled with water.<br />
Neither segregation of the effluent streams containing high TDS, generated from soaking<br />
and pickling processes, is adopted nor system for recovery of salt is installed.<br />
Hazardous waste was stored in open.<br />
WHEREAS, the Ministry of Environment and Forests, Government of India, vide Notification S.O.<br />
157 of 27.02.1996 has delegated powers vested under Section 5 of the Environment (Protection) Act,<br />
1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> to issue directions to any<br />
industry, Municipal Corporation and other authority for violation of the notified emission and effluent<br />
standards under the Environment (Protection) Rules, 1986 and other standards, and<br />

NOW, THEREFORE, in view of the shortcomings noticed and in exercise of the powers vested under<br />
the Section 5 of the Environment (Protection) Act, 1986, Ws Model Exim, Unit-H, Plot no.-A-32<br />
Leather Technology Plant, Souther, Unnao is hereby directed to carry out improvement in the<br />
p ciliary treatment system so as to comply with the prescribed primary treatment standards / CETP's<br />
design inlet parameters and to rectify the other short-comings within a period of three months.<br />
The compliance report of the above direction shall be submitted to the <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong><br />
<strong>Board</strong> within one week of the expiry of the time period stipulated for compliance of the directions.<br />
In case of non-compliance of the directions, action against the Unit will be initiated under the<br />
provision of the Environment (Protection) Act, 1986 and amendments thereof.<br />

WHEREAS, the <strong>Central</strong> Government has notified the standards for discharge of environmental<br />

the Environmental (Protection) Rules 1986.<br />

2012 and the inspecting team observed the following short-comings:<br />
Primary treated effluent discharged by the Unit for further treatment at the CETP in UPSIDC<br />
Leather Technology Park, Banthar, Unnao exceeded the prescribed CETP inlet quality<br />
(primary treatment) standards for Total Cr: 3.97 mg/I (Std.: 2 mg/I) which indicate that either<br />
segregation of high chromium effluent stream was not proper or treatment for recovery of<br />
chromium and overall primary treatment was not adequate.<br />
The Unit does not have any record of chrome recovery.<br />
Neither segregation of the effluent streams containing high TDS, generated from soaking and<br />
pickling processes, is adopted nor system for recovery of salt is installed.<br />
Display board on the gate of the unit indicating particulars (name, address, capacity and<br />
process and hazardous waste handling data) not provided.<br />
Housekeeping in the process and PETP area was very poor.<br />
WHEREAS, the Ministry of Environment and Forests, Government of India, vide Notification S.O.<br />
157 of 27.02.1996 has delegated powers vested under Section 5 of the Environment (Protection) Act,<br />
1986 (29 of 1986) to the Chairman, <strong>Central</strong> <strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> to issue directions to any<br />
