King Solomon’s Takanah: Rambam’s Eruv : 185
The ditches and mounds are nature’s ‏"י ‏,רה thus the braissa (Shabbos
6a) introduces the four domains with the statement "
ואיזו היא רה"י
‏,חריץ שהוא עמוק י'‏ וכו'‏ וכן גדר שהוא גבוה י'‏ ורחב ד'‏ זו היא רה"י גמורה"‏
רה
רה nor ‏"י
referring to the חריץ and תל 8 that are the י גמורה " of nature.
The
semi-accessible ‏,בקעה valley, is neither a רה ‏"ר and is placed
‏.כרמלית into a separate category called
Reshus HaRabbim, Reshus HaYachid―
Man’s Handiwork
To understand Rambam’s stance on the four reshuyos (domains) of
Hilchos Shabbos, it is important to take note of how Rambam presents
them. Whereas in the standard texts of Rambam, he begins his
ארבע רשויות presentation of the four domains with the statement
in fact all reliable manuscripts show that he does not make this ‏,לשבת
statement until later in the chapter. 10 The fourteenth chapter of
Hilchos Shabbos actually begins "
" . Before making the statement "
" in the fourth halachah of the chapter,
איזו היא רה"ר מדברות וכו'‏ ואיזו רה"י תל
שגבוה
ארבע רשויות לשבת,‏ רשות היחיד
ורשות הרבים וכרמלית ומקום פטור
8 According to this explanation these structures are הר ‏"י due to their
physical structures, not because they have ‏,מחיצות perhaps with the use
of the principle of . While Eruvin 15a seems to imply that these
are only a רה ‏"י because of ‏,מחיצות were this true, the gemara should have
proved its point by citing the prominent braissa (Shabbos 6a) that these
structures are a ‏"י ‏.רה The fact that it only adduces this law with regard
to the concept of קונה שביתה rather than with regard to creating a רה ‏"י is
in fact proof to our position. Also see Rashi Shabbos 6b ‏"ל who
clearly states that סיק is the operable principle.
9 See Shabbos 6b which explains what גמורה means. Tosafos ( " ד ) does
not accept Rashi’s explanation of the gemara. According to our
explanation, the braissa is telling us that while Rav Yehudah allows
artificial and symbolic structures to constitute a רה ‏"י even after Rabbinic
strictures have been applied, the rabbis contend that even at the Torah
level there is no רה ‏"י without fundamental physical characteristics. The
ד ‏"ה קמ
ה ואמאי
רה
גוד א סיק
גוד א
gemara goes on to say that the term גמורה used defining ‏"ר does not
teach us anything. Still, the usage is appropriate, for the braissa is
defining the fundamental domains, not explaining what Chazal
eventually defined when categorizing all physical area.
