• Section 18 of the <strong>Patent</strong>s Act 1990 (Cth)<br />

• An <strong>in</strong>vention is patent eligible if it is a manner of manufacture with<strong>in</strong> the<br />

mean<strong>in</strong>g of section 6 of the Statute of Monopolies 1623<br />

• Provides that patents are only available for manners of new manufacture<br />

that are ‘not contrary to law nor mischievous to the state by rais<strong>in</strong>g prices of<br />

commodities at home or hurt of trade or generally <strong>in</strong>convenient’
