This chart is intended as a guide to<br />

<strong>the</strong> various legal procedures used to<br />

authorise exhumation in differing<br />

circumstances. Additional permissions<br />

may well be needed according to <strong>the</strong><br />

status <strong>of</strong> <strong>the</strong> site <strong>and</strong> <strong>the</strong> work involved,<br />

<strong>for</strong> example, where work affects a<br />

scheduled ancient monument,<br />

or approval under <strong>the</strong> Care <strong>of</strong><br />

Ca<strong>the</strong>drals Measure.<br />

1 The Town <strong>and</strong> Country Planning<br />

regulations require all remains to be<br />

removed, <strong>and</strong> make no provision <strong>for</strong><br />

<strong>the</strong> cremation <strong>of</strong> removed remains.<br />

2 A Home Office licence is required where<br />

human remains are removed, except in<br />

cases where a body is moved from one 5<br />

consecrated place <strong>of</strong> burial to ano<strong>the</strong>r<br />

under authority <strong>of</strong> a faculty. A Home<br />

Office licence is <strong>the</strong>re<strong>for</strong>e required in<br />

addition to a faculty in relation to<br />

consecrated l<strong>and</strong> if <strong>the</strong> remains are to<br />

be cremated, stored above ground, or if<br />

<strong>the</strong>y are not to be removed to ano<strong>the</strong>r<br />

consecrated place <strong>of</strong> burial.<br />

Home Office licences require <strong>the</strong><br />

consent <strong>of</strong> <strong>the</strong> next <strong>of</strong> kin <strong>and</strong> <strong>of</strong> <strong>the</strong> 6<br />

grave owner unless <strong>the</strong> identity <strong>of</strong><br />

nei<strong>the</strong>r is known <strong>and</strong> <strong>the</strong> grave is<br />

over 100 years old so that <strong>the</strong>re is<br />

no likelihood <strong>of</strong> objection from direct<br />

descendants.<br />

Advertisement <strong>of</strong> <strong>the</strong> intention to disturb<br />

buried remains (similar to <strong>the</strong> statutory<br />

provisions under <strong>the</strong> Disused Burial Act<br />

1981) may be a pre-condition <strong>of</strong> <strong>the</strong><br />

issue <strong>of</strong> a Home Office licence involving<br />

multiple burials <strong>and</strong> <strong>the</strong> graves are less<br />

than 100 years old.<br />

The Disused Burial Grounds Act 1981<br />

applies, <strong>and</strong> unresolved objections from<br />

relatives <strong>of</strong> those buried at <strong>the</strong> site within<br />

<strong>the</strong> previous fifty years will be fatal to <strong>the</strong><br />

development. Removal <strong>of</strong> all <strong>the</strong> remains<br />

will o<strong>the</strong>rwise be required. However, to<br />

<strong>the</strong> extent that no buried remains will be<br />

disturbed by any building-related works,<br />

<strong>the</strong> Home Office may issue a dispensation<br />

order to relieve <strong>the</strong> obligation to remove<br />

such remains. Remains expected to be<br />

disturbed by non-building-related works<br />

are subject to <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> Burial<br />

Act 1857.<br />

relatives <strong>of</strong> those buried at <strong>the</strong> site<br />

within <strong>the</strong> previous fifty years will be fatal<br />

remains will be expected.<br />

This Measure does not require <strong>the</strong><br />

removal <strong>of</strong> buried remains unless <strong>the</strong>y<br />

are liable to disturbance. A dispensation<br />

order may be made to <strong>the</strong> extent that<br />

buried remains will not be disturbed.<br />

Where remains need to be removed,<br />

arrangements <strong>for</strong> <strong>the</strong>ir disposal are<br />

subject to Home Office directions. Fresh<br />

or amended orders will be required on<br />

change <strong>of</strong> use or ownership.<br />

The Home Office requires removal <strong>of</strong><br />

buried remains only to <strong>the</strong> extent<br />

necessary to avoid <strong>the</strong>ir disturbance<br />

by building-related works.<br />

3 This Measure allows an order to be<br />

made removing <strong>the</strong> legal effects <strong>of</strong><br />
