1. The <strong>Development</strong> <strong>Fund</strong><br />

The <strong>Development</strong> <strong>Fund</strong> was established in 1977, and is a<br />

flexible at-call account, paying a competitive interest rate,<br />

with no entry, exit, transaction or account keeping fees,<br />

nor any government charges. <strong>Fund</strong>s are invested directly<br />

in a diversified portfolio of cash and fixed interest<br />

investments in <strong>UCA</strong> Cash Portfolio as well as in loans to<br />

Uniting Church bodies.<br />

The <strong>Fund</strong> is a unique opportunity for investors to assist<br />

the philanthropic work of the Church while receiving a<br />

competitive return. Net interest is paid to investors after<br />

deducting operating costs and making a grant to the<br />

<strong>UCA</strong> Synod of Victoria and Tasmania. It is also possible<br />

for investors to increase their contribution by directing<br />

all or part of their interest to a particular congregation<br />

or charitable activity conducted by the church.<br />

Privacy<br />

<strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> respects the privacy of all<br />

individuals and we comply with privacy legislation.<br />

Investors will receive a quarterly newsletter in addition<br />

to information regarding their account.<br />

2. How it Works<br />

Start with a minimum investment of $100.<br />

• Your money is at call.<br />

• Lodge additional investments at anytime by cheque,<br />

BPay, electronic transfer or direct debit.<br />

• Regular investment option.<br />

• Withdrawals by cheque or Electronic <strong>Fund</strong>s Transfer<br />

(EFT) processed the same day (if received by 11.00am).<br />

• Telephone withdrawals are available.<br />

• Retain a minimum balance of $100.<br />

3. What About Interest?<br />

• Competitive interest rate.<br />

• Calculated daily.<br />

• Paid twice yearly.<br />

• You also have an opportunity to donate your interest<br />

(or part of your interest) to:<br />

– The UnitingCare SHARE Community Appeal.<br />

– Your congregation.<br />

– UnitingCare agencies.<br />

7. Child Accounts<br />

A <strong>Development</strong> <strong>Fund</strong> can also be an effective way to save<br />

for your child’s future expenses. It is also a useful way<br />

for older family members to engender a sense of saving<br />

amongst younger members of the family as well. You may<br />

wish to consider opening an account in the name of a<br />

grandchild, a niece, a nephew or a family friend. If so, there<br />

are two options you need to consider if you intend opening<br />

a <strong>Development</strong> <strong>Fund</strong> account for a child.<br />

Please note, both options require ID verification –<br />

please see Identification Requirements on page 4.<br />

Option 1 – In Trust For<br />

• You can set up an ‘In Trust For’ account for the purpose<br />

of investing funds for a child.<br />

• The account is opened in the name of the investor<br />

(parent or guardian) and the child’s name is placed<br />

‘In Trust For’.<br />

• Withdrawals from ‘In Trust For’ accounts are made<br />

payable to the investor, not the person the money<br />

is in trust for.<br />

• The investor must include their own Tax File<br />

Number, and the investor is the registered signatory<br />

on the account.<br />

• Parent(s)/guardian(s), grandparent(s) or a relative can<br />

open an ‘In Trust For’ account on behalf of a child.<br />

Option 2 – Child Accounts<br />

• You can open a <strong>Development</strong> <strong>Fund</strong> account in the<br />

name of the child.<br />

• Withdrawals are made payable to the child. If the child<br />

is under the age of 16 (and total income earned by the<br />

child is less than $420 per year) you can claim a Child<br />

Tax Exemption and you do not need to give your Tax<br />

File Number.<br />

• The parent(s)/guardian(s), grandparent(s) or a relative<br />

can be the registered signatory on the account.<br />

• All capital is guaranteed by The Uniting Church<br />

in Australia Property Trust (Victoria).

Terms for telephone withdrawals<br />

Whilst the funds permit you to make withdrawals by telephone, you should be aware that <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> (<strong>UCA</strong>FM) will not be able to accept a telephone<br />

request if the caller does not satisfactorily identify themselves as the investor or authorised representative for the account.<br />

Phone withdrawals can be credited to the nominated bank account or a cheque can be drawn payable to the account holder.<br />

The investor agrees that any payment made in accordance with the telephone instruction shall be in complete satisfaction of the obligation of <strong>UCA</strong>FM and that the<br />

investor or any person claiming through the investor will have no claim against <strong>UCA</strong>FM in respect of the payment.<br />

Definitions<br />

— Account means the account held at your financial institution from which<br />

we are authorised to arrange for funds to be debited.<br />

— Agreement means this Direct Debit Request Service Agreement between<br />

you and us.<br />

— Business day means a day other than a Saturday or a Sunday or a public<br />

holiday listed throughout Australia.<br />

— Debit day means the day that payment by you to us is due.<br />

— Debit payment means a particular transaction where a debit is made.<br />

— Direct debit request means the Direct Debit Request between us and you<br />

— Us or we means <strong>UCA</strong> Cash <strong>Management</strong> <strong>Fund</strong> Limited ABN 41075 948 444<br />

you have authorised by signing a direct debit request.<br />

— You means the customer who signed the direct debit request.<br />

— Your financial institution is the financial institution where you hold the<br />

account that you have authorised us to arrange to debit.<br />

1. Debiting your account<br />

1.1 By signing a direct debit request, you have authorised us to arrange<br />

for funds to be debited from your account. should refer to the direct debit<br />

request and this agreement for the terms of the arrangement between us<br />

and you.<br />

1.2 We will only arrange for funds to be debited from your account as<br />

authorised in the direct debit request.<br />

1.3 If the debit day falls on a day that is not a business day, we may direct your<br />

financial institution to debit your account on the following business day.<br />

If you are unsure about which day your account has or will be debited you<br />

should contact us directly.<br />

2. Changes by us<br />

2.1 We may vary any details of this agreement or a direct debit request at any<br />

time by giving you at least fourteen (14) days written notice.<br />

3. Changes by you<br />

3.1 Subject to 3.2 and 3.3, you may change the arrangements under a direct<br />

debit request by contacting us on (03) 92515450.<br />

3.2 If you wish to stop or defer a debit payment, you must notify us in writing<br />

at least seven (7) days before the next debit day. This notice should be<br />

given to us in the first instance.<br />

3.3 You may also cancel your authority for us to debit your account at any time<br />

by giving us seven (7) days notice in writing before the next debit day. This<br />

notice should be given to us in the first instance.<br />

4. Your obligations<br />

4.1 It is your responsibility to ensure that there are sufficient clear funds<br />

available in your account to allow a debit payment to be made in<br />

accordance with the direct debit request.<br />

4.2 If there are insufficient clear funds in your account to meet a debit payment:<br />

a) you may be charged a fee and/or interest by your financial institution;<br />

b) you may also incur fees or charges imposed or incurred by us; and<br />

c) you must arrange for the debit payment to be made by another method<br />

or arrange for sufficient clear funds to be in your account by an agreed<br />

time so that can process the debit payment.<br />

4.3 You should check your account statement to verify that the amounts debited<br />

from your account are correct.<br />

5. Dispute<br />

5.1 If you believe that there has been an error in debiting your account, you<br />

should notify us directly on (03) 92515450 and confirm that notice in writing<br />

with us as soon as possible so that we can resolve your query more quickly.<br />

5.2 If we conclude as a result of our investigations that your account has been<br />

incorrectly debited we will respond to your query by arranging for a credit to<br />

your account (including interest and charges) accordingly. We will also notify<br />

you in writing of the amount by which your account has been adjusted.<br />

5.3 If we conclude as a result of our investigations that your account has not<br />

been incorrectly debited we will respond to your query by providing you<br />

with reasons and any evidence for this finding.<br />

5.4 Any queries you may have about an error made in debiting your account<br />

should be directed to us in the first instance so that we can attempt to<br />

resolve the matter between us and you. If we cannot resolve the matter you<br />

can still refer it to your financial institution which will obtain details from<br />

you of the disputed transaction and may lodge a claim on your behalf.<br />

6. Accounts<br />

You should check:<br />

a) with your financial institution whether direct debiting is available from<br />

your account as direct debiting is not available on all accounts offered by<br />

financial institutions.<br />

b) your account details which you have provided to us are correct by<br />

checking them against a recent account statement; and<br />

c) with your financial institution before completing the direct debit request<br />

if you have any queries about how to complete the direct debit request.<br />

7. Confidentiality<br />

7.1 We will keep any information (including your account details) in your<br />

direct debit request confidential. We will make reasonable efforts to keep<br />

any such information that we have about you secure and to ensure that<br />

any of our employees or agents who have access to information about you<br />

do not make any unauthorised use, modification, reproduction or disclosure<br />

of that information.<br />

7.2 We will only disclose information that we have about you:<br />

a) to the extent specifically required by law; or<br />

b) for the purposes of this agreement (including disclosing information in<br />

connection with any query or claim).<br />

8. Notice<br />

8.1 If you wish to notify us in writing about anything relating to this agreement,<br />

you should write to <strong>UCA</strong> Cash <strong>Management</strong> <strong>Fund</strong> Limited, 130 Little Collins<br />

Street, Melbourne VIC 3000.<br />

8.2 We will notify you by sending a notice in the ordinary post to the address<br />

you have given us in the direct debit request.<br />

8.3 Any notice will be deemed to have been received two business days after it<br />

is posted.

<strong>Development</strong> <strong>Fund</strong> (“the <strong>Fund</strong>”)<br />

1. The <strong>Development</strong> <strong>Fund</strong> (the <strong>Fund</strong>) is a fund of The Uniting<br />

Church in Australia Property Trust (Victoria) (the Property<br />

Trust) administered on its behalf by <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong><br />

2. All investments are guaranteed by the Uniting Church in<br />

Australia Property Trust (Victoria) of 130 Little Collins Street,<br />

Melbourne, Victoria 3000 which is the body corporate<br />

incorporated by statute for the Victorian Synod.<br />

3. The Property Trust is not subject to the normal<br />

requirements to have a prospectus and trust deed under the<br />

Corporations Act, and this scheme has not been examined<br />

or approved by the Australian Securities & Investments<br />

Commission (ASIC). <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> will provide<br />

audited financial accounts to ASIC each year.<br />

4. The Property Trust schemes are designed for investors who<br />

wish to promote the religious, educational and charitable<br />

purposes of the Uniting Church in Australia Synod of Victoria<br />

and Tasmania the Church) and for who the considerations of<br />

profit are not of primary relevance.<br />

5. <strong>Fund</strong>s are invested within the ethical investment guidelines<br />

of the Church in loans to church bodies and the <strong>UCA</strong> Cash<br />

Portfolio.<br />

6. Subject to Clause 7 income derived from the investments,<br />

after distributions to investors is used for the mission of the<br />

Church.<br />

7. Reasonable expenses incurred in administration of the <strong>Fund</strong><br />

are deducted from income prior to distribution.<br />

8. A portion of the <strong>Fund</strong> is available for lending to<br />

congregations, parishes, programs or agencies or<br />

organisations of or related to the Church approved by<br />

Synod.<br />

9. The minimum acceptable amount which may be lodged as an<br />

initial investment is $100 and a minimum balance of $100<br />

must be maintained at all times.<br />

10. Investors receive a written acknowledgment for each<br />

investment unless the <strong>Fund</strong> is advised otherwise.<br />

Investments are repayable at call.<br />

11. An acknowledgement of investment is not a document of<br />

title.<br />

12. Investments are not transferable. Where change of<br />

ownership is requested, <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> will<br />

consider requests to invest the funds again in the new<br />

name.<br />

13. Additional investments of any amount may be lodged at<br />

any time.<br />

14. An investor may arrange for interest due to be either:<br />

a) credited and added to the amount of the investment;<br />

b) credited to another <strong>Development</strong> <strong>Fund</strong> account held by<br />

the Investor;<br />

c) credited to the investor’s nominated bank account; or<br />

d) paid to nominated congregation, parish, presbytery,<br />

agency or organisation of the Church.<br />

15. Investments can only be made electronically or by cheque.<br />

Cash will not be accepted.<br />

16. <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> reserves the right to refuse any<br />

investment without assigning a reason.<br />

17. Interest is calculated on a daily basis from the date of<br />

receipt of monies by the <strong>Fund</strong> provided that investments are<br />

received before 11a.m. on that day. Upon withdrawal,<br />

interest will be calculated to the day prior to the date of<br />

repayment.<br />

18. Interest will be paid on investments half yearly at 30 June<br />

and, 31 December and upon withdrawal in full unless<br />

otherwise notified by <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>.<br />

19. The rate of interest paid to investors may be varied from<br />

time to time and investors will be notified in writing in<br />

advance if the rate is reduced. Investors may choose to<br />

receive less than that rate by giving written notice in which<br />

case the foregone interest will be used for the mission of<br />

the Church.<br />

20. In the event of the death of the investor <strong>UCA</strong> <strong>Fund</strong>s<br />

<strong>Management</strong> will (except in the case of joint accounts) pay<br />

the investment(s) with the accrued interest to the investors’<br />

estate on completion of legal formalities to the satisfaction<br />

of <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>. In the case of joint accounts,<br />

the investment will be placed in the name of the surviving<br />

investor on satisfactory evidence of death.<br />

21. A signed withdrawal form or secure telephone request is<br />

required for a withdrawal.<br />

22. Requests for withdrawal of investments or telephone<br />

banking setup must be signed by all parties concerned<br />

unless authority on the signature form is completed to allow<br />

for one signatory to operate the account.<br />

23. Withdrawals will be repaid from the <strong>Fund</strong> on the day<br />

requested provided that the withdrawal form is received by<br />

11a.m.<br />

24. No withdrawals will be paid to third parties.<br />

Definitions<br />

— Account means the account held at your financial institution from which<br />

we are authorised to arrange for funds to be debited.<br />

— Agreement means this Direct Debit Request Service Agreement between<br />

you and us.<br />

— Business day means a day other than a Saturday or a Sunday or a public<br />

holiday listed throughout Australia.<br />

— Debit day means the day that payment by you to us is due.<br />

— Debit payment means a particular transaction where a debit is made.<br />

— Direct debit request means the Direct Debit Request between us and you<br />

— Us or we means <strong>UCA</strong> Cash <strong>Management</strong> <strong>Fund</strong> Limited ABN 41075 948 444<br />

you have authorised by signing a direct debit request.<br />

— You means the customer who signed the direct debit request.<br />

— Your financial institution is the financial institution where you hold the<br />

1. Debiting your account<br />

1.1 By signing a direct debit request, you have authorised us to arrange<br />

for funds to be debited from your account. should refer to the direct debit<br />

request and this agreement for the terms of the arrangement between us<br />

and you.<br />

1.2 We will only arrange for funds to be debited from your account as<br />

authorised in the direct debit request.<br />

1.3 If the debit day falls on a day that is not a business day, we may direct your<br />

financial institution to debit your account on the following business day.<br />

If you are unsure about which day your account has or will be debited you<br />

should contact us directly.<br />

2. Changes by us<br />

2.1 We may vary any details of this agreement or a direct debit request at any<br />

time by giving you at least fourteen (14) days written notice.<br />

3. Changes by you<br />

3.1 Subject to 3.2 and 3.3, you may change the arrangements under a direct<br />

debit request by contacting us on (03) 92515450.<br />

3.2 If you wish to stop or defer a debit payment, you must notify us in writing<br />

at least seven (7) days before the next debit day. This notice should be<br />

given to us in the first instance.<br />

3.3 You may also cancel your authority for us to debit your account at any time<br />

by giving us seven (7) days notice in writing before the next debit day. This<br />

notice should be given to us in the first instance.<br />

4. Your obligations<br />

4.1 It is your responsibility to ensure that there are sufficient clear funds<br />

available in your account to allow a debit payment to be made in<br />

accordance with the direct debit request.<br />

4.2 If there are insufficient clear funds in your account to meet a debit payment:<br />

a) you may be charged a fee and/or interest by your financial institution;<br />

b) you may also incur fees or charges imposed or incurred by us; and<br />

c) you must arrange for the debit payment to be made by another method<br />

or arrange for sufficient clear funds to be in your account by an agreed<br />

time so that can process the debit payment.<br />

4.3 You should check your account statement to verify that the amounts debited<br />

from your account are correct.<br />

5. Dispute<br />

5.1 If you believe that there has been an error in debiting your account, you<br />

should notify us directly on (03) 92515450 and confirm that notice in writing<br />

with us as soon as possible so that we can resolve your query more quickly.<br />

5.2 If we conclude as a result of our investigations that your account has been<br />

incorrectly debited we will respond to your query by arranging for a credit to<br />

your account (including interest and charges) accordingly. We will also notify<br />

you in writing of the amount by which your account has been adjusted.<br />

5.3 If we conclude as a result of our investigations that your account has not<br />

been incorrectly debited we will respond to your query by providing you<br />

with reasons and any evidence for this finding.<br />

5.4 Any queries you may have about an error made in debiting your account<br />

should be directed to us in the first instance so that we can attempt to<br />

resolve the matter between us and you. If we cannot resolve the matter you<br />

can still refer it to your financial institution which will obtain details from<br />

you of the disputed transaction and may lodge a claim on your behalf.<br />

6. Accounts<br />

You should check:<br />

a) with your financial institution whether direct debiting is available from<br />

your account as direct debiting is not available on all accounts offered by<br />

financial institutions.<br />

b) your account details which you have provided to us are correct by<br />

checking them against a recent account statement; and<br />

c) with your financial institution before completing the direct debit request<br />

if you have any queries about how to complete the direct debit request.<br />

7. Confidentiality<br />

7.1 We will keep any information (including your account details) in your<br />

direct debit request confidential. We will make reasonable efforts to keep<br />

any such information that we have about you secure and to ensure that<br />

any of our employees or agents who have access to information about you<br />

do not make any unauthorised use, modification, reproduction or disclosure<br />

of that information.<br />

7.2 We will only disclose information that we have about you:<br />

a) to the extent specifically required by law; or<br />

b) for the purposes of this agreement (including disclosing information in<br />

connection with any query or claim).<br />

8. Notice<br />

8.1 If you wish to notify us in writing about anything relating to this agreement,<br />

you should write to <strong>UCA</strong> Cash <strong>Management</strong> <strong>Fund</strong> Limited, 130 Little Collins<br />

8.2 We will notify you by sending a notice in the ordinary post to the address<br />

Synod.<br />

9. The minimum acceptable amount which may be lodged as an<br />

initial investment is $100 and a minimum balance of $100<br />

must be maintained at all times.<br />

10. Investors receive a written acknowledgment for each<br />

investment unless the <strong>Fund</strong> is advised otherwise.<br />

Investments are repayable at call.<br />

11. An acknowledgement of investment is not a document of<br />

title.<br />

12. Investments are not transferable. Where change of<br />

ownership is requested, <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> will<br />

consider requests to invest the funds again in the new<br />

name.<br />

13. Additional investments of any amount may be lodged at<br />

any time.<br />

14. An investor may arrange for interest due to be either:<br />

a) credited and added to the amount of the investment;<br />

b) credited to another <strong>Development</strong> <strong>Fund</strong> account held by<br />

the Investor;<br />

c) credited to the investor’s nominated bank account; or<br />

d) paid to nominated congregation, parish, presbytery,<br />

agency or organisation of the Church.<br />

15. Investments can only be made electronically or by cheque.<br />

Cash will not be accepted.<br />

16. <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> reserves the right to refuse any<br />

investment without assigning a reason.<br />

17. Interest is calculated on a daily basis from the date of<br />

receipt of monies by the <strong>Fund</strong> provided that investments are<br />

received before 11a.m. on that day. Upon withdrawal,<br />

interest will be calculated to the day prior to the date of<br />

repayment.<br />

18. Interest will be paid on investments half yearly at 30 June<br />

and, 31 December and upon withdrawal in full unless<br />

otherwise notified by <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>.<br />

19. The rate of interest paid to investors may be varied from<br />

time to time and investors will be notified in writing in<br />

advance if the rate is reduced. Investors may choose to<br />

receive less than that rate by giving written notice in which<br />

case the foregone interest will be used for the mission of<br />

the Church.<br />

20. In the event of the death of the investor <strong>UCA</strong> <strong>Fund</strong>s<br />

<strong>Management</strong> will (except in the case of joint accounts) pay<br />

the investment(s) with the accrued interest to the investors’<br />

estate on completion of legal formalities to the satisfaction<br />

of <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>. In the case of joint accounts,<br />

the investment will be placed in the name of the surviving<br />

investor on satisfactory evidence of death.<br />

21. A signed withdrawal form or secure telephone request is<br />

required for a withdrawal.<br />

22. Requests for withdrawal of investments or telephone<br />

banking setup must be signed by all parties concerned<br />

unless authority on the signature form is completed to allow<br />

for one signatory to operate the account.<br />

23. Withdrawals will be repaid from the <strong>Fund</strong> on the day<br />

requested provided that the withdrawal form is received by<br />

11a.m.<br />

24. No withdrawals will be paid to third parties.<br />

Terms for telephone withdrawals<br />

Whilst the funds permit you to make withdrawals by telephone, you should be aware that <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> (<strong>UCA</strong>FM) will not be able to accept a telephone<br />

Definitions<br />

— Account means the account held at your financial institution from which<br />

we are authorised to arrange for funds to be debited.<br />

— Agreement means this Direct Debit Request Service Agreement between<br />

you and us.<br />

— Business day means a day other than a Saturday or a Sunday or a public<br />

holiday listed throughout Australia.<br />

— Debit day means the day that payment by you to us is due.<br />

— Debit payment means a particular transaction where a debit is made.<br />

— Direct debit request means the Direct Debit Request between us and you<br />

1. Debiting your account<br />

1.1 By signing a direct debit request, you have authorised us to arrange<br />

for funds to be debited from your account. should refer to the direct debit<br />

request and this agreement for the terms of the arrangement between us<br />

1.2 We will only arrange for funds to be debited from your account as<br />

authorised in the direct debit request.<br />

4. Your obligations<br />

4.1 It is your responsibility to ensure that there are sufficient clear funds<br />

available in your account to allow a debit payment to be made in<br />

accordance with the direct debit request.<br />

4.2 If there are insufficient clear funds in your account to meet a debit payment:<br />

a) you may be charged a fee and/or interest by your financial institution;<br />

b) you may also incur fees or charges imposed or incurred by us; and<br />

c) you must arrange for the debit payment to be made by another method<br />

or arrange for sufficient clear funds to be in your account by an agreed<br />

time so that can process the debit payment.<br />

4.3 You should check your account statement to verify that the amounts debited<br />

from your account are correct.<br />

5. Dispute<br />

5.1 If you believe that there has been an error in debiting your account, you<br />

should notify us directly on (03) 92515450 and confirm that notice in writing<br />

with us as soon as possible so that we can resolve your query more quickly.<br />

5.2 If we conclude as a result of our investigations that your account has been<br />

incorrectly debited we will respond to your query by arranging for a credit to<br />

your account (including interest and charges) accordingly. We will also notify<br />

you in writing of the amount by which your account has been adjusted.<br />

5.3 If we conclude as a result of our investigations that your account has not<br />

been incorrectly debited we will respond to your query by providing you<br />

with reasons and any evidence for this finding.<br />

5.4 Any queries you may have about an error made in debiting your account<br />

should be directed to us in the first instance so that we can attempt to<br />

resolve the matter between us and you. If we cannot resolve the matter you<br />

can still refer it to your financial institution which will obtain details from<br />

you of the disputed transaction and may lodge a claim on your behalf.<br />

6. Accounts<br />

You should check:<br />

a) with your financial institution whether direct debiting is available from<br />

your account as direct debiting is not available on all accounts offered by<br />

financial institutions.<br />

b) your account details which you have provided to us are correct by<br />

checking them against a recent account statement; and<br />

c) with your financial institution before completing the direct debit request<br />

if you have any queries about how to complete the direct debit request.<br />

7. Confidentiality<br />

7.1 We will keep any information (including your account details) in your<br />

direct debit request confidential. We will make reasonable efforts to keep<br />

any such information that we have about you secure and to ensure that<br />

any of our employees or agents who have access to information about you<br />

do not make any unauthorised use, modification, reproduction or disclosure<br />

of that information.<br />

7.2 We will only disclose information that we have about you:<br />

a) to the extent specifically required by law; or<br />

b) for the purposes of this agreement (including disclosing information in<br />

connection with any query or claim).<br />

8. Notice<br />

8.1 If you wish to notify us in writing about anything relating to this agreement,<br />

you should write to <strong>UCA</strong> Cash <strong>Management</strong> <strong>Fund</strong> Limited, 130 Little Collins<br />

Street, Melbourne VIC 3000.<br />

8.2 We will notify you by sending a notice in the ordinary post to the address<br />

you have given us in the direct debit request.<br />

8.3 Any notice will be deemed to have been received two business days after it<br />

is posted.

Terms and Conditions relating to investments in the<br />

<strong>Development</strong> <strong>Fund</strong> (“the <strong>Fund</strong>”)<br />

1. The <strong>Development</strong> <strong>Fund</strong> (the <strong>Fund</strong>) is a fund of The Uniting<br />

Church in Australia Property Trust (Victoria) (the Property<br />

Trust) administered on its behalf by <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong><br />

Limited ABN 46102469821 (<strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>).<br />

2. All investments are guaranteed by the Uniting Church in<br />

Australia Property Trust (Victoria) of 130 Little Collins Street,<br />

Melbourne, Victoria 3000 which is the body corporate<br />

incorporated by statute for the Victorian Synod.<br />

3. The Property Trust is not subject to the normal<br />

requirements to have a prospectus and trust deed under the<br />

Corporations Act, and this scheme has not been examined<br />

or approved by the Australian Securities & Investments<br />

Commission (ASIC). <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> will provide<br />

audited financial accounts to ASIC each year.<br />

4. The Property Trust schemes are designed for investors who<br />

wish to promote the religious, educational and charitable<br />

purposes of the Uniting Church in Australia Synod of Victoria<br />

and Tasmania the Church) and for who the considerations of<br />

profit are not of primary relevance.<br />

5. <strong>Fund</strong>s are invested within the ethical investment guidelines<br />

of the Church in loans to church bodies and the <strong>UCA</strong> Cash<br />

Portfolio.<br />

6. Subject to Clause 7 income derived from the investments,<br />

after distributions to investors is used for the mission of the<br />

Church.<br />

7. Reasonable expenses incurred in administration of the <strong>Fund</strong><br />

are deducted from income prior to distribution.<br />

8. A portion of the <strong>Fund</strong> is available for lending to<br />

congregations, parishes, programs or agencies or<br />

organisations of or related to the Church approved by<br />

Synod.<br />

9. The minimum acceptable amount which may be lodged as an<br />

initial investment is $100 and a minimum balance of $100<br />

must be maintained at all times.<br />

10. Investors receive a written acknowledgment for each<br />

investment unless the <strong>Fund</strong> is advised otherwise.<br />

Investments are repayable at call.<br />

11. An acknowledgement of investment is not a document of<br />

title.<br />

12. Investments are not transferable. Where change of<br />

ownership is requested, <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> will<br />

consider requests to invest the funds again in the new<br />

name.<br />

13. Additional investments of any amount may be lodged at<br />

any time.<br />

14. An investor may arrange for interest due to be either:<br />

a) credited and added to the amount of the investment;<br />

b) credited to another <strong>Development</strong> <strong>Fund</strong> account held by<br />

the Investor;<br />

c) credited to the investor’s nominated bank account; or<br />

d) paid to nominated congregation, parish, presbytery,<br />

agency or organisation of the Church.<br />

15. Investments can only be made electronically or by cheque.<br />

Cash will not be accepted.<br />

16. <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong> reserves the right to refuse any<br />

investment without assigning a reason.<br />

17. Interest is calculated on a daily basis from the date of<br />

receipt of monies by the <strong>Fund</strong> provided that investments are<br />

received before 11a.m. on that day. Upon withdrawal,<br />

interest will be calculated to the day prior to the date of<br />

repayment.<br />

18. Interest will be paid on investments half yearly at 30 June<br />

and, 31 December and upon withdrawal in full unless<br />

otherwise notified by <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>.<br />

19. The rate of interest paid to investors may be varied from<br />

time to time and investors will be notified in writing in<br />

advance if the rate is reduced. Investors may choose to<br />

receive less than that rate by giving written notice in which<br />

case the foregone interest will be used for the mission of<br />

the Church.<br />

20. In the event of the death of the investor <strong>UCA</strong> <strong>Fund</strong>s<br />

<strong>Management</strong> will (except in the case of joint accounts) pay<br />

the investment(s) with the accrued interest to the investors’<br />

estate on completion of legal formalities to the satisfaction<br />

of <strong>UCA</strong> <strong>Fund</strong>s <strong>Management</strong>. In the case of joint accounts,<br />

the investment will be placed in the name of the surviving<br />

investor on satisfactory evidence of death.<br />

21. A signed withdrawal form or secure telephone request is<br />

required for a withdrawal.<br />

22. Requests for withdrawal of investments or telephone<br />

banking setup must be signed by all parties concerned<br />

unless authority on the signature form is completed to allow<br />

for one signatory to operate the account.<br />

23. Withdrawals will be repaid from the <strong>Fund</strong> on the day<br />

requested provided that the withdrawal form is received by<br />

11a.m.<br />

24. No withdrawals will be paid to third parties.<br />
