Before Mr. W.S. Caswell, P.M, Bridget Agnes <strong>Nolan</strong> (spinster) sued Michael Walsh for<br />

the maintenance <strong>of</strong> his children, John Francis (aged 3 years) Annie Florence (aged 3<br />

months).<br />

Mr. Parker appeared for the complainant and Mr. Johnson for the defendant, who was not<br />

present in court. Complainant deposed that the mother children was born 30 th March<br />

1897 at her parents place at Wheeo, and the female child was born 13 th November 1899<br />

at the Benevolent Asylum Sydney, she had been keeping company with the defendant for<br />

about 5 years before the birth <strong>of</strong> the first child, defendant had assisted her after the birth<br />

<strong>of</strong> the first child was born, and had told her he would not see her out <strong>of</strong> a home; he had<br />

<strong>of</strong>ten said he would marry her and that was why she had neglected taking action for so<br />

long, defendant never denied the parentage, he had neglected to support the children, she<br />

was unable to do so herself, and asked for an order for 5/- shillings per week for the male<br />

child and 7/6 shillings for the female; defendant was a farmer and in a position to pay,<br />

about 5months before the second child was born, defendant gave her 10/- shillings to go<br />

away to Goulburn and sent her₤1 subsequently, she afterwards went to Sydney where the<br />

girl was born, she returned about a fortnight ago.<br />

To Mr. Johnson; Never kept company with any other man and never misbehaved herself<br />

with anyone other than the defendant, never told anyone that another that another person<br />

(name mentioned) was going to marry her, would swear Walsh was the father <strong>of</strong> her<br />

children.<br />

Annie <strong>Nolan</strong>, mother <strong>of</strong> the complainant deposed the defendant frequenting her place,<br />

keeping company with her daughter prior to the birth <strong>of</strong> each child, no other man had<br />

done so to her knowledge, spoke to defendant about the matter, and he said he was not in<br />

the position to marry, <strong>of</strong>fered her, <strong>of</strong>fered him money to do so he said it was not for that<br />

reason, he did not deny being the father. <strong>Robert</strong> <strong>Nolan</strong>, (brother) also gave corroborative<br />

evidence.<br />

Mr. Johnson said he would not call any evidence for the defence<br />

Obituary<br />

The little daughter (aged 7-1/2 years sic) <strong>of</strong> Mr. and Mrs. R Hewitt, <strong>of</strong> Wheeo, died a painful death at<br />

the Crookwell Hospital yesterday, the result <strong>of</strong> burns received at her parents’ residence on 24th ultimo.<br />

It appears that the little child got up at about 7.30 am on the day mentioned in her flannelette night<br />

dress, and lit a fire, at which she sat warming her feet. Whilst she was sitting there, the flames rushed<br />

out, set fire to her night dress, and she rushed outside. This alarmed the mother (who was then in bed),


and rushing out she discovered her little daughter in flames. She at once wrapped a wet rug around her,<br />

but the child by that time had been fearfully burnt about the back and lower portions. She was driven to<br />

town by Mr. E Craig and admitted to the hospital, where she received every attention, but succumbed to<br />

her injuries as above stated. Yesterday Mr. S L Cox, JP, district coroner, held an inquest at the hospital<br />

touching cause <strong>of</strong> death, and after hearing the evidence found a verdict that death resulted from burns<br />

accidentally received<br />

PHILIP HENRY 'BERT' TOOLE:<br />

Bert was a likeable chap who lived and worked in the Taralga, Crookwell and Goulburn area all his life.<br />

Interestingly when Phillip married Grace <strong>Nolan</strong> in Taralga in December 1925 his marriage certificate<br />

shows his name as Phillip Herbert Toole, so by this time he used his mother’s maiden name and had been<br />

well known to everyone as Bert Toole. Bert and Grace had eight children before she died in 1939. Bert<br />

then married Sarah Ann <strong>Nolan</strong>, sister <strong>of</strong> Grace, in Crookwell NSW in 1940. This union produced five<br />

children. Bert died at Crookwell, on the same day as the death <strong>of</strong> King George VI, 6th February 1952, a<br />

day respectfully remembered by his daughter Gloria who declared, ‘that day the world lost two Kings.<br />

Phillip Herbert Toole


The sad and sudden passing <strong>of</strong> Phillip Herbert (Bert) Toole during the late hours <strong>of</strong> February 6, came as a<br />

great shock not only to his own family but to his many friends throughout the Crookwell, NSW district.<br />

The deceased was not been in the best <strong>of</strong> health for some four years before his demise but he gave no<br />

indication that the end was so near. He was 51 years <strong>of</strong> age and was a native <strong>of</strong> Crookwell, NSW.<br />

In his younger days he was a keen horseman and was never really happy unless he was in the saddle. He<br />

enjoyed a very favourable reputation as a horse-breaker and in years gone by was also well-known as a<br />

tennis player.<br />

He lost his first wife during the 1930's and was left with eight little children. In 1940 he married Miss Anne<br />

<strong>Nolan</strong> and there are five children <strong>of</strong> the latter union.<br />

A hard worker all his life was in the employ <strong>of</strong> the Shire Council for some years and about twelve months<br />

ago he entered business as a milk vendor. He quickly established the same goodwill in his business as had<br />

characterized his whole life and his clients were saddened to hear <strong>of</strong> his passing.<br />

Besides his sorrowing widow thirteen children survive to mourn the loss <strong>of</strong> a devoted father.<br />

They are Joan (Mrs. M. Mortimer) Pejar; Joyce (Mrs. Max Willoughby) Coolah; Phyliss ( Mrs. Leo Coves)<br />

Queanbeyan; Leo Rugby; Kevin, Neville, Lola, Barbara, Valerie, Gloria, Jenette, Patricia and Robin, all <strong>of</strong><br />

Crookwell, NSW.<br />

He is also survived by his mother, Mrs. Marmont, <strong>of</strong> Taralga. One son William died in infancy.<br />

Following a service at St. Bartholomew's at 3 p.m. February 8 the cortege moved to the C. <strong>of</strong> E. portion <strong>of</strong><br />

the Crookwell, NSW cemetery where the remains were interred. Rev. Donoghue <strong>of</strong>ficiated at the service<br />

and also at the graveside.<br />

Messrs T. E. Kennedy and Sons had charge <strong>of</strong> the funeral arrangements.<br />

Heavy Fine for Drink Driving<br />

Russell James Howarth pleaded guilty to a charge <strong>of</strong> driving with the prescribed amount <strong>of</strong> alcohol in<br />

his blood, in Crookwell Court <strong>of</strong> Petty Sessions on Wednesday.<br />

He was fined $150 and had his licence suspended. Senior Constable D. Brown said at 5.40 p.m. on<br />

December 21 he saw Howarth driving a car west in Carrington street. Howarth admitted he had<br />

consumed four "middies" in half an hour prior to his being stopped. A subsequent breath analysis had


ead .110. In reply to Mr. J. Mullen (for Howarth) Senior Constable Brown said there was no other<br />

traffic hazard or apparent danger when Howarth was stopped. Senior Constable Brown said Howarth<br />

had not, to his knowledge, driven a motor vehicle except at work, since the <strong>of</strong>fence. Mr. Mullen said<br />

Howarth contributed to the support <strong>of</strong> his family. Howarth had a previous conviction for a traffic<br />

<strong>of</strong>fence, last year, when he was fined ₤20. Howarth had held a driving licence since July 1968.<br />

Mr. Mullen said he customarily drove vehicles about paddocks and occasionally drove machinery<br />

associated with his work as a potato-digger, on public roads. Mr. Mullen preferred character references<br />

and asked that leniency be shown his client. Magistrate Mr. R. Davey, said Howarth had not held a<br />

licence for long but he had committed a serious <strong>of</strong>fence. It was most important that a person should not<br />

drink and drive a motor vehicle.<br />
