The Vellore Citizen Welfare Forum filed this Writ Petiti<strong>on</strong> as public <str<strong>on</strong>g>in</str<strong>on</strong>g>terest<br />

litigati<strong>on</strong>. In this petiti<strong>on</strong>, the Welfare Forum alleged that the tanneries and other<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>dustries were discharg<str<strong>on</strong>g>in</str<strong>on</strong>g>g untreated effluent <str<strong>on</strong>g>in</str<strong>on</strong>g>to the agriculture fields,<br />

roadsides, waterways and open lands <str<strong>on</strong>g>in</str<strong>on</strong>g> the State of Tamil Nadu. The untreated<br />

effluent of these tanneries and <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries were f<str<strong>on</strong>g>in</str<strong>on</strong>g>ally discharged <str<strong>on</strong>g>in</str<strong>on</strong>g> the river<br />

Palar which was the ma<str<strong>on</strong>g>in</str<strong>on</strong>g> source of water supply to the residents of the area.<br />

The Welfare Forum further alleged that the entire surface and sub-soil water of<br />

river Palar was polluted result<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> n<strong>on</strong>-availability of potable water to the<br />

residents of the area. Due to the operati<strong>on</strong> of these tanneries <str<strong>on</strong>g>in</str<strong>on</strong>g> the state of<br />

Tamil Nadu envir<strong>on</strong>mental degradati<strong>on</strong> was caused. Accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the survey<br />

c<strong>on</strong>ducted <str<strong>on</strong>g>by</str<strong>on</strong>g> the Tamil Nadu Agricultural University Research Centre, Vellore,<br />

nearly 35,000 hectares of agricultural land <str<strong>on</strong>g>in</str<strong>on</strong>g> the tanneries belt had turned out<br />

partially or totally unfit for cultivati<strong>on</strong>. These tanneries used about 170 types of<br />

chemicals <str<strong>on</strong>g>in</str<strong>on</strong>g> the Chrome tann<str<strong>on</strong>g>in</str<strong>on</strong>g>g processes. These chemicals <str<strong>on</strong>g>in</str<strong>on</strong>g>clude comm<strong>on</strong><br />

salt, lime, sodium sulphuric, chromium sulphate, fat liquor, amm<strong>on</strong>ia and<br />

sulphuric acid besides dyes which are used <str<strong>on</strong>g>in</str<strong>on</strong>g> large quantities. Approximately 35<br />

cubic metre of water is used for process<str<strong>on</strong>g>in</str<strong>on</strong>g>g 1 kg f<str<strong>on</strong>g>in</str<strong>on</strong>g>ished leather result<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

dangerously enormous quantity of toxic effluents which were let out <str<strong>on</strong>g>in</str<strong>on</strong>g> the open<br />

<str<strong>on</strong>g>by</str<strong>on</strong>g> the tann<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries. The effluents have spoiled physico chemical properties<br />

of the soil and have c<strong>on</strong>tam<str<strong>on</strong>g>in</str<strong>on</strong>g>ated groundwater <str<strong>on</strong>g>by</str<strong>on</strong>g> percolati<strong>on</strong>.


An <str<strong>on</strong>g>in</str<strong>on</strong>g>dependent survey was c<strong>on</strong>ducted <str<strong>on</strong>g>by</str<strong>on</strong>g> Peace Members, N<strong>on</strong>-<br />

Governmental Organizati<strong>on</strong> and Peddiar Chatram Anchayat Uni<strong>on</strong>s found that<br />

350 wells out of total 467 used for dr<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g and irrigati<strong>on</strong> purposes were<br />

polluted. Women, children were forced to walk miles to get dr<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g water. On<br />

the request of the Legal and Aid Advise Board of Tamil Nadu, two lawyers visited<br />

the area and submitted their report <str<strong>on</strong>g>in</str<strong>on</strong>g>dicat<str<strong>on</strong>g>in</str<strong>on</strong>g>g the polluti<strong>on</strong> caused <str<strong>on</strong>g>by</str<strong>on</strong>g> the<br />

tanneries. It was reported that the entire Ambur town and the villages situated<br />

near<str<strong>on</strong>g>by</str<strong>on</strong>g> did not have good dr<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g water. Dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g ra<str<strong>on</strong>g>in</str<strong>on</strong>g>y days and floods, the<br />

chemicals deposited <str<strong>on</strong>g>in</str<strong>on</strong>g>to the river bed were spread<str<strong>on</strong>g>in</str<strong>on</strong>g>g out quickly. The State<br />

Government also <str<strong>on</strong>g>in</str<strong>on</strong>g>formed the Court about the 59 villages that were affected <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

the tanneries. In those villages, there was acute shortage of dr<str<strong>on</strong>g>in</str<strong>on</strong>g>k<str<strong>on</strong>g>in</str<strong>on</strong>g>g water. The<br />

Tamil Nadu <str<strong>on</strong>g>Polluti<strong>on</strong></str<strong>on</strong>g> C<strong>on</strong>trol Board also submitted that their Board perusuated<br />

for the last 10 years to c<strong>on</strong>trol the polluti<strong>on</strong> generated <str<strong>on</strong>g>by</str<strong>on</strong>g> these tanneries. These<br />

tanneries were given opti<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> the Board that either to c<strong>on</strong>struct comm<strong>on</strong><br />

effluent treatment plants (CETPs) for a cluster of <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries or to setup <str<strong>on</strong>g>in</str<strong>on</strong>g>dividual<br />

polluti<strong>on</strong> c<strong>on</strong>trol devices. The Central Government were earlier agreed to give<br />

substantial subsidies for the c<strong>on</strong>structi<strong>on</strong> of CEPTs. The H<strong>on</strong>'ble Court observed<br />

that it was pity that till date most of the tanneries operat<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> the State of Tamil<br />

Nadu did not take any step to c<strong>on</strong>trol the polluti<strong>on</strong> caused <str<strong>on</strong>g>by</str<strong>on</strong>g> the discharge of<br />

effluent. On the directi<strong>on</strong> of the H<strong>on</strong>'ble Court, the Nati<strong>on</strong>al Envir<strong>on</strong>mental<br />

Eng<str<strong>on</strong>g>in</str<strong>on</strong>g>eer<str<strong>on</strong>g>in</str<strong>on</strong>g>g Research Institute also submitted the feasibility report for sett<str<strong>on</strong>g>in</str<strong>on</strong>g>g up


of CETPs for clusters of tanneries situated at different places <str<strong>on</strong>g>in</str<strong>on</strong>g> the State. The<br />

NEERI, the Tamil Nadu Board and Central Board visited the tann<str<strong>on</strong>g>in</str<strong>on</strong>g>g units and<br />

other <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries <str<strong>on</strong>g>in</str<strong>on</strong>g> the Tamil Nadu and submitted their reports.<br />

The H<strong>on</strong>'ble Court observed that the leather <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry was of vital<br />

importance to the country as it generated foreign exchange and provided<br />

employment avenues. But, it had no right to destroy the ecology, degrade the<br />

envir<strong>on</strong>ment and cause a health hazard. It could not be permitted to expend or<br />

even to c<strong>on</strong>t<str<strong>on</strong>g>in</str<strong>on</strong>g>ue with the present producti<strong>on</strong> unless appropriate acti<strong>on</strong> taken <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

the <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry itself. The traditi<strong>on</strong>al c<strong>on</strong>cept that development and ecology are<br />

opposed to each other is no l<strong>on</strong>ger acceptable. "Susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able Development" would<br />

be the answer. The "Susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able Development" has been accepted as a viable<br />

c<strong>on</strong>cept to eradicate poverty and improve the quality of human life. While liv<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

with<str<strong>on</strong>g>in</str<strong>on</strong>g> the carry<str<strong>on</strong>g>in</str<strong>on</strong>g>g capacity of the support<str<strong>on</strong>g>in</str<strong>on</strong>g>g eco-systems. "Susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able<br />

development" means development that meets the needs of the present without<br />

compromis<str<strong>on</strong>g>in</str<strong>on</strong>g>g the ability of the future generati<strong>on</strong>s to meet their own needs. The<br />

"Susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able Development" has come to be accepted as a viable c<strong>on</strong>cept to<br />

eradicate poverty and improve the quality of human life while liv<str<strong>on</strong>g>in</str<strong>on</strong>g>g with<str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

carry<str<strong>on</strong>g>in</str<strong>on</strong>g>g capacity of the support<str<strong>on</strong>g>in</str<strong>on</strong>g>g eco-system. The "Precauti<strong>on</strong>ary Pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple" and


the "The Polluter Pays Pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple" were the essential features of "Susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able<br />

Development ".<br />

The H<strong>on</strong>'ble Court <strong>on</strong> 28.8.1996 directed the Central Government to<br />

c<strong>on</strong>stitute an Authority under secti<strong>on</strong> 3(3) of the Envir<strong>on</strong>ment (Protecti<strong>on</strong>) Act,<br />

1986 and to c<strong>on</strong>fer <strong>on</strong> the Authority all the powers necessary to deal with the<br />

tanneries and other pollut<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>dustries <str<strong>on</strong>g>in</str<strong>on</strong>g> the State of Tamil Nadu. The authority<br />

so c<strong>on</strong>stituted would <str<strong>on</strong>g>in</str<strong>on</strong>g>voke the precauti<strong>on</strong>ary pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple and the polluter pays<br />

pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple. The Authority should determ<str<strong>on</strong>g>in</str<strong>on</strong>g>e the compensati<strong>on</strong> to be recovered from<br />

the polluters as cost of revers<str<strong>on</strong>g>in</str<strong>on</strong>g>g the damaged envir<strong>on</strong>ment. The Authority<br />

should direct the closure of the <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry owned/managed <str<strong>on</strong>g>by</str<strong>on</strong>g> a polluter <str<strong>on</strong>g>in</str<strong>on</strong>g> case he<br />

evades or refuses to pay the compensati<strong>on</strong> awarded aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st him. A f<str<strong>on</strong>g>in</str<strong>on</strong>g>e of<br />

Rs.10,000/- each <strong>on</strong> all the tanneries <str<strong>on</strong>g>in</str<strong>on</strong>g> the districts of North Arcot, Ambedkar,<br />

Erode Periyar, D<str<strong>on</strong>g>in</str<strong>on</strong>g>digul Anna, Trichi and Chengai M.G.R. was imposed. The said<br />

f<str<strong>on</strong>g>in</str<strong>on</strong>g>e was directed to be paid before 31.10.1996. The Chief Justice of the Madras<br />

High Court was requested to c<strong>on</strong>stitute a special bench "Green Bench" to further<br />

m<strong>on</strong>itor this case.<br />

The M<str<strong>on</strong>g>in</str<strong>on</strong>g>istry of Envir<strong>on</strong>ment & Forests, Government of India c<strong>on</strong>stituted<br />

the Loss of Ecology (Preventi<strong>on</strong> and Payments of Compensati<strong>on</strong>) Authority <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

year 1996 and appo<str<strong>on</strong>g>in</str<strong>on</strong>g>ted Mr. Justice P.Bhaskaran, as its Chairman. The Authority<br />

after detailed studies and deliberati<strong>on</strong>s delivered its award <strong>on</strong> March 12, 2002.<br />

Accord<str<strong>on</strong>g>in</str<strong>on</strong>g>gly, 546 tanneries <str<strong>on</strong>g>in</str<strong>on</strong>g> the District of Vellore to pay a compensati<strong>on</strong><br />

amount<str<strong>on</strong>g>in</str<strong>on</strong>g>g to Rs.26.82 crores to 29,193 families as polluti<strong>on</strong> damages.<br />

The Central Board has also analysed the soil, sludge and water samples<br />

c<strong>on</strong>cern<str<strong>on</strong>g>in</str<strong>on</strong>g>g this matter. The <str<strong>on</strong>g>in</str<strong>on</strong>g>depth <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong>s were taken up and reports<br />

were submitted to the H<strong>on</strong>'ble Supreme Court for c<strong>on</strong>siderati<strong>on</strong>.


Vedanta denied permissi<strong>on</strong> for Orissa m<str<strong>on</strong>g>in</str<strong>on</strong>g>e, but court offers escape<br />

route<br />

The British m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g group Vedanta has been denied permissi<strong>on</strong> to m<str<strong>on</strong>g>in</str<strong>on</strong>g>e<br />

bauxite for a c<strong>on</strong>troversial alum<str<strong>on</strong>g>in</str<strong>on</strong>g>ium project <str<strong>on</strong>g>in</str<strong>on</strong>g> the ecologically sensitive hills of<br />

Kalahandi and Rayagada districts of Orissa, unless it comes up with specific<br />

proposals to safeguard the rights of the local people and the ecology<br />

The Supreme Court of India has denied permissi<strong>on</strong> to Vedanta Alum<str<strong>on</strong>g>in</str<strong>on</strong>g>a Ltd<br />

-- the local unit of the British m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g group Vedanta Resources Plc -- and its<br />

associate Sterlite Industries India Ltd to m<str<strong>on</strong>g>in</str<strong>on</strong>g>e bauxite for a c<strong>on</strong>troversial<br />

alum<str<strong>on</strong>g>in</str<strong>on</strong>g>ium ref<str<strong>on</strong>g>in</str<strong>on</strong>g>ery <str<strong>on</strong>g>in</str<strong>on</strong>g> Orissa?s ecologically sensitive Niyamgiri hills. However, it<br />

left the door open for Sterlite to operate the m<str<strong>on</strong>g>in</str<strong>on</strong>g>es <str<strong>on</strong>g>in</str<strong>on</strong>g> collaborati<strong>on</strong> with state<br />

agencies, if it comes up with specific proposals to safeguard the <str<strong>on</strong>g>in</str<strong>on</strong>g>terests of the<br />

tribals who <str<strong>on</strong>g>in</str<strong>on</strong>g>habit the regi<strong>on</strong>, and the envir<strong>on</strong>ment.<br />

The court provided an escape clause for the m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g giants <str<strong>on</strong>g>by</str<strong>on</strong>g> sett<str<strong>on</strong>g>in</str<strong>on</strong>g>g up a<br />

special purpose vehicle (SPV) <str<strong>on</strong>g>in</str<strong>on</strong>g> the scheduled areas to ensure that<br />

envir<strong>on</strong>mental regulati<strong>on</strong>s are complied with <str<strong>on</strong>g>in</str<strong>on</strong>g> the development of the Rs 4,000<br />

crore, 3 milli<strong>on</strong> t<strong>on</strong>ne per annum bauxite m<str<strong>on</strong>g>in</str<strong>on</strong>g>e project. Once the requirements of<br />

employment of displaced people and tribals and protecti<strong>on</strong> of wildlife are taken<br />

care of, the companies can re-approach the court for approval of the project.


The bench also gave Sterlite the liberty to move the court with<str<strong>on</strong>g>in</str<strong>on</strong>g> eight<br />

weeks if it was ready to go ahead with the project, subject to compliance with<br />

certa<str<strong>on</strong>g>in</str<strong>on</strong>g> modalities.<br />

On November 23, a special three-judge bench (popularly known as the<br />

forests bench) compris<str<strong>on</strong>g>in</str<strong>on</strong>g>g Chief Justice K G Balakrishnan and Justices Arijit<br />

Pasayat and S H Kapadia, delivered its much-awaited judgment deny<str<strong>on</strong>g>in</str<strong>on</strong>g>g approval<br />

to the proposed bauxite m<str<strong>on</strong>g>in</str<strong>on</strong>g>e near Lanjigarh <str<strong>on</strong>g>in</str<strong>on</strong>g> Kalahandi district and the<br />

Khambasi hills <str<strong>on</strong>g>in</str<strong>on</strong>g> the adjo<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g Rayagada district, <strong>on</strong> the pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple of susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able<br />

development.<br />

Adherence to susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able development is a c<strong>on</strong>stituti<strong>on</strong>al requirement. the<br />

bench said <str<strong>on</strong>g>in</str<strong>on</strong>g> its order, which <strong>on</strong>ly seeks safeguards <str<strong>on</strong>g>by</str<strong>on</strong>g> which we are able to<br />

protect nature and subserve development. While the country needed to focus <strong>on</strong><br />

its present development needs, it had to be d<strong>on</strong>e without compromis<str<strong>on</strong>g>in</str<strong>on</strong>g>g the<br />

needs of future generati<strong>on</strong>s, the court added.<br />

However it left room for the project <str<strong>on</strong>g>by</str<strong>on</strong>g> ask<str<strong>on</strong>g>in</str<strong>on</strong>g>g Vedanta’s Indian unit,<br />

Sterlite Industries, to come back with a fresh proposal <strong>on</strong> safeguard<str<strong>on</strong>g>in</str<strong>on</strong>g>g the rights<br />

of local tribal people through a new <str<strong>on</strong>g>in</str<strong>on</strong>g>vestment firm.<br />

The court enjo<str<strong>on</strong>g>in</str<strong>on</strong>g>ed up<strong>on</strong> Sterlite to comply with the envir<strong>on</strong>mental<br />

regulati<strong>on</strong>s, cit<str<strong>on</strong>g>in</str<strong>on</strong>g>g newspaper reports <strong>on</strong> a government of Norway decisi<strong>on</strong> to sell<br />

off all its <str<strong>on</strong>g>in</str<strong>on</strong>g>vestments <str<strong>on</strong>g>in</str<strong>on</strong>g> Vedanta because the company had been resp<strong>on</strong>sible for<br />

caus<str<strong>on</strong>g>in</str<strong>on</strong>g>g envir<strong>on</strong>mental damage, violat<str<strong>on</strong>g>in</str<strong>on</strong>g>g human rights, and forcibly evict<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

tribal people.


The court stated that it did not entirely give credence to news reports, but<br />

s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce Vedanta could always walk out of the project and its assets and<br />

sharehold<str<strong>on</strong>g>in</str<strong>on</strong>g>g status were not clear, it could not be handed over the<br />

resp<strong>on</strong>sibility. ”We are not aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st the project <str<strong>on</strong>g>in</str<strong>on</strong>g> pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple” the court said. “M<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

is an important revenue-generat<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry. However, we cannot allow our<br />

nati<strong>on</strong>al assets to be placed <str<strong>on</strong>g>in</str<strong>on</strong>g> the hands of companies without a proper<br />

mechanism <str<strong>on</strong>g>in</str<strong>on</strong>g> place and without ascerta<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g the credibility of the user agency”.<br />

The court said that from the various legal documents it had received from<br />

the two firms, Sterlite seemed to be an associate company of Vedanta and not a<br />

subsidiary. It also said the new firm Sterlite needed to float would have to make<br />

fresh f<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial commitments to ensure the development of tribal people, and<br />

submit an account of its expenses to the court, am<strong>on</strong>g other terms.<br />

The court has suggested a rehabilitati<strong>on</strong> package to be followed before the<br />

c<strong>on</strong>troversial project starts <str<strong>on</strong>g>in</str<strong>on</strong>g> Kalahandi, <strong>on</strong>e of the poorest districts <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

country. The project is to be jo<str<strong>on</strong>g>in</str<strong>on</strong>g>tly implemented <str<strong>on</strong>g>by</str<strong>on</strong>g> Sterlite Industries (India)<br />

Limited (SSIL), the Orissa M<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g Corporati<strong>on</strong>, and the Orissa state government.<br />

The apex court also listed a number of suggesti<strong>on</strong>s made <str<strong>on</strong>g>by</str<strong>on</strong>g> the state<br />

government <strong>on</strong> the issue. These <str<strong>on</strong>g>in</str<strong>on</strong>g>clude soil c<strong>on</strong>servati<strong>on</strong> measures,<br />

development of green cover, provisi<strong>on</strong> to make diverted forest land n<strong>on</strong>transferable<br />

Vedanta wants to dig open-cast m<str<strong>on</strong>g>in</str<strong>on</strong>g>es <str<strong>on</strong>g>in</str<strong>on</strong>g> the Niyamgiri hills to feed an<br />

alum<str<strong>on</strong>g>in</str<strong>on</strong>g>a ref<str<strong>on</strong>g>in</str<strong>on</strong>g>ery it has already built <str<strong>on</strong>g>in</str<strong>on</strong>g> the area, as part of a Rs 4,000 crore (US$<br />

800 milli<strong>on</strong>) project expected <str<strong>on</strong>g>in</str<strong>on</strong>g>itially to produce 1 milli<strong>on</strong> t<strong>on</strong>nes of alum<str<strong>on</strong>g>in</str<strong>on</strong>g>a per<br />

year. The ref<str<strong>on</strong>g>in</str<strong>on</strong>g>ery at Lanjigarh, which was completed late last year, was<br />

predicated <strong>on</strong> a proposal to m<str<strong>on</strong>g>in</str<strong>on</strong>g>e 720 hectares of the adjacent Niyamgiri hills<br />

which is protected land under the Indian C<strong>on</strong>stituti<strong>on</strong>. The state and central


governments both back the m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g plan as part of efforts to <str<strong>on</strong>g>in</str<strong>on</strong>g>dustrialise and<br />

exploit the m<str<strong>on</strong>g>in</str<strong>on</strong>g>eral resources of underdeveloped eastern India.<br />

The decisi<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> India?s highest court to stay Vedanta’s proposal is the<br />

latest setback <str<strong>on</strong>g>in</str<strong>on</strong>g> a three-year legal battle to obta<str<strong>on</strong>g>in</str<strong>on</strong>g> f<str<strong>on</strong>g>in</str<strong>on</strong>g>al clearance for the m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

part of the project. In 2005, a fact-f<str<strong>on</strong>g>in</str<strong>on</strong>g>d<str<strong>on</strong>g>in</str<strong>on</strong>g>g committee appo<str<strong>on</strong>g>in</str<strong>on</strong>g>ted <str<strong>on</strong>g>by</str<strong>on</strong>g> the Supreme<br />

Court accused Vedanta of c<strong>on</strong>struct<str<strong>on</strong>g>in</str<strong>on</strong>g>g its ref<str<strong>on</strong>g>in</str<strong>on</strong>g>ery <str<strong>on</strong>g>in</str<strong>on</strong>g> blatant violati<strong>on</strong> of Indian<br />

plann<str<strong>on</strong>g>in</str<strong>on</strong>g>g and envir<strong>on</strong>mental guidel<str<strong>on</strong>g>in</str<strong>on</strong>g>es.<br />

When the company sought permissi<strong>on</strong> to start m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> the forest area of<br />

672.018 hectares <str<strong>on</strong>g>in</str<strong>on</strong>g> the backward Kalahandi district, it evoked high-level<br />

protests from envir<strong>on</strong>ment groups and wildlife enthusiasts who challenged the<br />

plan, argu<str<strong>on</strong>g>in</str<strong>on</strong>g>g that it would displace tribal people and destroy the regi<strong>on</strong>’s flora<br />

and fauna.<br />

Thousands of tribal people say the m<str<strong>on</strong>g>in</str<strong>on</strong>g>e will destroy hills they c<strong>on</strong>sider<br />

sacred, force them from their homes and destroy their livelihoods which are<br />

based <strong>on</strong> farm<str<strong>on</strong>g>in</str<strong>on</strong>g>g millet, hunt<str<strong>on</strong>g>in</str<strong>on</strong>g>g and collect<str<strong>on</strong>g>in</str<strong>on</strong>g>g fruits and spices from the forests.<br />

The latest verdict has been greeted with cautious optimism <str<strong>on</strong>g>by</str<strong>on</strong>g> those<br />

oppos<str<strong>on</strong>g>in</str<strong>on</strong>g>g the project, am<strong>on</strong>g them anthropologists and envir<strong>on</strong>mentalists.<br />

Meanwhile, Vedanta has termed it a m<str<strong>on</strong>g>in</str<strong>on</strong>g>or setback <str<strong>on</strong>g>in</str<strong>on</strong>g> its three-year battle to get<br />

the beleaguered project off the ground.<br />

However, voluntary groups that supported the campaign rema<str<strong>on</strong>g>in</str<strong>on</strong>g> cautious.<br />

“We are very apprehensive of this ‘special purpose vehicle’,” says Babu Mathew,<br />

country director of Acti<strong>on</strong> Aid India. “There have been too many such<br />

arrangements that have failed <str<strong>on</strong>g>in</str<strong>on</strong>g> the past”.


Bhakra dam case<br />

In the last two decades, a variety of petiti<strong>on</strong>s filed before the Supreme<br />

Court over illegalities c<strong>on</strong>cern<str<strong>on</strong>g>in</str<strong>on</strong>g>g large dam and irrigati<strong>on</strong> projects have all had a<br />

comm<strong>on</strong> result. Project prop<strong>on</strong>ents have gotten the judicial go-ahead. What is<br />

the po<str<strong>on</strong>g>in</str<strong>on</strong>g>t of overcrowd<str<strong>on</strong>g>in</str<strong>on</strong>g>g laws with more 'enabl<str<strong>on</strong>g>in</str<strong>on</strong>g>g' provisi<strong>on</strong>s then, asks<br />

The India Internati<strong>on</strong>al Centre is the hub of Delhi's <str<strong>on</strong>g>in</str<strong>on</strong>g>telligentsia. On 18<br />

April, I went there to listen to the f<str<strong>on</strong>g>in</str<strong>on</strong>g>d<str<strong>on</strong>g>in</str<strong>on</strong>g>gs of a study assess<str<strong>on</strong>g>in</str<strong>on</strong>g>g the 'Temple of<br />

Resurgent India'- the Bhakra Dam. Through an extensively researched work, the<br />

pr<str<strong>on</strong>g>in</str<strong>on</strong>g>cipal author Shripad Dharmadhikary gave enough po<str<strong>on</strong>g>in</str<strong>on</strong>g>ters to suggest that<br />

the legend of Bhakra has critical caveats and, as he said, the Bhakra's imagery of<br />

larger than life is exactly that - an image and <strong>on</strong>e that is larger than life. For<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>stance the study suggests that the Bhakra project's c<strong>on</strong>tributi<strong>on</strong> to irrigati<strong>on</strong> is<br />

severely limited – with unsusta<str<strong>on</strong>g>in</str<strong>on</strong>g>able groundwater extracti<strong>on</strong> be<str<strong>on</strong>g>in</str<strong>on</strong>g>g the real<br />

source of irrigati<strong>on</strong> - and its c<strong>on</strong>tributi<strong>on</strong> to food security has been<br />

overemphasized, perhaps to c<strong>on</strong>vert a story <str<strong>on</strong>g>in</str<strong>on</strong>g>to a legend. The study c<strong>on</strong>cludes<br />

that the Bhakra dam and project is "a most ord<str<strong>on</strong>g>in</str<strong>on</strong>g>ary project, an ord<str<strong>on</strong>g>in</str<strong>on</strong>g>ary dam<br />

much like any other large dam – with all its flaws and blemishes".


The details <str<strong>on</strong>g>in</str<strong>on</strong>g> the report are meticulous, the arguments c<strong>on</strong>v<str<strong>on</strong>g>in</str<strong>on</strong>g>c<str<strong>on</strong>g>in</str<strong>on</strong>g>g and the<br />

sheer effort <str<strong>on</strong>g>in</str<strong>on</strong>g>spir<str<strong>on</strong>g>in</str<strong>on</strong>g>g. But as I came out of the meet<str<strong>on</strong>g>in</str<strong>on</strong>g>g the big questi<strong>on</strong> to me<br />

for the dedicated team was: Where do you go from here? And who's listen<str<strong>on</strong>g>in</str<strong>on</strong>g>g?<br />

Even as I was com<str<strong>on</strong>g>in</str<strong>on</strong>g>g out, the auditorium next door was abuzz with the<br />

sound of Arun Jaitly who was speak<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> how the Judiciary <str<strong>on</strong>g>in</str<strong>on</strong>g> recent times<br />

might have crossed the <str<strong>on</strong>g>in</str<strong>on</strong>g>visible lakshman rekha and encroached <strong>on</strong> the powers<br />

of the other organs of the government. Gett<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> I could see the decisiveness <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

his t<strong>on</strong>e as he said: the Supreme Court despite be<str<strong>on</strong>g>in</str<strong>on</strong>g>g fallible is f<str<strong>on</strong>g>in</str<strong>on</strong>g>al. His words<br />

immediately after what I had heard about Bhakra provoked me to th<str<strong>on</strong>g>in</str<strong>on</strong>g>k how the<br />

Apex Court has resp<strong>on</strong>ded with the f<str<strong>on</strong>g>in</str<strong>on</strong>g>al word <str<strong>on</strong>g>in</str<strong>on</strong>g> a world dom<str<strong>on</strong>g>in</str<strong>on</strong>g>ated <str<strong>on</strong>g>by</str<strong>on</strong>g> c<strong>on</strong>flict<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

percepti<strong>on</strong>s, op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s and worldviews has resp<strong>on</strong>ded to large dam projects.<br />

The f<str<strong>on</strong>g>in</str<strong>on</strong>g>al words of the Court <str<strong>on</strong>g>in</str<strong>on</strong>g> such cases over the last two decades have a<br />

familiar r<str<strong>on</strong>g>in</str<strong>on</strong>g>g to them. There have been petiti<strong>on</strong>s filed before the Apex court <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

different c<strong>on</strong>texts and diverse grounds challeng<str<strong>on</strong>g>in</str<strong>on</strong>g>g aspects of violati<strong>on</strong> of laws,<br />

but almost <str<strong>on</strong>g>in</str<strong>on</strong>g>evitably, they all have had a comm<strong>on</strong> result. Project prop<strong>on</strong>ents<br />

have gotten a judicial go-ahead. Even the reas<strong>on</strong>s given <str<strong>on</strong>g>by</str<strong>on</strong>g> justices from their<br />

rul<str<strong>on</strong>g>in</str<strong>on</strong>g>gs have predictably follow<str<strong>on</strong>g>in</str<strong>on</strong>g>g a pattern - that petiti<strong>on</strong>ers raise technical<br />

issues, those are typically policy matters and thus bey<strong>on</strong>d judicial expertise and<br />

review. In fact, close exam<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> of the cases will f<str<strong>on</strong>g>in</str<strong>on</strong>g>d this pattern <str<strong>on</strong>g>in</str<strong>on</strong>g> both <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

apex court's operative decisi<strong>on</strong>s and <str<strong>on</strong>g>in</str<strong>on</strong>g> the reas<strong>on</strong>s support<str<strong>on</strong>g>in</str<strong>on</strong>g>g the decisi<strong>on</strong>s,<br />

despite the petiti<strong>on</strong>s themselves be<str<strong>on</strong>g>in</str<strong>on</strong>g>g made <strong>on</strong> a variety of different grounds.<br />

The high water mark <str<strong>on</strong>g>in</str<strong>on</strong>g> the l<str<strong>on</strong>g>in</str<strong>on</strong>g>e of cases was the 2000 judgment <strong>on</strong> Sardar<br />

Sarovar where despite the efficacy of dams per se be<str<strong>on</strong>g>in</str<strong>on</strong>g>g not a technical issue<br />

before the Court, the judgment put a number of str<strong>on</strong>g words together extoll<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

the virtues of large dams. That judgment was close <strong>on</strong> the heels of another<br />

verdict where the court has made it clear <str<strong>on</strong>g>in</str<strong>on</strong>g> the c<strong>on</strong>text of water polluti<strong>on</strong> issues<br />

that they al<strong>on</strong>e have the prerogative to draw the lakshman rekha as <str<strong>on</strong>g>in</str<strong>on</strong>g> its own<br />

words, 'These issues are too important to be left to the officers drawn from the


Executive'. The fact that judicial aggressi<strong>on</strong> <strong>on</strong> envir<strong>on</strong>ment may be out of sync<br />

with judicial deference <strong>on</strong> large projects hardly seems to matter. Because <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

r<str<strong>on</strong>g>in</str<strong>on</strong>g>g<str<strong>on</strong>g>in</str<strong>on</strong>g>g words, Jaitly says that the Supreme Court despite be<str<strong>on</strong>g>in</str<strong>on</strong>g>g fallible, def<str<strong>on</strong>g>in</str<strong>on</strong>g>itely<br />

has the f<str<strong>on</strong>g>in</str<strong>on</strong>g>al word.<br />

Com<str<strong>on</strong>g>in</str<strong>on</strong>g>g out of the two meet<str<strong>on</strong>g>in</str<strong>on</strong>g>gs further questi<strong>on</strong>s l<str<strong>on</strong>g>in</str<strong>on</strong>g>ger <str<strong>on</strong>g>in</str<strong>on</strong>g> my m<str<strong>on</strong>g>in</str<strong>on</strong>g>d. If<br />

the study like the <strong>on</strong>e <strong>on</strong> the Bhakra dam has to make sense at least for the<br />

future projects, could law and policy reform be thought of as a way ahead? If<br />

there have been c<strong>on</strong>cerns <strong>on</strong> lack of efforts for alternatives at the time of<br />

project c<strong>on</strong>ceptualisati<strong>on</strong>, n<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g>volvement of the people <str<strong>on</strong>g>in</str<strong>on</strong>g> decisi<strong>on</strong> mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>adequate envir<strong>on</strong>mental assessments and rehabilitati<strong>on</strong> efforts, could specific<br />

amendments be suggested <str<strong>on</strong>g>in</str<strong>on</strong>g> the legal framework to enforce these aspects?<br />

Yes, that is <strong>on</strong>e way ahead and <str<strong>on</strong>g>in</str<strong>on</strong>g>deed, generally speak<str<strong>on</strong>g>in</str<strong>on</strong>g>g, over the last<br />

fifteen years there have been some additi<strong>on</strong>/amendments <str<strong>on</strong>g>in</str<strong>on</strong>g> law <str<strong>on</strong>g>in</str<strong>on</strong>g> the right<br />

directi<strong>on</strong>. However, some of my recent visits to the command areas of two of the<br />

biggest irrigati<strong>on</strong> projects <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>dependent India - the Indira Gandhi Nahar<br />

Pariyojana (IGNP) <str<strong>on</strong>g>in</str<strong>on</strong>g> Rajasthan and the Sharda Shayak Pariyojana <str<strong>on</strong>g>in</str<strong>on</strong>g> UP - has<br />

taught me <strong>on</strong>e comm<strong>on</strong> less<strong>on</strong>: there are <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>al structures with def<str<strong>on</strong>g>in</str<strong>on</strong>g>itive<br />

legal mandate that have acquired a promis<str<strong>on</strong>g>in</str<strong>on</strong>g>g look <strong>on</strong> paper, but they have<br />

delivered little <strong>on</strong> the ground.<br />

For example, both the projects had created frameworks backed <str<strong>on</strong>g>by</str<strong>on</strong>g> law for<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>aliz<str<strong>on</strong>g>in</str<strong>on</strong>g>g farmers' participati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> irrigati<strong>on</strong> management and <str<strong>on</strong>g>in</str<strong>on</strong>g>volvement<br />

of the gram sabha and gram panchayats at the village levels and above, but<br />

most for whom the law was meant are totally oblivious of it. The story of how<br />

India's envir<strong>on</strong>mental impact assessment process is managed <str<strong>on</strong>g>by</str<strong>on</strong>g> the project<br />

prop<strong>on</strong>ents has been so told so often and repeatedly that it is now obvious to<br />

many that the EIA notificati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> the gazette papers and the way it is carried out<br />

<strong>on</strong> the ground are two entirely different th<str<strong>on</strong>g>in</str<strong>on</strong>g>gs.


That be<str<strong>on</strong>g>in</str<strong>on</strong>g>g the case I w<strong>on</strong>der aga<str<strong>on</strong>g>in</str<strong>on</strong>g> what is the po<str<strong>on</strong>g>in</str<strong>on</strong>g>t of overcrowd<str<strong>on</strong>g>in</str<strong>on</strong>g>g laws<br />

with more 'enabl<str<strong>on</strong>g>in</str<strong>on</strong>g>g' provisi<strong>on</strong>s that almost never seem to have an enabl<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

effect? Should I not <str<strong>on</strong>g>in</str<strong>on</strong>g>ternalize the limits of law and ignore its potential reach?<br />

With questi<strong>on</strong>s galore, <strong>on</strong>ly fatigue envelops my m<str<strong>on</strong>g>in</str<strong>on</strong>g>d and I c<strong>on</strong>clude, almost <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

defeat that let those who are affected raise their own voices. They have to reach<br />

out to the law, perhaps the law will never reach them<br />

Rights groups to fight court order <strong>on</strong> Blue Lady<br />

More than a year after it docked at Alang, the fate of the l<str<strong>on</strong>g>in</str<strong>on</strong>g>er Blue Lady<br />

still hangs <str<strong>on</strong>g>in</str<strong>on</strong>g> the balance despite a recent Supreme Court order allow<str<strong>on</strong>g>in</str<strong>on</strong>g>g it to be<br />

scrapped. Activists are challeng<str<strong>on</strong>g>in</str<strong>on</strong>g>g the judgment that, they say, has shown “a<br />

disregard for <str<strong>on</strong>g>in</str<strong>on</strong>g>ternati<strong>on</strong>al law and even India’s own laws” while defend<str<strong>on</strong>g>in</str<strong>on</strong>g>g the<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>terests of the shipbreak<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry


A global coaliti<strong>on</strong> of envir<strong>on</strong>mental, labour and human rights organisati<strong>on</strong>s<br />

plans to file a review petiti<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> the Supreme Court of India challeng<str<strong>on</strong>g>in</str<strong>on</strong>g>g the apex<br />

court’s decisi<strong>on</strong> to allow the dismantl<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the c<strong>on</strong>troversial Norwegian<br />

cruisel<str<strong>on</strong>g>in</str<strong>on</strong>g>er Blue Lady , alleged to be carry<str<strong>on</strong>g>in</str<strong>on</strong>g>g t<strong>on</strong>nes of radioactive and other<br />

hazardous waste, at Gujarat’s Alang shipyard. The coaliti<strong>on</strong> also plans to<br />

challenge the court’s decisi<strong>on</strong> at global forums.<br />

The Platform <strong>on</strong> Shipbreak<str<strong>on</strong>g>in</str<strong>on</strong>g>g c<strong>on</strong>demned the Supreme Court’s September<br />

12 decisi<strong>on</strong>, say<str<strong>on</strong>g>in</str<strong>on</strong>g>g it had been taken to safeguard the <str<strong>on</strong>g>in</str<strong>on</strong>g>terests of India’s dy<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

own strict order <strong>on</strong> shipbreak<str<strong>on</strong>g>in</str<strong>on</strong>g>g -- passed just days earlier, <strong>on</strong> September 6 --<br />

Jenssen, Platform coord<str<strong>on</strong>g>in</str<strong>on</strong>g>ator.


The Platform <strong>on</strong> Shipbreak<str<strong>on</strong>g>in</str<strong>on</strong>g>g says that s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce June 2006, even before the<br />

Blue Lady was beached, it had provided <str<strong>on</strong>g>in</str<strong>on</strong>g>disputable evidence to the Supreme<br />

Court that the ship c<strong>on</strong>ta<str<strong>on</strong>g>in</str<strong>on</strong>g>ed large amounts of hazardous material that could not<br />

be dealt with <str<strong>on</strong>g>in</str<strong>on</strong>g> a safe and envir<strong>on</strong>mentally sound manner, at Alang.<br />

Platform says it has made the court fully aware that India lacked the<br />

capacity to properly destroy the waste <str<strong>on</strong>g>in</str<strong>on</strong>g> accordance with the UN’s Stockholm<br />

C<strong>on</strong>venti<strong>on</strong>. But, the “court has c<strong>on</strong>sistently chosen to ignore Platform’s<br />

submissi<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> the SS Blue Lady case; they have also paid no attenti<strong>on</strong> to the<br />

c<strong>on</strong>cerns of 30,000 villagers liv<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> the surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g areas of the Alang yards,”<br />

Jenssen said.<br />

The coaliti<strong>on</strong> notified the court that allow<str<strong>on</strong>g>in</str<strong>on</strong>g>g the dismantl<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the ship<br />

was <str<strong>on</strong>g>in</str<strong>on</strong>g> breach of India’s own laws and commitments to <str<strong>on</strong>g>in</str<strong>on</strong>g>ternati<strong>on</strong>al labour rights<br />

and envir<strong>on</strong>mental c<strong>on</strong>venti<strong>on</strong>s.<br />

Despite this, the vessel was allowed to dock at Alang <strong>on</strong> August 15, 2006,<br />

and will now be dismantled there at the <str<strong>on</strong>g>in</str<strong>on</strong>g>evitable cost of workers’ lives and<br />

envir<strong>on</strong>mental c<strong>on</strong>tam<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong>, says Platform. “This rul<str<strong>on</strong>g>in</str<strong>on</strong>g>g sends an unmistakable<br />

signal that India does not care about the welfare of its poorest, most desperate<br />

workers,” Jenssen added.<br />

In its c<strong>on</strong>troversial order, a two-judge Supreme Court bench allowed the<br />

dismantl<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the c<strong>on</strong>troversial vessel, observ<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the process had become<br />

“irreversible” after its “illegal” beach<str<strong>on</strong>g>in</str<strong>on</strong>g>g at Alang <str<strong>on</strong>g>in</str<strong>on</strong>g> August 2006. The court,<br />

however, asked the government and other c<strong>on</strong>cerned authorities to take<br />

appropriate precauti<strong>on</strong>ary measures before go<str<strong>on</strong>g>in</str<strong>on</strong>g>g ahead with the dismantl<str<strong>on</strong>g>in</str<strong>on</strong>g>g of<br />

the vessel.


The court said it c<strong>on</strong>sidered the dearth of employment opportunities and<br />

scarcity of steel <str<strong>on</strong>g>in</str<strong>on</strong>g> India as factors <str<strong>on</strong>g>in</str<strong>on</strong>g> allow<str<strong>on</strong>g>in</str<strong>on</strong>g>g the Blue Lady to be dismantled <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

Alang, Asia’s largest ship recycl<str<strong>on</strong>g>in</str<strong>on</strong>g>g yard that has been ail<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> recent years.<br />

“Nearly 700 workers will be employed <str<strong>on</strong>g>in</str<strong>on</strong>g> the project. Further, 41,000 MT (metric<br />

t<strong>on</strong>nes) of steel will be made available. This will lower the pressure <strong>on</strong> m<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

activity elsewhere,” said Justices Arijit Pasayat and S H Kapadia while dispos<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

of a public <str<strong>on</strong>g>in</str<strong>on</strong>g>terest litigati<strong>on</strong> filed <str<strong>on</strong>g>by</str<strong>on</strong>g> the Research Foundati<strong>on</strong> for Science<br />

Technology and Natural Resource Policy.<br />

The judges stressed proporti<strong>on</strong>ality <str<strong>on</strong>g>in</str<strong>on</strong>g> development and said: “When we<br />

apply the pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple of susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able development we need to keep <str<strong>on</strong>g>in</str<strong>on</strong>g> m<str<strong>on</strong>g>in</str<strong>on</strong>g>d the<br />

c<strong>on</strong>cept of development <strong>on</strong> the <strong>on</strong>e hand and c<strong>on</strong>cepts like generati<strong>on</strong> of<br />

revenue, employment and public <str<strong>on</strong>g>in</str<strong>on</strong>g>terest <strong>on</strong> the other.” The fact that susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able<br />

development is overwhelm<str<strong>on</strong>g>in</str<strong>on</strong>g>gly <str<strong>on</strong>g>in</str<strong>on</strong>g> the public <str<strong>on</strong>g>in</str<strong>on</strong>g>terest and that the two are not<br />

mutually exclusive appears to have escaped the judges.<br />

SC denies more compensati<strong>on</strong> for Bhopal gas tragedy survivors


A bench compris<str<strong>on</strong>g>in</str<strong>on</strong>g>g Justices C K Thakker and H S Bedi dismissed an<br />

applicati<strong>on</strong> filed <str<strong>on</strong>g>by</str<strong>on</strong>g> the Bhopal Gas Peedit Mahila Udyog Sangathan that victims<br />

of the Bhopal gas tragedy be given greater compensati<strong>on</strong><br />

“It would have been better if we too had died that day,” declared a<br />

survivor of the Bhopal gas tragedy after the Supreme Court, <strong>on</strong> May 4, 2007,<br />

dismissed a petiti<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> survivors demand<str<strong>on</strong>g>in</str<strong>on</strong>g>g greater compensati<strong>on</strong>. Twenty-two<br />

years <strong>on</strong>, Bhopal’s survivors are still battl<str<strong>on</strong>g>in</str<strong>on</strong>g>g the effects of the toxic gas that<br />

spewed out of the Uni<strong>on</strong> Carbide plant <str<strong>on</strong>g>in</str<strong>on</strong>g> the city <strong>on</strong> the nights of December 2<br />

and 3, 1984.<br />

A bench compris<str<strong>on</strong>g>in</str<strong>on</strong>g>g Justices C K Thakker and H S Bedi dismissed the<br />

applicati<strong>on</strong> filed <str<strong>on</strong>g>by</str<strong>on</strong>g> the Bhopal Gas Peedit Mahila Udyog Sangathan (BGPMUS)<br />

hold<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the 1989 settlement between the US-based Uni<strong>on</strong> Carbide<br />

Corporati<strong>on</strong> (UCC) and the central government had been arrived at with the<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>terventi<strong>on</strong> of a five-judge c<strong>on</strong>stituti<strong>on</strong>al bench headed <str<strong>on</strong>g>by</str<strong>on</strong>g> then Chief Justice of<br />

India (CJI) R S Pathak, and that a two-judge bench could not re-open and review<br />

the judgment of a larger bench.<br />

Justice Pathak, who headed the bench that arrived at the settlement, was<br />

later elevated as judge to the Internati<strong>on</strong>al Court of Justice.<br />

Over 3,000 residents of Bhopal were killed when toxic methyl isocyanate (MIC)<br />

gas leaked from Uni<strong>on</strong> Carbide’s pesticide plant <str<strong>on</strong>g>in</str<strong>on</strong>g> Bhopal. Thousands more were<br />

seriously affected and hundreds of people became disabled for life.<br />

The total amount of compensati<strong>on</strong> awarded, the petiti<strong>on</strong>er argued, was<br />

meagre compared to the scale of the tragedy and loss of life and harm <str<strong>on</strong>g>in</str<strong>on</strong>g>flicted.<br />

The petiti<strong>on</strong>er c<strong>on</strong>tended that the compensati<strong>on</strong> amount be enhanced<br />

c<strong>on</strong>siderably to do justice to the victims, most of whom bel<strong>on</strong>g to weaker<br />

secti<strong>on</strong>s of society.


The court, however, did not agree and said that the gap of 18 years s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce<br />

the settlement and the date of fil<str<strong>on</strong>g>in</str<strong>on</strong>g>g this applicati<strong>on</strong> could not be lost sight of.<br />

The BGPMUS claims that the number of people killed <str<strong>on</strong>g>in</str<strong>on</strong>g> the disaster is four<br />

times greater than the number orig<str<strong>on</strong>g>in</str<strong>on</strong>g>ally arrived at and so more compensati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

the same ratio should be given to the victims. “The court has not given the<br />

reas<strong>on</strong>s beh<str<strong>on</strong>g>in</str<strong>on</strong>g>d reject<str<strong>on</strong>g>in</str<strong>on</strong>g>g our plea,” says Abdul Jabbar, c<strong>on</strong>venor of the BGPMUS.<br />

The compensati<strong>on</strong> of $ 478 milli<strong>on</strong> paid <str<strong>on</strong>g>by</str<strong>on</strong>g> the Uni<strong>on</strong> Carbide Corporati<strong>on</strong><br />

was for 102,000 people <str<strong>on</strong>g>in</str<strong>on</strong>g>jured, while the number of people dead was put at<br />

3,000. However, the Gas Claims Court disbursed compensati<strong>on</strong> to 572,000<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>jured, and for 15,272 deaths. “This <str<strong>on</strong>g>in</str<strong>on</strong>g> itself means that the number of <str<strong>on</strong>g>in</str<strong>on</strong>g>jured<br />

and those who died is almost four times that <str<strong>on</strong>g>in</str<strong>on</strong>g>itially believed,” Jabbar says,<br />

add<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the central government should have paid the amount accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to<br />

earlier orders of the Supreme Court.<br />

Shobha S<strong>on</strong>i, aged 60, said that although she lost two children she<br />

received <strong>on</strong>ly Rs 120,000 as compensati<strong>on</strong>. She was given a meagre Rs 20,000<br />

for her own treatment, an amount that has l<strong>on</strong>g been spent.<br />

Champalal Gupta was an operator at Uni<strong>on</strong> Carbide’s pesticide plant from<br />

where the gas leaked. Till date he has received <strong>on</strong>ly Rs 25,000 for the drastic toll<br />

the gas has taken <strong>on</strong> his health. His dues from Uni<strong>on</strong> Carbide too are yet to be<br />

cleared; he has been fight<str<strong>on</strong>g>in</str<strong>on</strong>g>g a case aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st his former employers <str<strong>on</strong>g>in</str<strong>on</strong>g> the Jabalpur<br />

High Court for years.<br />

Justices Thakker and Bedi, while dismiss<str<strong>on</strong>g>in</str<strong>on</strong>g>g the petiti<strong>on</strong> for enhanced<br />

compensati<strong>on</strong>, ruled, however, that an <str<strong>on</strong>g>in</str<strong>on</strong>g>dividual victim could approach the<br />

claims tribunal <str<strong>on</strong>g>in</str<strong>on</strong>g> case he/she had been denied proper compensati<strong>on</strong>.


Meanwhile, other organisati<strong>on</strong>s like the Bhopal Gas Peedit Mahila<br />

Stati<strong>on</strong>ery Karmachari Sangh (BGPMSKS), Bhopal Gas Peedit Mahila Purush<br />

Sangharsh Morcha (BGPMPSM), Bhopal Group for Informati<strong>on</strong> and Acti<strong>on</strong> (BGIA),<br />

and Bhopal Ki Aawaaz (BKA) refused to comment say<str<strong>on</strong>g>in</str<strong>on</strong>g>g that they still had to<br />

study the verdict.
