Judge Adelman of the United States District Court for<br />
the Eastern District of Wisconsin recently authored an<br />
opinion granting a downward departure which should be<br />
a model for other district judges. United States v. Eisinger,<br />
___ F.Supp.2d ___, <strong>2004</strong> WL 1368338 (E.D.Wis. June 9,<br />
<strong>2004</strong>).<br />
Judge Adelman<br />
• Granted the defendant a three-level reduction<br />
under U.S.S.G. §3E1.1.<br />
• Denied a vertical departure because of the lan<br />
guage of U.S.S.G. §5H1.6.<br />
• Granted a horizontal departure from criminal<br />
history category III to category I as provided for<br />
by U.S.S.G. § 4A1.3.<br />
Judge Adelman’s opinion leaves no question as to what<br />
he did or why he did it. Defense lawyers would be well<br />
served to read his opinion before arguing a downward<br />
departure motion. G<br />
