What do I get for my money<br />

from <strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong><br />

This leaflet aims to help you to make<br />

a direct l<strong>in</strong>k between the council<br />

tax you pay and the services we<br />

deliver to you. At the same time<br />

we will destroy some of the myths<br />

surround<strong>in</strong>g council tax.<br />

The leaflet also expla<strong>in</strong>s the different<br />

levels of council tax that you pay to<br />

<strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong>, Cumbria<br />

County <strong>Council</strong> and Cumbria Police<br />

Authority, as well as tell<strong>in</strong>g you how<br />

you can claim a discount on council<br />

tax and the easy methods for pay<strong>in</strong>g.<br />

Remember that direct debit is the<br />

cheapest way for us to collect the<br />

council tax and it is now easier us<strong>in</strong>g<br />

our website to set up your direct<br />

debit as there is no paperwork at all.<br />

Myth: All my council tax goes<br />

to <strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong><br />

<strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong> collects all your<br />

council tax but only keeps a small amount of it.<br />

The council tax is a local tax set by local<br />

authorities to pay for local services. Cumbria<br />

County <strong>Council</strong>, Cumbria Police Authority,<br />

<strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong> and your local parish<br />

council work out the cost of provid<strong>in</strong>g their<br />

services each year, which then determ<strong>in</strong>es how<br />

much the council tax will be. Then <strong>Allerdale</strong><br />

<strong>Borough</strong> <strong>Council</strong> collects it all on their behalf.<br />

Cumbria County <strong>Council</strong> sets the largest part<br />

of your council tax bill (74.6%). The money<br />

they receive is used to deliver services such as<br />

education, roads ma<strong>in</strong>tenance, the fire service,<br />

social services and libraries.<br />

How your council tax bill is shared among<br />

the local authorities <strong>in</strong> <strong>2012</strong>-<strong>13</strong>:<br />

Cumbria County <strong>Council</strong> - 74.6%<br />

Cumbria Police Authority - 12.9%<br />

<strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong> - 9.5%<br />

Parish councils - 3.0%<br />

Cumbria Police’s share (12.9%) of the bill is<br />

for tackl<strong>in</strong>g crime and disorder and for other<br />

polic<strong>in</strong>g issues.<br />

The parish and town councils <strong>in</strong> <strong>Allerdale</strong> also<br />

set an amount for the work they do <strong>in</strong> their<br />

communities, such as look<strong>in</strong>g after community<br />

build<strong>in</strong>gs and allotments. They also give views,<br />

on behalf of the community, on plann<strong>in</strong>g<br />

applications and other proposals that affect the<br />

parish.<br />

That leaves about 9.5% of your council tax<br />

which is set by <strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong> to<br />

pay towards delivery of services such as refuse<br />

and recycl<strong>in</strong>g collections, plann<strong>in</strong>g, provision of<br />

leisure services and economic regeneration.<br />

We believe that your council tax represents<br />

excellent value for money with only £9.50 out<br />

of every £100 you pay for your council tax bill<br />

go<strong>in</strong>g to <strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong>.<br />

Myth: I have no street<br />

light<strong>in</strong>g on my road, so I can<br />

have a discount on my council<br />

tax<br />

Individual council tax bills are worked out us<strong>in</strong>g<br />

the value of a householder’s property, not on<br />

the services you use or receive, such as street<br />

light<strong>in</strong>g or road gritt<strong>in</strong>g. If council tax was based<br />

on just the services you used, people without<br />

children would not be pay<strong>in</strong>g the County <strong>Council</strong><br />

for schools and education <strong>in</strong> their council tax.<br />

Your property will be <strong>in</strong> a valuation band set by<br />

the Valuation Office, which is an <strong>in</strong>dependent<br />

organisation. Bands range from A to H.<br />

Some properties, however, are entitled to<br />

discounts.<br />

Hous<strong>in</strong>g and council tax benefits<br />

Hous<strong>in</strong>g benefit is available to help you pay your<br />

rent if you are on a low <strong>in</strong>come. If you pay rent<br />

to a hous<strong>in</strong>g association or private landlord, the<br />

benefit is called rent allowance.<br />

<strong>Council</strong> tax benefit may be claimed by the person<br />

responsible for payment of the council tax for<br />

your accommodation. Your council tax bill will be<br />

reduced by the amount of benefit due to you.<br />

If you are s<strong>in</strong>gle and have other adults liv<strong>in</strong>g<br />

with you, who do not pay you rent, you may<br />

be entitled to second adult rebate. This is an<br />

alternative to council tax benefit and is worked<br />

out us<strong>in</strong>g the <strong>in</strong>come of all other adults <strong>in</strong> the<br />

property.<br />

Whether you qualify depends on:<br />

• Your <strong>in</strong>come<br />

• The size of your family<br />

• Your sav<strong>in</strong>gs<br />

• The <strong>in</strong>come of anyone else who lives with you,<br />

such as grown-up children or parents.<br />

You will not be entitled to benefit if you have<br />

sav<strong>in</strong>gs over £16,000 unless you are <strong>in</strong> receipt<br />

of Guaranteed Pension Credit. The first £6,000 of<br />

your capital will be ignored when assess<strong>in</strong>g your<br />

entitlement. However, if you have reached the<br />

qualify<strong>in</strong>g age for state pension credit, the first<br />

£10,000 of your capital will be ignored.<br />

You can claim benefit if you have to pay rent<br />

or council tax. You do not have to be claim<strong>in</strong>g<br />

Income Support or Jobseekers Allowance. You<br />

can claim if you or your partner is <strong>in</strong> full-time or<br />

part-time work or receiv<strong>in</strong>g benefits.<br />

benefit calculator. If your net weekly <strong>in</strong>come<br />

is less than the amount shown aga<strong>in</strong>st your<br />

circumstances you should make a claim.<br />

Exempt dwell<strong>in</strong>gs<br />

Some properties are exempt from council tax. Here<br />

is a brief description of the circumstances where an<br />

exemption may apply:<br />

• Occupied only by student(s)<br />

• Occupied only by a severely mentally ill person<br />

• Occupied only by those under 18<br />

• Unoccupied and unfurnished (for up to 6 months)<br />

• Unoccupied and owned by a charity (for up to 6<br />

months)<br />

• Unoccupied, unfurnished and need<strong>in</strong>g major<br />

structural works (for up to 12 months)<br />

• Left empty by someone <strong>in</strong> prison<br />

• Left empty by someone permanently <strong>in</strong> a care<br />

home or hospital<br />

• Left empty by someone giv<strong>in</strong>g or receiv<strong>in</strong>g personal<br />

care<br />

• Left empty by a student<br />

• Left empty hav<strong>in</strong>g been repossessed<br />

• Left empty by someone who has died (for up to 6<br />

months after probate)<br />

• Left empty because occupation is illegal<br />

• Left empty by someone who has become bankrupt<br />

• Wait<strong>in</strong>g to be occupied by a m<strong>in</strong>ister of religion<br />

• Annex occupied by an elderly or disabled relative<br />

• Unoccupied annex which is difficult to let<br />

separately.<br />

There are also other categories of exempt property<br />

which cover visit<strong>in</strong>g forces, UK armed forces,<br />

diplomats, and unoccupied caravan pitches and<br />

houseboat moor<strong>in</strong>gs.<br />

Discounts<br />

A 25% discount is available where only one adult<br />

lives <strong>in</strong> a property, and also where the second or<br />

all other occupiers fall <strong>in</strong>to one or other of these<br />

categories:<br />

• Full time student, student nurse, apprentice or<br />

Youth Tra<strong>in</strong><strong>in</strong>g Scheme tra<strong>in</strong>ee<br />

• Permanent hospital resident<br />

• Permanent care home resident<br />

• Person who is severely mentally ill<br />

• Person <strong>in</strong> prison (but not if the offence was for nonpayment<br />

of council tax or a f<strong>in</strong>e)<br />

• Care worker work<strong>in</strong>g for low pay (usually for<br />

charities)<br />

• 18 or 19 year old who has just left school<br />

• Members of religious communities<br />

• Those car<strong>in</strong>g for a disabled person who is not their<br />

partner or child under 18<br />

• Those stay<strong>in</strong>g <strong>in</strong> certa<strong>in</strong> hostels or night shelters<br />

• Diplomats, members of certa<strong>in</strong> <strong>in</strong>ternational<br />

organisations and their spouses, and members of<br />

visit<strong>in</strong>g forces.<br />

A 10% discount is available for second homes. Where<br />

a property is made available to the public for short<br />

term holiday lett<strong>in</strong>g <strong>in</strong> the course of a bus<strong>in</strong>ess, then<br />

council tax does not apply, but the owner will have<br />

to pay bus<strong>in</strong>ess rates <strong>in</strong>stead.<br />

A 50% discount will apply to an unoccupied<br />

and unfurnished property where the appropriate<br />

exemption class has expired.<br />

Disabled relief<br />

If anyone <strong>in</strong> your household needs any of the<br />

follow<strong>in</strong>g <strong>in</strong> order to receive care or treatment aris<strong>in</strong>g<br />

from a substantial and permanent disability, you may<br />

be entitled to a reduction off your council tax:<br />

• A devoted room used ma<strong>in</strong>ly for the care or<br />

treatment<br />

• An extra bathroom or kitchen<br />

• Extra space for a wheelchair which is needed<br />

<strong>in</strong>doors.<br />

Appeals<br />

Appeals concern<strong>in</strong>g your council tax band should<br />

be made to the List<strong>in</strong>g Officer, Rufus House, Castle<br />

Street, Carlisle, CA3 8TJ.<br />

You may also appeal to us us<strong>in</strong>g one of the methods<br />

shown on your bill if you th<strong>in</strong>k you are not the person<br />

who has to pay, or you th<strong>in</strong>k your property is exempt,<br />

or you th<strong>in</strong>k we have calculated your bill wrongly.<br />

Mak<strong>in</strong>g an appeal does not allow you to withhold<br />

payment <strong>in</strong> the meantime. If your appeal is<br />

successful you will be entitled to a refund of any<br />

overpaid tax. For further details of the appeal<br />

So why has my council tax gone up<br />

The Government has cut the grant that it gives to the <strong>Council</strong>. In <strong>2012</strong>-<strong>13</strong> the grant has been reduced<br />

by 11.6%; <strong>in</strong> 20<strong>13</strong>-14 it is estimated that it will reduce by a further 3.4% and <strong>in</strong> 2014-15 by another<br />

2.9%. This means the <strong>Council</strong> must, over the next three years, f<strong>in</strong>d sav<strong>in</strong>gs of £3.5 million.<br />

To f<strong>in</strong>d these sav<strong>in</strong>gs, the <strong>Council</strong> now has a ‘Reduc<strong>in</strong>g Spend’ programme, which focuses on build<strong>in</strong>g<br />

ma<strong>in</strong>tenance and operational costs, management structures, adm<strong>in</strong>istration review, efficiencies,<br />

re-negotiat<strong>in</strong>g contracts, <strong>in</strong>come generation and service reductions. The <strong>Council</strong> recognises that while<br />

try<strong>in</strong>g to ma<strong>in</strong>ta<strong>in</strong> and improve the services which the public want, reductions <strong>in</strong> its services are<br />

unavoidable.<br />

For <strong>2012</strong>-<strong>13</strong>, sav<strong>in</strong>gs of nearly £1.5 million have been identified. Details of the sav<strong>in</strong>gs are available<br />

at www.allerdale.gov.uk<br />

However, despite f<strong>in</strong>d<strong>in</strong>g these sav<strong>in</strong>gs and cont<strong>in</strong>u<strong>in</strong>g to work to f<strong>in</strong>d another £2 million of sav<strong>in</strong>gs,<br />

the <strong>Council</strong> has had to <strong>in</strong>crease council tax. <strong>Allerdale</strong> <strong>Borough</strong> <strong>Council</strong>’s share of the council tax<br />

has gone up by 2.9%, or an average of 8p per week for a band D house. Although Cumbria County<br />

<strong>Council</strong> has frozen its share of the council tax, the Police has <strong>in</strong>creased its portion of the council tax<br />

Increases <strong>in</strong> expenditure have been strictly limited to those to which the <strong>Council</strong> is contractually<br />

committed. There are ‘one-off’ <strong>in</strong>creases to cover reductions <strong>in</strong> <strong>in</strong>come, such as a reduction <strong>in</strong> rental<br />

<strong>in</strong>come from Work<strong>in</strong>gton town centre properties and a reduction <strong>in</strong> <strong>in</strong>come from the Benefits<br />

Adm<strong>in</strong>istration Grant.<br />

The <strong>Council</strong> could have chosen to freeze the council tax <strong>in</strong> <strong>2012</strong>-<strong>13</strong> and received a government grant<br />

of 2.5%. However, this would have meant a larger council tax <strong>in</strong>crease <strong>in</strong> 20<strong>13</strong>-14 or deeper cuts<br />

hav<strong>in</strong>g to be made <strong>in</strong> order to balance the budget (or both), as the grant is unlikely to be available<br />

aga<strong>in</strong> and its removal will leave a shortfall of fund<strong>in</strong>g <strong>in</strong> every year after <strong>2012</strong>-<strong>13</strong>. If the <strong>Council</strong><br />

accepted the grant, <strong>in</strong> order to stand still f<strong>in</strong>ancially the <strong>Council</strong> would have to <strong>in</strong>crease the council<br />

tax <strong>in</strong> 20<strong>13</strong>-14 and to meet its contractual commitments the council tax for 20<strong>13</strong>-14 would have to<br />

be doubled.<br />

Police and Crime Commissioners:<br />

Accountable for Cumbria from November<br />

Police and Crime Commissioners will be powerful new <strong>in</strong>dividuals who will hold the police<br />

force and the Chief Constable to account. They will decide how the polic<strong>in</strong>g part of the council<br />

tax is allocated and will consult the public and victims of crime on issues of community safety.<br />

They will also monitor how the police deal with public compla<strong>in</strong>ts and if you do not th<strong>in</strong>k they<br />

are listen<strong>in</strong>g to public concerns, you can vote them out and elect somebody who will.<br />

Who can stand for election as Police and Crime Commissioner<br />

for Cumbria<br />

These are important roles which it is hoped will attract high calibre candidates with a public<br />

service ethos. You do not need to be a politician to stand for election – anyone can stand as<br />

long as they are: 18 or over; British, Commonwealth or European Union citizens; and resident<br />

<strong>in</strong> Cumbria. Public servants, such as civil servants and police officers, cannot stand, neither can<br />

those convicted of an imprisonable offence. In<strong>format</strong>ion for anyone <strong>in</strong>terested <strong>in</strong> stand<strong>in</strong>g as a<br />

Police authorities will be replaced by Police and Crime Commissioners <strong>in</strong> November. You will be<br />
