Legal Counsel<br />
The legal counsel provides legal advice to the acquisition team and reviews acquisition<br />
documents for legal sufficiency.<br />
<strong>COR</strong><br />
The <strong>COR</strong> is nominated by the requiring activity and is designated, in writing, by the<br />
Contracting Officer. The <strong>COR</strong> appointment shall be acknowledged by both the <strong>COR</strong> and<br />
<strong>COR</strong> management. The Contracting Officer shall provide the contractor notification of<br />
<strong>COR</strong> assignment. The <strong>COR</strong>, who will have technical expertise related to the<br />
requirement, shall monitor the technical or performance aspects of the contract and<br />
perform other duties specified by the appointment/designation letter. Ideally, the <strong>COR</strong><br />
participates in pre-award activities (such as defining the requirement) so he or she is<br />
familiar with all aspects of the contract. The <strong>COR</strong> acts as the eyes and ears of the<br />
Contracting Officer. Appendix C provides additional information on <strong>COR</strong> qualifications<br />
and training.<br />
Quality Assurance Representative<br />
If a Quality Assurance Representative (QAR) from DCMA is assigned, the <strong>COR</strong> may<br />
work closely with the QAR. The QAR ensures the contractor is in compliance with<br />
contractual requirements, evaluates and documents contractor performance, follows up<br />
with the contractor on documented deficiencies, and provides input for the Performance<br />
Evaluation Board through the ACO.<br />
Contractor<br />
Once the contract is awarded, the contractor becomes a member of the Acquisition Team.<br />
FAR 46.105, “Contractor Responsibilities”, directs that the contractor be responsible,<br />
under the contract, for the following:<br />
• Controlling the quality of supplies or services;<br />
• Tendering to the Government for acceptance only those supplies or services that<br />
conform to contract requirements;<br />
• Maintaining evidence that the supplies or services conform to required quality<br />
requirements, are within the expected cost, and are delivered on time; and,<br />
• Furnishing such information to the Government.<br />
