GENERAL ORDER REGARDING<br />

DISCOVERY MOTIONS IN ALL<br />

CIVIL CASES BEFORE KELLY H.<br />

JUDGE<br />

ORDER <br />

In an effort to avoid potenti<strong>all</strong>y unnecessary <strong>discovery</strong> disputes, parties <strong>in</strong> <strong>all</strong> <strong>cases</strong> assigned<br />

or referred to the Honorable Kelly H. Rank<strong>in</strong> sh<strong>all</strong> follow the follow<strong>in</strong>g procedure prior to<br />

submitt<strong>in</strong>g any written motion for <strong>discovery</strong>.<br />

First, most <strong>discovery</strong> disputes, especi<strong>all</strong>y those deal<strong>in</strong>g with (1) schedul<strong>in</strong>g or calendar<strong>in</strong>g<br />

issues; (2) the number, length, or form oforal or written questions; (3) the responsiveness ofanswers<br />

to oral or written questions; and (4) the mechanics of document production, <strong>in</strong>clud<strong>in</strong>g protective<br />

<strong>order</strong>s and the proper method ofrais<strong>in</strong>g claims ofprivilege, should be resolved by counsel without<br />

court <strong>in</strong>tervention. Therefore, parties are to strictly comply with Local Rule 7. 1 (b)(1)(A) and sh<strong>all</strong><br />

confer or<strong>all</strong>y <strong>in</strong> person or by telephone <strong>regard<strong>in</strong>g</strong> any <strong>discovery</strong> dispute. In the event that the parties<br />

cannot settle the <strong>discovery</strong> dispute on their own, then counsel sh<strong>all</strong> jo<strong>in</strong>tly contact chambers for<br />

approval prior to fil<strong>in</strong>g any written <strong>discovery</strong> motion. The Court will attempt to resolve as many<br />

disputes as possible <strong>in</strong> this <strong>in</strong>formal manner. If the Court determ<strong>in</strong>es that the issue requires the<br />

formal fil<strong>in</strong>g ofa motion and brief<strong>in</strong>g, the Court will permit the parties to file a written motion. No


written motions on <strong>discovery</strong> disputes will be considered unless this process is followed.<br />
