Open Tender Notice to provide Security<br />
Open sealed tenders are invited on the prescribed form by Addl. Registrar, <strong>Railway</strong><br />
Claims Tribunal, Ghaziabad Bench at Lohia Nagar, Ghaziabad 201001 on behalf of the<br />
President of India. Tender forms will be sold between 10.30 to 15.00 hours on each<br />
working day, up to 08.08.2011. Tender Forms duly filled in can be dropped in Tender<br />
Box up to 13.00 hours on 09.08.2011 and will be opened same day at 15.00 hours, for<br />
the under noted works.<br />
Description: - To provide security to the office premises of <strong>Railway</strong> Claims Tribunal<br />
Ghaziabad Bench at Lohia Nagar Ghaziabad. Approximate value Rs.8,40,000/- Earnest<br />
money Rs.42,000/- and period of contract will be 02 (two) years. Earnest money may<br />
be deposited in favour of FA&CAO, <strong>Northern</strong> <strong>Railway</strong>. Tender form along with conditions<br />
can be had from the office of Addl. Registrar, <strong>Railway</strong> Claims Tribunal, Lohia Nagar,<br />
Ghaziabad, between 10.30 hours to 15.00 hours up to 08.8.2011, personally on cash<br />
payment of Rs.1000/- and by post on payment through Demand Draft of Rs.1100/- in<br />
favour of FA&CAO, <strong>Northern</strong> <strong>Railway</strong>. Tenders accompanied without Earnest Money will<br />
be summarily rejected. In case, if for any reason, the office is closed on the specified<br />
date, the tenders will be opened at the same time on the next working day. The validity<br />
of offer shall be for 90 days.<br />
The notice inviting tender and the tender form along with conditions can also be<br />
downloaded from the website: www.nr.indianrail.gov.in However, such firms who submit<br />
tender on downloading the form from the website, will have to submit a Demand Draft<br />
for Rs.1000/- (Rupees One thousand only) towards the cost of tender documents, in<br />
favour of FA&CAO, <strong>Northern</strong> <strong>Railway</strong>, along with the offer, failing which their tender will<br />
be summarily rejected.<br />

agree to keep this offer open for acceptance for a period of 90 days from the date<br />
fixed for the opening of the same and in default thereof, I/We will be liable for<br />
forfeiture of my/our security deposit. I/We agree to extend the validity of offer for<br />
another 60 days after expiry of said period, if specifically called upon to do so in<br />
writing.<br />

“SPECIAL CONDITIONS TO TENDERER”<br />
1. Sealed tenders in the enclosed form addressed to the Addl. Registrar,<br />
<strong>Railway</strong> Claims Tribunal, Lohia Nagar Ghaziabad are invited that may<br />
be sent in a cover marked "Tender form providing security to the premises of<br />
<strong>Railway</strong> Claims Tribunal Lohia Nagar Ghaziabad Bench at Ghaziabad.” The tender<br />
documents have to be dropped in the tender box kept in the office. of Addl.<br />
Registrar, <strong>Railway</strong> Claims Tribunal, Ghaziabad up to 13.00 hr. on 09.8.2011 . The<br />
tender box will be opened at 15.00 hours on the same day in the presence of such<br />
tenderers who may wish to be present. The period of the contract will be two years.<br />
2. Tender received after the date &- time specified above shall not be accepted.<br />
3. The acceptance or rejection of any tender is left entirely to the discretion of the<br />
authority empowered to deal with the matter and no explanation can be demanded<br />
of the cause of rejection of his tender by any tenderer.<br />
4. The tenderers are required to deposit in favour of FA & CAO, <strong>Northern</strong> <strong>Railway</strong> a<br />
sum of Rs.42,000/- as Earnest Money Deposit along with the tender. The Earnest<br />
money should be deposited by way of demand draft or pay order issued by a<br />
Scheduled Bank preferably Nationalized Bank, in favour of FA & CAO, <strong>Northern</strong><br />
<strong>Railway</strong>, only be accepted. The tender form without earnest money deposit will not<br />
be considered and will be summarily rejected. The Earnest Money will be refunded<br />
without interest to all unsuccessful tenderers. There will be no liability of the<br />
<strong>Railway</strong> Claims Tribunal in case of delay in the refund of Earnest money to the<br />
unsuccessful tenderers.<br />
5. The rates are to be filled in legibly in ink, in figures as well as words.<br />
Tender form containing erasures or alteration or overwriting may be<br />
declared invalid. In case specific amount has not been mentioned by the<br />
tenderers, the tenders will be liable to be rejected out rightly. The rates in<br />
words will be treated as final.<br />
6. The latest Income Tax Clearance Certificate must also accompany the tender form.'<br />
The RCT reserves the right to reject the application not accompanied with latest<br />
Income Tax Clearance Certificate.<br />
7. Documentary proof, where possible in support of all information should<br />
be enclosed with tender form. The RCT reserves the right to reject the application<br />
unaccompanied with relevant documents.<br />
8. If the tenderer is a partnership firm or Ltd. Company or a Hindu undivided family, a<br />
copy of the relevant deed/documents should be attached with the tender along with<br />
the letter of authority as to who would act on behalf of the firm, partnership/family.<br />
9. The successful tenderer will have to execute an agreement (draft copy attached)<br />
within ten days after the issue of acceptance letter to the tenderer by the RCT.<br />
10. The cost of the stamp duty for the execution of the agreement will be borne by the<br />
contractor.<br />
11. The duration of the contract will be two years from the date of commencement of the<br />

contract.<br />
12. If any accommodation is provided to the successful tenderer, they will be required to<br />
pay rent as may be fixed from time to time by the RCT whose decision shall be final<br />
and binding.<br />
13. RCT reserves the right to hold negotiation with the tenderer as per rule applicable<br />
on the subject.<br />
14. Addendum or corrigendum to the agreement may however be issued as and<br />
when necessary.<br />
15. The tenderers shall hold the offer open for a period of 90 days from the date of<br />
opening of tenders and will extend the same for another 60 days in case specifically<br />
called upon to do so, in writing.<br />
16. The Earnest money shall be forfeited:-<br />
a) If the selected tenderer fails to commence work within ten days after<br />
execution of agreement contract.<br />
b) If the selected tenderer does not execute the contract documents within ten days<br />
after the receipt of the acceptance letter.<br />
17. The RCT reserves the right to call for any document in original.<br />
18. The price variation as regards value of the Contract Act will be allowed as and when<br />
the rates are revised under Provision of minimum Wages Act after the award of<br />
contract. The rates under this clause will be revised on receipt of written request of<br />
the contractor supported by documentary evidence as regard to revision of<br />
salaries/wages under the provision of minimum wages act. The revision will<br />
however, be effected in case of minimum wages only.<br />
19. The tenderers will provide two security guards, one at each session as per<br />
following duty hours.<br />

The above timings can be modified by Rly Claims Tribunal authority any time.<br />
20. The functions and duties of contractor are outlined below:-<br />
a) To provide security to the office premises of <strong>Railway</strong> Claims Tribunal Ghaziabad<br />
Bench, Ghaziabad<br />
b) To prevent entry of unauthorized persons to the premises.<br />

c) To remove the unauthorized persons from the said premises as and when<br />
instructed by the Rly Claims Tribunal Authority.<br />
d) To perform general watch & ward duties including prevention of all other<br />
unauthorized and illegal activities and unhealthy practice in<br />
the above said premises so as to maintain healthy, peaceful and<br />
congenial atmosphere etc.<br />
e) To prevent commissioning of thefts, hooliganism and rowdyism<br />
within the premises by taking suitable steps according to process of<br />
law, to do necessary coordination with the auxiliary authorities of<br />
state Govt. from time to time. The tenderers and his agents or<br />
employees shall also perform such connected duties as entrusted to<br />
them by the Rly Claims Tribunal authority as and when warranted<br />
without any extra charges. The manner in which the duties will be<br />
performed, duly registered and details of the staff<br />
deployed in each shift and other working instructions as framed by<br />
the <strong>Railway</strong> Claims Tribunal from time to time will be binding on<br />
the contractor. This will be deemed to form part of agreement.<br />
21. The RCT shall pay to the contractor the agreed amount on satisfactory performance<br />
of the above duties. The payment will be made on monthly basis by cheque on<br />
production of certificate from the nominated authority of Rly Claims Tribunal<br />
regarding satisfactory functioning of the work.<br />
22. The tenderer shall at all times, abide by the instructions given to them or to their<br />
agents and employees from time to time by the officers and subordinates of RCT<br />
deputed for this purpose and to supervise the work.<br />
23. The RCT. shall be at liberty to terminate this contract at any time before the expiry<br />
thereof on giving three months notice in writing without assigning any reason 'and<br />
without being liable to pay any compensation for such termination. It shall further be<br />
lawful for the RCT at any time to terminate the agreement without notice and without<br />
being liable to pay compensation whatsoever in the event of breach or violation of<br />
any of terms and conditions herein, contained or any order given to him, or his<br />
servants and employees.<br />
24. The Tenderer or his staff shall not take any intoxicant while on duty.<br />
25. The tenderer shall pay to staff engaged in/with this work not less than fair wages,<br />
being the minimum wages notified from time to time or where not notified, wages<br />
paid for similar work in the neighborhood. The wages paid shall not be less than<br />
prescribed by the law enacted by the Govt. of India or by the State Govt. concerned<br />
in so far as it may be applicable to such staff engaged on such work on the Rlys.<br />
The tenderer shall maintain proper record of payments and submit to the RCT<br />
certificate each month to the effect that he has paid wages in accordance with<br />
prescribed wages.<br />
26. In the case of expiry of contract period, it will be obligatory for the tenderer to<br />
continue working on accepted rates terms & conditions for a period of three months,<br />

27. The tenderer or his agent shall not without prior permission of Rly. Claims Tribunal<br />
in writing absent himself from the work of which he is employee, and shall at all time<br />
provide on duty the number of persons specified in the instructions.<br />
28. During the currency of the contract, all claims by the tenderer against RCT must be<br />
preferred within ten days from the date of transaction.<br />
29. The tenderer shall not sublet or assign this work or any part thereof to any persons,<br />
whatsoever. In the event of tenderer fails to comply the above instructions, the<br />
RCT. shall be entitled forthwith to terminate the contract without notice and tenderer<br />
shall have no claim whatsoever in consequence of such termination of the contract.<br />
As to whether or not the said instructions have been infringed, the decision of RCT<br />
shall be final, conclusive and binding.<br />
30. In the event of any dispute or difference of opinion arising between RCT. and the<br />
tenderer as to the respective rights and obligations of the parties or as to the true<br />
intent and meanings of these presents or any articles or conditions thereof, such<br />
dispute or differences of opinion shall be referred to the sole arbitration of one<br />
arbitrator who shall be nominated for the purpose by Hon'ble Member, RCT,<br />
Ghaziabad for the time being whose decisions shall be final conclusive and binding<br />
on the 'parties, under the provisions of the Indian Arbitration Act and rules in force.<br />
31. In the event of the tenderer failing to comply with or committing any breach of any<br />
instructions(terms):-<br />
a. The RCT shall have the right to terminate the contract.<br />
b. To impose a penalty not exceeding a sum of Rs.500/- in respect of each case of<br />
substandard work noted by <strong>Railway</strong> Administration or breach of<br />
instructions/terms mentioned above for which decision of Additional Registrar,<br />
RCT, GZB will be final and binding. In case of loss to the RCT the full amount of<br />
loss will be recovered and the RCT decision as to the extent of the loss shall be<br />
binding and final.<br />
c. To terminate the agreement as well as forfeit the security deposit, if any when<br />
the whole or a part of said security deposit has been forfeited but the agreement<br />
has not been determined the tenderer shall be required to pay to RCT the<br />
amount to be allowed to carry on his work.<br />
32. After the award of the contract the contractor shall deposit security money i.e. 10%<br />
of the contract value in the form of FDR of a reputed/scheduled bank in favour of FA<br />
& CAO, <strong>Northern</strong> <strong>Railway</strong>.<br />
33. The Income Tax at source as applicable will be deducted by this office.<br />
34. Payment of Service Tax will be responsibility of the tenderer.<br />
35. TAN Number and Service Tax Number are also to be provided by the tenderer.<br />

CONTRACT AGREEMENT TO BE EXECUTED BY THE SECURITY CONTRACTOR AT<br />
<strong>RAILWAY</strong> <strong>CLAIMS</strong> <strong>TRIBUNAL</strong>, LOHIANAGAR, <strong>GHAZIABAD</strong>.<br />
1. An agreement made this….day of ….2011 between the President of India acting through the<br />
Additional Registrar <strong>Railway</strong> Claims Tribunal, Lohia Nagar, Ghaziabad hereinafter called<br />
“Tribunal” which expression shall where the contract so admits include his successors and<br />
assigns of the one part and M/S….…. with their office at …………………..hereinafter called the<br />
“Contractor” of the other part relating to provide security at <strong>Railway</strong> Claims Tribunal Office at<br />
Lohia Nagar, Ghaziabad.<br />
2. Whereas the contractor has deposited Rs…(….) by means of FDR No……Dated…… the<br />
same to be held by the Tribunal as security deposit for the performance of the contractor the<br />
said amount will be subject to the terms and condition of the contract. No interest shall however<br />
be paid on the security deposit.<br />
3. The contract shall be effective from …..to…… on each and every day including Sundays and<br />
all public holidays the duration of the contract may however at the sole discretion of the Tribunal<br />
be extended for a further period of one year or for such periods as may be decided by the<br />
<strong>Railway</strong> Administration.<br />
4. The function and duties in terms of the contract are outlined below:-<br />
(a) To guard <strong>Railway</strong> Claims Tribunal office and its entire office complex round the clock<br />
(b) To prevent entry of unauthorized person from the premises of Tribunal as and when<br />
instructed by the <strong>Railway</strong> Claims Tribunal Authority.<br />
(d) To perform general watch and ward duties including prevention of all other unauthorized and<br />
illegal acts/activities, observe and unhealthy practice in the Tribunal office so as to maintain<br />
healthy peaceful and congenial atmosphere.<br />

(e) To prevent commission of thefts and damage to Tribunal property hooliganism and<br />
rowdyism within the premises by taking suitable steps according to due process of Law. To do<br />
necessary coordination with the security authorities of State Govt. from time to time. The<br />
contractor and his agents or employees shall also perform such connected duties as may be<br />
entrusted to them by the Tribunal Authority as and when warranted by the circumstances<br />
without any extra charges. The manner in which the duties will be performed duly roastered and<br />
details of the security supervisor deployed in each shift and other working instruction as framed<br />
by the Tribunal from time to time will be binding on the contractor. This will be deemed to form<br />
part of agreement<br />
(f) The price variation will be allowed to the contractor in case of any revision of minimum<br />
wages under the provision of Minimum Wages Act after the award of the contract escalation in<br />
the rates under the provision of Minimum Wages Act will be allowed on the written request of<br />
the contractor duly supported by the notification under the Act issued by the Competent<br />
Authority in case of wages of three security guards only if covered under the said Act and not of<br />
the wages of the supervisory staff and service charges. The revision will however be allowed in<br />
respect of other charges like relieving charges and service charges etc.<br />
(g) The contractor will provide security guards and one security supervisor as per following<br />
details.<br />

5. The Tribunal shall pay the contractor a monthly sum of Rs……(………) for satisfactory<br />
performance of the above duties. The payment will be made after the close of each month on<br />
production of a certificate from the Office Superintendent (Adm) regarding the satisfactory<br />
functioning of the contractor. The contractor shall maintain proper record of payment and submit<br />
to the administration the certificate every month to the effect that he has paid wages in<br />
accordance with the provisions of the Minimum Wages Act along with the other benefits viz. PF,<br />
ESI, Bonus, etc which are admissible under the said Act.<br />

6. The contractor will at all time abide by the instructions given to them or to their agents and<br />
employees from time to time by the officers and subordinates of the Tribunal deputed for this<br />
purpose and to supervise their work.<br />
7. The contractor shall be at liberty to terminate this agreement without assigning any reason<br />
on giving three months notice in writing to the Tribunal of his/her intention to do so. In the event<br />
of contractor leaving without giving three months notice his security deposit will be forfeited and<br />
the security arrangement will be made at the risk and cost of the contractor<br />
8. The Tribunal shall be at liberty to terminate this agreement at any time before the expiry<br />
thereof on giving 3 months prior notice in writing without assigning any reason and without being<br />
liable to pay any compensation for such termination. It shall be lawful for the Tribunal at any<br />
time to determine the contract without notice & without being liable to pay compensation<br />
whatsoever in the event of breach or violation of any of the terms & conditions contained herein<br />
or any, order on him or his servant & employees.<br />
9. The contractor shall not employ any person of bad antecedents and shall arrange to have the<br />
antecedents of each individual employee checked by him and duly verified by the police at his<br />
own expense. The police verification roll of good character will be deposited with the Tribunal.<br />
The guard should possess identification card and medical fitness certificates obtained from the<br />
<strong>Railway</strong> Doctor. The contractor will employ 60% of the guard from ex., Service man. The<br />
supervisor must necessarily be an ex. Serviceman.<br />
10. They will not the considered as <strong>Railway</strong> employees and will not be entitled to any rights and<br />
privileges of <strong>Railway</strong> employees.<br />
11. In the event of the contractor failing to comply with or committing any breach of any of the<br />
terms of this agreement, the Tribunal shall have the right to terminate the contract forthwith as<br />
per clause No. 8<br />
12. The contractor shall be responsible to comply with the provisions of the Employment Act<br />
1958 or any statutory modification therein and the rules framed there under.<br />

13. The contractor shall be responsible for compliance of the provisions of the Hours of<br />
Employment Regulation in respect of the staff employed by him in the manner decided upon by<br />
the Appropriate Authorities.<br />
14. The cost of stamp of this agreement shall be born by the contractor.<br />
15. Except as otherwise provided any verbal or written agreement modifying or varying or<br />
supplementing this contract agreement or of the terms thereof shall be deemed conditional and<br />
shall not be binding on the Tribunal unless and until the same is endorsed to this agreement or<br />
is incorporated in a formal instrument and signed by the parties there to and till then the Tribunal<br />
shall have the rights to repudiate such agreement.<br />
16. In the event of any dispute or difference of opinion arising between the Tribunal and the<br />
contractor as to the respective rights and obligations of the parties hereunder or as to the true<br />
intent and meaning of these presents or any terms or condition there of, such dispute or<br />
difference of opinion shall be referred to the arbitration of a sole arbitrator who shall be<br />
nominated for the purpose by the Hon’ble Member(T), <strong>Railway</strong> Claims Tribunal, Ghaziabad and<br />
whose decisions shall be final, conclusive and binding on the parties, under the provisions of the<br />
Indian Arbitration Act and rules made there under.<br />
17. The security guard and the supervisor deputed by the contractor are the employees of the<br />
Contractor and in the case of death or injury to any security personnel arising out of and in the<br />
course of performance of the duties by the security personnel, the compensation under the<br />
Workmen’s Compensation Act 1923 (as amended from time to time) or liability arising under any<br />
law at the time being in force, shall be solely that of the contractor and Ist party (Tribunal) will<br />
have nothing to do with it.<br />
18. The contractor agrees that the conditions in this agreement are subject to alterations<br />
considered necessary by the Tribunal during the currency of the agreement.<br />
19. In case the agreement for the next term is not finalized in time, it will be obligatory for the<br />
contractor to continue working on this rate agreement and terms & conditions for a period of<br />
three months.<br />

20. The contractor shall at all times keep the Tribunal indemnified against and shall reimburse to<br />
the Tribunal all claims, demands, suits, losses, damages, costs, charges and expenses<br />
whatsoever which the Tribunal may sustain or incur in case of any injury to any person or to any<br />
property resulting directly or indirectly from any act or omission on the part of, the contractor or<br />
his agents, servants and employees in the conduct, of the business, for the purpose for which<br />
this contract is granted.<br />
21. The contractor or his agent /servant/ employees shall not without the previous permission of<br />
Tribunal in writing absent himself from the work on which he is employed and shall at all times<br />
provide on duty the number of persons specified in the instruction<br />
22. The contractor shall not sublet or assign this contract or any part thereof to any person<br />
whosoever, without prior written permission of the Tribunal. In the event of contractor infringing<br />
the provisions of these clause the Tribunal shall be entitled forthwith to terminate the contract<br />
without notice and the contractor shall have no claim whatsoever in consequence of such<br />
termination of the claim., as to whether or not the provision of the clauses have been infringed,<br />
the decision of the Tribunal shall be final, conclusive and binding.<br />
In witness thereof the said parties here to have set their hands at the places and on the dates<br />
hereafter mentioned respectively.<br />
