<strong>The</strong> Internal Revenue Service has classified<br />

<strong>The</strong> <strong>New</strong> <strong>York</strong> <strong>Community</strong> <strong>Trust</strong> as<br />

“tax exempt” under Section 501(c)(3) of<br />

the Internal Revenue Code; as a “publicly<br />

supported” organization under Section<br />

170b(1)(A)(vi); and as “not a private foundation”<br />

under Section 509(a)(1). This status<br />

ensures donors the maximum tax benefit allowed<br />

by law. <strong>The</strong> Long Island <strong>Community</strong><br />

Foundation and the Westchester <strong>Community</strong><br />

Foundation (described on page 29) are<br />

divisions of <strong>Community</strong> Funds.<br />

A FUND IN THE TRUST, A PRIVATE<br />

FOUNDATION—OR BOTH<br />

A fund in <strong>The</strong> <strong>Trust</strong> provides a very attractive<br />

alternative to establishing a private<br />

foundation. We are a public charity with<br />

the attendant tax advantages. A full-time<br />

professional staff takes care of all the<br />

administrative and grantmaking activities,<br />

eliminating the need to set up a separate<br />

institution, formulate policies, file innumerable<br />

forms, and monitor the status of grant<br />

Often, the donor uses a fund here to support<br />

causes and nonprofits that are outside<br />

the general focus of the private foundation.<br />

And almost all want to increase the impact<br />

of their philanthropy by joining other generous<br />

<strong>New</strong> <strong>York</strong>ers who care about the City.<br />

We offer substantial advantages over most<br />

commercial donor-advised funds: in-depth<br />

knowledge of the nonprofit community,<br />

the capacity to accept unusual gifts, smaller<br />

minimums, and lower fees. Because our<br />

<strong>Trust</strong>, the legal apparatus is already in place,<br />

and creating a fund can take less than a day.<br />

For some people, a private foundation is<br />

the preferred option, but many donors with<br />

private foundations also have funds with us.
