Proefboringen naar aardgas in de
Noordzeekustzone en op Ameland
Op 17 juli 1998 heeft de rechtbank te Leeuwarden
uitspraak gedaan in de bodemprocedure van de
Waddenvereniging e.a. tegen de door de Minister van
Economische Zaken verleende 5 vergunningen voor
proefboringen op de locaties Pinkegat, Plaatgat,
Ballonplaat, Huibertplaat en Ballum (Ameland), in
1994 aangevraagd door de Nederlands Aardolie
Maatschappij B.V.
De Rechtbank heeft deze besluiten in een uitvoerig
gemotiveerd vonnis vernietigd. Het vonnis geeft
evenwel ook duidelijk aan welke gebreken in de
besluitvorming hersteld moesten worden om de
procedure opnieuw ter hand te kunnen nemen.
Voor de locatie op Ameland betekent dit de noodzaak
tot het aanvullen van het milieueffectrapport op een
specifiek punt. Voor de locaties in de Noordzeekustzone
volgt uit het vonnis dat een integrale vergunningverlening
voor 4 zeelocaties tegelijkertijd niet
mogelijk is. Een vergunning voor één eerste proefboring
zou echter, onder nadere voorwaarden, wel
toegestaan kunnen worden.
Door de Minister EZ en de NAM is geen beroep
ingesteld tegen de uitspraak. Zij hebben inmiddels
stappen ondernomen om de hierboven genoemde
gebreken te herstellen zodat de vergunningen voor
Ballum en één zeelocatie opnieuw in procedure
kunnen worden gebracht. Dit betekent concreet dat, na
een advies terzake van de Commissie voor de milieueffectrapportage,
door de Minister EZ op 24 november
1998 aan de NAM is verzocht om het MER voor Ballum
aan te vullen, het gehele MER voor de Noordzeekustzone
en Ameland (uit 1995) waar nodig te actualiseren
en een geologische en ecologische voorkeurslocatie
in de Noordzeekustzone voor te stellen.
Exploration wells for gas in the North
Sea coastal zone and on the island of
Ameland
The Leewarden district court on 17 July 1998 passed
judgement in the proceeedings on the merits,
instituted by the Waddenvereniging and others
against the 5 licences awarded by the Minister of
Economic Affairs for exploration wells on locations:
Pinkegat, Plaatgat, Ballonplaat, Huibertplaat and
Ballum (Ameland), applied for in 1994 by NAM
(Nederlandse Aardolie Maatschappij B.V.).
The Court annulled these decisions in an elaborately
reasoned judgement. However, the judgement also
points out which defects in decision making have to
be rectified to re-open the procedure. For the
Ameland location, this involves adding a specific
detail to the EIA. For the locations in the North Sea
Coastal zone the judgement implies that the simultaneous
granting of full licences for all four offshore
locations will not be possible. A licence for a single,
first exploration well, however, might be awarded
subject to further conditions.
Neither the Minister of Economic Affairs nor NAM
have appealed against this judgement. By now they
have proceeded to rectify said inadequacies, enabling
the licence applications for Ballum and for a single
offshore location to be filed again. In practice, this
means that, on 24 November 1998, the Minster of
Economic Affairs, upon advice on the matter from the
EIA Commission, asked NAM to supplement the
Ballum EIA, to update the 1995 EIA for the North Sea
Coast and the island of Ameland wherever necessary
and to propose a preferred location in the North Sea
coastal zone on the basis of geological and ecological
criteria.
Proefboringen naar aardgas in de

In het voorgaande verslagjaar zijn door de bevoegde
bestuursorganen ontwerp-besluiten in de inspraakprocedure
gebracht ten aanzien van de door de NAM
voorgenomen proefboringen in de Waddenzee op de
locaties Hollum Zuid, Blija-Noord, St. Jacobiparochie-
West, Roode Hooft en Rottumeroog-I.
Met het oog op de bodemprocedure inzake de
eveneens door de NAM aangevraagde vergunningen
voor proefboringen in de Noordzeekustzone en op
Ameland (zie hierboven) is de besluitvorming rond de
Waddenzee-boringen vervolgens aangehouden,
aangezien in die gerechtelijke procedure ook

In the preceding review year, the competent authorities
have submitted for public comment, the preliminary
decisions on the proposed NAM exploration
wells in the Waddenzee at locations: Hollum Zuid,
Blija-Noord, St. Jacobiparochie-West, Roode Hooft
and Rottumeroog-I.
In view of the above-mentioned proceedings on the
merits of NAM’s licence applications for exploration
wells in the North Sea Coastal Zone and on the island
of Ameland, the decision-making process concerning
drilling in the Waddenzee has been suspended.
