Dear Mr. Gillespie,<br />

We would like <strong>to</strong> thank you for meet<strong>in</strong>g with <strong>CIDSE</strong> members and<br />

our <strong>Cambodia</strong>n partner <strong>NGO</strong> Forum <strong>on</strong> 11 July. It was a positive<br />

opportunity <strong>to</strong> exchange <strong>in</strong>formati<strong>on</strong> about the situati<strong>on</strong> <strong>in</strong> <strong>Cambodia</strong><br />

and <strong>to</strong> share with you the specific c<strong>on</strong>cerns of civil society<br />

organisati<strong>on</strong>s (CSO) relat<strong>in</strong>g <strong>to</strong> the draft <strong>NGO</strong> law.<br />

However, as you will be aware, the third draft of the law has n ow<br />

been made public and we are gravely c<strong>on</strong>cerned <strong>to</strong> see that few of<br />

the key issues raised by civil society have been addressed. We note<br />

that some positive amendments have been made relat<strong>in</strong>g <strong>to</strong> the<br />

registrati<strong>on</strong> process and that an appeals process for nati<strong>on</strong>al <strong>NGO</strong>s<br />

has been <strong>in</strong>troduced but the law still fails <strong>to</strong> c<strong>on</strong>sider the follow<strong>in</strong>g<br />

fundamental issues, namely<br />

1. Registrati<strong>on</strong> is manda<strong>to</strong>ry and complex, rather than voluntary<br />

and simple<br />

2. There is no appeal process for the denial of registrati<strong>on</strong> for<br />

<strong>in</strong>ternati<strong>on</strong>al <strong>NGO</strong>s and the process for nati<strong>on</strong>al <strong>NGO</strong>s is<br />

unclear<br />

3. There is an absence of clear criteria for refusal of registrati<strong>on</strong><br />

<strong>to</strong> both nati<strong>on</strong>al and <strong>in</strong>ternati<strong>on</strong>al <strong>NGO</strong>s<br />

Furthermore, although the Royal Government of <strong>Cambodia</strong> (RGC) has<br />

<strong>in</strong>vited CSOs <strong>to</strong> submit written comments <strong>on</strong> the new draft of the<br />

law, the time period <strong>in</strong> which <strong>to</strong> do this is extraord<strong>in</strong>arily short (<strong>on</strong>e<br />

week) and we note that the draft has already been passed <strong>on</strong> <strong>to</strong> the<br />

Council of M<strong>in</strong>isters and is likely <strong>to</strong> proceed quickly <strong>to</strong> the Nati<strong>on</strong>al<br />

Assembly. Past experience has shown that <strong>on</strong>ce legislati<strong>on</strong> reaches<br />

this stage, there is very limited opportunity for the <strong>in</strong>corporati<strong>on</strong> of<br />

further changes. In the absence of any clear timel<strong>in</strong>e, the legislati<strong>on</strong><br />

could pass at any time so there is a real need for urgent acti<strong>on</strong> <strong>from</strong><br />

the <strong>in</strong>ternati<strong>on</strong>al community.


You menti<strong>on</strong>ed that the EC Delegati<strong>on</strong> would be meet<strong>in</strong>g with the<br />

RGC <strong>to</strong> discuss the law <strong>in</strong> August. In your capacity as a key<br />

development and trade partner of <strong>Cambodia</strong>, we ask you <strong>to</strong><br />

1) Use this August meet<strong>in</strong>g <strong>to</strong> call <strong>on</strong> the RGC <strong>to</strong> prevent this law<br />

<strong>from</strong> be<strong>in</strong>g passed until the aforementi<strong>on</strong>ed c<strong>on</strong>cerns of CSOs<br />

are adequately addressed. We welcomed your commitment for<br />

the EC Delegati<strong>on</strong> <strong>to</strong> meet with <strong>Cambodia</strong>n civil society <strong>to</strong> feed<br />

back <strong>to</strong> them follow<strong>in</strong>g this August meet<strong>in</strong>g and would <strong>in</strong>vite<br />

the Delegati<strong>on</strong> <strong>to</strong> coord<strong>in</strong>ate directly with the civil society core<br />

group <strong>to</strong> arrange this.<br />

2) We also ask you <strong>to</strong> write <strong>to</strong> the Prime M<strong>in</strong>ister and Deputy<br />

Prime M<strong>in</strong>ister of <strong>Cambodia</strong> <strong>to</strong> raise these c<strong>on</strong>cerns directly, as<br />

well as the Council of M<strong>in</strong>isters and the Chairman of the<br />

Nati<strong>on</strong>al Assembly.<br />

As we expressed <strong>to</strong> you <strong>in</strong> our meet<strong>in</strong>g, if the legislati<strong>on</strong> passes <strong>in</strong><br />

its current form, it will significantly restrict the voice and space of<br />

civil society organisati<strong>on</strong>s <strong>in</strong> a country where we are already see<strong>in</strong>g<br />

an <strong>in</strong>crease <strong>in</strong> the <strong>in</strong>cidences of <strong>in</strong>timidati<strong>on</strong>, arrest and prosecuti<strong>on</strong><br />

by the RGC aga<strong>in</strong>st its critics. In the absence of any mean<strong>in</strong>gful<br />

political oppositi<strong>on</strong> <strong>in</strong> <strong>Cambodia</strong>, civil society serves as the <strong>on</strong>ly real<br />

means <strong>to</strong> hold government accountable.<br />

The w<strong>in</strong>dow of opportunity <strong>to</strong> ensure that this law strengthens<br />

rather than h<strong>in</strong>ders civil society is rapidly clos<strong>in</strong>g. We recognise that<br />

this is a politically sensitive issue but ask you <strong>to</strong> use all diplomatic<br />

channels available <strong>to</strong> you <strong>to</strong> further highlight these c<strong>on</strong>cerns as so<strong>on</strong><br />

as possible.<br />
