master Mr. Zevotek. They met with <str<strong>on</strong>g>the</str<strong>on</strong>g> Supervisor prior to this <str<strong>on</strong>g>meeting</str<strong>on</strong>g>.<br />

PUBLIC PARTICIPATION:<br />

Noting a c<strong>on</strong>cern about <str<strong>on</strong>g>the</str<strong>on</strong>g> expense <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> proposed GPS install<strong>at</strong>i<strong>on</strong>s, P<strong>at</strong> Griffin<br />

questi<strong>on</strong>ed <str<strong>on</strong>g>the</str<strong>on</strong>g> need for <str<strong>on</strong>g>the</str<strong>on</strong>g>m and asked if a problem <str<strong>on</strong>g>was</str<strong>on</strong>g> ever brought up or discussed<br />

under prior Highway Superintendents. Councilwoman Y<strong>on</strong>chuk said th<strong>at</strong> her recollecti<strong>on</strong><br />

is th<strong>at</strong> it <str<strong>on</strong>g>was</str<strong>on</strong>g> discussed in <str<strong>on</strong>g>the</str<strong>on</strong>g> past, but not specifically a GPS system. Supervisor Kniffen<br />

said th<strong>at</strong> <strong>at</strong> different times people have expressed <str<strong>on</strong>g>the</str<strong>on</strong>g>ir c<strong>on</strong>cerns and <str<strong>on</strong>g>the</str<strong>on</strong>g>y were passed <strong>on</strong><br />

to <str<strong>on</strong>g>the</str<strong>on</strong>g> highway department <strong>at</strong> th<strong>at</strong> time and it <str<strong>on</strong>g>was</str<strong>on</strong>g> up to <str<strong>on</strong>g>the</str<strong>on</strong>g>m to deal with it. P<strong>at</strong><br />

questi<strong>on</strong>ed how people th<strong>at</strong> have c<strong>on</strong>cerns know where trucks are supposed to be. She<br />

thinks this is a lot <str<strong>on</strong>g>of</str<strong>on</strong>g> m<strong>on</strong>ey and maybe <str<strong>on</strong>g>the</str<strong>on</strong>g>re is something else th<strong>at</strong> could be put in place.<br />

Marchie Diffendorf <str<strong>on</strong>g>of</str<strong>on</strong>g> 483 Gorman Road said th<strong>at</strong> he told <str<strong>on</strong>g>the</str<strong>on</strong>g> past Highway<br />

Superintendent, Richard J<strong>on</strong>es, th<strong>at</strong> he had seen <str<strong>on</strong>g>the</str<strong>on</strong>g> town vehicles in Vestal and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

sec<strong>on</strong>d time he called Mr. J<strong>on</strong>es, Mr. J<strong>on</strong>es asked where <str<strong>on</strong>g>the</str<strong>on</strong>g> employee <str<strong>on</strong>g>was</str<strong>on</strong>g> now. He feels<br />

it is an <strong>on</strong>going problem. He said th<strong>at</strong> he is <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>e th<strong>at</strong> originally brought this up to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Town</str<strong>on</strong>g> <str<strong>on</strong>g>Board</str<strong>on</strong>g>. Unfortun<strong>at</strong>ely <str<strong>on</strong>g>the</str<strong>on</strong>g>re is really no o<str<strong>on</strong>g>the</str<strong>on</strong>g>r policing going <strong>on</strong> and it has been<br />

reactive instead <str<strong>on</strong>g>of</str<strong>on</strong>g> proactive. The drivers should be prevented from going to McD<strong>on</strong>alds<br />

in Pennsylvania, Court Street and Vestal.<br />

Kurt Frisbie said th<strong>at</strong> he feels it is a lot <str<strong>on</strong>g>of</str<strong>on</strong>g> m<strong>on</strong>ey to spend <strong>on</strong> GPS units. He questi<strong>on</strong>ed<br />

if o<str<strong>on</strong>g>the</str<strong>on</strong>g>r towns are doing <str<strong>on</strong>g>the</str<strong>on</strong>g> same thing. He said it is a costly expense if it is <strong>on</strong>ly <strong>on</strong>e<br />

particular pers<strong>on</strong> with this issue. He questi<strong>on</strong>ed if <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> has looked into cell ph<strong>on</strong>es,<br />

noting th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a free app.<br />

Delbert Austin <str<strong>on</strong>g>of</str<strong>on</strong>g> 2347 Rt. 11 addressed a problem in Riverside <strong>at</strong> 2366 Rt. 11. He had<br />

an uns<strong>at</strong>isfactory <str<strong>on</strong>g>meeting</str<strong>on</strong>g> with Scott Russell in regard to his c<strong>on</strong>cern since Scott seemed<br />

to be overwhelmed with his back log <str<strong>on</strong>g>of</str<strong>on</strong>g> work, being <strong>on</strong>ly allowed to work 30 hours per<br />

week. The house <strong>at</strong> 2366 Rt. 11 flooded in 2<strong>00</strong>6 and 2011. During th<strong>at</strong> time frame it <str<strong>on</strong>g>was</str<strong>on</strong>g><br />

questi<strong>on</strong>able whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> house should have been occupied, but it <str<strong>on</strong>g>was</str<strong>on</strong>g>. The house has<br />

now not been occupied for over a year. According to Mr. Russell <str<strong>on</strong>g>the</str<strong>on</strong>g> owner <str<strong>on</strong>g>was</str<strong>on</strong>g><br />

c<strong>on</strong>tacted back in November <strong>at</strong> which time <str<strong>on</strong>g>the</str<strong>on</strong>g> owner told him <str<strong>on</strong>g>the</str<strong>on</strong>g>y are looking to have a<br />

structural engineer determine whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r it should be demolished or rebuilt. He said<br />

according to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g>’s own regul<strong>at</strong>i<strong>on</strong>s, <str<strong>on</strong>g>the</str<strong>on</strong>g>y have a time frame to work this out and in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> building and safety repair removal secti<strong>on</strong>s, every article rel<strong>at</strong>es to this building:<br />

grass <str<strong>on</strong>g>of</str<strong>on</strong>g> 4 feet high, broken windows, access to <str<strong>on</strong>g>the</str<strong>on</strong>g> railroad (vagrant issue), fire hazards<br />

(<str<strong>on</strong>g>the</str<strong>on</strong>g>y can’t even get to <str<strong>on</strong>g>the</str<strong>on</strong>g> fr<strong>on</strong>t door in case <str<strong>on</strong>g>of</str<strong>on</strong>g> a fire), closeness to neighbors. From <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Pennsylvania St<strong>at</strong>e Line to <str<strong>on</strong>g>the</str<strong>on</strong>g> cemetery <str<strong>on</strong>g>the</str<strong>on</strong>g>re are over 18 houses th<strong>at</strong> have sustained<br />

flood damage in both 2<strong>00</strong>6 and 2011 and all <str<strong>on</strong>g>of</str<strong>on</strong>g> those houses, with <str<strong>on</strong>g>the</str<strong>on</strong>g> excepti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> two,<br />

are rebuilt, maintained and up to code. His questi<strong>on</strong> is why this is not being followed<br />

through with by <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g>. He submitted pictures <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> neighborhood to show <str<strong>on</strong>g>the</str<strong>on</strong>g> pride<br />

his neighbors take in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir property. It is a privilege for him to live in <str<strong>on</strong>g>Kirkwood</str<strong>on</strong>g>, New<br />

York and he feels th<strong>at</strong> a gre<strong>at</strong> job is being d<strong>on</strong>e but some<strong>on</strong>e is dropping <str<strong>on</strong>g>the</str<strong>on</strong>g> ball <strong>on</strong> this<br />

particular code viol<strong>at</strong>i<strong>on</strong>. He would like an answer <strong>on</strong> how 2366 Rt. 11 is going to be<br />

dealt with. He added th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a picture <str<strong>on</strong>g>of</str<strong>on</strong>g> a house th<strong>at</strong> has not been occupied since<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> flood damage <str<strong>on</strong>g>of</str<strong>on</strong>g> 2<strong>00</strong>6 but <str<strong>on</strong>g>the</str<strong>on</strong>g> people come from three hours away to maintain <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

house and see th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> lawn is mowed.<br />

In regard to <str<strong>on</strong>g>the</str<strong>on</strong>g> st<strong>at</strong>ement <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> 30 hours for <str<strong>on</strong>g>the</str<strong>on</strong>g> Code Enforcement Officer, Supervisor<br />

Kniffen said th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> salary is kept down in an effort to meet <str<strong>on</strong>g>the</str<strong>on</strong>g> 2% tax cap law, which<br />

keeps taxes down and is a challenge with <str<strong>on</strong>g>the</str<strong>on</strong>g> sacrifice <str<strong>on</strong>g>of</str<strong>on</strong>g> services involved. Some <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r sacrifices are th<strong>at</strong> brush pickup has been elimin<strong>at</strong>ed and <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no l<strong>on</strong>ger a full<br />

time engineer. He said th<strong>at</strong> Mr. Austin brought this up a year ago and it <str<strong>on</strong>g>was</str<strong>on</strong>g> addressed<br />

<strong>at</strong> th<strong>at</strong> time and <str<strong>on</strong>g>the</str<strong>on</strong>g> lawn <str<strong>on</strong>g>was</str<strong>on</strong>g> mowed. Now nothing has been d<strong>on</strong>e. It cannot be<br />

occupied without an engineering study which costs a lot <str<strong>on</strong>g>of</str<strong>on</strong>g> m<strong>on</strong>ey. The people th<strong>at</strong> own<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> property live out <str<strong>on</strong>g>of</str<strong>on</strong>g> st<strong>at</strong>e but <str<strong>on</strong>g>the</str<strong>on</strong>g>y will be coming in this weekend to clean up. In<br />

comparis<strong>on</strong>, Mr. Austin said th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r property two doors up th<strong>at</strong> is not occupied is<br />

owned by some<strong>on</strong>e from Rochester and it looks good. He added th<strong>at</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> law<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>re are regul<strong>at</strong>i<strong>on</strong>s th<strong>at</strong> allow acti<strong>on</strong> to be taken for n<strong>on</strong>-compliance in a timely manner<br />

and he wants something to be d<strong>on</strong>e.<br />

Supervisor Kniffen said th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y can be taken to local court and fined but it is difficult<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g>re are costs to all <str<strong>on</strong>g>the</str<strong>on</strong>g> taxpayers to take specific acti<strong>on</strong> against some<strong>on</strong>e. Mr.<br />

Austin said th<strong>at</strong> within 2<strong>00</strong> feet <str<strong>on</strong>g>of</str<strong>on</strong>g> th<strong>at</strong> house <str<strong>on</strong>g>the</str<strong>on</strong>g>re are seven children between <str<strong>on</strong>g>the</str<strong>on</strong>g> ages <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

2 and 16 and he is c<strong>on</strong>cerned with <str<strong>on</strong>g>the</str<strong>on</strong>g> children getting hurt <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> property, r<strong>at</strong> infest<strong>at</strong>i<strong>on</strong><br />

and fire and who would be resp<strong>on</strong>sible, <str<strong>on</strong>g>the</str<strong>on</strong>g> property owner or <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g>. Supervisor<br />

Kniffen said th<strong>at</strong> when <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a known danger th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> is trying to rectify, it is <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

parent’s oblig<strong>at</strong>i<strong>on</strong> to keep <str<strong>on</strong>g>the</str<strong>on</strong>g>m away from <str<strong>on</strong>g>the</str<strong>on</strong>g> property. Mr. Austin questi<strong>on</strong>ed why <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Town</str<strong>on</strong>g> would have <str<strong>on</strong>g>the</str<strong>on</strong>g> code if <str<strong>on</strong>g>the</str<strong>on</strong>g>y can’t deal with it and he and his neighbors are not<br />

happy with this situ<strong>at</strong>i<strong>on</strong>.<br />

Audrey Glover <str<strong>on</strong>g>of</str<strong>on</strong>g> 116 Main Street said th<strong>at</strong> she feels $5,<strong>00</strong>0 is a lot <str<strong>on</strong>g>of</str<strong>on</strong>g> m<strong>on</strong>ey for a GPS<br />

and if <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a problem it should be solved. She said th<strong>at</strong> Mr. Coolbaugh said he has<br />

had no complaints for <str<strong>on</strong>g>the</str<strong>on</strong>g> last two years and Mr. Kniffen has not st<strong>at</strong>ed he received any<br />

calls. She said Mr. Diffendorf said his c<strong>on</strong>cern rel<strong>at</strong>ed to a previous Highway<br />

Superintendent. There is no m<strong>on</strong>ey for tires and asked when <str<strong>on</strong>g>was</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> last time <str<strong>on</strong>g>the</str<strong>on</strong>g>re <str<strong>on</strong>g>was</str<strong>on</strong>g> a<br />

white goods pickup. If <str<strong>on</strong>g>the</str<strong>on</strong>g>re is enough m<strong>on</strong>ey for GPS units in 12 trucks <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g><br />

should be able to come up with enough m<strong>on</strong>ey to take care <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> trash in <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Kirkwood</str<strong>on</strong>g>. She said th<strong>at</strong> she agrees with Mr. Grubham th<strong>at</strong> it is necessary protecti<strong>on</strong> for<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> dog c<strong>at</strong>cher.<br />

Councilman Weingartner presented <str<strong>on</strong>g>the</str<strong>on</strong>g> dog c<strong>on</strong>trol report for May.<br />

Ray Coolbaugh reported th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Public Works <str<strong>on</strong>g>was</str<strong>on</strong>g> recently h<strong>on</strong>ored with<br />

a dinner and plaque <strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Elk’s club, organized by Joe Thomps<strong>on</strong>.<br />

He added th<strong>at</strong> it could change depending <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> bid. Discussi<strong>on</strong> as to whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r this would<br />

have to be voted <strong>on</strong> and whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r it would be a stand-al<strong>on</strong>e district and <str<strong>on</strong>g>the</str<strong>on</strong>g>n c<strong>on</strong>solid<strong>at</strong>ed<br />

or be c<strong>on</strong>solid<strong>at</strong>ed so th<strong>at</strong> all w<strong>at</strong>er users would pay per unit. Since <str<strong>on</strong>g>the</str<strong>on</strong>g>re are about 7,3<strong>00</strong><br />

units <str<strong>on</strong>g>the</str<strong>on</strong>g> cost would be about $24 per unit, <strong>on</strong>e time. Councilwoman Y<strong>on</strong>chuk said th<strong>at</strong><br />

since this is a rough estim<strong>at</strong>e this should be c<strong>on</strong>sidered <strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> next <str<strong>on</strong>g>meeting</str<strong>on</strong>g>. Ray said th<strong>at</strong><br />

this includes design cost. Mr. Blaise said th<strong>at</strong> if a new district is formed <str<strong>on</strong>g>the</str<strong>on</strong>g> people<br />

forming <str<strong>on</strong>g>the</str<strong>on</strong>g> district can petiti<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> but under Article 12A <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> can do this <strong>on</strong><br />

its own. Various details will be researched and reviewed for additi<strong>on</strong>al discussi<strong>on</strong> <strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Supervisor Kniffen explained th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re has been an <strong>on</strong>going discussi<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Town</str<strong>on</strong>g> sends all it’s flow. The expense <str<strong>on</strong>g>of</str<strong>on</strong>g> processing is called sewer rent. When a bill is<br />

received from <str<strong>on</strong>g>the</str<strong>on</strong>g> plant it has to be passed <strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> special district. He explained th<strong>at</strong><br />

when <str<strong>on</strong>g>the</str<strong>on</strong>g> last district in <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> <str<strong>on</strong>g>was</str<strong>on</strong>g> cre<strong>at</strong>ed (Bell School) <str<strong>on</strong>g>the</str<strong>on</strong>g> sewer rent cost, in<br />

additi<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> actual capital costs to build <str<strong>on</strong>g>the</str<strong>on</strong>g> system, <str<strong>on</strong>g>was</str<strong>on</strong>g> $1.20 per 1<strong>00</strong> cubic feet with<br />

a typical house billed for approxim<strong>at</strong>ely 1<strong>00</strong> cubic feet annually. Through <str<strong>on</strong>g>the</str<strong>on</strong>g> years <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

costs have increased dram<strong>at</strong>ically due to things such as <str<strong>on</strong>g>the</str<strong>on</strong>g> EPA’s demands <strong>on</strong> how to<br />

process <str<strong>on</strong>g>the</str<strong>on</strong>g> flow involving chemicals which increase <str<strong>on</strong>g>the</str<strong>on</strong>g> cost, <str<strong>on</strong>g>the</str<strong>on</strong>g> 2<strong>00</strong>6 flood and facility<br />

upd<strong>at</strong>es <str<strong>on</strong>g>of</str<strong>on</strong>g> $60 milli<strong>on</strong> in capital costs, etc. Those are spread out over all <str<strong>on</strong>g>the</str<strong>on</strong>g> outside<br />

users <str<strong>on</strong>g>of</str<strong>on</strong>g> which <str<strong>on</strong>g>Kirkwood</str<strong>on</strong>g> is <strong>on</strong>e. DEC filed a C<strong>on</strong>sent Order which required better<br />

c<strong>on</strong>trol because <str<strong>on</strong>g>of</str<strong>on</strong>g> too much infiltr<strong>at</strong>i<strong>on</strong> resulting in too much w<strong>at</strong>er being processed.<br />

There is currently a CMOM program which is very expensive which all <str<strong>on</strong>g>the</str<strong>on</strong>g> users have to<br />

comply with and without any warning after <str<strong>on</strong>g>the</str<strong>on</strong>g> 2013 budget <str<strong>on</strong>g>was</str<strong>on</strong>g> established in 2012<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>re <str<strong>on</strong>g>was</str<strong>on</strong>g> a large increase. Fortun<strong>at</strong>ely with Jim Smith’s guidance and suspici<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

rising costs, <str<strong>on</strong>g>the</str<strong>on</strong>g> r<strong>at</strong>e <str<strong>on</strong>g>was</str<strong>on</strong>g> increased to $5.25. The facility bills <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> four times a year<br />

based <strong>on</strong> prior years flow and <str<strong>on</strong>g>the</str<strong>on</strong>g> first bill <str<strong>on</strong>g>was</str<strong>on</strong>g> over 30% increase for all <str<strong>on</strong>g>the</str<strong>on</strong>g> outsider<br />

users. This increase amounts to $280,<strong>00</strong>0 a year th<strong>at</strong> <str<strong>on</strong>g>was</str<strong>on</strong>g> not budgeted for but since an<br />

increase <str<strong>on</strong>g>was</str<strong>on</strong>g> anticip<strong>at</strong>ed <str<strong>on</strong>g>the</str<strong>on</strong>g> impact <str<strong>on</strong>g>was</str<strong>on</strong>g> not as gre<strong>at</strong> as it could have been. The <str<strong>on</strong>g>Town</str<strong>on</strong>g> has<br />

no choice but to pay <str<strong>on</strong>g>the</str<strong>on</strong>g> bill since <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no o<str<strong>on</strong>g>the</str<strong>on</strong>g>r place to send <str<strong>on</strong>g>the</str<strong>on</strong>g> sewage.<br />

Jim Smith added th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y generally try to buffer how quickly <str<strong>on</strong>g>the</str<strong>on</strong>g> r<strong>at</strong>es are raised but <str<strong>on</strong>g>the</str<strong>on</strong>g>y<br />

used to get <str<strong>on</strong>g>the</str<strong>on</strong>g> inform<strong>at</strong>i<strong>on</strong> earlier and now <str<strong>on</strong>g>the</str<strong>on</strong>g>y get it in May and it is retroactive to<br />

January 1. The Flow Management Report indic<strong>at</strong>ed to <str<strong>on</strong>g>the</str<strong>on</strong>g>m th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y needed to raise <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

r<strong>at</strong>e. They received an estim<strong>at</strong>ed bill for 2012 <str<strong>on</strong>g>of</str<strong>on</strong>g> $4.05 per 1<strong>00</strong> cubic feet and now it is<br />

up to $5.41 and <str<strong>on</strong>g>the</str<strong>on</strong>g>re <str<strong>on</strong>g>was</str<strong>on</strong>g> no warning th<strong>at</strong> it would increase th<strong>at</strong> dram<strong>at</strong>ically. He<br />

recently found out th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> biggest reas<strong>on</strong> is <str<strong>on</strong>g>the</str<strong>on</strong>g> $4 milli<strong>on</strong> flood remedi<strong>at</strong>i<strong>on</strong>. They are<br />

hoping th<strong>at</strong> FEMA will pay back <strong>at</strong> least $3 milli<strong>on</strong> (and/or insurance), but <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no<br />

guarantee <str<strong>on</strong>g>of</str<strong>on</strong>g> th<strong>at</strong>. Going to $5.25 helped to buffer when it <str<strong>on</strong>g>was</str<strong>on</strong>g> changed to $5.41. The<br />

hope is th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y will be somewh<strong>at</strong> stable going into 2014 <strong>at</strong> this r<strong>at</strong>e. The <str<strong>on</strong>g>Town</str<strong>on</strong>g> needs to<br />

get <str<strong>on</strong>g>the</str<strong>on</strong>g>ir r<strong>at</strong>e up or <str<strong>on</strong>g>the</str<strong>on</strong>g> fund balance will be used up. He feels th<strong>at</strong> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r municipalities<br />

are worse <str<strong>on</strong>g>of</str<strong>on</strong>g>f than <str<strong>on</strong>g>Kirkwood</str<strong>on</strong>g> with much more dram<strong>at</strong>ic increases.<br />

Supervisor Kniffen and Jim Smith are recommending a raise in <str<strong>on</strong>g>the</str<strong>on</strong>g> r<strong>at</strong>e by September so<br />

a public hearing will be need to be scheduled by resoluti<strong>on</strong> <strong>at</strong> this <str<strong>on</strong>g>meeting</str<strong>on</strong>g> for June 25 th .<br />

Supervisor Kniffen explained th<strong>at</strong> <str<strong>on</strong>g>Kirkwood</str<strong>on</strong>g> has adopted two road use laws in regard to<br />

protecting roads in <str<strong>on</strong>g>the</str<strong>on</strong>g> event <str<strong>on</strong>g>of</str<strong>on</strong>g> gas drilling. Broome County has adopted a similar law<br />

and is asking all <str<strong>on</strong>g>the</str<strong>on</strong>g> municipalities in <str<strong>on</strong>g>the</str<strong>on</strong>g> county to c<strong>on</strong>sidering adopting <str<strong>on</strong>g>the</str<strong>on</strong>g>ir law.<br />

Although <str<strong>on</strong>g>the</str<strong>on</strong>g> County is asking for a decisi<strong>on</strong> by today, <str<strong>on</strong>g>the</str<strong>on</strong>g>re is not enough time to<br />

c<strong>on</strong>sider it so <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a resoluti<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> agenda advising <str<strong>on</strong>g>the</str<strong>on</strong>g> County Executive th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Town</str<strong>on</strong>g> will c<strong>on</strong>sider it but <str<strong>on</strong>g>the</str<strong>on</strong>g>y need more inform<strong>at</strong>i<strong>on</strong>. He said th<strong>at</strong> if a town does not<br />

adopt Broome County’s law <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cern is th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re are different laws to adhere to and<br />

how would it be managed. Most likely <str<strong>on</strong>g>the</str<strong>on</strong>g> County law is as good or better than <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g><br />

law and <str<strong>on</strong>g>the</str<strong>on</strong>g>y would have to manage it and <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no cost to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g>. The initial cost<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> $9,9<strong>00</strong> will be absorbed by <str<strong>on</strong>g>the</str<strong>on</strong>g> County.<br />

Councilman Diffendorf said th<strong>at</strong> he likes <str<strong>on</strong>g>the</str<strong>on</strong>g> idea <str<strong>on</strong>g>of</str<strong>on</strong>g> a county wide law but wants more<br />

inform<strong>at</strong>i<strong>on</strong>.<br />

Oliver Blaise said th<strong>at</strong> is why <str<strong>on</strong>g>the</str<strong>on</strong>g> proposed resoluti<strong>on</strong> st<strong>at</strong>es th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y want to review <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

proposed Technical Manual and Program Manual. This basically notifies <str<strong>on</strong>g>the</str<strong>on</strong>g> County th<strong>at</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> towns are interested in <str<strong>on</strong>g>the</str<strong>on</strong>g> proposal subject to getting more inform<strong>at</strong>i<strong>on</strong>. Councilman<br />

Weingartner questi<strong>on</strong>ed if <str<strong>on</strong>g>the</str<strong>on</strong>g> law <str<strong>on</strong>g>the</str<strong>on</strong>g>y reviewed last October <str<strong>on</strong>g>was</str<strong>on</strong>g> supposed to be <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

law. Supervisor Kniffen said th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> County went with ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r law firm. Mr. Blaise<br />

explained th<strong>at</strong> his firm developed <str<strong>on</strong>g>the</str<strong>on</strong>g> Windsor law which <str<strong>on</strong>g>was</str<strong>on</strong>g> adopted by a number <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

towns and <str<strong>on</strong>g>the</str<strong>on</strong>g> County went with <str<strong>on</strong>g>the</str<strong>on</strong>g> Delta plan developed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Delta Engineering firm.<br />

He noted th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y are very similar. The major difference is <str<strong>on</strong>g>the</str<strong>on</strong>g> up-fr<strong>on</strong>t cost, th<strong>at</strong> Delta<br />

provides <str<strong>on</strong>g>the</str<strong>on</strong>g> local law and any engineering studies and sampling <str<strong>on</strong>g>of</str<strong>on</strong>g> roads <strong>at</strong> a certain<br />

expense. The good thing is th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re is actually scientific evidence <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> roads prior to being driven <strong>on</strong> with a road use permit. The County will pay <str<strong>on</strong>g>the</str<strong>on</strong>g> upfr<strong>on</strong>t<br />

costs for towns th<strong>at</strong> adopt <str<strong>on</strong>g>the</str<strong>on</strong>g>ir law.<br />

Councilwoman Y<strong>on</strong>chuk noted th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re are st<strong>at</strong>e roads in <str<strong>on</strong>g>Kirkwood</str<strong>on</strong>g> and noted a<br />

c<strong>on</strong>cern if <str<strong>on</strong>g>the</str<strong>on</strong>g>y will have a plan as well.<br />

Councilman Grubham said th<strong>at</strong> he is basically in favor since it benefits <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> cost<br />

wise and with administr<strong>at</strong>i<strong>on</strong>. Mr. Blaise said <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> questi<strong>on</strong>s is in regard to<br />

administr<strong>at</strong>i<strong>on</strong>. With a uniform system it would make sense th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> County will issue<br />

permits but it is not clear yet. The County plan does not include enforcement so th<strong>at</strong> is<br />

something <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Town</str<strong>on</strong>g> would have to bear. An issue also is who is going to negoti<strong>at</strong>e a<br />

road permit.<br />

Mr. Blaise said th<strong>at</strong> under <str<strong>on</strong>g>the</str<strong>on</strong>g> Delta plan who pays subsequent costs is <strong>at</strong> issue. Basically<br />

c<strong>on</strong>sidered. He feels Ray needs more <str<strong>on</strong>g>of</str<strong>on</strong>g> a chance to manage <str<strong>on</strong>g>the</str<strong>on</strong>g> situ<strong>at</strong>i<strong>on</strong> and to fix it.<br />

He said th<strong>at</strong> he does not know how this will go, but if it doesn’t go and things d<strong>on</strong>’t get<br />

fixed Ray and his management will be looked <strong>at</strong>. He feels this should be fixable without<br />

Councilman Grubham said th<strong>at</strong> he has had people call him over <str<strong>on</strong>g>the</str<strong>on</strong>g> past three or four<br />

years about this issue and he saw a couple <str<strong>on</strong>g>of</str<strong>on</strong>g> things himself which led him to questi<strong>on</strong><br />

why people were out <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> town. He said he saw a couple <str<strong>on</strong>g>of</str<strong>on</strong>g> people driving around just<br />

<str<strong>on</strong>g>was</str<strong>on</strong>g>ting time in Johns<strong>on</strong> City. He does not know how <strong>on</strong>e pers<strong>on</strong> can keep track <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

trucks all <str<strong>on</strong>g>the</str<strong>on</strong>g> time without having some way <str<strong>on</strong>g>of</str<strong>on</strong>g> knowing where <str<strong>on</strong>g>the</str<strong>on</strong>g>y are. He does not<br />

care about sending <str<strong>on</strong>g>the</str<strong>on</strong>g>m home without pay but th<strong>at</strong> is Ray’s problem to take care. There<br />

is no way he can know for sure where <str<strong>on</strong>g>the</str<strong>on</strong>g>y are. Although he does not want to spend <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

m<strong>on</strong>ey he would like to see how this works for <strong>at</strong> least a year and he thinks <str<strong>on</strong>g>the</str<strong>on</strong>g> dog<br />

c<strong>on</strong>trol <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer would benefit from it.<br />

Councilwoman Y<strong>on</strong>chuk said th<strong>at</strong> from wh<strong>at</strong> has been brought to <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>at</strong>tenti<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>re are<br />

maybe two or three <str<strong>on</strong>g>of</str<strong>on</strong>g>fending individuals and <str<strong>on</strong>g>the</str<strong>on</strong>g>y would be putting this <strong>on</strong> 12 trucks.<br />

She said th<strong>at</strong> if this is going to be d<strong>on</strong>e it should be put <strong>on</strong> all trucks, but <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g>fense is<br />

wr<strong>on</strong>g but is th<strong>at</strong> enough to go to this expense. She would like to see this corrected in<br />

house and she is not comfortable with this expense for wh<strong>at</strong> she believes is not a major<br />

problem. She also noted th<strong>at</strong> this proposal does not st<strong>at</strong>e wh<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sequences are for<br />

an <str<strong>on</strong>g>of</str<strong>on</strong>g>fending party and she is uneasy about passing it if it might not be c<strong>on</strong>sistently<br />

enforced.<br />

Councilman Diffendorf said th<strong>at</strong> by having <str<strong>on</strong>g>the</str<strong>on</strong>g> GPS system <str<strong>on</strong>g>the</str<strong>on</strong>g>y know where <str<strong>on</strong>g>the</str<strong>on</strong>g> trucks<br />

are <strong>at</strong>, if <str<strong>on</strong>g>the</str<strong>on</strong>g>y are working or if <str<strong>on</strong>g>the</str<strong>on</strong>g>y are just sitting some place. If <str<strong>on</strong>g>the</str<strong>on</strong>g>y are where <str<strong>on</strong>g>the</str<strong>on</strong>g>y are<br />

supposed to be <str<strong>on</strong>g>the</str<strong>on</strong>g>n it isn’t a problem. This is something new and every trucking<br />

company in <str<strong>on</strong>g>the</str<strong>on</strong>g> country has this system <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir trucks so th<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>y know wh<strong>at</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir truck<br />

drivers are doing.<br />
