The responsibilities assumed by those who become trustees are increasingly onerous; it is vital that the
day to day and routine management of a trust is conducted to the very highest standards.
Withers LLP is able to offer through its trust management group a highly professional and dedicated
service to trustees incorporating all aspects of trust management:
• administering trust assets including property and valuable chattels
• monitoring investment management performance
• maintaining accounting records
• preparation of annual trust accounts
• completion of annual tax returns and paying tax liabilities
• inheritance tax compliance
• arranging income and capital distributions
• providing beneficiaries with income tax certificates
• liaising with other professional advisers
• attending trustees meetings.
Backed by the strengths of the firm’s specialist legal, taxation and planning services to private clients
and trustees, including advising on trust disputes and litigation, the trust management group provides a
comprehensive and in depth service to trustees.
The group has been providing trust management services to trustees for more than thirty years and has
a wealth of experience in dealing with all types of trusts, including discretionary, interest in possession,
accumulation and maintenance, will trusts and charities.
Julia Abrey is the principal responsible for the trust management group, which comprises a team of
experienced trust managers, supported by a dedicated trust accounting team who use the latest
computer systems. Overall, group personnel have over 90 years’ experience of dealing with trusts
and trustees.

Our service
Continuity is vitally important when dealing with trusts and therefore each trust is allocated a dedicated
manager who will be responsible for all aspects of the trust management service.
In all cases, a principal of Withers LLP will oversee the work of the individual manager and provide legal
and professional support to the trustees.
Trust managers are carefully matched with each trust to derive the full benefits of their experience and
charging rates.
Through continuing investment in modern computer systems, combined with a personal and practical
understanding of the needs of trustees and beneficiaries, each trust manager is readily in touch on a
daily basis with those trusts for which they are responsible and is able to provide any information needed
promptly and efficiently.
To assist trustees in complying with current legislation and regulation, including the Trustee Act 2000,
the trust management group will draw on the legal support of Withers LLP to ensure that appropriate
policy statements are put in place.
Fees
Fees are based either on a set scale or on hourly rates and will vary depending on the seniority and
experience of the manager involved. The selection of the appropriate manager is agreed with the client
prior to the appointment of Withers LLP to undertake the trust management.
The scale of fees in force from 6 April 2002 is 0.5% pa for a life interest trust and 0.7% pa for other types,
based on the value of the trust at 5 April at the commencement of the accounting year in question,
subject to a minimum fee of £500 pa.
VAT will be added to the above fees as appropriate.
Terms and conditions
The firm’s terms and conditions of business in force from time to time will apply and Withers LLP reserves
the right to charge additional fees for any matters arising which do not occur in the normal course of
business.

Withers Trust Corporation Limited
(WITCo)
Individual principals of Withers LLP are happy to act as a trustee but
an alternative is to appoint WITCo; an authorised trust corporation
wholly owned by Withers LLP . The company may act either as sole
or as a joint trustee and is a recognised body under the Solicitors
Incorporated Practice Rules 1988. This means that anyone
dealing with the company has the reassurance that the same
regulatory framework applies to the company as to Withers LLP
itself, including professional negligence insurance. Reasons to
appoint the company might be to:
• provide continuity on the retirement of an individual trustee
• ensure decision making and management are not disrupted by
an individual’s death or retirement
• provide trustee services where no specific individuals are
available to act for the settlor .
