OVERVIEW<br />

The <strong>candidate</strong> <strong>handbook</strong> is a useful tool in preparing for an<br />

examination.<br />

It is highly recommended that the Virginia Insurance <strong>handbook</strong> be reviewed, with<br />

special attention given to the content outlines, before taking the examination. (content<br />

outlines begin on page S1 <strong>of</strong> this <strong>handbook</strong>)<br />

Individuals who wish to obtain an <strong>insurance</strong> license in the<br />

<strong>Commonwealth</strong> <strong>of</strong> Virginia must:<br />

1. Make a reservation and pay examination fee.<br />

Make a reservation online or by phone with Promissor for the<br />

examination. Either a Social Security number or DMV-assigned<br />

number MUST be provided at the time <strong>of</strong> reservation. (see page 5)<br />

Whichever number you choose to use to register for the examination,<br />

you must use throughout the examination and <strong>licensing</strong> process.<br />

2. Go to the test center.<br />

Go to the test center on the day <strong>of</strong> the examination, bringing along all<br />

required materials. (see page 9)<br />

3. Apply for a license.<br />

After passing the examination, apply for your license by contacting<br />

the Virginia Bureau <strong>of</strong> Insurance. For complete procedures and<br />

A MESSAGE FROM THE BUREAU<br />

This <strong>handbook</strong> provides you with information about the license examination and<br />

application process for becoming licensed by the State Corporation Commission’s<br />

Bureau <strong>of</strong> Insurance (referred to as “the Bureau” in this <strong>handbook</strong>) as an <strong>insurance</strong><br />

agent or <strong>insurance</strong> consultant in Virginia. It also contains information that is useful<br />

after you become licensed. We suggest you keep this <strong>handbook</strong> for future reference.<br />

Once the Bureau is satisfied that you have met all requirements for a license, the<br />

appropriate license will be issued.<br />

Remember, however, that you cannot sell, solicit or negotiate contracts <strong>of</strong><br />

<strong>insurance</strong> until the Bureau has issued your agent’s license, nor may you receive<br />

or accept, directly or indirectly, any commission or other valuable consideration<br />

unless you are properly licensed at the time <strong>of</strong> the transaction from which the<br />

right to such commission or other valuable consideration arose and you are<br />

a duly appointed agent <strong>of</strong> the insurer at the time that such insurer pays such<br />

commission or other valuable consideration.<br />

Issuance <strong>of</strong> a license depends on review and approval <strong>of</strong> all license application material.<br />

Passing an exam does not guarantee that you will be issued a license. You take exams<br />

and submit license applications at your own risk. If you take an exam unnecessarily<br />

or are found unqualified, neither the exam fee nor the license-processing fee will be<br />

refunded.<br />

We wish you well in preparing for your examination and remind you that by law you<br />

are required to continue your <strong>insurance</strong> education after becoming licensed. Remember,<br />

however, that a license is a privilege, not a right or a gift. You must commit yourself<br />

from the beginning to comply with the laws and regulations set forth to regulate the<br />

<strong>insurance</strong> industry.<br />

GENERAL GUIDELINES<br />

THE LICENSURE PROCESS<br />

Licensure is the process by which an agency <strong>of</strong> state government or other jurisdiction<br />

grants permission to individuals to engage in the practice <strong>of</strong>, and prohibits all others<br />

from legally practicing, a particular pr<strong>of</strong>ession, vocation, or occupation pr<strong>of</strong>ession. By<br />

ensuring a minimum level <strong>of</strong> competence, the licensure process protects the general<br />

public. The state regulatory agency is responsible for establishing the acceptable level<br />

<strong>of</strong> safe practice and for determining whether an individual meets that standard.<br />

The <strong>Commonwealth</strong> <strong>of</strong> Virginia has retained the services <strong>of</strong> Promissor to develop<br />

and administer its <strong>insurance</strong> <strong>licensing</strong> examination program. Promissor is a leading<br />

provider <strong>of</strong> assessment services to regulatory agencies and national associations.<br />

OVERVIEW OF LICENSURE<br />

The <strong>Commonwealth</strong> <strong>of</strong> Virginia issues several types <strong>of</strong> <strong>insurance</strong> licenses. Some<br />

types <strong>of</strong> licenses require <strong>candidate</strong>s to take an exam in addition to fulfilling other<br />

requirements. Other types <strong>of</strong> licenses do not require an exam. Licensing requirements<br />

may also differ according to where a <strong>candidate</strong> lives.<br />

Title 38.2, Chapter 18, <strong>of</strong> the Code <strong>of</strong> Virginia empowers the Virginia State<br />

Corporation Commission, through its Bureau <strong>of</strong> Insurance, to qualify those who<br />

wish to operate as <strong>insurance</strong> agents and consultants in Virginia. The legislature<br />

may change these laws annually, and administrative procedures may be changed at<br />

any time. Licensees are expected to be aware <strong>of</strong> changes in the law that affect their<br />

occupational practice.<br />

After you fulfill your exam requirements (if any), you may submit your application<br />

for licensure to the Bureau. (For application instructions, see “Applying for your<br />

License” on page 29). The Bureau will review your application materials, along with<br />

a current copy <strong>of</strong> your criminal history record report. If the Bureau approves your<br />

application, you will receive a license and may solicit <strong>insurance</strong> <strong>of</strong> the type for which<br />

you have been licensed. If your application is denied, you will be notified in writing<br />

<strong>of</strong> the reason for such denial.<br />

LICENSES THAT REQUIRE EXAMS<br />

The Bureau issues five types <strong>of</strong> <strong>insurance</strong> agent licenses that require Virginia resident<br />

applicants to pass an exam before <strong>licensing</strong>. (In addition, the Variable Contracts<br />

license requires applicants to pass a NASD exam.) If the license terminates for any<br />

reason, a resident must pass the examination again prior to applying for the license.<br />

The following table shows the five license types and their license codes.<br />

Holding one <strong>of</strong> these five agent license types would enable you to sell several classes<br />

<strong>of</strong> <strong>insurance</strong>. However, it would prevent you from obtaining a limited line license for<br />

a class <strong>of</strong> <strong>insurance</strong> authorized under the major license type.<br />

CONSULTANT LICENSES<br />

The Bureau issues two <strong>insurance</strong> consultant licenses that require Virginia resident<br />

applicants to pass an exam before <strong>licensing</strong>. The table shows the license types, license<br />

codes and the required exam.<br />

Anyone who charges a fee to advise or purport to advise in the area <strong>of</strong> Life Insurance,<br />

Accident and Sickness Insurance, Property and Casualty Insurance, or Health Care<br />

Services as defined in the Code <strong>of</strong> Virginia is required to be licensed as an <strong>insurance</strong><br />

consultant. Following are the only exceptions:<br />

• A licensed attorney acting in a pr<strong>of</strong>essional capacity.<br />

• A trust <strong>of</strong>ficer <strong>of</strong> a bank acting in the normal course <strong>of</strong> his or her<br />

employment.<br />

• An actuary or certified public accountant who consults during the normal<br />

course <strong>of</strong> business.<br />

• Any person employed as a risk manager and who consults for his or her<br />

employer only.<br />

WAIVING EXAM REQUIREMENTS<br />

If you hold the Chartered Life Underwriter (CLU) designation, you may apply for the<br />

Life and Annuities license, Health license, or both without taking the pre-<strong>licensing</strong><br />

exam. Similarly, if you hold the Chartered Property and Casualty Underwriter<br />

(CPCU) designation, you may apply for the Personal Lines license or the Property<br />

and Casualty license without taking the pre-<strong>licensing</strong> exam. By law, these are the only<br />

circumstances under which an exam may be waived except for waivers granted to<br />

nonresident licensees moving into Virginia and applying for resident licenses within<br />

90 days (see page 28).<br />

To request a waiver, you must submit pro<strong>of</strong> that you hold the designation in question<br />

directly to the Bureau with your license application, criminal history record report,<br />

and nonrefundable license application processing fee.<br />

licenses and several miscellaneous licenses that do not require applicants to pass a<br />

location and will answer questions. The reservation will be made based on the next<br />

available examination date.<br />

ONLINE RESERVATIONS<br />

Candidates MUST go to www.promissor.com to make an online reservation for an<br />

examination. First-time users are required to create an account. The <strong>candidate</strong> will<br />

need to fill-in all required fields, which are listed in BOLD, on the online form in<br />

order to create a User ID and be assigned a password. Step-by-step instructions will<br />

follow on how to make a reservation for an examination.<br />

An online reservation MUST be made at least twenty-four (24) hours before the<br />

desired examination date.<br />

down in the space provided below. This number should be used for any contact with<br />

EXAM FEES<br />

The examination fee must be paid at the time <strong>of</strong> reservation by credit card, debit<br />

card, voucher or electronic check. Fees will NOT be accepted at the test center.<br />

Examination fees are non-refundable and non-transferable, except as detailed in the<br />

Change/Cancel Policy. The fee for each exam is $58.<br />

Electronic Checks<br />

Candidates who choose to pay the examination fee by electronic check must have a<br />

personal checking account, and must be prepared to provide to Promissor at the time<br />

<strong>of</strong> reservation the following information:<br />

• Bank name<br />

• Account number<br />

• Social Security number (SSN) or DMV-assigned number<br />

• Name and address on the account<br />

Using this information, Promissor can request payment from the <strong>candidate</strong>’s bank<br />

account just as if the <strong>candidate</strong> had submitted an actual paper check.<br />

Vouchers<br />

Candidates may pre-pay examination fees and receive a voucher to use when they<br />

contact Promissor to make an examination reservation. The number listed on the<br />

voucher will be accepted by Promissor as payment for the examination fee. Vouchers<br />

may be purchased for one fee or many; therefore, companies may buy vouchers in<br />

bulk and distribute them to <strong>candidate</strong>s as desired.<br />

Those who wish to purchase a voucher should send a Voucher Request Form (found on<br />

page 39 <strong>of</strong> <strong>handbook</strong>), along with proper payment. Promissor will process voucher<br />

requests within one (1) week <strong>of</strong> receipt. Vouchers are valid for one (1) year from the<br />

issue date and can be renewed or refunded.<br />

CHANGE/CANCEL POLICY<br />

Candidates should call Promissor at (888) 204-6272 forty-eight (48) hours before<br />

the examination to change or cancel a reservation. Candidates who change or cancel<br />

a reservation with proper notice may transfer the fee to a new reservation, or may<br />

request a refund. Candidates who change or cancel a reservation without proper<br />

notice will forfeit the examination fee. Refunds for credit/debit cards are immediate,<br />

Candidates are individually liable for the full amount <strong>of</strong> the examination fee once a<br />

reservation has been made, whether paid individually or by a third party.<br />

ABSENCE/LATENESS POLICY<br />

Candidates who are late to or absent from an examination may be excused for the<br />

following reasons:<br />

• Illness <strong>of</strong> the <strong>candidate</strong> or that <strong>of</strong> the <strong>candidate</strong>’s immediate family<br />

member<br />

• Death in the immediate family<br />

• Disabling traffic accident<br />

• Court appearance or jury duty<br />

• Military duty<br />

• Weather emergency<br />

Written verification and supporting documentation for excused absences must be<br />

submitted to Promissor within fourteen (14) days <strong>of</strong> the original examination date.<br />

Candidates who are absent and failed to change or cancel their reservation according<br />

to the Change/Cancel Policy will forfeit the examination fee. Candidates who are late<br />

will not be admitted to the examination and will forfeit the examination fee.<br />

WEATHER DELAYS AND CANCELLATIONS<br />

If severe weather or a natural disaster makes the Promissor Test Center inaccessible<br />

or unsafe, the examination may be delayed or canceled. Candidates should contact<br />

Promissor at (800) 274-2615 for details on delays and cancellations during severe<br />

weather.<br />

SPECIAL EXAM REQUESTS & SERVICES<br />

Americans with Disabilities Act (ADA)<br />

Promissor complies with the provisions <strong>of</strong> the Americans with Disabilities Act (42<br />

U.S.C. 12101 et seq.) and Title VII <strong>of</strong> the Civil Rights Act, as amended (42 U.S.C.<br />

2000e et seq.), in accommodating disabled <strong>candidate</strong>s who need special arrangements<br />

to take an examination.<br />

Candidates who require special arrangements due to impaired sensory, manual or<br />

speaking skills, or other disability, should fax the Special Accommodations Request<br />

Form (on page 41 <strong>of</strong> this <strong>handbook</strong>) to Promissor.<br />

The form must be accompanied by supporting documentation from a physician or<br />

other qualified pr<strong>of</strong>essional reflecting a diagnosis <strong>of</strong> the <strong>candidate</strong>’s condition and an<br />

explanation <strong>of</strong> examination aids or modifications. Promissor will provide auxiliary<br />

aids and services, except where such may fundamentally alter the examination or<br />

results, or result in an undue burden. The examination will be scheduled upon receipt<br />

<strong>of</strong> all required information by Promissor.<br />

Candidates who have additional questions concerning ADA arrangements may contact<br />

the ADA Coordinator at (800) 274-3707. However, the Special Accommodations<br />

Request Form, along with the required supporting documentation, MUST be submitted<br />

to Promissor before any special examination arrangements can be finalized.<br />

Promissor will determine the time and place <strong>of</strong> specially arranged examinations and<br />

will confirm these arrangements directly with the <strong>candidate</strong>. Candidates who need to<br />

retake an examination should notify Promissor that special arrangements were used<br />

for the previous examination.<br />

Non-Saturday Exams<br />

Candidates who for religious reasons cannot take an examination <strong>of</strong>fered only on<br />

in writing on <strong>of</strong>ficial stationery by the <strong>candidate</strong>’s religious advisor and faxed to (610)<br />

617-9397 or mail to Promissor (address found on inside front cover).<br />

English as a Second Language (ESL)<br />

Candidates for whom English is a second language may request additional time for<br />

the examination by completing the Special Accommodations Request Form (found<br />

on page 41). Candidates requesting an ESL accommodation must first go to www.<br />

catglobal.com to create an account and obtain a User ID. Click on the Create Your<br />

Account link and then follow the directions to create a new test taker account and ID.<br />

DO NOT continue to follow instructions which prompt you to make an online<br />

reservation. You will need the ID number generated by the system to complete the<br />

Special Accommodations Request Form and mail it to Promissor. Candidates should<br />

include with this form a letter from his/her English instructor or sponsoring company<br />

(on <strong>of</strong>ficial letterhead, if from a company) stating that English is not the primary<br />

language for the <strong>candidate</strong>.<br />

Candidates should NOT attempt to make an examination reservation until after<br />

they have been notified by Promissor that their request for additional time has<br />

been approved.<br />

The approval <strong>of</strong> additional time will be for one (1) year from the date <strong>of</strong> the<br />

request for the level you have requested. Candidates who have additional questions<br />

WHAT TO BRING<br />

All <strong>candidate</strong>s must bring to the test center on examination day the following.<br />

Required:<br />

• Two (2) forms <strong>of</strong> current signature identification one <strong>of</strong> which must<br />

include a government-issued photo.<br />

• Candidates who have changed their names must provide written<br />

documentation <strong>of</strong> the change. This documentation may be a copy <strong>of</strong> a<br />

marriage license, divorce decree or other <strong>of</strong>ficial document.<br />

• The confirmation number provided when the reservation was made.<br />

EXAM PROCEDURES<br />

Candidates should report to the Promissor Test Center thirty (30) minutes before the<br />

examination and check in with the test center manager. The manager will review the<br />

<strong>candidate</strong>’s confirmation number, identification, and any other required documents,<br />

and will photograph him/her for the score report.<br />

After check-in, <strong>candidate</strong>s may take a tutorial on the PC unit. The time spent on<br />

this tutorial will not reduce the examination time. The examination proctors will<br />

answer questions at this time, but <strong>candidate</strong>s should be aware that the proctors<br />

are not familiar with the content <strong>of</strong> the examinations or with the state’s <strong>licensing</strong><br />

requirements. Candidates are responsible for determining which examinations they<br />

need to take. Examination proctors have been instructed not to advise <strong>candidate</strong>s on<br />

requirements for licensure.<br />

Once <strong>candidate</strong>s are familiar with the PC unit, they may begin the examination. The<br />

examination begins the moment a <strong>candidate</strong> looks at the first examination question.<br />

After the examination time has expired, the examination will automatically end.<br />

Candidates will leave the Promissor Test Center with their <strong>of</strong>ficial scores in hand.<br />

ABOUT THE EXAM<br />

The content <strong>of</strong> the major lines examination is based upon information obtained from<br />

a job analysis performed by Promissor. Responses from <strong>insurance</strong> pr<strong>of</strong>essionals were<br />

analyzed to determine the nature and scope <strong>of</strong> tasks they perform and the knowledge<br />

and skills needed to perform them. This information is the basis upon which<br />

examination questions are written and ensures that examinations reflect the practice<br />

<strong>of</strong> <strong>insurance</strong>. The examination has been developed to reflect the laws, statutes, rules<br />

and regulations for the practice <strong>of</strong> <strong>insurance</strong> in Virginia, and has been reviewed and<br />

approved by Virginia <strong>insurance</strong> pr<strong>of</strong>essionals.<br />

Each major lines examination is given in a multiple-choice format and consists <strong>of</strong> two<br />

exams. The general exam deals with basic <strong>insurance</strong> product knowledge. The state exam<br />

deals with <strong>insurance</strong> laws, rules, regulations, and practices that are unique to Virginia.<br />

Through standardization and control, Promissor ensures that no individual has an<br />

unfair disadvantage or advantage because <strong>of</strong> a particular examination format.<br />

Promissor maintains examination administration and examination security standards<br />

designed to ensure that all <strong>candidate</strong>s are given the same opportunity to demonstrate<br />

their abilities and to prevent some <strong>candidate</strong>s from gaining an unfair advantage<br />

over others because <strong>of</strong> testing irregularities or misconduct. Promissor routinely<br />

reviews irregularities and examination scores believed to be earned under unusual or<br />

nonstandard circumstances.<br />

Promissor maintains the right to question any examination score whose validity is in<br />

doubt because the score may have been obtained unfairly. Promissor first undertakes<br />

a confidential review <strong>of</strong> the circumstances contributing to the questions about score<br />

validity. If there is sufficient cause to question the score, Promissor will refer the<br />

matter to the Bureau <strong>of</strong> Insurance, which will make the final decision on whether or<br />

not to cancel the score.<br />

The performance <strong>of</strong> all <strong>candidate</strong>s is monitored and may be analyzed statistically<br />

for the purpose <strong>of</strong> detecting and verifying fraud. If it is determined that a score has<br />

questionable validity, the Bureau <strong>of</strong> Insurance will be so notified and will determine<br />

whether the <strong>candidate</strong>’s scores will be released.<br />

Pretest Questions<br />

The examination will contain “pretest” questions. Pretest questions are questions<br />

on which statistical information is being collected for use in constructing future<br />

examinations. Responses to pretest questions do not affect a <strong>candidate</strong>’s score. Pretest<br />

questions are mixed in with the scored questions and are not identified.<br />

SCORE REPORTING<br />

When <strong>candidate</strong>s complete the examination, they will receive a score report marked<br />

“pass” or “fail”. Candidates who pass the examination will receive a score report<br />

that includes information on how to apply for a license. Candidates who fail the<br />

examination will receive a score report that includes a numeric score and diagnostic<br />

information relating to the General portion <strong>of</strong> the examination, as well as information<br />

about re-examination. Reservations for reexamination are not made at the Promissor<br />

Test Center, and <strong>candidate</strong>s must wait twenty-four (24) hours before making<br />

one. Failing <strong>candidate</strong>s MUST retake the entire exam. Failing <strong>candidate</strong>s have two<br />

attempts to retake the exam at any time. After the third attempt, they must wait 30<br />

days before retesting.<br />

DUPLICATE SCORE REPORTS<br />

Candidates may request a duplicate score report from Promissor by completing the<br />

form on page 37 <strong>of</strong> this <strong>handbook</strong>. This service is <strong>of</strong>fered free <strong>of</strong> charge.<br />

RETAKING THE EXAM<br />

Reservations for re-examination are not made at the Promissor Test Center. Candidates<br />

must wait 24 hours before scheduling a re-examination. Failing <strong>candidate</strong>s must<br />

retake the entire exam. After the third attempt, Virginia law requires a 30-day waiting<br />

period before the <strong>candidate</strong> may retake the examination.<br />

For security reasons, examination material is not available to <strong>candidate</strong>s for review.<br />

Candidates who have questions, comments, or concerns about the examinations<br />

should direct written inquiries to Promissor’s address provided on the inside front<br />

cover <strong>of</strong> this <strong>handbook</strong>.<br />

In all correspondence, <strong>candidate</strong>s should provide their name and address information.<br />

If questions or comments are concerning an examination already taken, <strong>candidate</strong>s<br />

should also include:<br />

(1) the name <strong>of</strong> the examination<br />

(2) the date the examination was taken<br />

(3) the location <strong>of</strong> the test center<br />

(4) the confirmation number<br />

PROMISSOR TEST CENTER POLICIES<br />

The following policies are observed at each Promissor Test Center.<br />

• No calculators are permitted. An online calculator will be available<br />

during the exam. If for any reason you do not think your calculator is<br />

working properly tell the test center staff and ask for a hand held calculator.<br />

• No cellular phones, beepers, or any other electronic devices are<br />

permitted during the examination. Lockers, in which <strong>candidate</strong>s may store<br />

personal items, are available at most test centers.<br />

• No dictionaries, books, or reference materials are permitted in the<br />

examination room, and <strong>candidate</strong>s are strongly urged not to bring such<br />

materials to the Promissor Test Center. Candidates who are found with<br />

these or any other aids such as watch alarms, listening devices, recording<br />

or photographic devices during the examination will not be allowed to<br />

continue the examination.<br />

• No personal belongings such as briefcases or large bags are permitted<br />

in the examination room. Lockers, in which <strong>candidate</strong>s may store personal<br />

items, are available at most test centers. Promissor is not responsible for<br />

lost, misplaced or stolen items.<br />

• No eating, drinking, or smoking is permitted during the examination.<br />

• No leaving the test center is permitted during the examination.<br />

Candidates may use the restroom with specific permission from the<br />

proctor. Candidates who receive permission to use the restroom must<br />

use the nearest restroom, and may go only to the restroom. Candidates<br />

who take restroom breaks will not be allowed any extra time for the<br />

examination.<br />

• No misconduct <strong>of</strong> any kind, such as giving or receiving help; using notes,<br />

books, or other aids; taking part in an act <strong>of</strong> impersonation; or removing<br />

examination materials or notes from the examination room. Candidates<br />

who do so will be dismissed from the examination and will be reported<br />

to the Bureau <strong>of</strong> Insurance. Decisions regarding disciplinary measures are<br />

the responsibility <strong>of</strong> the Bureau <strong>of</strong> Insurance. The Bureau <strong>of</strong> Insurance can<br />

deny or revoke a license for cheating.<br />

• No visitors, guests, pets or children are allowed at the Promissor Test Center.<br />

Each examination is based on a detailed content outline <strong>of</strong> topics, subtopics, and<br />

references to applicable Virginia statutes and regulations. These content outlines are<br />

provided to publishers <strong>of</strong> study materials and to state-approved education providers<br />

for their use in developing and updating their educational materials and programs.<br />

Content outlines are updated periodically to reflect changes in practice, state laws<br />

and regulations. Virginia <strong>of</strong>fers these content outlines as part <strong>of</strong> the <strong>handbook</strong>.<br />

STUDY MATERIALS<br />

Neither the Bureau <strong>of</strong> Insurance nor Promissor endorses any particular study materials<br />

or pre-<strong>licensing</strong> schools.<br />

The exam content outlines in this <strong>handbook</strong> are the basis for the exams. Make sure<br />

your study materials cover the topics in the outlines.<br />

The Bureau <strong>of</strong> Insurance does not specify an <strong>of</strong>ficial study manual, nor are you<br />

required to take a pre-<strong>licensing</strong> study course; however, the Bureau urges you to enroll<br />

in a pre-<strong>licensing</strong> study course to help you prepare for the exam. You may obtain<br />

recommendations for study materials and pre-<strong>licensing</strong> study courses from <strong>insurance</strong><br />

companies, the company or agency you plan to work for, or local <strong>insurance</strong> and<br />

agents’ associations.<br />

APPLYING FOR LICENSURE IN VIRGINIA<br />

RESIDENT LICENSING REQUIREMENTS<br />

To qualify as a Virginia resident <strong>insurance</strong> agent, you must:<br />

• Be at least 18 years old.<br />

• Demonstrate to the Bureau’s satisfaction that you are <strong>of</strong> good character<br />

and have a good reputation for honesty (including submitting a current<br />

criminal history record report).<br />

• Be a legal resident <strong>of</strong> Virginia.<br />

• Pass the appropriate license exam(s).<br />

The state may consider you to be a resident <strong>of</strong> Virginia if you can provide<br />

documentation that you:<br />

• Maintain your principal place <strong>of</strong> residence in Virginia.<br />

• Declare yourself to be a Virginia resident on your federal tax return.<br />

• Declare yourself to be a Virginia resident for the purposes <strong>of</strong> paying<br />

Virginia income tax and personal property taxes.<br />

In addition, an applicant who lives outside <strong>of</strong> Virginia but whose principal place <strong>of</strong><br />

business is in Virginia may be considered a resident for purposes <strong>of</strong> issuing a license<br />

if the applicant:<br />

• Demonstrates to the Bureau’ satisfaction that the laws <strong>of</strong> his or her state <strong>of</strong><br />

residence prevents him or her from obtaining a resident license in that state.<br />

• Affirmatively chooses to qualify as and be treated as a resident <strong>of</strong> Virginia<br />

for purposes <strong>of</strong> <strong>licensing</strong> and continuing education, both in Virginia and<br />

in the state in which he or she resides.<br />

EQUIVALENT AUTHORITY FOR NONRESIDENTS<br />

An individual or a business entity licensed in his or her or its state <strong>of</strong> residence may<br />

obtain equivalent license authority in Virginia if all <strong>of</strong> the following apply:<br />

• The applicant pays all required fees.<br />

• The applicant submits or transmits to the Bureau either the application<br />

for licensure that was submitted to the home state or a completed NAIC<br />

Uniform Application (provide updated demographic information if it has<br />

changed). An individual applicant may apply online at<br />

www.licenseregistry.com/html/nrlWelcome.html.<br />

• The applicant’s home state issues nonresident agent licenses to residents <strong>of</strong><br />

Virginia on the same basis.<br />

• The applicant—if a corporation, limited liability company or limited<br />

partnership— has obtained from the Clerk <strong>of</strong> the Commission a<br />

Certificate <strong>of</strong> Authority, Certificate <strong>of</strong> Registration, or Certificate <strong>of</strong><br />

Limited Partnership, respectively. For information on obtaining a<br />

Maintaining a nonresident license depends on the continuation <strong>of</strong> your authority in<br />

your state or province <strong>of</strong> residence. If your license or authority to act as an agent is<br />

revoked, suspended or otherwise terminated in your state or province <strong>of</strong> residence,<br />

your nonresident Virginia license and appointments for the same classes <strong>of</strong> <strong>insurance</strong><br />

is automatically void.<br />

NONRESIDENT LICENSES<br />

If a nonresident’s home state authority does not include all the lines <strong>of</strong> authority<br />

authorized under the corresponding Virginia license, the Bureau will issue the<br />

applicant a nonresident license that includes only the authorities authorized by the<br />

applicant’s home state license.<br />

For example, if a nonresident’s home state authority includes fewer lines <strong>of</strong> authority<br />

than a Virginia Personal Lines license, the applicant would be issued a Nonresident<br />

Personal Lines license. That license would permit the applicant to sell only those lines<br />

<strong>of</strong> authority authorized by his or her home state license.<br />

REQUIREMENTS FOR INDIVIDUALS MOVING TO VIRGINIA<br />

Individuals with Nonresident Licenses<br />

Licensees holding one or more active nonresident Virginia licenses when relocating<br />

to Virginia can continue to operate under the nonresident licenses for a maximum <strong>of</strong><br />

90 days from the date <strong>of</strong> moving to Virginia.<br />

During that 90-day period, the licensee must submit an application and the<br />

nonrefundable application processing fee. The licensee must apply for each and every<br />

license type you wish to maintain as a resident. Licensee must be clearanced in their<br />

previous state <strong>of</strong> residence prior to applying for a resident license.<br />

Two results are possible, depending on whether licensees comply or fail to comply<br />

with these requirements.<br />

1 If they comply within 90 days <strong>of</strong> the cancellation <strong>of</strong> their licenses in<br />

their previous home state, their nonresident licenses will terminate<br />

simultaneously with the effective date <strong>of</strong> their new Virginia resident<br />

licenses. All appointments in effect under the previous nonresident licenses<br />

will automatically be converted to Virginia resident appointments under<br />

the new licenses.<br />

2 Licensees who fail to convert a nonresident license to a Virginia resident<br />

license within the 90-day period will have each nonresident license<br />

and all appointments under the licenses administratively terminated at<br />

the end <strong>of</strong> the 90 days. If this occurs, the licensees will be treated as if<br />

they never held a Virginia license and will be required to satisfy all pre<strong>licensing</strong><br />

requirements for the license type they are applying for. This<br />

includes passing any pre-<strong>licensing</strong> exam required and submitting a new<br />

application and fee and a current criminal history record report from the<br />

former state <strong>of</strong> residence. Licensees who have lived in Virginia for more<br />

than 183 calendar days must submit a criminal history record report from<br />

the Virginia State Police. Once their new licenses have been issued, these<br />

licensees will be required to obtain new appointments from each company<br />

they wish to represent in Virginia.<br />

Individuals without Nonresident Licenses<br />

Individuals licensed in another state who do not hold a current Virginia nonresident<br />

license when they move into Virginia, but who held equivalent authority in their<br />

former state <strong>of</strong> residence, also have a deadline. Within 90 days <strong>of</strong> the cancellation <strong>of</strong><br />

their license(s) in their previous home state, they must file an application and pay the<br />

required fee for each license applied for.<br />

Two results are possible, depending on whether these licensees comply or fail to<br />

comply with these requirements.<br />

1 If they comply during the 90-day period, these applicants will not be<br />

required to satisfy any pre-<strong>licensing</strong> exam requirements. However, they<br />

are prohibited from selling, soliciting or negotiating <strong>insurance</strong> in Virginia<br />

until the applied-for license has been issued.<br />

2 Applicants failing to file their applications within the 90-day period<br />

described above will not be entitled to reciprocity. They will be required<br />

to satisfy all Virginia pre-<strong>licensing</strong> requirements before a resident license<br />

will be issued. This includes passing any pre-<strong>licensing</strong> exams required and<br />

submitting an application and fee and a current criminal history record<br />

report from the former state <strong>of</strong> residence. Applicants who have been<br />

living in Virginia for more than 183 calendar days must submit a criminal<br />

history record report from the Virginia State Police.<br />

APPLYING FOR YOUR LICENSE<br />

After passing your exam, submit all <strong>of</strong> the following to the Bureau:<br />

• The proper license application form, completed;<br />

• A current (no more than 90 days old) Criminal History Record Report,<br />

which must be obtained through the Virginia State Police; and<br />

• A $15 nonrefundable license application processing fee for each license<br />

type. You do not have to submit pro<strong>of</strong> <strong>of</strong> passing the exam.<br />

The Virginia Application for License form for licenses requiring a pre-<strong>licensing</strong> exam<br />

is supplied on page 35. The Bureau also accepts the NAIC Uniform Application for<br />

Individual Insurance Producer License, which is available at the National Insurance<br />

Producer Registry (NIPR) Web site at: http://www.licenseregistry.com/resident_<br />

paper_<strong>licensing</strong>.htm.<br />

Virginia law requires that you must apply for and be issued a license within 183<br />

calendar days <strong>of</strong> taking the examination, or you will have to retake the examination.<br />

Bureau Approval<br />

If you have been convicted <strong>of</strong> a misdemeanor or a felony (other than a minor traffic<br />

violation), you must obtain special approval from the Bureau before your application<br />

for license may be granted. To obtain prior approval, address your request to the<br />

attention <strong>of</strong> the Supervisor <strong>of</strong> the Bureau’s Agents Licensing Section at the mailing<br />

address shown in the Quick Reference section. Please submit all <strong>of</strong> the following:<br />

• License application. You must submit the nonrefundable license<br />

application processing fee if you have already satisfied all exam<br />

requirements.<br />

• A certified copy <strong>of</strong> the charging document.<br />

• A certified copy <strong>of</strong> the <strong>of</strong>ficial document which demonstrates the<br />

resolution <strong>of</strong> the charges or any final judgment.<br />

• A current copy (no more than 90 days old) <strong>of</strong> your criminal history record<br />

report, which may be obtained through the state law enforcement agency<br />

in your state <strong>of</strong> residence.<br />

• A letter explaining, in your own words, the circumstances involving your<br />

arrest(s) and conviction(s).<br />

• If you are currently on probation or have been on probation, either (1)<br />

a letter from your probation <strong>of</strong>ficer providing information about your<br />

performance during the probation period and, if possible, his or her<br />

opinion <strong>of</strong> your suitability for <strong>licensing</strong> as an <strong>insurance</strong> agent or (2) court<br />

documents showing successful completion.<br />

After receiving all required documents described above, the Bureau will review<br />

your request to determine if a license should be granted or may request additional<br />

information as needed to evaluate the application. Once a decision has been made<br />

(allow a minimum <strong>of</strong> 30 days), you will be notified.<br />

OBTAINING AN APPOINTMENT<br />

In addition to obtaining your license, you must receive an appointment from each<br />

<strong>insurance</strong> company you wish to represent.<br />

The <strong>Commonwealth</strong> <strong>of</strong> Virginia recognizes three types <strong>of</strong> appointments: Life and<br />

Health (LH), Property and Casualty (PC) and Title (TI).<br />

An insurer may appoint any licensed agent to sell the classes <strong>of</strong> <strong>insurance</strong> it is<br />

authorized to market in Virginia. However, the appointment is limited to the classes<br />

<strong>of</strong> <strong>insurance</strong> authorized by the agent’s license type.<br />

The employment contract or agent contract with an <strong>insurance</strong> company does not<br />

give you the legal authority to represent the insurer. As noted, your contract with the<br />

<strong>insurance</strong> company is not the same as an appointment. An appointment is a formal<br />

notification from the <strong>insurance</strong> company to the Bureau, for which the insurer pays<br />

a processing fee.<br />

A company must make an appointment within 30 days <strong>of</strong> the date <strong>of</strong> execution<br />

<strong>of</strong> the first <strong>insurance</strong> application you submit. Companies should verify this before<br />

filing appointment notifications with the Bureau. Also, you must be notified by the<br />

company <strong>of</strong> your appointment within the same 30-day period.<br />

Upon receipt <strong>of</strong> an appointment notification, the Bureau will verify that you hold an<br />

appropriate license and that the appointment is proper. The Bureau will mail you an<br />

Acknowledgment <strong>of</strong> Appointment within five days <strong>of</strong> receipt <strong>of</strong> a valid appointment<br />

notification from the company. Do NOT assume that a company has appointed you<br />

unless you receive an Acknowledgment <strong>of</strong> Appointment from the Bureau.<br />

The appointing company will also be notified within five days <strong>of</strong> the Bureau’s receipt<br />

<strong>of</strong> an appointment. That notice indicates either that the appointment is invalid or<br />

that the appointment has been recorded and that you were notified.<br />

You may continue to solicit and submit applications to a company for a period <strong>of</strong> 45<br />

days from the date you submit the first application to that company. If you do not<br />

receive an Acknowledgment <strong>of</strong> Appointment from the Bureau within this 45-day<br />

period, you must stop soliciting <strong>insurance</strong> on behalf <strong>of</strong> that company until you receive<br />

such acknowledgment. Continued selling, soliciting, or negotiating without a formal<br />

appointment beyond the initial 45 days allowed by law would place both you and the<br />

<strong>insurance</strong> company in violation <strong>of</strong> Virginia law.<br />

Agents who have not received an Acknowledgment <strong>of</strong> Appointment are urged to<br />

contact the appointing insurer well before the end <strong>of</strong> the 45-day period to verify that<br />

the appointment was submitted to the Bureau. If it was submitted, the agent should<br />

contact the Bureau to determine the status <strong>of</strong> the appointment.<br />

An agent’s or business entity’s appointment remains valid as long as the company’s<br />

authority continues, until the appointment is terminated, suspended, or revoked by<br />

the Bureau or until the company terminates it.<br />

Renewal <strong>of</strong> Appointments<br />

Appointments must be renewed annually by June 30. This is done by the <strong>insurance</strong><br />

company. If a company fails to renew your appointment or terminates your<br />

appointment at any time, it must notify you in writing within five days. Once you<br />

receive such notice, you must immediately stop soliciting applications on behalf <strong>of</strong><br />

that insurer.<br />

The Bureau will not notify you <strong>of</strong> appointment cancellations. It is your responsibility<br />

to keep track <strong>of</strong> your appointment status and to keep your license in force.<br />

CHANGES OF ADDRESS OR NAME<br />

Each licensed agent is required by law to notify the Bureau in writing within 30<br />

calendar days <strong>of</strong> any change <strong>of</strong> residence or name. Virginia law requires all <strong>of</strong>ficial<br />

correspondence is mailed to the agent’s residence address.<br />

When notifying the Bureau <strong>of</strong> address changes, please use the online address change<br />

option on the Bureau’s Web site at https://boi.scc.<strong>virginia</strong>.gov/agentUpdate/. If<br />

changing a name, moving out <strong>of</strong> Virginia, or a nonresident moving from one state<br />

to another, please use the Virginia Service Request Form, PIN 5001, which can be<br />

downloaded from http://scc.<strong>virginia</strong>.gov/division/boi/webpages/boiproducer.htm. A<br />

licensed resident agent who moves his or her residence from Virginia has, by law, all<br />

licenses terminated on the date the agent moved.<br />

The Bureau acknowledges all formal notifications <strong>of</strong> address changes and name<br />

changes. If you have not received an acknowledgment within 30 days, please contact<br />

the Bureau to determine the status <strong>of</strong> your notification. Please note that changes made<br />

to your address or name by Promissor do not update the Bureau’s system. You must also<br />

notify the Bureau <strong>of</strong> address and/or name changes by using either the on-line option<br />

or by submitting the Virginia Service Request Form, which may be downloaded from<br />

the Bureau’s website.<br />

TEMPORARY LICENSE<br />

In certain circumstances, a Virginia resident may be issued a temporary license<br />

and appointment. Submit inquiries for information on this procedure to<br />

bureau<strong>of</strong><strong>insurance</strong>@scc.<strong>virginia</strong>.gov.<br />

ASSUMED OR FICTITIOUS NAMES (TRADE NAMES)<br />

Any person or business entity conducting the business <strong>of</strong> <strong>insurance</strong> in this<br />

<strong>Commonwealth</strong> under an assumed or fictitious name is required by law to notify the<br />

Bureau in writing at bureau<strong>of</strong><strong>insurance</strong>@scc.<strong>virginia</strong>.gov. This notification may occur<br />

either when the application for a license is filed or when the assumed or fictitious<br />

name is adopted, changed or discontinued.<br />

The Bureau will acknowledge all formal notifications <strong>of</strong> new or changed trade names.<br />

If you have not received an acknowledgment within 30 days, please contact the<br />

Bureau to determine the status <strong>of</strong> your notification.<br />

LICENSING OF AGENCIES<br />

Agencies must be licensed in order to sell, solicit or negotiate <strong>insurance</strong> coverage<br />

and/or to receive commissions.<br />

Resident Agencies<br />

Business entities domiciled in the <strong>Commonwealth</strong> <strong>of</strong> Virginia may obtain license<br />

authority if all <strong>of</strong> the following apply:<br />

• The applicant pays all required fees.<br />

• The applicant submits to the Bureau either the agency application for<br />

licensure (PIN4052) or a completed NAIC Uniform Application (provide<br />

updated demographic information if it has changed).<br />

• The business entity must have designated a licensed producer responsible<br />

for the business entity’s compliance with the <strong>insurance</strong> laws, rules and<br />

regulations <strong>of</strong> the <strong>Commonwealth</strong> <strong>of</strong> Virginia.<br />

• A corporation, limited liability company or limited partnership must<br />

obtain from the Clerk <strong>of</strong> the Commission a certificate <strong>of</strong> authority,<br />

certificate <strong>of</strong> registration or certificate <strong>of</strong> limited partnership, respectively.<br />

Nonresident Agencies<br />

Virginia law (§38.2-1836) allows the Bureau to issue a nonresident license to a<br />

corporation, limited liability company, limited partnership or partnership only if its<br />

home state would issue a similar license to a Virginia corporation, limited liability<br />

company, limited partnership or partnership.<br />

A business entity licensed in its state <strong>of</strong> residence may obtain equivalent license<br />

authority in Virginia if all <strong>of</strong> the following apply:<br />

• The applicant pays all required fees.<br />

• The applicant submits to the Bureau either the application for licensure<br />

that was submitted to the home state or a completed NAIC Uniform<br />

Application (provide updated demographic information if it has changed).<br />

• The applicant’s home state issues nonresident agency licenses to residents<br />

<strong>of</strong> Virginia on the same basis.<br />

• The business entity must have designated a licensed producer responsible<br />

but they are required to furnish pro<strong>of</strong> <strong>of</strong> home state compliance following the end <strong>of</strong><br />

APPLICATION FORM<br />

1. Make sure you use the correct form. The form in this <strong>handbook</strong> (PIN 3001) is ONLY for the use <strong>of</strong> applicants<br />

seeking individual Life and Annuities, Health, Variable Contracts, Property and Casualty, Personal Lines<br />

or Title licenses. If you are applying for any OTHER type <strong>of</strong> license, do NOT use this form. Instead, visit the<br />

Bureau’s Web site at http://www.scc.<strong>virginia</strong>.gov/division/boi/webpages/boiproducer.htm to determine what form<br />

you need or call the Bureau’s interactive voice response (IVR) number: 804.371.9631.<br />

Residents or nonresidents applying for Life and Annuities, Health, Variable Contracts, Property and Casualty, or<br />

Personal Lines licenses may instead use the NAIC Uniform Application for Individual Insurance Producer License,<br />

which is available at the National Insurance Producer Registry (NIPR) Web site at:<br />

2. Be sure to complete both the Home (Resident) Address and Business Address sections <strong>of</strong> the application. Virginia<br />

law requires that you provide a residential street address as your address <strong>of</strong> record, so do NOT use a P.O. Box<br />

Number instead <strong>of</strong> a street address.<br />

3. Make sure you have answered ALL questions on each page <strong>of</strong> the application form. If a question is not applicable<br />

to you, mark the “N/A” box. If there is not an option for “N/A”, you must answer either “Yes” or “No.”<br />

4. Don’t forget to SIGN AND DATE the application.<br />

5. You must have the following items attached to the application (if applicable):<br />

• Nonrefundable License Application Processing Fee—$15 for each license. Payable by certified check,<br />

bank check, teller’s check, money order or company check made payable to: State Corporation Commission.<br />

PERSONAL CHECKS WILL NOT BE ACCEPTED UNLESS CERTIFIED. There is a $25 penalty for<br />

returned checks. NOTE:Life and Annuities and Health are two separate licenses, which require a $15 fee for each.<br />

• VIRGINIA RESIDENTS ONLY: DMV-assigned number. If you choose to use a DMV-assigned number<br />

in lieu <strong>of</strong> your Social Security number, you must notify the <strong>insurance</strong> company to appoint you under that<br />

number, and you must use that number to file your continuing education credits.<br />

• VIRGINIA RESIDENTS ONLY: Criminal History Record Report. A current (no more than 90 days old)<br />

Criminal History Record Report must be enclosed with each application, and must be obtained through the<br />

Virginia State Police by calling 804.674.2000 or download the form (SP-167) from its Web site at: http://www.<br />

vsp.state.va.us/forms.htm.<br />

• VIRGINIA RESIDENTS ONLY: Certificate from the American College—if you are a CLU and want the<br />

Life and Annuities examination or the Health examination, or the combination Life and Health examination<br />

waived, you must submit pro<strong>of</strong> <strong>of</strong> your CLU designation.<br />

• VIRGINIA RESIDENTS ONLY: Certificate from the American Institute for Property and Liability<br />

Underwriters—if you are a CPCU and want the Property and Casualty examination or the Personal Lines<br />
