<strong>India</strong> <strong>–</strong> <strong>Employment</strong> <strong>Visa</strong> <strong>without</strong> <strong>India</strong>n <strong>Employment</strong> Contract<br />
The consular mission of the Republic of <strong>India</strong> has reported that visas in the category “<strong>Employment</strong>” must also be<br />
applied for by business travellers if the purpose of visit no longer meets the prerequisites, as <strong>de</strong>fined by the<br />
consulate, for the category “Business”. The category “Business” is now only approved for the following purposes<br />
of visit: meetings and talks, investment-related visits and purchase trips.<br />
All other purposes of visit, such as contract signing and consulting, etc., now also fall into the category<br />
“<strong>Employment</strong>”.<br />
Application for an employment visa WITHOUT submission of an <strong>India</strong>n employment contract is only possible if<br />
the traveller is being sent out to <strong>India</strong> by his German company, his salary continues to be paid from Germany,<br />
and he is travelling to <strong>India</strong> for the purpose of, for example, assembly work, technical work, or training courses.<br />
IMPORTANT: STRICT CONSULAR JURISDICTION<br />
Berlin accepts the following applications: from applicants resi<strong>de</strong>nt in Berlin, Bran<strong>de</strong>nburg, Mecklenburg-<br />
Vorpommern, Sachsen, Sachsen-Anhalt, and Thueringen<br />
Frankfurt accepts the following applications: from applicants resi<strong>de</strong>nt in Hessen, Nordrhein-Westfalen,<br />
Rheinland-Pfalz, and Saarland.<br />
Hamburg accepts the following applications: from applicants resi<strong>de</strong>nt in Bremen, Hamburg, Nie<strong>de</strong>rsachsen, and<br />
Schleswig-Holstein.<br />
Munich accepts the following applications: from applicants resi<strong>de</strong>nt in Ba<strong>de</strong>n-Württemberg and Bayern.<br />
The <strong>India</strong>n Consulates General of <strong>India</strong> require a new visa application form. <strong>Visa</strong> application forms shall<br />
be accepted only online with effect from June 20, 2011.<br />
Applicants may follow the procedure given below:<br />

Please note that the consulates have different visa application forms. Please select the right consulate in the<br />
mandatory field “<strong>India</strong>n mission” at the top of the online form!<br />
1. Fill in all the relevant fields and follow instructions on the screen to complete the form.<br />
All mandatory fields must be filled in <strong>without</strong> any mistakes; after online submission to the <strong>India</strong>n authorities a further<br />
correction is impossible.<br />
2. Print your completely filled-in Online Application Form including barco<strong>de</strong>, sign it twice (below the space for the photo<br />
on page 1 and at the end of the application form on page 2 and submit it in original to our responsible service office<br />
with the following:<br />
• Relevant documents supporting your application <strong>de</strong>pending on the type of visa (see below)<br />
• Two recent passport-size photos (50x50mm,<br />
color & i<strong>de</strong>ntical with white background and<br />
<strong>without</strong> any frame; please follow the instructions<br />

• Please do not staple the photograph. Affix the<br />
photos only with a paper clip on the form and sign<br />
in the column below the photo space and on page<br />
2 at the end of the form.<br />
• Your original passport (should be valid for more than 180 days at the time of submission).<br />
For “non-German” applicants a valid resi<strong>de</strong>nce or stay permit<br />
Non-German citizens must submit proof of their valid right of domicile or EU freedom of movement permit (a<br />
clearly legible copy is sufficient). The right of domicile must have a remaining validity period of at least 6 months.<br />
Important: It must be proved that the applicant has been living in Germany for at least two years. If such proof<br />
cannot be furnished, the applicant must apply for his or her visa at the competent <strong>India</strong>n mission in their home<br />
country.<br />
1 letter of the German company sending out the employee, stating the following <strong>de</strong>tails: traveler’s name,<br />
duration of visit, <strong>de</strong>tailed <strong>de</strong>scription of work to be performed and exact place of work, and the full address and<br />
telephone number of the <strong>India</strong>n business partner. This letter must also confirm the assumption of travel expenses<br />
and costs of the stay. The <strong>de</strong>sired visa validity period must also be mentioned.<br />

1 invitation letter from the <strong>India</strong>n business partner is required (a clearly legible fax copy is sufficient). The<br />
invitation must inclu<strong>de</strong> all the <strong>de</strong>tails also required in the employee transfer letter. It is urgently recommen<strong>de</strong>d that<br />
the two accompanying letters (invitation and employee transfer letter) are drafted with i<strong>de</strong>ntical content. It should<br />
be mentioned that the required activity cannot be achieved by an <strong>India</strong>n citizen.<br />
1 copy of the Certificate of Incorporation of the <strong>India</strong>n partner company must be attached<br />
Contractual papers: copy of the contract between the German company and the <strong>India</strong>n company in which<br />
the provision of personnel is agreed. These contracts must inclu<strong>de</strong> the following <strong>de</strong>tails: traveler’s name, duration<br />
of visit, <strong>de</strong>tailed <strong>de</strong>scription of work to be performed and exact <strong>de</strong>tails of place of work, working hours, salary,<br />
payment of tax, travel expenses, and project name. The <strong>de</strong>sired visa validity period must also be mentioned.<br />
Qualification certificates: copies of the applicant’s specialist certificates. The <strong>de</strong>cision on the visa validity period<br />
issued lies with the competent consulate. In or<strong>de</strong>r to obtain a 1-year visa, it is recommen<strong>de</strong>d that all submitted<br />
documents correspondingly state this same validity period. Should the corresponding <strong>de</strong>tails in these documents<br />
differ, the consulate will foreseeably only approve the minimal validity period.<br />
The consular missions of <strong>India</strong> reserve the right to <strong>de</strong>mand additional documents, <strong>de</strong>pending on the respective<br />
case.<br />
Important: the place of work is registered in the visa. Hence the visa is only valid for this place of work. In the<br />
event of a new place of work, a new employment visa must also be applied for.<br />
Consular fees charged by the embassy per person (for German citizens):<br />
<strong>Employment</strong> visa<br />
Valid for 1 to 6 months as of the issue date for multiple entries €97.00<br />
Valid for 1 year as of the issue date for multiple entries €147.00<br />
Consular fees for citizens of other countries on request.<br />
Processing takes at least 14 embassy working days.<br />
The consular missions of <strong>India</strong> reserve the right to <strong>de</strong>mand additional documents, <strong>de</strong>pending on the respective<br />
case.<br />
The consular missions of the republic of <strong>India</strong> have reported that hol<strong>de</strong>rs of an employment visa must<br />
have themselves registered by the FRRO in <strong>India</strong>. We recommend that all travelers ask about the<br />
corresponding formalities and <strong>de</strong>adlines immediately on arrival since the registration regulations may<br />
change continuously and procurement of the documents required for registration may take several<br />
days. In this connection, please note the special information on registration with the FRRO.
