Florida Building Commission
nears completion of 2010 Code
By Jennifer Hatfield, FSPA Government Relations Consultant
The Florida Building Commission
met December 7-8 in Melbourne for its
last meeting of the year. In addition
to addressing regular meeting items,
the commissioners met in a rule
development workshop to make final
decisions on recommendations given
by the Technical Advisory Committee
on all proposals and comments
submitted for adoption into the 2010
Florida Building Code.
The Florida Swimming Pool
Association made a number of
code proposals this year, as well
Americans with Disabilities Act
(ADA) - What you need to know
By Jennifer Hatfield, FSPA Government Relations Consultant
The original Americans with
Disabilities Act was signed into law in
1990 and it did not have accessibility
standards for swimming pools / spas. In
2004, the Department of Justice issued
guidelines that included pools / spas, but
What is ADA The ADA is a civil rights law
that prohibits discrimination based on disability.
Discrimination occurs when an individual is treated less
favorably because of a disability. It requires reasonable
accommodation, unless doing so causes significant
difficulty or expense. The Department of Justice (DOJ)
is the federal agency charged with enforcement.
as providing a number of public
comments on proposals made by
others regarding swimming pools
and spas. In the end, all of the FSPA
proposals and suggested edits to
other proposals were adopted. This
marks another successful code cycle
for the Association.
The next step is for the Florida
Building Commission staff to insert
all changes into the 2010 Code. A
supplement format of the code will
be available to review for accuracy
they were not law.
July 2010, the Department of Justice
announced that revised regulations made
those guidelines into law and take effect
on March 15, 2011. Compliance will be
required no later than March 15, 2012.
YOUR BUSINESS
Use a FSPA benefit every month
Wendy Parker Barsell
FSPA Executive Director
PRESIDENT’S COLUMN
Thank you for this chance to grow
Richard Moseley
FSPA President
As your trade
association, FSPA
c o n t i n u o u s l y
works to provide
programs and
benefits to the
swimming pool
and spa industry.
There is a wide
variety of options,
everything from
this newsletter
to a prescription
discount card. Each member has differing
wants and needs based on their type and
size of business. But many of our members
don’t take advantage of all the benefits that
they can.
In 2011, I’m asking our members to
take a look at the list of programs and
benefits we offer and see if you can start
utilizing more this year. Where do you start
Here is a list offering one per month.
T h e f i r s t
thing I would like
to say is that I am
honored to be the
new president of
the FSPA. I also
want to be sure
to congratulate
Wendy (FSPA
E x e c u t i v e
D i r e c t o r ) a n d
Gary Barsell on
the birth of their
daughter, Parker Grace Barsell. Mom and
Parker are doing well; what a great way to
start out the year.
The excitement I have with this
opportunity to grow, work and learn from
all the awesome members of FSPA is
overwhelming to me at times. I have always
tried to ask the questions that I thought
members might ask if they were sitting in
on a committee or board meeting, and I
encourage this year’s Board of Directors
to do the same. Discussion is never a bad
January – send your credit card
statement to FSPA and see if the new credit
card processing program can save your
company money.
February – attend the Orlando Pool &
Spa Show February 11-12.
March – be sure that your (or an
employee’s) college age student applies for
the FSPA Scholarship program by April 1;
an average of $750 is given out to qualified
applicants.
April – attend a local chapter meeting
to network with other professionals and
possibly earn CE credit for a course.
May – promote swimming pool safety
by distributing FSPA safety brochures,
coloring books and pool watcher badges
to your customers.
June – attend the FSPA quarterly
Board of Directors meeting in Orlando
to see how the committees function and
what the association is working on for your
industry.
thing and it has is no ending.
During the next year I have the great
pleasure of working with the best Executive
Committee ever and I look forward to
learning from each of them. Our Board
of Directors continues to impress me with
their desire to improve our industry and
look to answer today’s questions with future
consequences and questions in mind. We
get into our time machines and try to guess
what may be next and see how we can
be ahead of the game instead of simply
reacting to the results of said game. If
a Board Meeting is held near you in the
future, please attend. They are free and I
don’t know anyone who has ever left their
first state Board Meeting without saying,
”Wow,” at least once.
One of the cool things that the president
has the chance to do is go to each Chapter
and sit with all the members. I look forward
to meeting new people and seeing old
friends as I try to get to all the Chapters
this year. This organization is unique in
that it is driven by the people who do much
July – be sure that your company is
listed in the proper categories on the FSPA
“Find a Pool Pro” search page (this page
is used by more than 1,000 consumers
each month!).
August – provide your customers with
information about preparing their swimming
pool and spa for hurricanes – a brochure is
available from FSPA.
September – sign up for the prescription
discount card (it’s free!).
October – submit an entry to the FSPA
Design Awards program to earn recognition
for your work.
November – sign up for GreenFlag
Profit Recovery Services to collect your past
due accounts from the past year.
December – order holiday cards for
your customers at a discount.
Visit www.FloridaPoolPro.biz for a
complete list of programs or check with your
local Chapter for additional information.
of the in-field work in our industry. Meeting
and learning from you is something I look
forward to for this year.
Please feel free to tell me and your
Board of Directors what we can do this year
and how we can make this Association and
industry better. The Executive Committee
and Board will continue to try, but it
takes all of our members to be a GREAT
organization.
I also want thank all past presidents
and Hall of Fame inductees for everything
they have done to make this organization
what it is; please stay involved or come back
and join us as we try to predict the future.
Wendy, thank you for this chance
to work with you and the great staff in
Sarasota. I must also take a quick second
to thank my staff at Champagne Pools
for allowing me the time this year to grow
and learn. I will end with a truly special
thank you to Eva Adcock for being such
an awesome person and president for us
in 2010.

ENERGY TALK
Don’t wait to sell
By Rick Myers, Auto Pilot Systems, Inc.
Florida Pool Pro sm • January 2011 7
When a piece of equipment is sold for a
swimming pool, many times we assume that
there is no chance to replace that equipment
until it fails. So is that customer out of the
market for replacement or upgrade for a
number of years Not necessarily so.
Recent changes in the efficiencies of
equipment, newer and better equipment,
and changes that are always good for the
end user should tell us that with a customer
that is energy conscious, information on
upgrades should always be passed along
to them. Let them make up their mind on
whether or not to change. Some people
buy a new car every year or so, even
though the current vehicle is in perfect
working condition. We get new furniture or
the latest and greatest piece of electronic
equipment because it is better or faster or
simply because we can. Why should pool
equipment be any different
Recently I had the pleasure of
accompanying a customer to a jobsite
where there were several, large heat
pumps installed for a pool. Even though
they still worked, the property was looking
to avoid a large repair bill on the 13-
year-old equipment. As we talked to the
property manager, he asked if he would
save any operating expenses on the newer
equipment. I told him that there would be
some savings, and I knew that the new heat
pumps were more efficient than they were
in 1997. I also told him that I would do an
audit on both scenarios to give him accurate
numbers both ways. To my surprise, I found
that upgrading to the 2010 models, with the
higher COP’s and higher BTU ratings, would
save anywhere between $250 and $350
per month! The savings in electricity would
almost pay for the equipment change out.
So, I got to thinking that with all the
positive changes in pumps, heat pumps,
cleaners, lights, automation, etc., shouldn’t
we let our customers know about these
changes and the money that they can save
by upgrading Instead of just assuming
that they won’t be ready to change until
the existing equipment breaks, be in front
of the issue and educate your customers
on all of the new changes. Let them decide
on whether to upgrade or not. How can we
accomplish this E-mails (FSPA members
can receive a discount on Constant Contact
programs), mailers, displays in our stores,
etc. or even the old fashioned way of just
calling them up and asking if you can go to
their property and show them the changes.
All manufacturers have literature and
brochures that will show the savings and
you can even give payback analysis that
breaks down savings very accurately.
The moral of the story is that your
customers deserve the very best and the
very latest in pool equipment. Don’t wait
until the equipment fails to begin selling.
Make you customers the best educated they
can be. Trust me, you will get some sales
in the process.
Look and act like a professional
By Joan Vienot, Pool Pal, Inc.
THE SCOOP ON SERVICE
Everyone we meet is a prospective
client or a possible referral so first
impressions matter. So do second and third
impressions. I rely on my first impression
when I hire, and I expect that my clients
rely on their first impression when I call
on them.
When I interview an applicant for
employment, whether consciously or
subconsciously, I know that there are certain
things I look at that may have nothing to do
with competence, but they have everything
to do with whether the individual is a good
candidate. Following are some of the
thoughts that might go through my head.
My best pool operators are both men and
women, but for the sake of consistency, I am
writing this as if it were a male applicant.
1. Does he look me square in the eye
(And are his eyes clear and his pupils
normal)
2. Does he look clean and neat and is
he dressed appropriately
3. If I met him at his car, when he
opened his door, was it neat inside,
or did food wrappers and trash fall
out onto the ground
4. Does he smell like cigarettes
(Sorry, smokers, but it’s a fact –
5.
6.
7.
cigarettes are not cool, and smokers
as a group have higher absenteeism
than nonsmokers.) Even worse,
did he throw his cigarette onto the
ground when he got out of his car
Does he let foul language slip into
his conversation
Does he behave respectfully towards
my other employees I need for him
to be “a good fit.”
Was he on time for our appointment
Or did he at least call if he was going
to be late
It is not very different when our
customers hire us as contractors. I know
when I hire a contractor at my home, in
addition to licensing, experience, and
references, I want a contractor who is
punctual, who respects my time, and
who looks me straight in the eye (with his
sunglasses off). I don’t care if he has tattoos
and piercings but I want a contractor who
bothered to change his dirty shirt to a clean
one before our appointment, and I notice
if his truck is clean and if there is a gap
between his shirt and his pants. There is
no smoking at my house, and I sure don’t
want to see a cigarette butt in my driveway
after the contractor leaves. I need to feel
comfortable enough to leave my property
with him there and not be worried about
whether he will abuse my dog or be eyeing
my daughter. And I want him to keep his
shirt on while he is working. He needs to
be “a good fit.”
In short, I want my contractor to look
like and act like a professional. As a
contractor I learned how important this was
within the first six months of starting my pool
service business more than 25 years ago.
I probably had only six contracts cleaning
and operating pools for condominiums in a
resort area. I was annoyed by members of
the homeowners associations who would
come up to me and want to give me advice
on how to operate the swimming pool.
When I got a little extra cash, I had my
business name printed on the back of my
shirts and I bought some magnetic signs
for my truck doors. Instantly, overnight,
instead of people offering me advice, they
were coming up and asking my advice. I
was floored. I had learned the first tenet of
professionalism, dress the part. Look like
a professional. No matter how competent
we are, a professional appearance is
prerequisite for credibility.
INSURANCE UPDATE
Thank you for 2010 and cheers to 2011
By David Griffiths, Insurance By Ken Brown
From Ken Brown and his family as
well as all of us at Insurance by Ken Brown
(IBKB), we express our profound sense of
appreciation and gratitude to FSPA and all
of the FSPA members for the opportunity to
serve your insurance needs.
The partnership between IBKB and
FSPA/NSPI spans a time of over 25 years.
In that time we have had the opportunity
to serve thousands of business in the
swimming pool service, swimming pool
construction and related industries with
their insurance needs. Our entire firm is
dedicated to FSPA and we proudly serve
in many different capacities.
Along with IBKB being the endorsed
insurance agency by FSPA, the Amerisure
Insurance Company has been the endorsed
insurance carrier for much of those 25
years. They too are fully committed to
FSPA. We have dedicated individuals in
the underwriting, claims adjusting, loss
control services and audit department
who work exclusively with IBKB and FSPA
to help keep both claims and premiums
down! In addition we have the FSPA /
IBKB / Amerisure group dividend plan which
returns hundreds of thousands of premiums
to participating members each year. On
behalf of all of the wonderful people we work
with at Amerisure we express their gratitude
for the partnership as well.
As we traveled the state of Florida in
2010, we have seen many of our clients
speaking more bullish about their future
and the future of this industry. They had
more work and more opportunities last year.
No, not the “good ole days,” no mistake,
but easily better than 2009! Unfortunately,
the profit margin seems to remain slim. It
appears that one bottle neck (at least) is
the difficulty homeowners continue to have
securing loans to build pools. Hopefully the
real estate market will gain a better footing
in 2011 with more stable property values,
fewer foreclosures, and lending will begin
to loosen.
So, the obvious question is, what
adjustments do we all make as we enter
2011 Let’s look at things as the glass half
full! We have new leadership in Tallahassee
which will hopefully, over time, rebuild our
Florida economy. While it is true that we do
not control the economy there are things we
all can do to help control our own individual
destiny.
Believe it or not, your insurance program
can play a role in this. By “program” we
refer to the triangular partnership between
your business, your insurance agency and
your insurance carrier. Next month we are
going to discuss a few areas the triangular
insurance partnership can positively affect
your business and improve your bottom
line!
For now though, thank you for allowing
IBKB to serve FSPA in 2010 and for these
many years. All of us appreciate all of you!
Cheers to 2011!
DIGGING UP IDEAS
The market is always changing
By Lori Bryant, Bryant Pools
In choosing a topic for this article
I reflected on changes in our industry.
Some thirty years ago building pools in this
area was more of a production drill. The
market was very price driven and to make
a dollar pool builders had to work fast and
efficient.
In the eighties the desire of home
owners to experience the Florida lifestyle
was very popular. A palm tree in the front
yard and a pool in the back yard became a
theme for Florida suburbia.
Slowly we saw a demand for more
than just a bull nose marcited pool. By the
nineties pools became almost unlimited
in their options; automation, sanitization,
fiber optics, you name it. It seems the pool
builders’ job was to keep up with what was
new and innovative. Successful builders
soon learned that they could increase profits
by adding product lines.
Pools became more and more
complicated and soon a new era rushed in.
It was the era of the Internet, where every
consumer interested in building a pool could
read, study, compare and analyze. The
consumer had become more demanding
then ever. Pools built during the last
decade seem to have even more options
and choices. Many customers suggested
products they saw on the neighbor’s pool,
and the pool builders’ knowledge and
understanding of all available products
became pivotal.
Now things have changed again.
Today even with the Internet the consumer
cannot keep up with all of the changes
and options available. Today's pools are
designed to be safe and energy efficient
and easy to operate. We are in a very
price driven market again, but the lesson
here is to not short sell the consumer. The
customer of today should be informed
about energy, safety, maintenance and
sanitization improvements.
I think the current analysis is that our
market is still price sensitive. However,
as contractors it is still in our best interest
to offer and explain some of our new and
existing products. As in the past, successful
contractors will be those that can use their
understanding of innovative products and
use them in their projects.

base and experience in the industry, Rich’s
stand-out characteristic is his heart. Talking
with some of Rich’s clients, you would think
FBC nears completion of 2010 Code Cycle
Continued from front page
in the beginning of January. If any party
requests a rule adoption hearing on any
part of the revised code, it would be held at
the end of January. The rule adopting the
new code will then be submitted to the 2011
Legislature for approval. The 2010 Florida
Building Code will go into effect December
31, 2011.
**Important to note: The Glitch Fix
Cycle begins in March. Glitch amendments
have to be submitted by March 18. The goal
is for any glitches to be fixed and adopted
into the 2010 Code prior to print in October
2011 and the new code going into effect
December 31, 2011. If any pool/spa glitches
are needed, FSPA will have a chance to do
so prior to the new code going into effect.
A summary of the changes to the 2010 Code include the following:
NEW requirements for existing residential pools & spas. These changes will be found
in the Florida Existing Building Code, not in the sections contractors typically find pool/spa
requirements. These changes include:
o Specifically requiring pool / spa circulation systems or components undergoing
alterations to comply with Section 6 of the ANSI/APSP-7 Suction Entrapment
Avoidance Standard,
o Providing broad guidance that any pool / spa component or system undergoing
alterations (not repair) comply with Chapter 41 of the Residential Code (the
residential pool section). In order to ensure certain alterations do not trigger Chapter
41 compliance, the following exceptions were provided for:
• Installation of pavers or coating to an existing pool or spa deck,
• Re-tiling a pool or spa,
• Re-plastering or re-lining a pool or spa, except the drain cover must
comply with the 2007 ASME A112.19.8 Standard,
• Installation of a water filtration or sanitizations component or system,
• Installation of an automation or a time switch component or system,
• Installation of a heating component or system.
o The exceptions laid out do not trigger the existing building code pool/spa
requirements. The FSPA will continue to look into the existing pool/spa requirements
and a discussion will occur at the January Board and Committee meetings.
Addition of provisions (found in the International Codes) for pools in a flood hazard area.
Energy efficient language for pools and spas
that implement the legislative mandate (House
Bill 663) and provide additional clarifications
to the energy requirements. These changes will
be found in the Florida Energy Conservation Code,
not in the sections contractors typically find pool/spa
requirements. The changes include:
o Pool and spa energy efficiency heating
requirements that follow federal requirements
manufacturers already meet,
o Residential filtration pump and motor
requirements (minimum two-speed if installing a
pump or motor 1 HP or greater),
o Portable spa energy efficiency
requirements,
o Removed an unenforceable portion
of the pool/spa cover requirements and
provide for additional means to come into
compliance,
o Appendices that provide additional
criteria to implement the new energy
requirements for residential pools and inground
spas, and portables spas based on
the draft APSP Energy Standards.
An exception to panic hardware requirements
found in Chapter 10 of the Building Code,
allowing outdoor gates from residential and
commercial pools or pool decks to go without
such devices unless the pool deck serves as
a portion of the means of egress of a building
or has an occupant load of 300 or greater.
Clarification to prevent adding a building fixture
count to a pool fixture count when determining
the number required for commercial pools that
only serve a designated group of dwelling units
and is not for use by the general public.
Clean-up language of barrier alarm
requirements found in Chapter 41 of the
Residential Code and in Section 424.2 of the
Building Code (updated the UL Standard that
alarms must meet to the most recent version
and made changes to language that was
inconsistent with the UL Standard).
Americans with Disabilities Act
(ADA) - What you need to know
Continued from front page
(Title III) and their requirements are virtually the same.
There are some exceptions. Title II facilities can be excluded
if they can prove modifications would significantly alter the historic
nature of the building or would create undue financial hardship for the
facility. Title III facilities can be excluded if they can demonstrate that
reasonable accommodations are not readily achievable. However, the
Department of Justice has made it very clear that, given the flexibility
and cost of a pool lift, it would be very difficult for any entity to escape
their responsibility to provide access.
ADA regulations are enforced directly and indirectly. Most direct
enforcement is a result of civil lawsuits. If the plaintiff prevails, the
court usually orders the defendant to remedy the violation, and pay
attorney’s fees for the plaintiff. There are generally no monetary
awards.
The ADA is also enforced indirectly by requiring compliance
prior to receiving licenses, certifications, or grants from prevailing
authorities. For example, prior to a local government receiving a
federal grant, it must provide proof of compliance with a wide array of
regulations ranging from environmental mandates to equal opportunity
programs to ADA compliance. In addition, in most localities, any new
construction or building modification will not receive a certificate of
occupancy without meeting all relevant ADA requirements. Many
states will adopt the latest guidelines into their state or local building
codes. See page 17 for frequently asked questions.

ADA Frequently Asked Questions
Florida Pool Pro sm • January 2011 17
What sections of ADA apply to swimming pools,
wading pools and spas
1. Title II (Public Industry) – All public entities at the local and state
levels, i.e. school districts, municipalities, cities and counties. 2.
Title III (Private Industry) – Any place of public accommodation
(commercial facilities), i.e. a place of recreation, education, or
lodging. More details on what constitutes a public accommodation
will be in a separate document available soon.
Do the new requirements apply to both existing
and new pools / spas
Yes, new and existing swimming pools, wading pools and spas
(in-ground and portable) that fall under the Title II or III categories
must provide accessible entry no later than March 15, 2012.
However, it is highly recommended these means of access be
added as soon as possible.
What are the permitted means of access
Pool lifts, sloped entries (ramps), transfer walls, transfer systems,
or stairs. The criteria for each of these can be found in chapter
10, section 1009, of the revised ADA guidelines; a link to this is on
the FSPA Web site at www.FloridaPoolPro.biz. The number and
type of accessible entries depends on the structure.
How will this be enforced
It will vary from state to state, but does not change the fact this is
the law. Direct action against noncompliant facilities may be taken
by local building or health officials enforcing state or health building
codes that reference the new guidelines. Individuals may also file
civil lawsuits against noncompliant facilities. Indirect enforcement
can occur when a local government becomes ineligible for a federal
grant unless all facilities are in compliance.
How does the ADA affect existing state and local
building codes and health department rules for
public pools
Existing codes and rules remain in effect. The ADA allows the
Attorney General to certify that a state law, local building code, or
similar ordinance meets or exceeds the minimum requirements.
Any state or local government may apply for this certification.
The Florida Department of Health public pool rule (64E-9, F.A.C.)
references the 1990 ADA and will be updated to reflect the revised
law, but timing of such is indeterminate at this time. However, in
Florida, the ADA is typically imposed by the building code and
the Florida Building Commission is currently working to insert
the revised ADA guidelines into the Florida Accessibility Code.
Once complete, the FBC will seek Attorney General/Department
of Justice Certification. This will help to ensure direct enforcement
by local building officials throughout Florida.
Are there service requirements for ADA
equipment
Yes, the regulations provide a “Maintenance of Accessible
Features” provision which mandates the accessibility features
must be maintained in working order.
What are the swimming pool requirements
Pools with more than 300 linear feet of wall require at least two
accessible entries and pools with less than 300 linear feet require
at least one. When providing only one means of access, it must
be a pool lift or sloped entry. Wave action pools, leisure rivers,
sand bottom pools, and other pools where user access is limited
to one area are not required to have another entry provided the
one is either a pool lift, a sloped entry, or a transfer system. Catch
pools that have a catch pool edge on an accessible route are not
required to provide a means of access.
*Note: 1) The ADA recommends that when using more than one
means of access they be different types in different locations. 2)
Pool walls at diving areas and where there is no pool entry because
of landscaping or adjacent structures are still to be counted when
determining the linear feet of pool wall.
What are the spa requirements and how does ADA
apply to portable hot tubs
The ADA does not distinguish between in-ground and portable
spas. Both Title II and III entities that have any type of spa are
required to provide at least one accessible entry. This can be a lift,
transfer wall, or transfer system. When spas are adjacent to each
other, only one spa must provide a means of access. However,
portable spas are not allowed in commercial facilities in Florida,
per 64E-9, F.A.C.
What are the wading pool requirements
Both Title II and III entities are required to provide “accessible
means of entry for wading pools.” Wading pools must have a
sloped entry (ramp). The entry must extend to the deepest part
of the wading pool, but it is not required to provide handrails.
What financial assistance is available to help
employers/owners comply with ADA
A special tax credit is available to help smaller employers make
accommodations. Information discussing the tax credits and
deductions is contained in the Department of Justice’s ADA
