nears completion of 2010 Code<br />

The <strong>Florida</strong> Building Commission<br />
met December 7-8 in Melbourne for its<br />
last meeting of <strong>the</strong> year. In addition<br />
to addressing regular meeting items,<br />
<strong>the</strong> commissioners met in a rule<br />
development workshop to make final<br />
decisions on recommendations given<br />
by <strong>the</strong> Technical Advisory Committee<br />
on all proposals and comments<br />
submitted for adoption into <strong>the</strong> 2010<br />
<strong>Florida</strong> Building Code.<br />
The <strong>Florida</strong> <strong>Swimming</strong> <strong>Pool</strong><br />
<strong>Association</strong> made a number of<br />
code proposals this year, as well<br />
Americans with Disabilities Act<br />
(ADA) - What you need to know<br />

The original Americans with<br />
Disabilities Act was signed into law in<br />
1990 and it did not have accessibility<br />
standards for swimming pools / spas. In<br />
2004, <strong>the</strong> Department of Justice issued<br />
guidelines that included pools / spas, but<br />
What is ADA The ADA is a civil rights law<br />
that prohibits discrimination based on disability.<br />
Discrimination occurs when an individual is treated less<br />
favorably because of a disability. It requires reasonable<br />
accommodation, unless doing so causes significant<br />
difficulty or expense. The Department of Justice (DOJ)<br />
is <strong>the</strong> federal agency charged with enforcement.<br />

o<strong>the</strong>rs regarding swimming pools<br />
and spas. In <strong>the</strong> end, all of <strong>the</strong> FSPA<br />
proposals and suggested edits to<br />
o<strong>the</strong>r proposals were adopted. This<br />
marks ano<strong>the</strong>r successful code cycle<br />
for <strong>the</strong> <strong>Association</strong>.<br />
The next step is for <strong>the</strong> <strong>Florida</strong><br />
Building Commission staff to insert<br />
all changes into <strong>the</strong> 2010 Code. A<br />
supplement format of <strong>the</strong> code will<br />
be available to review for accuracy<br />

overwhelming to me at times. I have always<br />
tried to ask <strong>the</strong> questions that I thought<br />
members might ask if <strong>the</strong>y were sitting in<br />
on a committee or board meeting, and I<br />
encourage this year’s Board of Directors<br />
to do <strong>the</strong> same. Discussion is never a bad<br />

possibly earn CE credit for a course.<br />
May – promote swimming pool safety<br />
by distributing FSPA safety brochures,<br />
coloring books and pool watcher badges<br />
to your customers.<br />
June – attend <strong>the</strong> FSPA quarterly<br />
Board of Directors meeting in Orlando<br />
to see how <strong>the</strong> committees function and<br />
what <strong>the</strong> association is working on for your<br />
industry.<br />

During <strong>the</strong> next year I have <strong>the</strong> great<br />
pleasure of working with <strong>the</strong> best Executive<br />
Committee ever and I look forward to<br />
learning from each of <strong>the</strong>m. Our Board<br />
of Directors continues to impress me with<br />
<strong>the</strong>ir desire to improve our industry and<br />
look to answer today’s questions with future<br />
consequences and questions in mind. We<br />
get into our time machines and try to guess<br />
what may be next and see how we can<br />
be ahead of <strong>the</strong> game instead of simply<br />
reacting to <strong>the</strong> results of said game. If<br />
a Board Meeting is held near you in <strong>the</strong><br />
future, please attend. They are free and I<br />
don’t know anyone who has ever left <strong>the</strong>ir<br />
first state Board Meeting without saying,<br />
”Wow,” at least once.<br />
One of <strong>the</strong> cool things that <strong>the</strong> president<br />
has <strong>the</strong> chance to do is go to each Chapter<br />
and sit with all <strong>the</strong> members. I look forward<br />
to meeting new people and seeing old<br />
friends as I try to get to all <strong>the</strong> Chapters<br />
this year. This organization is unique in<br />
that it is driven by <strong>the</strong> people who do much<br />

When a piece of equipment is sold for a<br />
swimming pool, many times we assume that<br />
<strong>the</strong>re is no chance to replace that equipment<br />
until it fails. So is that customer out of <strong>the</strong><br />
market for replacement or upgrade for a<br />
number of years Not necessarily so.<br />
Recent changes in <strong>the</strong> efficiencies of<br />
equipment, newer and better equipment,<br />
and changes that are always good for <strong>the</strong><br />
end user should tell us that with a customer<br />
that is energy conscious, information on<br />
upgrades should always be passed along<br />
to <strong>the</strong>m. Let <strong>the</strong>m make up <strong>the</strong>ir mind on<br />
whe<strong>the</strong>r or not to change. Some people<br />
buy a new car every year or so, even<br />
though <strong>the</strong> current vehicle is in perfect<br />
working condition. We get new furniture or<br />
<strong>the</strong> latest and greatest piece of electronic<br />
equipment because it is better or faster or<br />
simply because we can. Why should pool<br />
equipment be any different<br />
Recently I had <strong>the</strong> pleasure of<br />
accompanying a customer to a jobsite<br />
where <strong>the</strong>re were several, large heat<br />
pumps installed for a pool. Even though<br />
<strong>the</strong>y still worked, <strong>the</strong> property was looking<br />
to avoid a large repair bill on <strong>the</strong> 13-<br />
year-old equipment. As we talked to <strong>the</strong><br />
property manager, he asked if he would<br />
save any operating expenses on <strong>the</strong> newer<br />
equipment. I told him that <strong>the</strong>re would be<br />
some savings, and I knew that <strong>the</strong> new heat<br />
pumps were more efficient than <strong>the</strong>y were<br />
in 1997. I also told him that I would do an<br />
audit on both scenarios to give him accurate<br />
numbers both ways. To my surprise, I found<br />
that upgrading to <strong>the</strong> 2010 models, with <strong>the</strong><br />
higher COP’s and higher BTU ratings, would<br />
save anywhere between $250 and $350<br />
per month! The savings in electricity would<br />
almost pay for <strong>the</strong> equipment change out.<br />
So, I got to thinking that with all <strong>the</strong><br />
positive changes in pumps, heat pumps,<br />
cleaners, lights, automation, etc., shouldn’t<br />
we let our customers know about <strong>the</strong>se<br />
changes and <strong>the</strong> money that <strong>the</strong>y can save<br />
by upgrading Instead of just assuming<br />
that <strong>the</strong>y won’t be ready to change until<br />
<strong>the</strong> existing equipment breaks, be in front<br />
of <strong>the</strong> issue and educate your customers<br />
on all of <strong>the</strong> new changes. Let <strong>the</strong>m decide<br />
on whe<strong>the</strong>r to upgrade or not. How can we<br />
accomplish this E-mails (FSPA members<br />
can receive a discount on Constant Contact<br />
programs), mailers, displays in our stores,<br />
etc. or even <strong>the</strong> old fashioned way of just<br />
calling <strong>the</strong>m up and asking if you can go to<br />
<strong>the</strong>ir property and show <strong>the</strong>m <strong>the</strong> changes.<br />
All manufacturers have literature and<br />
brochures that will show <strong>the</strong> savings and<br />
you can even give payback analysis that<br />
breaks down savings very accurately.<br />
The moral of <strong>the</strong> story is that your<br />
customers deserve <strong>the</strong> very best and <strong>the</strong><br />
very latest in pool equipment. Don’t wait<br />
until <strong>the</strong> equipment fails to begin selling.<br />
Make you customers <strong>the</strong> best educated <strong>the</strong>y<br />
can be. Trust me, you will get some sales<br />
in <strong>the</strong> process.<br />

Look and act like a professional<br />

THE SCOOP ON SERVICE<br />
Everyone we meet is a prospective<br />
client or a possible referral so first<br />
impressions matter. So do second and third<br />
impressions. I rely on my first impression<br />
when I hire, and I expect that my clients<br />
rely on <strong>the</strong>ir first impression when I call<br />
on <strong>the</strong>m.<br />
When I interview an applicant for<br />
employment, whe<strong>the</strong>r consciously or<br />
subconsciously, I know that <strong>the</strong>re are certain<br />
things I look at that may have nothing to do<br />
with competence, but <strong>the</strong>y have everything<br />
to do with whe<strong>the</strong>r <strong>the</strong> individual is a good<br />
candidate. Following are some of <strong>the</strong><br />
thoughts that might go through my head.<br />
My best pool operators are both men and<br />
women, but for <strong>the</strong> sake of consistency, I am<br />
writing this as if it were a male applicant.<br />
1. Does he look me square in <strong>the</strong> eye<br />
(And are his eyes clear and his pupils<br />
normal)<br />
2. Does he look clean and neat and is<br />
he dressed appropriately<br />
3. If I met him at his car, when he<br />
opened his door, was it neat inside,<br />
or did food wrappers and trash fall<br />
out onto <strong>the</strong> ground<br />
4. Does he smell like cigarettes<br />
(Sorry, smokers, but it’s a fact –<br />
5.<br />

cigarettes are not cool, and smokers<br />
as a group have higher absenteeism<br />
than nonsmokers.) Even worse,<br />
did he throw his cigarette onto <strong>the</strong><br />
ground when he got out of his car<br />
Does he let foul language slip into<br />
his conversation<br />
Does he behave respectfully towards<br />
my o<strong>the</strong>r employees I need for him<br />
to be “a good fit.”<br />
Was he on time for our appointment<br />
Or did he at least call if he was going<br />
to be late<br />
It is not very different when our<br />
customers hire us as contractors. I know<br />
when I hire a contractor at my home, in<br />
addition to licensing, experience, and<br />
references, I want a contractor who is<br />
punctual, who respects my time, and<br />
who looks me straight in <strong>the</strong> eye (with his<br />
sunglasses off). I don’t care if he has tattoos<br />
and piercings but I want a contractor who<br />
bo<strong>the</strong>red to change his dirty shirt to a clean<br />
one before our appointment, and I notice<br />
if his truck is clean and if <strong>the</strong>re is a gap<br />
between his shirt and his pants. There is<br />
no smoking at my house, and I sure don’t<br />
want to see a cigarette butt in my driveway<br />
after <strong>the</strong> contractor leaves. I need to feel<br />
comfortable enough to leave my property<br />
with him <strong>the</strong>re and not be worried about<br />
whe<strong>the</strong>r he will abuse my dog or be eyeing<br />
my daughter. And I want him to keep his<br />
shirt on while he is working. He needs to<br />
be “a good fit.”<br />
In short, I want my contractor to look<br />
like and act like a professional. As a<br />
contractor I learned how important this was<br />
within <strong>the</strong> first six months of starting my pool<br />
service business more than 25 years ago.<br />
I probably had only six contracts cleaning<br />
and operating pools for condominiums in a<br />
resort area. I was annoyed by members of<br />
<strong>the</strong> homeowners associations who would<br />
come up to me and want to give me advice<br />
on how to operate <strong>the</strong> swimming pool.<br />
When I got a little extra cash, I had my<br />
business name printed on <strong>the</strong> back of my<br />
shirts and I bought some magnetic signs<br />
for my truck doors. Instantly, overnight,<br />
instead of people offering me advice, <strong>the</strong>y<br />
were coming up and asking my advice. I<br />
was floored. I had learned <strong>the</strong> first tenet of<br />
professionalism, dress <strong>the</strong> part. Look like<br />
a professional. No matter how competent<br />
we are, a professional appearance is<br />
prerequisite for credibility.<br />

more work and more opportunities last year.<br />
No, not <strong>the</strong> “good ole days,” no mistake,<br />
but easily better than 2009! Unfortunately,<br />
<strong>the</strong> profit margin seems to remain slim. It<br />
appears that one bottle neck (at least) is<br />
<strong>the</strong> difficulty homeowners continue to have<br />
securing loans to build pools. Hopefully <strong>the</strong><br />
real estate market will gain a better footing<br />
in 2011 with more stable property values,<br />
fewer foreclosures, and lending will begin<br />
to loosen.<br />
So, <strong>the</strong> obvious question is, what<br />
adjustments do we all make as we enter<br />
2011 Let’s look at things as <strong>the</strong> glass half<br />
full! We have new leadership in Tallahassee<br />
which will hopefully, over time, rebuild our<br />
<strong>Florida</strong> economy. While it is true that we do<br />
not control <strong>the</strong> economy <strong>the</strong>re are things we<br />
all can do to help control our own individual<br />
destiny.<br />
Believe it or not, your insurance program<br />
can play a role in this. By “program” we<br />
refer to <strong>the</strong> triangular partnership between<br />
your business, your insurance agency and<br />
your insurance carrier. Next month we are<br />
going to discuss a few areas <strong>the</strong> triangular<br />
insurance partnership can positively affect<br />
your business and improve your bottom<br />
line!<br />
For now though, thank you for allowing<br />
IBKB to serve FSPA in 2010 and for <strong>the</strong>se<br />
many years. All of us appreciate all of you!<br />

DIGGING UP IDEAS<br />
The market is always changing<br />

In choosing a topic for this article<br />
I reflected on changes in our industry.<br />
Some thirty years ago building pools in this<br />
area was more of a production drill. The<br />
market was very price driven and to make<br />
a dollar pool builders had to work fast and<br />
efficient.<br />
In <strong>the</strong> eighties <strong>the</strong> desire of home<br />
owners to experience <strong>the</strong> <strong>Florida</strong> lifestyle<br />
was very popular. A palm tree in <strong>the</strong> front<br />
yard and a pool in <strong>the</strong> back yard became a<br />
<strong>the</strong>me for <strong>Florida</strong> suburbia.<br />
Slowly we saw a demand for more<br />
than just a bull nose marcited pool. By <strong>the</strong><br />
nineties pools became almost unlimited<br />
in <strong>the</strong>ir options; automation, sanitization,<br />
fiber optics, you name it. It seems <strong>the</strong> pool<br />
builders’ job was to keep up with what was<br />
new and innovative. Successful builders<br />
soon learned that <strong>the</strong>y could increase profits<br />
by adding product lines.<br />
<strong>Pool</strong>s became more and more<br />
complicated and soon a new era rushed in.<br />
It was <strong>the</strong> era of <strong>the</strong> Internet, where every<br />
consumer interested in building a pool could<br />
read, study, compare and analyze. The<br />
consumer had become more demanding<br />
<strong>the</strong>n ever. <strong>Pool</strong>s built during <strong>the</strong> last<br />
decade seem to have even more options<br />
and choices. Many customers suggested<br />
products <strong>the</strong>y saw on <strong>the</strong> neighbor’s pool,<br />
and <strong>the</strong> pool builders’ knowledge and<br />
understanding of all available products<br />
became pivotal.<br />
Now things have changed again.<br />
Today even with <strong>the</strong> Internet <strong>the</strong> consumer<br />
cannot keep up with all of <strong>the</strong> changes<br />
and options available. Today's pools are<br />
designed to be safe and energy efficient<br />
and easy to operate. We are in a very<br />
price driven market again, but <strong>the</strong> lesson<br />
here is to not short sell <strong>the</strong> consumer. The<br />
customer of today should be informed<br />
about energy, safety, maintenance and<br />
sanitization improvements.<br />
I think <strong>the</strong> current analysis is that our<br />
market is still price sensitive. However,<br />
as contractors it is still in our best interest<br />
to offer and explain some of our new and<br />
existing products. As in <strong>the</strong> past, successful<br />
contractors will be those that can use <strong>the</strong>ir<br />
understanding of innovative products and<br />
use <strong>the</strong>m in <strong>the</strong>ir projects.

<strong>Pool</strong> Guy<br />
Rich Tarricone beat out 150 o<strong>the</strong>r<br />
contestants to be named Pleatco’s Perfect<br />
<strong>Pool</strong> Guy. Rich has been in <strong>the</strong> pool<br />
industry for 29 years, is a member of <strong>the</strong><br />
FSPA Manasota Chapter and has served<br />
on <strong>the</strong> Chapter Board of Directors.<br />
The Pleatco Perfect <strong>Pool</strong> Guy / Gal<br />
contest is a way to honor hard-working<br />
individuals in <strong>the</strong> pool service industry.<br />
“From all of us here at Pleatco, thank<br />
you to everyone who entered, nominated<br />
and voted in our third annual ‘Pleatco<br />
Perfect <strong>Pool</strong> Guy / Gal Contest,’” said<br />
Howard Smith, Pleatco’s Chief Executive<br />

FBC nears completion of 2010 Code Cycle<br />

in <strong>the</strong> beginning of January. If any party<br />
requests a rule adoption hearing on any<br />
part of <strong>the</strong> revised code, it would be held at<br />
<strong>the</strong> end of January. The rule adopting <strong>the</strong><br />
new code will <strong>the</strong>n be submitted to <strong>the</strong> 2011<br />
Legislature for approval. The 2010 <strong>Florida</strong><br />
Building Code will go into effect December<br />
31, 2011.<br />
**Important to note: The Glitch Fix<br />
Cycle begins in March. Glitch amendments<br />
have to be submitted by March 18. The goal<br />
is for any glitches to be fixed and adopted<br />
into <strong>the</strong> 2010 Code prior to print in October<br />
2011 and <strong>the</strong> new code going into effect<br />
December 31, 2011. If any pool/spa glitches<br />
are needed, FSPA will have a chance to do<br />
so prior to <strong>the</strong> new code going into effect.<br />
A summary of <strong>the</strong> changes to <strong>the</strong> 2010 Code include <strong>the</strong> following:<br />
NEW requirements for existing residential pools & spas. These changes will be found<br />
in <strong>the</strong> <strong>Florida</strong> Existing Building Code, not in <strong>the</strong> sections contractors typically find pool/spa<br />
requirements. These changes include:<br />
o Specifically requiring pool / spa circulation systems or components undergoing<br />
alterations to comply with Section 6 of <strong>the</strong> ANSI/APSP-7 Suction Entrapment<br />
Avoidance Standard,<br />
o Providing broad guidance that any pool / spa component or system undergoing<br />
alterations (not repair) comply with Chapter 41 of <strong>the</strong> Residential Code (<strong>the</strong><br />
residential pool section). In order to ensure certain alterations do not trigger Chapter<br />
41 compliance, <strong>the</strong> following exceptions were provided for:<br />
• Installation of pavers or coating to an existing pool or spa deck,<br />
• Re-tiling a pool or spa,<br />
• Re-plastering or re-lining a pool or spa, except <strong>the</strong> drain cover must<br />
comply with <strong>the</strong> 2007 ASME A112.19.8 Standard,<br />
• Installation of a water filtration or sanitizations component or system,<br />
• Installation of an automation or a time switch component or system,<br />
• Installation of a heating component or system.<br />
o The exceptions laid out do not trigger <strong>the</strong> existing building code pool/spa<br />
requirements. The FSPA will continue to look into <strong>the</strong> existing pool/spa requirements<br />
and a discussion will occur at <strong>the</strong> January Board and Committee meetings.<br />
Addition of provisions (found in <strong>the</strong> International Codes) for pools in a flood hazard area.<br />
Energy efficient language for pools and spas<br />
that implement <strong>the</strong> legislative mandate (House<br />
Bill 663) and provide additional clarifications<br />
to <strong>the</strong> energy requirements. These changes will<br />
be found in <strong>the</strong> <strong>Florida</strong> Energy Conservation Code,<br />
not in <strong>the</strong> sections contractors typically find pool/spa<br />
requirements. The changes include:<br />
o <strong>Pool</strong> and spa energy efficiency heating<br />
requirements that follow federal requirements<br />
manufacturers already meet,<br />
o Residential filtration pump and motor<br />
requirements (minimum two-speed if installing a<br />
pump or motor 1 HP or greater),<br />
o Portable spa energy efficiency<br />
requirements,<br />
o Removed an unenforceable portion<br />
of <strong>the</strong> pool/spa cover requirements and<br />
provide for additional means to come into<br />
compliance,<br />
o Appendices that provide additional<br />
criteria to implement <strong>the</strong> new energy<br />
requirements for residential pools and inground<br />
spas, and portables spas based on<br />
<strong>the</strong> draft APSP Energy Standards.<br />
An exception to panic hardware requirements<br />
found in Chapter 10 of <strong>the</strong> Building Code,<br />
allowing outdoor gates from residential and<br />
commercial pools or pool decks to go without<br />
such devices unless <strong>the</strong> pool deck serves as<br />
a portion of <strong>the</strong> means of egress of a building<br />
or has an occupant load of 300 or greater.<br />
Clarification to prevent adding a building fixture<br />
count to a pool fixture count when determining<br />
<strong>the</strong> number required for commercial pools that<br />
only serve a designated group of dwelling units<br />
and is not for use by <strong>the</strong> general public.<br />
Clean-up language of barrier alarm<br />
requirements found in Chapter 41 of <strong>the</strong><br />
Residential Code and in Section 424.2 of <strong>the</strong><br />
Building Code (updated <strong>the</strong> UL Standard that<br />
alarms must meet to <strong>the</strong> most recent version<br />
and made changes to language that was<br />
inconsistent with <strong>the</strong> UL Standard).<br />

Americans with Disabilities Act<br />
(ADA) - What you need to know<br />

(Title III) and <strong>the</strong>ir requirements are virtually <strong>the</strong> same.<br />
There are some exceptions. Title II facilities can be excluded<br />
if <strong>the</strong>y can prove modifications would significantly alter <strong>the</strong> historic<br />
nature of <strong>the</strong> building or would create undue financial hardship for <strong>the</strong><br />
facility. Title III facilities can be excluded if <strong>the</strong>y can demonstrate that<br />
reasonable accommodations are not readily achievable. However, <strong>the</strong><br />
Department of Justice has made it very clear that, given <strong>the</strong> flexibility<br />
and cost of a pool lift, it would be very difficult for any entity to escape<br />
<strong>the</strong>ir responsibility to provide access.<br />
ADA regulations are enforced directly and indirectly. Most direct<br />
enforcement is a result of civil lawsuits. If <strong>the</strong> plaintiff prevails, <strong>the</strong><br />
court usually orders <strong>the</strong> defendant to remedy <strong>the</strong> violation, and pay<br />
attorney’s fees for <strong>the</strong> plaintiff. There are generally no monetary<br />
awards.<br />
The ADA is also enforced indirectly by requiring compliance<br />
prior to receiving licenses, certifications, or grants from prevailing<br />
authorities. For example, prior to a local government receiving a<br />
federal grant, it must provide proof of compliance with a wide array of<br />
regulations ranging from environmental mandates to equal opportunity<br />
programs to ADA compliance. In addition, in most localities, any new<br />
construction or building modification will not receive a certificate of<br />
occupancy without meeting all relevant ADA requirements. Many<br />
states will adopt <strong>the</strong> latest guidelines into <strong>the</strong>ir state or local building<br />

What sections of ADA apply to swimming pools,<br />
wading pools and spas<br />
1. Title II (Public Industry) – All public entities at <strong>the</strong> local and state<br />
levels, i.e. school districts, municipalities, cities and counties. 2.<br />
Title III (Private Industry) – Any place of public accommodation<br />
(commercial facilities), i.e. a place of recreation, education, or<br />
lodging. More details on what constitutes a public accommodation<br />
will be in a separate document available soon.<br />
Do <strong>the</strong> new requirements apply to both existing<br />
and new pools / spas<br />
Yes, new and existing swimming pools, wading pools and spas<br />
(in-ground and portable) that fall under <strong>the</strong> Title II or III categories<br />
must provide accessible entry no later than March 15, 2012.<br />
However, it is highly recommended <strong>the</strong>se means of access be<br />
added as soon as possible.<br />
What are <strong>the</strong> permitted means of access<br />
<strong>Pool</strong> lifts, sloped entries (ramps), transfer walls, transfer systems,<br />
or stairs. The criteria for each of <strong>the</strong>se can be found in chapter<br />
10, section 1009, of <strong>the</strong> revised ADA guidelines; a link to this is on<br />
<strong>the</strong> FSPA Web site at www.<strong>Florida</strong><strong>Pool</strong>Pro.biz. The number and<br />
type of accessible entries depends on <strong>the</strong> structure.<br />
How will this be enforced<br />
It will vary from state to state, but does not change <strong>the</strong> fact this is<br />
<strong>the</strong> law. Direct action against noncompliant facilities may be taken<br />
by local building or health officials enforcing state or health building<br />
codes that reference <strong>the</strong> new guidelines. Individuals may also file<br />
civil lawsuits against noncompliant facilities. Indirect enforcement<br />
can occur when a local government becomes ineligible for a federal<br />
grant unless all facilities are in compliance.<br />
How does <strong>the</strong> ADA affect existing state and local<br />
building codes and health department rules for<br />
public pools<br />
Existing codes and rules remain in effect. The ADA allows <strong>the</strong><br />
Attorney General to certify that a state law, local building code, or<br />
similar ordinance meets or exceeds <strong>the</strong> minimum requirements.<br />
Any state or local government may apply for this certification.<br />
The <strong>Florida</strong> Department of Health public pool rule (64E-9, F.A.C.)<br />
references <strong>the</strong> 1990 ADA and will be updated to reflect <strong>the</strong> revised<br />
law, but timing of such is indeterminate at this time. However, in<br />
<strong>Florida</strong>, <strong>the</strong> ADA is typically imposed by <strong>the</strong> building code and<br />
<strong>the</strong> <strong>Florida</strong> Building Commission is currently working to insert<br />
<strong>the</strong> revised ADA guidelines into <strong>the</strong> <strong>Florida</strong> Accessibility Code.<br />
Once complete, <strong>the</strong> FBC will seek Attorney General/Department<br />
of Justice Certification. This will help to ensure direct enforcement<br />
by local building officials throughout <strong>Florida</strong>.<br />
Are <strong>the</strong>re service requirements for ADA<br />
equipment<br />
Yes, <strong>the</strong> regulations provide a “Maintenance of Accessible<br />
Features” provision which mandates <strong>the</strong> accessibility features<br />
must be maintained in working order.<br />
What are <strong>the</strong> swimming pool requirements<br />
<strong>Pool</strong>s with more than 300 linear feet of wall require at least two<br />
accessible entries and pools with less than 300 linear feet require<br />
at least one. When providing only one means of access, it must<br />
be a pool lift or sloped entry. Wave action pools, leisure rivers,<br />
sand bottom pools, and o<strong>the</strong>r pools where user access is limited<br />
to one area are not required to have ano<strong>the</strong>r entry provided <strong>the</strong><br />
one is ei<strong>the</strong>r a pool lift, a sloped entry, or a transfer system. Catch<br />
pools that have a catch pool edge on an accessible route are not<br />
required to provide a means of access.<br />
*Note: 1) The ADA recommends that when using more than one<br />
means of access <strong>the</strong>y be different types in different locations. 2)<br />
<strong>Pool</strong> walls at diving areas and where <strong>the</strong>re is no pool entry because<br />
of landscaping or adjacent structures are still to be counted when<br />
determining <strong>the</strong> linear feet of pool wall.<br />
What are <strong>the</strong> spa requirements and how does ADA<br />
apply to portable hot tubs<br />
The ADA does not distinguish between in-ground and portable<br />
spas. Both Title II and III entities that have any type of spa are<br />
required to provide at least one accessible entry. This can be a lift,<br />
transfer wall, or transfer system. When spas are adjacent to each<br />
o<strong>the</strong>r, only one spa must provide a means of access. However,<br />
portable spas are not allowed in commercial facilities in <strong>Florida</strong>,<br />
per 64E-9, F.A.C.<br />
What are <strong>the</strong> wading pool requirements<br />
Both Title II and III entities are required to provide “accessible<br />
means of entry for wading pools.” Wading pools must have a<br />
sloped entry (ramp). The entry must extend to <strong>the</strong> deepest part<br />
of <strong>the</strong> wading pool, but it is not required to provide handrails.<br />
What financial assistance is available to help<br />
employers/owners comply with ADA<br />
A special tax credit is available to help smaller employers make<br />
accommodations. Information discussing <strong>the</strong> tax credits and<br />
deductions is contained in <strong>the</strong> Department of Justice’s ADA<br />
Tax Incentive Packet for Businesses available from <strong>the</strong> ADA<br />
Information Line. The information can also be obtained from a<br />
local IRS office, or by contacting <strong>the</strong> Office of Chief Counsel,<br />
Internal Revenue Service.<br />

Oh what a night! The annual Holiday<br />
Party was held December 14 at <strong>the</strong> Tiki<br />
Waterfront Sea Grill. Loads of food,<br />

Happy New Year! The Space Coast<br />
Chapter Christmas Party was a great<br />
success. Forty nine people representing<br />
nine of our Chapter member companies<br />
participated on Saturday, December 6. The<br />
food was plentiful and <strong>the</strong> camaraderie was<br />
outstanding. The only thing missing this<br />
year was <strong>the</strong> magnificent space launch we<br />
all got to see at last year’s party!<br />

Happy New Year! The year ended<br />
with <strong>the</strong> Chapter’s wonderful Christmas<br />
party! We had a great turnout and a great<br />
time. Our winner for <strong>the</strong> I-Pad drawing was<br />
Karol Grabowski, Flamingo <strong>Pool</strong>s! She<br />
was delighted when Joe Janis delivered<br />
<strong>the</strong> I-Pad to her.<br />
The first meeting of 2011 will be<br />
Tuesday, January 18. The location is to be<br />
announced soon.<br />

Friday, February 11 offers continuing<br />
education courses, hands-on courses and<br />
<strong>the</strong> opportunity to walk <strong>the</strong> exhibit hall<br />
floor. Courses begin at 8:00 a.m., handson<br />
courses at 12:30 p.m. and <strong>the</strong> exhibit<br />
hall is open from 11:00 a.m. to 5:30 p.m.<br />
That evening food, drinks (open bar) and<br />
entertainment can all be taken care of at <strong>the</strong><br />
Friday night industry party from 6:30 p.m.<br />
to 10:30 p.m. The festivities are at Howl at<br />
<strong>the</strong> Moon which is walking distance from<br />
<strong>the</strong> host hotels.<br />
Saturday, February 12 starts off with<br />
continuing education courses at 8:00 a.m.<br />
The exhibit hall is open from 10:00 a.m.<br />
to 3:30 p.m. with <strong>the</strong> hands-on courses<br />
beginning at 11:30 a.m. Both days of <strong>the</strong><br />
show feature cash prizes in <strong>the</strong> exhibit<br />
hall.<br />
Friday and Saturday will also include<br />
a Product Showcase outside <strong>the</strong> exhibit<br />
hall. See new products, energy-efficient<br />
products, VGB products and overall great<br />
products. Don’t forget to<br />
vote for your favorite!<br />
