A wise old contracts administrator<br />

once said to me you may as well go<br />

fishing as go broke under pricing<br />

work or agreeing to unfair conditions<br />

<strong>of</strong> contract. Yet this is what we see<br />

happening today with many trade<br />

contractors being prepared to cut<br />

their price and / or sign up to anything<br />

without even reading the terms.<br />

Another great saying comes from<br />

Paul Funnell, hydraulic consultant,<br />

estimator, trainer and author who<br />

says, “Know when to say no when<br />

your price is too low.” I think he<br />

could also say, “Know when to say no<br />

when you’re not getting a fair go!”<br />

Major contractor members <strong>of</strong><br />

the AMCA, NFIAQ and MPAQ came<br />

together recently over breakfast to<br />

discuss their concerns with contract<br />

conditions and were addressed<br />

by Ian Heathwood <strong>of</strong> McKays<br />

Solicitors. It was clear that no one<br />

is immune to these problems.<br />

In his presentation Ian highlighted<br />

an increasing risk imbalance appearing<br />

in the industry in favour <strong>of</strong> developers<br />

and head contractors. The party best<br />

able to manage a risk should be the<br />

one to deal with it but at the same time<br />

they should be rewarded for doing so.<br />

There were twenty six issues raised<br />

as examples <strong>of</strong> onerous contract<br />

conditions which had been identified<br />

in recent documents presented<br />

to trade contractors to sign.<br />

Some examples included:<br />

• reductions in the time available<br />

to meet contract requirements<br />

for extension <strong>of</strong> time requests<br />

and variation claims,<br />

• costs imposed on trade contractors<br />

for design and works coordination<br />

problems <strong>of</strong> other trades over<br />

which they have no control,<br />

Increasingly trade contractors are being presented with contract documents<br />

to sign with onerous provisions included within them. Clearly this is a sign<br />

<strong>of</strong> the times which for many is becoming more and more bleak.<br />

• defect rectification undertaken<br />

by third parties at the cost <strong>of</strong> the<br />

trade contractor who had not been<br />

given the opportunity to respond,<br />

• blatant attempts to circumvent<br />

the operation <strong>of</strong> the Building<br />

and Construction Industry<br />

Payments Act and<br />

• termination for convenience<br />

without compensation for loss <strong>of</strong><br />

pr<strong>of</strong>its and provisions that wrongful<br />

termination could subsequently<br />

be considered for convenience.<br />

Trade contractors <strong>of</strong> all sizes should<br />

be mindful <strong>of</strong> the risks they face by not<br />

reading and understanding the terms and<br />

conditions imposed by the documents<br />

they sign. You should know what you<br />

are being asked to sign and ensure you<br />

agree the terms before doing so. If you<br />

are unsure get pr<strong>of</strong>essional assistance or<br />

undertake contract management training.<br />

CCIQ Carbon Tax Summary<br />

On Sunday 10 July <strong>2011</strong>, the Prime<br />

Minister announced the Government’s<br />

final Carbon Pricing package.<br />

Commencing from 1 July 2012, a<br />

carbon price <strong>of</strong> $23 per tonne <strong>of</strong> CO2<br />

emissions will apply under a fixed price<br />

carbon permit mechanism. In its initial<br />

review <strong>of</strong> Sunday’s Federal Government<br />

announcement, Chamber <strong>of</strong> Commerce<br />

and Industry <strong>Queensland</strong> (CCIQ) has<br />

been largely unimpressed with the<br />

lack <strong>of</strong> support being given to smallmedium<br />

sized businesses, believing<br />

this demonstrates little recognition and<br />

understanding <strong>of</strong> how the tax will hit<br />

business operating costs.<br />

<strong>Queensland</strong>’s small-medium sized<br />

businesses will pay the highest price<br />

for the Federal Government’s carbon<br />

tax as it will drive down consumer<br />

spending, and business confidence<br />

and viability. Accordingly CCIQ strongly<br />

opposes the introduction <strong>of</strong> a price on<br />

carbon believing there are far better<br />

ways to get businesses to reduce their<br />

carbon footprint and to diversify our<br />

economy such as investing in research<br />

and development and incentives for new<br />

technologies and efficient production<br />

<strong>Queensland</strong> local appointed chair <strong>of</strong> WELSAG<br />

In June this year, a <strong>Queensland</strong><br />

local, Ian Carmody, Technical<br />

Product Advisor for Con-Serv<br />

Corporation was appointed<br />

chair to the newly formed Water<br />

Efficiency Labelling Standards<br />

Advisory Group (WELSAG).<br />

The group will advise the<br />

federal and state governments on<br />

a range <strong>of</strong> matters including the<br />

development <strong>of</strong> a strategic plan<br />

for the Water Efficiency Labelling<br />

and Standards (WELS) scheme.<br />

The 10 Advisory Group members<br />

were appointed in consultation with<br />

state and territory governments,<br />

and drawn from a range <strong>of</strong> key<br />

stakeholders groups including<br />

retailers, the plumbing and whitegoods<br />

industries, regulators, and water<br />

utility and consumer groups.<br />

"Each member brings a wealth<br />

<strong>of</strong> industry experience to the<br />

WELS Advisory Group, and I look<br />

forward to working closely with<br />

them.” Mr Carmody said.<br />

will provide invaluable advice in<br />

shaping the future direction <strong>of</strong> the<br />

WELS scheme through development<br />

Raising houses subject to<br />

flood or storm surge events<br />

Raising a house can be a way <strong>of</strong> avoiding future<br />

water damage to homes from floods or storm<br />

surges associated with tropical cyclones.<br />

House-raising works require a building<br />

and a plumbing approval. The building<br />

approval involves consideration <strong>of</strong> compliance<br />

with the sustainability requirements<br />

<strong>of</strong> the <strong>Queensland</strong> Development Code<br />

mandatory part 4.1—Sustainable buildings<br />

(QDC 4.1). Also, work may not proceed<br />

until a plumbing permit is in place.<br />

To minimise costs for homeowners who<br />

are raising their homes to make them<br />

more resilient to future flood and storm<br />

surge events, the QDC 4.1 has been<br />

amended to relax its requirements where:<br />

• a building certifier has certified in<br />

writing that the building has been<br />

affected by a flood or storm surge<br />

• the building is located<br />

in a natural hazard<br />

management area (flood)<br />

• a local government<br />

has declared that the<br />

building is likely to be<br />

affected by a future<br />

flood or storm surge by<br />

written notice given to the owner or<br />

notice published on its website.<br />

Pool amnesty expires<br />

The Standard Plumbing and Drainage<br />

Regulation 2003 (SPDR) has been<br />

amended to facilitate house raising by<br />

removing the need for a plumbing approval.<br />

Instead, plumbing work to disconnect,<br />

extend and reconnect existing plumbing and<br />

The six month exemption for rental properties<br />

with non-shared pools from obtaining pool safety<br />

certificates ended on Friday 8 July <strong>2011</strong>.<br />

The exemption was a temporary<br />

disaster relief measure that was<br />

required to ensure that houses were<br />

available for rent without delay for<br />

evacuees and tradespeople helping<br />

with flood and cyclone recovery efforts.<br />

The need for the exemption has now<br />

passed and properties with a pool that is<br />

exclusive to that home (non-shared) will<br />

again be required to obtain a pool safety<br />

certificate before a lease is entered.<br />

Also in response to the <strong>Queensland</strong><br />

flood and cyclone recovery efforts, an<br />

extension was provided to pool owners<br />

to register their pools on <strong>Queensland</strong>'s<br />

pool safety register. Pool owners<br />

now have until 4 November <strong>2011</strong> to<br />

register their pool. This exemption<br />

does not affect other<br />

aspects <strong>of</strong> the pool laws.<br />

For the sale <strong>of</strong> a home<br />

with a non-shared pool a<br />

buyer must obtain a pool<br />

safety certificate within 90<br />

days <strong>of</strong> settlement, if the seller does not<br />

provide them with a certificate. Sellers<br />

are required to notify the potential<br />

purchaser if there is no certificate<br />

before entering a contract <strong>of</strong> sale.<br />

For the sale <strong>of</strong> a shared pool the<br />

owner <strong>of</strong> the pool, for example a body<br />

corporate, must obtain a pool safety<br />

certificate if one is not already in place<br />

within 90 days <strong>of</strong> a sale or lease taking<br />

place. However, shared pool owners<br />

can take advantage <strong>of</strong> a two year<br />

drainage for a house is now prescribed as<br />

‘notifiable minor work’. Under the Plumbing<br />

and Drainage Act 2002, ‘notifiable minor<br />

work’ must be notified to the relevant<br />

local government in the approved form,<br />

but there is no need to obtain a plumbing<br />

permit prior to undertaking the work.<br />

The local government may audit the<br />

plumbing work. For more information<br />

Integrated hand basin/toilet cistern<br />

This water-saving device<br />

comprises a hand basin that<br />

sits on top <strong>of</strong> a toilet cistern.<br />

When the toilet is flushed, the water<br />

supply for the cistern is diverted to the spout<br />

<strong>of</strong> the hand basin for hand washing, which<br />

in turn directs and discharges greywater<br />

into the cistern for future toilet flushing.<br />

Regulation (SPDR) has been amended to<br />

Mark-ups<br />

You're invited to the CSQ<br />

Training <strong>2011</strong>/12 Roadshow<br />

As an industry stakeholder, Construction Skills<br />

<strong>Queensland</strong> (CSQ) would like to invite you to attend<br />

the Annual Training Plan <strong>2011</strong>/12 presentation.<br />

During the tender process, it is<br />

important to separately identify the<br />

true cost <strong>of</strong> construction, preliminary<br />

costs, overheads and target pr<strong>of</strong>it.<br />

Without this, it is difficult to<br />

successfully negotiate a tender price.<br />

The project cost, is the sum<br />

<strong>of</strong> the materials and labour hours<br />

multiplied by the cost <strong>of</strong> labour. This<br />

is also referred to as the first cost.<br />

Mark-ups are the sum <strong>of</strong><br />

the preliminaries, overheads<br />

and target pr<strong>of</strong>it expressed as a<br />

percentage. The percentage may<br />

vary, however it will be minimal.<br />

Preliminary costs are those<br />

which the company incur due<br />

to the foreman’s non productive<br />

time, such as organising workers,<br />

attending site meetings, ordering<br />

materials and recording time sheets.<br />

Other costs include the site shed,<br />

phone charges, deliveries, tools<br />

directly related to the project and<br />

maintenance costs. Preliminary costs<br />

are calculated as a fixed amount<br />

and converted to a percentage that<br />

forms part <strong>of</strong> the mark-up. During<br />

construction, these allowances are<br />

used as a budget for the foreman.<br />

It is anticipated preliminary costs<br />

will account for 3% to 5%.<br />

Overheads are the cost <strong>of</strong><br />

running the company. Such items<br />

include wages for administration<br />

staff, supervisors and directors.<br />

As well as, <strong>of</strong>fice phones and<br />

power, vehicle leases, fuel, oil, and<br />

servicing. Insurance, public liability,<br />

advertising, promotion, bank charges,<br />

accounting fees and the list goes on.<br />

Too <strong>of</strong>ten contractors add the<br />

pricely sum <strong>of</strong> 5% to 10% for<br />

overheads. Unless the company is<br />

turning over $15m to $50m a year,<br />

it is simply too low. The result is that<br />

the company will have to raise capital<br />

and increase debt, just to service the<br />

increasing bank overdraft limits, raising<br />

a personal loan or increase credit<br />

card limits are typical examples that<br />

can be detrimental to the company.<br />

If turnover is $1m a year and 10%<br />

was included for overheads, only<br />

$100,000 is available to cover all the<br />

items listed above, yet the director’s<br />

salary should be greater than the 10%.<br />

Based on this example, there is no hope<br />

<strong>of</strong> meeting the company’s obligations.<br />

Overheads are individually calculated<br />

for each business, and will be affected<br />

by the structure <strong>of</strong> the business. After<br />

many years <strong>of</strong> observation, the following<br />

are provided as a guide only. They are a<br />

reasonable indication for subcontractors<br />

in the building and construction industry.<br />

The higher the turnover,<br />

the lower the percentage.<br />

Within the free enterprise system<br />

a company must make a pr<strong>of</strong>it, lest it<br />

will fail. A company may base its pr<strong>of</strong>it<br />

on ‘a return on investment’, which is<br />

good if looking at a business that was<br />

purchased, or if it is a saleable item,<br />

many contracting businesses don’t fit<br />

this criteria. In which case, it could be<br />

better to view pr<strong>of</strong>it as ‘a return on the<br />

risk taken in running a business’. It<br />

may be a builder does not pay, which<br />

could place the family home at risk. A<br />

reasonable pr<strong>of</strong>it is required to build<br />

working capital and ensure suppliers<br />

are paid on time. A good credit rating<br />

is imperative to the company.<br />

Pr<strong>of</strong>its can also be viewed as a<br />

return on the licensed contractor’s<br />

time studying and gaining trade<br />

qualifications as well as the time and<br />

effort in keeping up to date with the<br />

latest rules and regulations. Pr<strong>of</strong>it<br />

represents the quality <strong>of</strong> life we want.<br />

Target pr<strong>of</strong>it is determined by<br />

supply and demand. How important<br />

is winning the tender If it is not<br />

important a higher target pr<strong>of</strong>it would<br />

be appropriate. Conversely, a lower<br />

pr<strong>of</strong>it should apply if it is important.<br />

When work is in short supply, 8% may<br />

be realistic, while on other occasions<br />

12% to 15% may be appropriate.<br />

If preliminaries are set at 3%,<br />

overheads at 17% and pr<strong>of</strong>its at<br />

12%, this equates to 32%, however,<br />

it actually represents 30.5% markup,<br />

due to the method <strong>of</strong> adding<br />

each percentage to the previous<br />

cost during the final summary<br />

<strong>of</strong> the estimating process.<br />

In suggesting that mark-ups should<br />

be around 32% to 36%, it is <strong>of</strong>ten<br />

sc<strong>of</strong>fed at, with the suggestion that<br />

by allowing such mark-ups one would<br />

never win a job. The difference is,<br />

we are learning to price tenders at<br />

cost and the suggested mark-ups are<br />

both realistic and keep the company<br />

pr<strong>of</strong>itable. By using the estimating<br />

principals, methods and procedures<br />

outlined in Estimating for <strong>Plumbers</strong>,<br />

contractors are finding that they<br />

have in fact been marking-up their<br />

projects by 40% without realising<br />

it. A company will become more<br />

competitive by using the cost plus<br />

mark-up method <strong>of</strong> estimating.<br />

Modern plumbing<br />

award variations<br />

The modern award in the plumbing<br />

industry is called the Plumbing<br />

& Fire Sprinklers Award 2010.<br />

A copy <strong>of</strong> the award is available<br />

from the members only section<br />

<strong>of</strong> MPAQ website. This area also<br />

provides information about how to<br />

get pay slips correct, and apprentice<br />

wages information, which were<br />

all adjusted as at first full pay<br />

period on or after 1st July <strong>2011</strong>.<br />

This modern award now covers all<br />

plumbers, drainers and labourers in<br />

our industry, as well as a few other<br />

classifications depending on the nature<br />

<strong>of</strong> the employer. The modern Award<br />

allows for daily hire for plumbers and<br />

labourers, which is a continued provision<br />

from historical occupational awards.<br />

Variations now finalised<br />

Recent variations that sought<br />

clarification <strong>of</strong> some parts <strong>of</strong> this<br />

award have now been finalised and a<br />

copy <strong>of</strong> the latest version is available<br />

on the MPAQ website for members.<br />

Changes to clarification have been<br />

made to the definitions <strong>of</strong> daily hire,<br />

part-time and casual employment;<br />

Adult Apprentice wages; and to<br />

Saturday penalty rates in Qld. These<br />

variations have been made to provide<br />

clarification <strong>of</strong> particular clauses and<br />

are retrospective to the beginning <strong>of</strong><br />

the Award being 1st January 2010.<br />

“PFS vs NES”<br />

Unfortunately some confusion remains<br />

about the accuracy <strong>of</strong> information<br />

provided by the Fair Work Ombudsman’s<br />

info line which has caused some angst.<br />

There is considerable complexity in the<br />

understanding <strong>of</strong> our modern award<br />

and the interaction with the redundancy<br />

provisions <strong>of</strong> the National Employment<br />

Standards (NES); under our industry<br />

Award there are some exemptions<br />

that apply to the NES redundancy<br />

provisions and the Award redundancy<br />

will prevail, which means care must be<br />

taken to ensure notice and final pays are<br />

calculated correctly. Members are advised<br />

to get accurate, timely information<br />

from the MPAQ’s Advisory Services<br />

staff about these important issues.<br />

Top 5 tips to trim your tax<br />

These are the top 5 tax laws<br />

you must know about if you are<br />

a business owner. Tax can be<br />

one <strong>of</strong> your biggest expenses.<br />

Our top 5 tax<br />

minimisation tips are:<br />

1. Work Related Expenses/<br />

Home Office<br />

If it is related to work you can<br />

claim it. You can claim up to $200 or<br />

more depending on the work related<br />

clothing expense without a receipt.<br />

Any telephone, mobile and internet<br />

work related expenses will also be<br />

deductible. If you have self education<br />

expenses directly related to your field <strong>of</strong><br />

work, you can claim it as a deduction,<br />

but not if the study helped you obtain<br />

a qualification in a new field. You<br />

may look at the benefits <strong>of</strong> salary<br />

packaging items that are primarily<br />

acquired for work- related purposes<br />

(eg car, laptop, phones, PDA etc) and<br />

are FBT exempt. Certain non-work<br />

related expenses may be a partially or<br />

fully deductible expense eg tax agent<br />

fees, management fees to financial<br />

planners, bank charges/ interest on<br />

investments and donations to charities.<br />

If you do any work from home you<br />

will be able to claim a deduction on<br />

running your home <strong>of</strong>fice based on<br />

26c per hour and calculated on how<br />

many hours you spend in the <strong>of</strong>fice.<br />

If you are renting your home you can<br />

claim the usage percentage (eg 9%)<br />

<strong>of</strong> your rent and all the normal home<br />

<strong>of</strong>fice deductions mentioned above.<br />

If you own your home but your<br />

home <strong>of</strong>fice is actually your principle<br />

place <strong>of</strong> business then you can<br />

claim the mortgage interest and<br />

all the rates and running expenses<br />

associated with ownership as well as<br />

the normal home <strong>of</strong>fice deductions.<br />

Again, when you sell the property,<br />

your home which would normally be<br />

exempt from capital gain tax, will be<br />

subject to the same extent as the usage<br />

percentage as what was claimed.<br />

2. Education Tax Refund (ETR)<br />

If you have kids in school you will<br />

be able to claim certain educational<br />

expenses (eg computers, computer<br />

related equipment or repairs, internet<br />

connections, educational s<strong>of</strong>tware, school<br />

textbooks, prescribed trade tools etc) and<br />

receive a 50% tax refund for each primary<br />

school child valued up to $397 and<br />

secondary school child valued up to $794.<br />

You must have received Family Tax Benefit<br />

(FTB) Part A for the child or you received<br />

a payment (eg Youth allowance, disability<br />

pension, ABSTUDY etc) that prevented<br />

you from receiving FTB Part A or your<br />

child stopped full time school during the<br />

year and received income over the cutout<br />

amount which prevented you from<br />

receiving FTB Part A. Remember to keep<br />

your receipts. If you do not need to lodge<br />

an income tax return, it is still possible<br />

to claim the Education Tax Refund.<br />

3. Private Health Care/<br />

Medical Expenses<br />

If you earn over $77,000 pa (single)<br />

or as a couple earn more than $154,000<br />

pa then you should look at obtaining<br />

private patient hospital cover rather than<br />

pay 1% <strong>of</strong> your taxable income as the<br />

Medicare levy surcharge. You are not<br />

required to get auxiliary health cover<br />

(eg dental, optometry etc), but that is<br />

predominantly where the customer value<br />

in private health insurance is today.<br />

Low income earners are exempt from the<br />

Medicare levy with a threshold <strong>of</strong> $18,839<br />

for singles and $37,398 for couples/<br />

families for the 10/11 financial year.<br />

If you have had more than $2,000<br />

worth <strong>of</strong> out <strong>of</strong> pocket expenses provided<br />

by a registered medical practitioner<br />

including prescriptions then you would be<br />

entitled to a rebate <strong>of</strong> 20% from the ATO.<br />

4. Write Off<br />

If you have old equipment (plant) or<br />

stock that your business can't physically<br />

sell before 30 June then you may consider<br />

writing it <strong>of</strong>f and get a tax deduction<br />

for that year. Similarly, bad debts<br />

(income) which can't be expected to be<br />

collected can be written <strong>of</strong>f and claimed<br />

as a tax deduction before 30 June.<br />

5. Income Splitting<br />

High income investors and business<br />

owners taxed at a higher marginal tax<br />

rate (46.5%) can split their income<br />

with a lower taxed spouse (0 - 16.5%)<br />

or company (30%), where it is done for<br />

normal business or commercial reasons.<br />

If a taxpayer derives income from<br />

personal services and attempts to split that<br />

income with family members by diverting it<br />

to a family company or trust, then this may<br />

be viewed by the ATO as an attempt to avoid<br />

tax, and the "anti-avoidance provisions"<br />

(ITA Act 1936 (Part IVA) may apply.<br />

There are good websites, bad websites<br />

and worse still – no websites.<br />

So why a website Currently in<br />

Australia, more than 60% <strong>of</strong> people<br />

between the ages <strong>of</strong> 20 and 50 now look<br />

exclusively on the internet for providers <strong>of</strong><br />

local services – they look no where else.<br />
