Sub: Reconstitution of the Expert Committee on Agro biodiversity-intimation of– reg.

1. Whereas, under Section 13(1) of the Biological Diversity Act, 2002 it is stated
that National Biodiversity Authority (NBA) may constitute a Committee to deal with
agro biodiversity, and under Section 13(2) of the Biological Diversity Act, 2002 it is
stated that National Biodiversity Authority (NBA) may constitute Expert Committees
for the efficient discharge of its duties and performance of its functions under the
Act.
2. Whereas, in exercise of the powers conferred under Sub-section (2) of
Section 13 of the Biological Diversity Act, 2002 read with Rule 11 of Biological
Diversity Rules, 2004, it is decided to reconstitute the EC on Agro-biodiversity.
3. And, whereas, the Expert Committee has been constituted under Office
Order No. No.2/6/Admin.NBA.2005 dated 19 th December 2005 and re-constituted
vide Office Order No. No.2/82/Admin/EC/09/09-10 dated 27 th October, 2009.
4. And whereas, due to administrative reasons, the Expert Committee is
reconstituted as under and the tenure of this committee will be for a period of twelve
months from the date of issue of this order.

The Chairman and members of the Committee are entitled to receive such
allowances or fees for attending the said meeting of the Committee as may be fixed
by the Authority from time to time.
Terms of Reference of the Committee are as follows:-
i. Undertake an assessment of issues relevant to agrobiodiversity that needs to be
considered within the framework of the Biological Diversity Act, 2002 and Rules
2004.

Develop a guidance paper for consideration by NBA detailing the linkages
between the provisions of the Act and that of other existing legal and
institutional frameworks.
Provide a strategic policy approach to deal with agrobiodiversity related issues
for conservation and sustainable use action as well as access and benefit
sharing.
Develop a set of advisory papers, as required under section 18(3) of the
Biological Diversity Act, 2002 and Rule 12 of the Biological Diversity Rules, 2004
focusing on emerging issues.

v. Suggest ways for institutional linkages between NBA and other national
agencies, including Ministries on issues related to agrobiodiversity.
GUIDELINES
1. The Expert Committees have been constituted mainly to advise NBA on
technical, techno- administrative, legal, scientific, statutory and miscellaneous
matter as NBA does not have required in house expertise and experience in
various disciplines. The performance Audit of NBA was conducted by the office
of Principal Director of Audit recently and certain comments were made with
regard to conduct of Expert Committee meetings and expected outcomes.
2. As per section 50 (7) – Every proceeding before the National Biodiversity
Authority (NBA) shall be deemed to be a judicial proceeding within the
meaning of sections 193 and 228 and for the purpose of section 196, of the Indian
Penal Code and the NBA shall be deemed to be Civil Court for all the purposes
of section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973. The
role of Expert Committee is more or less similar to that of ‘Amicus Curiae’ in the
Court of Law.
3. Hence, in the light of above facts the following guidelines are issued for all
concerned in order to achieve the expected outcomes.
(a) The travel cost by Air (economy class) by Indian Airlines /Rail II AC/Road etc.,
will be reimbursed to the Chairman and the members by the NBA. In case of AC
Taxi Rs-16/- Km will be reimbursed.
(b) The members attending the committee meetings are also entitled for sitting fee
of Rs.1000/- per day.
(c) The meeting of the Committee shall be generally held at NBA’s office premises,
5 th Floor, TICEL BIOPARK, Taramani, Chennai or any other city / place and
members are requested to kindly make it convenient to attend meeting at the
said venue and on the date and time as intimated by NBA. The NBA shall
arrange transport – from Airport/Railway station/Bus stand/place of stay to
the venue of the meeting and back.
(d) The members may preferably come to Chennai one day in advance of the date
of meeting.
(e) The lodging and boarding (working breakfast/lunch/dinner) will be provided
by the NBA at its cost.
