SUMMARY <br />

The most common patent strategy for<br />

Japanese companies when filing patent<br />

applications internationally is to have a patent<br />

applicant drafted for filing in the Japan Patent<br />

Office (JPO) and then simply translating the<br />

application into local languages (e.g., English<br />

and Chinese) and then filing the Japandrafted<br />

application in the United States,<br />

Europe, China, etc."<br />

This international filing strategy raises several<br />

issues that can affect patent quality.<br />

While<br />

there is a short-term cost saving to the<br />

Japanese company, the applications drafted<br />

according to Japanese patent law are being<br />

filed in countries where the laws are different<br />

from Japan."<br />

Filing mere translations of Japanese patent<br />

applications in foreign countries without<br />

properly preparing the translation for filing can<br />

be dangerous for the Japanese companies. A<br />

short term cost saving now could result in loss<br />

of patent rights later if a a translated<br />

application is not properly prepared for filing.<br />

Tomotoshi Shimano <br />

Mr. Shimano is a Japanese Patent Attorney (Chemistry and Biotech) at<br />

Shiga International Patent Office. Until October 2013, Mr. Shimano worked<br />

for the Unitalen patent firm in Beijing as a partner for more than six years.<br />

Mr. Shimano has prosecuted more than 4,000 Office Actions from the State<br />

Intellectual Property Office of the P.R.C..<br />

Osamu Suzuki <br />

Mr.$Suzuki$is$the$Director$of$Quality$Control$at$the$Sugimura$International$<br />

Patent$&$Trademark$Attorneys.$$His$practice$encompasses$patent$<br />

prosecution$in$the$mechanical,$industrial$manufacturing$and$chemical$<br />

fields.$$Prior$to$joining$SUGIMURA,$he$worked$in$the$IP$division$of$<br />

Bridgestone$Corporation$for$more$than$30$years,$where$he$has$been$<br />

responsible$for$many$fields$of$IP$management$covering$patent$prosecution$<br />

worldwide$including$China.<br />

Benjamin J. Hauptman <br />

Professor Hauptman, Adjunct Professor - Franklin Pierce Law Center<br />

(1991-2013), has practiced for more than 30 years in the fields of patent<br />

and trademark matters, including preparing and prosecuting patent<br />

applications in the complex mechanical and electrical arts, and in<br />

counseling clients in all aspects of intellectual property protection. He has<br />

lectured in China on numerous occasions, including as a guest lecturer<br />

invited by the China Intellectual Property Training Center (CIPTC) and is familiar with<br />

Japanese and Chinese patent prosecution. Professor Hauptman is a senior partner at Lowe<br />

Hauptman & Ham LLP.<br />

Jim Ribeiro <br />

Mr. Ribeiro is a partner at the European firm of Withers & Rogers LLP. He<br />

is a European and UK Patent Attorney with over 20 years of experience<br />

drafting and prosecuting patent applications. He has a wide range of<br />

experience in the aerospace, defence, electronics, computing and<br />

telecommunications sectors. He is a regular visitor to Japan.<br />
