BACKGROUND TO THE <strong>INQUIRY</strong><br />

<strong>The</strong> Inquiry in session<br />

1.10 Contributions from all sources have been welcomed, but when only as a paper substitute for a<br />

dialogue with <strong>the</strong> Inquiry <strong>the</strong>y lose value, perhaps more than half <strong>of</strong> it. An MCA <strong>of</strong>ficer, <strong>the</strong><br />

Secretary <strong>of</strong> State’s Representative for Salvage and Intervention (SoSREP) is a key player in all<br />

incidents <strong>of</strong> this kind at sea. He or she is <strong>the</strong> invention <strong>of</strong> Lord Donaldson’s report following <strong>the</strong><br />

Sea Empress incident in Milford Haven in 1993 and has overall command <strong>of</strong> action responding<br />

to <strong>the</strong> incident at sea, can overrule harbourmasters and ship’s captains, and has a direct line to<br />

<strong>the</strong> Secretary <strong>of</strong> State. <strong>The</strong> post holder in 2007 was Robin Middleton, <strong>the</strong> first <strong>of</strong> <strong>the</strong>m. By <strong>the</strong><br />

time <strong>of</strong> <strong>the</strong> Napoli foundering he had dealt with some 700 incidents, had thus much experience,<br />

was well practised and had a good working relationship with, among o<strong>the</strong>rs, his French<br />

counterparts, <strong>the</strong> Préfets Maritime who appear to act within separate coastal Departmental<br />

areas. Mr Middleton could have been a key witness and a great help to <strong>the</strong> Inquiry and <strong>the</strong><br />

public image <strong>of</strong> <strong>the</strong> MCA. He retired at <strong>the</strong> end <strong>of</strong> 2007 and under <strong>the</strong> protection <strong>of</strong> o<strong>the</strong>r MCA<br />

personnel and through <strong>the</strong>m, declined to come to <strong>the</strong> Inquiry’s hearings. His successor, who was<br />

his deputy in 2007, also declined to come. Never<strong>the</strong>less, <strong>the</strong> Chairman <strong>of</strong> <strong>the</strong> Inquiry had <strong>the</strong><br />

benefit <strong>of</strong> seeing an hour long uncut, unedited and unpublished video <strong>of</strong> <strong>the</strong> SoSREP<br />

responding to questions about <strong>the</strong> whole incident just before he retired. <strong>The</strong> questioner was a<br />

journalist, Duncan Sleightholme, who had followed <strong>the</strong> incident from Day One and who agreed<br />

to talk to us at <strong>the</strong> public hearing.<br />

1.11 So <strong>the</strong> Inquiry’s ability to examine <strong>the</strong> principal actors at sea was limited. <strong>The</strong> MAIB and <strong>the</strong><br />

MCA Reports (despite <strong>the</strong> latter’s careful or clumsy timing) were never<strong>the</strong>less very helpful and a<br />

number <strong>of</strong> maritime experts assisted <strong>the</strong> Inquiry in public hearing and elsewhere. <strong>The</strong> chairman<br />

<strong>of</strong> <strong>the</strong> SoSREP’s Environmental Advisory Group (EAG) did appear, as did <strong>the</strong> Falmouth<br />

Harbourmaster. As both had direct contact with <strong>the</strong> SoSREP during <strong>the</strong> incident <strong>the</strong>ir<br />

contribution was more than welcome. <strong>The</strong> EAG is still involved, and will be until <strong>the</strong> fate <strong>of</strong> <strong>the</strong><br />

4000 tons <strong>of</strong> metal (including Napoli’s engines) still <strong>of</strong>f Branscombe is resolved.<br />
