About this document<br />

1 This document tells you that your vehicle has not been shown to meet the minimum legal requirements for the reason(s) detailed in section A. If you<br />

intend to use your vehicle on the road you should have it repaired without delay <strong>an</strong>d have it retested before the existing test validity expires. In a few<br />

cases, this document may be issued because the test could not be satisfactorily carried out. The Vehicle <strong>Test</strong> Station that issued the document c<strong>an</strong><br />

advise you what to do in these circumst<strong>an</strong>ces - alternatively you may call VOSA's National Enquiry Line (see note 6) for advice.<br />

2 It is generally <strong>an</strong> <strong>of</strong>fence to use on a public road, a vehicle <strong>of</strong> testable age that does not have a current test certificate, except when:<br />

• Taking it to a test station for a test BOOKED IN ADVANCE<br />

• Bringing it away from a test station after it has failed the test, to a place <strong>of</strong> repair<br />

• Taking it to or bringing it away from a place where by PREVIOUS ARRANGEMENT repairs are to be, or have been, made to remedy the defects for<br />

which the vehicle was failed.<br />

Even in the above circumst<strong>an</strong>ces you may still be prosecuted for driving <strong>an</strong> unroadworthy vehicle if it does not comply with various Regulations<br />

affecting its construction <strong>an</strong>d use. Additionally the insur<strong>an</strong>ce may not be valid.<br />

3 Normally the details on this document are machine printed. If they are h<strong>an</strong>d written you may arr<strong>an</strong>ge to exch<strong>an</strong>ge it for a free printed version at the<br />

Vehicle <strong>Test</strong> Station that issued this document.<br />

About the <strong>MOT</strong> <strong>Test</strong><br />

4 The <strong>MOT</strong> <strong>Test</strong> checks whether your vehicle meets the minimum legal requirements for those items required to be tested under Section 45 <strong>of</strong> the Road<br />

Traffic Act 1988. It does not tell you how long your vehicle will continue to meet these minimum requirements. It does not check that the vehicle fully<br />

meets all legal requirements. Your vehicle has been shown not to meet these minimum requirements. Therefore, you might well have been prosecuted<br />

for driving <strong>an</strong> unroadworthy vehicle before this test <strong>an</strong>d you could also be prosecuted if you continue to use the vehicle in its present condition. If,<br />

after the necessary repairs, you continue to use the vehicle, you should improve your future mainten<strong>an</strong>ce arr<strong>an</strong>gements to ensure that your vehicle<br />

will always pass <strong>an</strong> <strong>MOT</strong> <strong>Test</strong>.<br />

Retest<br />

5 For the purposes <strong>of</strong> retests, working days do not include Saturdays, Sundays or b<strong>an</strong>k holidays. If the test station ch<strong>an</strong>ges ownership then a full retest<br />

must be carried out <strong>an</strong>d a full test fee may be charged. Only 1 partial retest c<strong>an</strong> be conducted in connection with this refusal notice - if that test is<br />

unsatisfactory then a full retest must be carried out when the vehicle is next inspected. Further information on retest fees <strong>an</strong>d procedures c<strong>an</strong> be found<br />

• In the <strong>MOT</strong> <strong>Test</strong>ing Guide, a copy <strong>of</strong> which must be held by every vehicle testing station<br />

Vehicle condition<br />

6 If you do not agree with the items listed as failures on this <strong>Refusal</strong> <strong>of</strong> <strong>an</strong> <strong>MOT</strong> <strong>Test</strong> <strong>Certificate</strong>, you may appeal. IF YOU WISH TO APPEAL, DO NOT<br />

HAVE YOUR VEHICLE REPAIRED before <strong>an</strong>y such appeal test is carried out. Any ch<strong>an</strong>ge in the condition <strong>of</strong> the vehicle may affect the outcome.<br />

Please see the Appeal <strong>an</strong>d Fees poster displayed at every test station, or phone VOSA’s National Enquiry Service on 0870 60 60 440.* Calls are<br />

charged at a national rate. The current appeal fee (the same as the test fee) must be received at your local VOSA Office within 14 working days <strong>of</strong><br />

the date <strong>of</strong> the refusal notice being issued. If your appeal is successful the fee, or if appropriate part <strong>of</strong> it, will be returned to you.<br />

7 The appropriate <strong>MOT</strong> Inspection M<strong>an</strong>ual is the comprehensive guide to inspection procedures <strong>an</strong>d st<strong>an</strong>dards applied during the <strong>MOT</strong> <strong>Test</strong>. This sets<br />

out in detail the statutory requirements that vehicles have to meet, the methods <strong>of</strong> inspection <strong>an</strong>d the reasons for failure. The above m<strong>an</strong>ual c<strong>an</strong> be<br />

ordered through all leading bookshops.<br />
