On appeal from: North Gauteng High Court, Pretoria (Bertelsmann J s itting<br />

as court of first instance):<br />

1 The appeal succeeds partially to the extent that the order of the court<br />

below is set aside and replaced with the following:<br />

'(a) Prayer (a) of the notice of motion (declaring a <strong>customary</strong> marriage<br />

between Hlengani Dyson Moyana (the deceased) and th e First<br />

Respondent null and void ab initio ) is dismissed.<br />

(b) Prayer (b) (directing the Second Respondent to register the<br />

marriage between the applicant and the deceased Hle ngani Dyson<br />

Moyana nin: 5701085803086) is granted.<br />

(c) Each party is ordered to pay its own costs.'<br />

2. There is no order as to costs.<br />

Introduction<br />

[1] This appeal concerns the interpretation of s 7( 6) of the Recognition of<br />

Customary Marriages Act 1 (the Act). The section regulates the proprietary<br />

consequences of a <strong>customary</strong> marriage in circumstanc es where the husband<br />
