was to provide a safety net for Aborig<strong>in</strong>al heritage where state <strong>and</strong> territory<br />

regimes failed to provide appropriate protection. It explicitly covered items <strong>and</strong><br />

places of significance to ‘Aborig<strong>in</strong>als or Isl<strong>and</strong>ers <strong>in</strong> accordance with their<br />

traditions.’ 13 However, accord<strong>in</strong>g to the 1996 <strong>in</strong>quiry <strong>in</strong>to the ATSIHP Act by<br />

Justice Evatt, the execution of the Act rema<strong>in</strong>ed easily manipulated due to the<br />

ways <strong>in</strong> which M<strong>in</strong>isterial discretion was exercised <strong>and</strong> the lack of scope for<br />

proactive protection. 14<br />

Despite progress <strong>in</strong> some states, <strong>in</strong> other jurisdictions heritage legislation has<br />

changed little, although reviews of legislation <strong>and</strong> progress towards change are<br />

occurr<strong>in</strong>g <strong>in</strong> most circumstances. For example, Western Australia’s Aborig<strong>in</strong>al<br />

<strong>Heritage</strong> Act 1972 <strong>and</strong> the Tasmanian Aborig<strong>in</strong>al Relics Act 1975 both rema<strong>in</strong> <strong>in</strong><br />

force, largely <strong>in</strong> their orig<strong>in</strong>al formats, despite several recent reviews <strong>and</strong><br />

<strong>in</strong>quiries.<br />

In New South Wales, the <strong>Heritage</strong> Act 1977 allows for <strong>Indigenous</strong> places to be<br />

nom<strong>in</strong>ated to the NSW <strong>Heritage</strong> Register if they are ‘considered of high<br />

significance to the cultural heritage values of the community or to the Aborig<strong>in</strong>al<br />

peoples of NSW’, 15 but there has never been a specific Act dedicated to<br />

<strong>Indigenous</strong> heritage. Aborig<strong>in</strong>al heritage is also <strong>in</strong>corporated <strong>in</strong>to sections<br />

deal<strong>in</strong>g with archaeological materials <strong>in</strong> the National Parks <strong>and</strong> Wildlife Act 1974.<br />

The <strong>Victoria</strong>n government attempted to <strong>in</strong>troduce new legislation <strong>in</strong> the 1980s to<br />

replace its Archaeological <strong>and</strong> Aborig<strong>in</strong>al Relics Preservation Act 1972, but was<br />

prevented from do<strong>in</strong>g so by the State Opposition’s Upper House majority. The<br />

<strong>Victoria</strong>n government appealed to the Commonwealth for assistance, which, <strong>in</strong><br />

response, amended the ATSIHP Act to <strong>in</strong>clude Part IIA, which provided specific<br />

protection for objects <strong>and</strong> places of particular significance to Aborig<strong>in</strong>al people <strong>in</strong><br />

<strong>Victoria</strong>, <strong>in</strong> accordance with their traditions. This scheme rema<strong>in</strong>ed <strong>in</strong> force until<br />

the recent enactment of the Aborig<strong>in</strong>al <strong>Heritage</strong> Act 2006.<br />

Consultation models: ‘Ask First’<br />

By the 1990s, despite the persistence of ’relics’ legislation, processes <strong>and</strong> policies<br />

favour<strong>in</strong>g consultation were typically implemented at agency level. These were<br />

manifested mostly <strong>in</strong> the form of direct contact between heritage agencies <strong>and</strong><br />
