THE STATE OF FLORIDA<br />

To each Sheriff <strong>of</strong> <strong>the</strong> State:<br />

YOU ARE COMMANDED to summon Garnishee, whose name and address is<br />

to service an answer to this <strong>Writ</strong> on plaintiff, or plaintiff's attorney, whose name and address is<br />

with <strong>the</strong> <strong>Clerk</strong> <strong>of</strong> <strong>the</strong> <strong>Court</strong> within twenty (20) days after service <strong>of</strong> this <strong>Writ</strong>, exclusive <strong>of</strong> <strong>the</strong> day <strong>of</strong> service, stating whe<strong>the</strong>r<br />

<strong>the</strong> Garnishee is indebted to defendant,<br />

THE GARNISHEE SHALL REPORT in its answer <strong>the</strong> amount <strong>of</strong> <strong>the</strong> defendant's salary or wages and whe<strong>the</strong>r <strong>the</strong><br />

defendant's earnings are paid weekly, bi-weekly, monthly, or o<strong>the</strong>rwise. THE GARNISHEE SHALL DEDUCT AND<br />

RETAIN 25% <strong>of</strong> <strong>the</strong> "disposable earnings" from <strong>the</strong> defendant's salary or wages each pay period until <strong>the</strong> judgment in <strong>the</strong><br />

amount <strong>of</strong> $ with interest at <strong>the</strong> rate <strong>of</strong> % a year from , 20 , and cost are<br />

satisfied or until o<strong>the</strong>rwise provided by court order or statutory law. The Garnishee shall be reimbursed for administrative<br />

costs and may collect up to $5.00 against <strong>the</strong> defendant's salary or wages for <strong>the</strong> first deduction and up to $2.00 for each<br />

deduction <strong>the</strong>reafter.<br />

FAILURE TO FILE AN ANSWER within <strong>the</strong> time required may cause a default and judgment to be entered against<br />

<strong>the</strong> Garnishee for <strong>the</strong> amount remaining unpaid on <strong>the</strong> judgment against <strong>the</strong> original defendant with interest and cost<br />
