MILEAGE APPLICATION<br />
MILEAGE ALLOWANCE APPLICATION<br />
Customer warrants that its interest in the Equipment used under rates in this Tariff is sufficient to permit it to waive<br />
payments of mileage allowances. Customer and Railroad agree that Railroad shall not be liable for any mileage<br />
allowance that may accrue on Equipment used under this Tariff. In the event that the owner of the Equipment or the<br />
person whose reporting marks appear on the Equipment, other that the Customer (hereinafter "Car Owner"), makes a<br />
claim against Railroad for payment od mileage allowances which have not been provided for in the Tariff (hereinafter<br />
"Mileage Allowance"), Customer shall, upon notification thereof by Railroad, either (1) defend Railroad against and<br />
relieve Railroad from said claim or (2) reinburse Railroad for payment of the Mileage Allowance to the Car Owner.<br />
Customer waives payment of all mileage allowances applicable under RPS 6007, as amended, supplemented, and/or<br />
reissued, which would have been due from Railroad for the use of Private Equipment in the absence of this Tariff.<br />
No mileage allowances will be paid.<br />
