Item 16.3 Motion without Notice (previously 8.2 – Cr K Fischer – Martindale Nursing

Motion No: 2012:08:297
1. Under the provisions of Section 90(2) of the Local Government Act,
1999, an order be made that the public be excluded from attendance at
the Meeting excepting the Chief Executive Officer, Director Corporate
and Community Services, and Director Planning & Infrastructure,
Executive Assistant and Minute Taker in order to consider Item 16.3
(previously listed as Agenda Item 8.2) in confidence, under the
provisions of Section 90(3)(i) of the Act regarding information relating
to:
(i) information relating to actual litigation, or litigation that the
council or council committee believes on reasonable grounds
will take place, involving the council or an employee of the
council;
2. Accordingly, on this basis, the principle that Meetings of the Council
should be conducted in a place open to the public has been outweighed
by the need to keep the information or discussion confidential.

Cr A Shackley declared a conflict of interest as a member of Gawler Environment &
Heritage Association (GEHA) and being publicly identified as being associated with
GEHA, and having declared a conflict of interest when the development application
was considered by the Development Assessment Panel.
Cr A Shackley asked for leave of the meeting to provide a personal explanation.
Deputy Mayor put the request for Leave of the Meeting and Leave was granted.
11:51pm Cr A Shackley left the Chamber
Cr B Neylon declared an interest as a member of Gawler Environment & Heritage
Association (GEHA) but did not believe this was a conflict of interest.
