In <strong>the</strong> result <strong>the</strong> Prelim<strong>in</strong>ary objection fails and is overruled,<br />
.<br />
In <strong>the</strong> light of forego<strong>in</strong>g, I hold that <strong>the</strong> defendants are bound by <strong>the</strong> agreement<br />
between <strong>the</strong>m and <strong>the</strong> Pla<strong>in</strong>tiff. Consequently I enter judgment <strong>in</strong> favour of pla<strong>in</strong>tiff <strong>in</strong> <strong>the</strong><br />
follow<strong>in</strong>g terms.<br />
1, The pla<strong>in</strong>tiff is <strong>the</strong> owner of <strong>the</strong> 86 oil wells by virtue of <strong>the</strong> political solution<br />
agreement between <strong>the</strong> pla<strong>in</strong>tiff and <strong>the</strong> 1 st defendant <strong>the</strong> terms of which are<br />
conta<strong>in</strong>ed <strong>in</strong> exhibit AMBI and <strong>the</strong>refore entitled to be paid revenue derivable<br />
<strong>the</strong>refrom under <strong>the</strong> provisions of <strong>the</strong> 1999 Constitution from April, 2009 till date<br />
and subsequently.<br />
2. The defendants are hereby directed to <strong>the</strong>mselves and/or <strong>the</strong>ir appropriate<br />
agencies to forthwith compute and calculate all such sums of money accru<strong>in</strong>g from<br />
86 oil wells belong<strong>in</strong>g to <strong>the</strong> pla<strong>in</strong>tiff by virtue of <strong>the</strong> subsist<strong>in</strong>g and b<strong>in</strong>d<strong>in</strong>g<br />
Political Solution Agreement which sums has been unlawfully paid to this 1 st<br />
defendant with effect from April 2009 till date of this Judgment and payment of all<br />
such sums to <strong>the</strong> pla<strong>in</strong>tiff by <strong>the</strong> 1 st defendant forthwith.<br />
3. There shall be <strong>in</strong>terest at <strong>the</strong> prevail<strong>in</strong>g commercial rate per annum on <strong>the</strong> total<br />
sums calculated as due <strong>the</strong> pla<strong>in</strong>tiff from April 2009 till date of this judgment<br />
<strong>the</strong>reafter at 8 percent <strong>in</strong>terest per annum on <strong>the</strong> judgment debt until full liquidation<br />
of <strong>the</strong> judgment sum and <strong>in</strong>terest<br />
4. I make no order as to costs.<br />
