ELECTRONIC RECORDING DELIVERY SYSTEM COMES TO SACRAMENTO COUNTY
Sacramento, CA.,-- The Sacramento County Clerk/Recorder made recording history in March by
accepting and confirming its first electronically recorded public document from Stewart Title of Sacramento.
Electronic recording will help expedite recording for title companies by allowing them to avoid sending
paper documents by mail or courier. It may also provide them faster confirmation of the recorded transaction.
“Authorized submitters such as title companies need only push a button to receive electronic
confirmation to be able to hand over original documents to their client more efficiently. Customer service at its
best!” said Craig Kramer, Clerk/Recorder for the County.
Although Sacramento County currently records documents electronically from governmental agencies,
known as government to government, the new system opens electronic recording to the public through
authorized submitters. Since March 23rd, the County has recorded more than 3,000 documents electronically.
Sacramento County records approximately 425,000 documents annually, involving a multistep process
and many points of handling, including receipt, examination, indexing, imaging and finally returning to the
submitter. Electronic recording streamlines the recording process for the County, submitters and their clients
by eliminating imaging and manual layers of processing.

System Background:
The Electronic Recording Delivery Act of 2004 (Government Code Sections 27390 through 27399)
authorizes a County Recorder, upon approval by resolution of the Board of Supervisors and System
Certification by the Department of Justice (DOJ) Electronic Recording Delivery System (ERDS) program to
establish an ERDS for the delivery, and when applicable, return of specified electronic records that are an
instrument of real estate transactions. In 2007, DOJ issued regulations for implementing an Electronic
Recording Delivery System (ERDS) program, specifying all conditions, including system certification, regulation
and oversight by DOJ’s ERDS Program. These regulations require documents are secure while in transmit to
the County and in the return to the submitter to prevent any possible fraud.
The regulations also state that counties are authorized to join forces and provide a single portal for this
process. Orange, Riverside, San Diego and Los Angeles Counties developed a multi-county electronic
recording delivery system portal known as SECURE, which these counties jointly own. SECURE was certified
by the DOJ September 29, 2009.
October 4, 2005, The Board of Supervisors approved the Clerk/Recorder’s participation in the ERDS
program. December 1, 2009, The Board also approved the Clerk/Recorder joining the multi-county electronic
recording delivery system portal, SECURE. Sacramento County was certified as a partner county of SECURE
by the DOJ November 18, 2010.
