(2) An application under subsection (1) must:<br />
(a)<br />
(b)<br />
be in such form as is specified by the Reserve Bank; and<br />
be accompanied by:<br />
(i)<br />
(ii)<br />
(iii)<br />
a statement disclosing the ultimate and intermediate, if any, beneficial<br />
ownership of the applicant; and<br />
such documents as are specified by the Reserve Bank; and<br />
the prescribed application fee and the prescribed annual licence fee.<br />
(3) The Reserve Bank may in writing request that an applicant provide such additional<br />
information and documents as the Reserve Bank considers necessary to determine the<br />
application.<br />
(4) If a request has been made under subsection (3), the applicant must provide such<br />
additional information and documents to the Reserve Bank within the time specified by<br />
the Reserve Bank.<br />
(5) If an application is refused, the Reserve Bank is to refund the annual fee to the applicant.<br />
However, the application fee is not refundable.<br />
(6) An applicant must not furnish any information or document that is false or misleading in<br />
any material particular in connection with an application.<br />
(7) If an applicant contravenes subsection (6), the applicant is guilty of an offence punishable<br />
on conviction by a fine not exceeding $250,000.<br />
7. Reserve Bank to issue or refuse licence within 4 months<br />
(1) The Reserve Bank must within 4 months after receiving an application for a licence and<br />
all other information and documents requested by the Reserve Bank under subsection<br />
6(3):<br />
(a)<br />
(b)<br />
issue a licence to the applicant subject to such terms and conditions as the Reserve<br />
Bank considers fit; or<br />
refuse the application and inform the applicant of the refusal.<br />
(2) The Reserve Bank must advise an applicant in writing of the reasons for its refusal to<br />
issue a licence under this section.<br />
(3) As soon as practicable after a licence has been issued, the Reserve Bank must publish a<br />
notice to this effect in the Gazette.<br />
8. Criteria for the issue of a licence<br />
(1) The Reserve Bank must not issue a licence unless it is satisfied that:<br />
(a)<br />
the ownership spread, financial capacity and financial history (if any) of the<br />
applicant are satisfactory; and<br />
