1 (2) For purposes of this section, an offense is considered a
2 second or subsequent offense, if, prior to his or her conviction of
3 the offense, the offender has at any time been convicted under this
4 chapter or under any. statute of the United States or of any state
5 relating to narcotic drugs, marihuana, depressant, stimulant, or
6 hallucinogenic drugs.
7 (3) This section does not apply to offenses under RCW 69.50.4013
8 or RCW 69.50.4014.
9 Sec. 3. RCW 69.50.412, 2002 c 213 s 1, and 1981 c 48 s 2 are
10 each amended to read as follows:
11 (1) It is unlawful for any person to use drug paraphernalia to
12 plant, propagate, cultivate, grow; harvest, manufacture, compound,
13 convert, produce, process, prepare, test, analyze, pack, repack,
14 store, contain, conceal, inject, ingest, inhale; or otherwise
15 introduce into the human body a controlled substance. Any person who
16 violates, this subsection is guilty of a misdemeanor; except that any
17 person eighteen years of age or older who violates this subsection in
18 relation to an offense involving only marijuana and no other
19 controlled substance commits a class 2 civil infraction under chapter
20 7.80 RCW with a monetary penalty of one hundred dollars.
21 (2) It is unlawful for any person to deliver, possess with
22 intent to deliver, or manufacture with intent to deliver drug
23 paraphernalia, knowing, or under circumstances where one reasonably
24 should know, that it will be used to plant, propagate, cultivate,
25 grow, harvest, manufacture, compound, convert, produce, process,
26 prepare, test, analyze, pack, repack, store, contain, conceal,
27 inject, ingest, inhale, or otherwise introduce into the human body a
28 controlled substance. Any person who violates this subsection is
29 guilty of a misdemeanor.
30 (3) Any person eighteen years of age or over who violates
31 subsection (2) of this section by delivering drug paraphernalia to a
