STATEMENT OF INTEREST OF AMICI CURIAE<br />

The American Association of University Professors (AAUP) is an organization of approximately<br />

44,000 faculty members and research scholars <strong>in</strong> all academic discipl<strong>in</strong>es. Founded <strong>in</strong> 1915, <strong>the</strong><br />

Association is committed to <strong>the</strong> defense of academic freedom and <strong>the</strong> free exchange of ideas <strong>in</strong> scholarly<br />

and creative work. Among <strong>the</strong> organization's central functions is <strong>the</strong> development of policy standards for<br />

<strong>the</strong> protection of academic freedom, tenure, and o<strong>the</strong>r elements central to higher education. The<br />

Association's policy statements have long emphasized <strong>the</strong> need for wide latitude <strong>in</strong> teach<strong>in</strong>g and<br />

research for professors and <strong>the</strong>ir students <strong>in</strong> <strong>the</strong> pursuit of knowledge <strong>in</strong>clud<strong>in</strong>g with regard to<br />

controversial topics or examples that are relevant to <strong>the</strong> subject matter. See, e.g., 1940 Statement of<br />

Pr<strong>in</strong>ciples on Academic Freedom and Tenure, AAUP Policy Documents & Reports (1995 ed.)<br />

(endorsed by more than 150 professional organizations and learned societies). AAUP's policies are<br />

widely respected and followed as models <strong>in</strong> American colleges and universities. See, e.g., Board of<br />

Regents of State Colleges v. Roth, 408 U.S. 564, 579 n. 17 (1972); Tilton v. Richardson, 403 U.S. 672,<br />

681-82 (1971).<br />

Faculty members rely <strong>in</strong>creas<strong>in</strong>gly on <strong>the</strong> Internet for teach<strong>in</strong>g and research. AAUP is concerned that <strong>the</strong><br />

<strong>CD</strong>A will chill on-l<strong>in</strong>e expression and discussion on a wide variety of academic subjects (e.g., medic<strong>in</strong>e,<br />

biology, anatomy, social work, art, and journalism), impair<strong>in</strong>g use of this promis<strong>in</strong>g new medium for<br />

legitimate pedagogical and research purposes <strong>in</strong> <strong>the</strong> pursuit of truth and knowledge.<br />

The American Society of Journalists and Authors is a professional association represent<strong>in</strong>g<br />

journalists and authors, primarily <strong>in</strong> <strong>the</strong> pr<strong>in</strong>t media, many of whose works are placed <strong>in</strong> whole or <strong>in</strong> part<br />

onto <strong>the</strong> Internet. Claire Safran is <strong>the</strong> Chairperson of <strong>the</strong> ASJA's First Amendment Committee and its<br />

amicus contact person. The ASJA and its members are concerned that <strong>the</strong> <strong>CD</strong>A will prohibit certa<strong>in</strong><br />

writ<strong>in</strong>gs from be<strong>in</strong>g placed on <strong>the</strong> Internet and chill free expression onl<strong>in</strong>e. See Exhibit 35.<br />
